STAFF CONCLUSION Staff concludes that there is excess right-of-way along the north side of West 32nd Avenue between Kipling and Simms Street and that it is not needed for street purposes. Staff further concludes that City Council directed Staff to vacate said right- of-way. For these. reasons, a recommendation of Approval is given with the condition that a facilities and maintenance easement will be reserved over the entire width. IV. Case No. WV-93-6• An application initiated by the City of Wheat Ridge for approval of a vacation of excess right-of-way along the north side of West 32nd Avenue between Kipling and Simms Streets. This request involves 25 properties and the width of the parcels being vacated varies from two (2) feet to eighteen (18) feet wide, beginning two (2) feet behind the back of sidewalk. _-- Mr. Gidley presented the case and pointed out the properties in question on the projected transparencies. Commissioner JOHNSON asked if the right-of-way was being vacated right up to the back of sidewalk? Mr. Goebel, Director of Public Works, stated the City had retained two feet behind the walk for future signage/telephone poles, etc. Commissioner JOHNSON-asked if a utility easement would be added to the quit claim deeds? Planning Commission Minutes Page 3 June 17, 1993 Mr. Gidley stated the utility easements had already been made a part of the quit claim deeds. Commissioner JOHNSON asked why it was necessary-to return this land. Mr. Gidley explained that the land being vacated is right-of-way not now needed by the City. Following reconstruction of West 32nd Avenue, Staff was directed to vacate .any excess right-of-way to back to property owners. Mr. Goebel explained further that the right-of-way vacation was Council's way of assuring the property owners involved that West 32nd Avenue could not be easily widened in the future. George Raitzr 3204 Pierson Street was sworn in. Mr. Raitz stated his confusion regarding the right-of-way street vacation. Mr. Goebel informed Mr. Raitz that the width of the right-of-way to be vacated-in front of his residence is eight feet, totalling 1040 square feet. Mr. Raitz asked from where the right-of-way to be vacated was measured. Mr. Goebel stated it is measured beginning two-feet from the back of the sidewalk. Mr. Raitz-asked then if he would be getting property back. Mr. Goebel stated yes, he would, as would the other property owners-involved. Mr. Raitz stated when that his taxes would increase. Mr. Goebel confirmed that his property taxes would increase -- slightly. Chairman LANGDON asked Mr. Goebel if all property owners-could measure two feet from the back of the sidewalk to their property lines to calculate the right-of-way to be vacated. Mr. Goebel answered yes, the new front property line would be measured two feet back from the north sidewalk. Janeil Cill n, 3201 Rotitt Street was sworn in: Ms. Cillessen stated she had spoken with a staff member regarding this vacation requested, but that she still. was confused. She asked if the homeowner had an option whether the land would be vacated? She said she does not want the property back, as she would have to ~ maintain it and pay additional taxes. Mr. Goebel xplained that if Ms. Cillessen did not want the property re~urned to her,-..she ..could let both Planning Commission and City Council know her feelings at public_hearings. Then, Council could then decide whether or not to,vacate the land. Ms. Cillessen asked if City Council could return only those parcels. of land that the property owners wanted. _ Mr. Goebel stated they could decide to do that. __ ___ . Ms. Cillessen asked if her property at 11595 West 32nd Avenue was involved. Mr. Goebel stated that property was not involved. Ms. Cillessen wanted to know where the property line would be located along West 32nd Avenue. Mr. Goebel stated that if-the front property line is within two or three feet of the back .. of sidewalk constructed, then the_City did not initiate a vacation. __ Mr. Goebel stated that a majority of citizens living along the area-of reconstruction wanted the property vacated. He also urged Ms. Cillessen to voice her opinion to City Council when this case comes before them. He explained further. Chairperson LANGDON asked if the-case before Commission would go to City Council for _final review. Mr. Gidley stated that it would. Chairperson LANGDON asked Ms. Cillessen if she_was aware of her. neighbors` feelings regarding the gacation. Ms. Cillessen answered that she was not. Chairman LANGDON stated he didn't understand why these people had not been notified of how much property would be vacated. He asked Mr. Gidley how much their taxes might be-increased :due to the right-of-way vacation. Mr. Gidley stated that he doubted the tax on "raw-land"-would amount to much. He figured-he had 20 additional feet of ground on which he'd be_paying taxes. Commissioner ECKHARDT informed Mr. Raitz that if the land is vacated, he would receive .an eight-foot-wide piece of property, amounting to 1,040 square feet. He thought the increased tax would be minimal. Chairman LANGDON explained that he had been appointed to a citizens' task force whose job it was to see that the residents on West 32nd Avenue were treated Fairly during-the reconstruction. We are proposing to vacate right of way from approximately 3 feet behind the sidewalk to your southerly property 'line. Public Works is initiating this action in accordance with the Ordnance City Council adopted when they made the decision to construct West 32nd Avenue to its current configuration. The right of way vacation process requires preparation of appro- priate documentation-for presentation to the Planning Commission and City Council for review and approval or disapproval. Because this action is City initiated, City Staff will prepare all documents and surveys required for the process at no expense to the property owners. After the application for vacation is filed by Public Works, the issue goes to Planning Commission for review and comment. After the Planning Commission review, an Ordnance is prepared for City Council review and adopt the proposed right of way vacation during two meetings. Durinq the first meeting, the vacation ordnance is read and Council decides if this action is something they wish to continue. If the Council votes to continue the vacation, they establish a date for public comment, second reading and final action of the ordnance. In 1990, West 32nd Avenue was reconstructed and as part of the decision-making process, City Council directed Staff to vacate any extra right-of-way to the adjacent property owners once the project- is completed. See Exhibit 'A'. There are 25 separate property owners involved. The right-of-way to be vacated .starts roughly two feet behind the back-of-walk and varies in width from eight feet to 18 feet. Once the ordinance to vacate is approved, quit claim deeds for each property will be recorded. Please refer to Exhibit 'B' which identifies the .parcel numbers. PLANNING ACTION Planning Commissioner reviewed this case at a public hearing held on June 17, 1993. A recommendation of Approval was made for the following reasons: 1. The excess right-of-way is not needed for street purposes; I and 2. City Council directed staff to initiate the vacation. With the following condition: 1. A maintenance and facility easement for utilities be reserved over the entire width. IV. STAFF CONCLUSION___ Staff concludes that there is excess right-of-way along the north side of West 32nd Avenue between Kipling and Simms Street and that it is not needed for street purposes. Staff further concludes that City Council directed Staff to vacate said right- of-way. For these reasons, a recommendation of Approval is given with the condition that a facilities and maintenance easement will be reserved over the entire width. V. Council Bill 25 - An Ordinance vacating an unused portion of West 32nd Avenue between Kipling Street and Simms Street within the City of Wheat Ridge, County of Jefferson, State of ~,olorado. (Case ido. WV-93-6) Council Bi11 25 was introduced on second reading by Mrs. Brougham; title read by the Clerk; Ordinance No. 940 assigned. h1r. i,iddaugh explained that this was being done as part of the reconstruction of W. 32nd Avenue; certain representations had been made to property owners that surplus right-of-way would be vacated at the conclusion of the reconstruction of the road; this fulfills these representations. David DiGiacomo, 3275 Quail Street, was sworn in by the I~layor; he spoke in favor of Council Bill 25; tie feels the traffic has increased since the street improvement and the speed seems to be in excess of the.posted speed limit; had he known the full effect he would not have supported this at the time. Beverly Phillips, 10405 w. 32nd Avenue, was sworn in by the Mayor; urged that the City give back the property along w. 32nd Avenue; complained about the landscaping provided by the City on her property. tars. Brougham insisted that the reason for this being done would be part of the record. On September 72, 1988 this road reconstruction was approved by the then City Council; motion was made by Mr. Merkl that 32nd Avenue from Youngfield to Kipling be reconstructed in accordance with the recommendations of the task force attached to the minutes. Some of the recommendations are: 1. We believe that the excess right-of-way should be offered to the residents adjoining 32nd Avenue as a concession to accepting this compromise; the deeding back of the excess right-of-way would indicate the willingness to give something back to the community; .~ CITY COUNCIL MINUTES: September 27. 1993 Page -3- clearly there will not be need to widen beyond 44 feet in the fore- seeable future; and if this eventually should occur the land use in the corridor would likely change and the acquisition of property would be possible at that time. 2. We believe that there shoul-d be some guarantee put in place that should the City wish to re-stripe the project to a 4-lane roadway additional public input would be mandatory. We realize this Council cannot bind further, Council but if the approval of this could be made an Ordinance which would require Council action to change, then we believe protection would be in place that would allow the citizens to'have some assurance the City would not re-stripe the street without additional public input. Motion by Mrs. Brougham to approve Council Ei11 25 (Ordinance No.-940), order it published, and that it take effect 1 day after final publication; seconded by Vance Edwards; carried 8-0. Item 4.
