Please be advised that the above referenced property is in an area served by The Consolidated Mutual Water Company by virtue of a Distributor's Contract with the Denver Water Board. Domestic water service may be provided to this property subject to compliance with the Company's rules, regulations and requirements for such service, as well as the water tap allocation policies as established by the Denver Water Board. The Company's rules, regulations and requirements further require that each separate structure be served by a separate tap and meter, and in order to receive domestic water service, the property must also front a Company main. We are asking for an emergency access that will adjoin Camping Worlds parking lot on the north side. Mr. Casement has agreed to this and has proposed a roller gate that will be acceptable.. There will also have to be a fire hydrant installed at the main entrance to the property. He will be in contact with Consolidated Water District regarding this issue. There will be a slight change in the size of the parking island on the east end to accommodate proper turn radius for the trucks ..There may be other issues unforeseen at this time that will be addressed as the need arises. The City will require cross-access between this property and the property to the south. This should occur at-the__western- most drive aisle (dust east of the first row of parking). The Wheat Ridge Fire Department is requiring emergency access between Lots 2 and 3 where .the pedestrian access is-being shown. 2. Staff will not support a variance for a six-foot-high fence within the western 50 feet of the property. If a variance is not granted by Planning Commission, you may want to replace the western-row of display parking with customer parking. You need to provide justification for the variance using the nine questions for evaluation. 'See attached. 3. Since you are asking for a sign size variance, justification needs to be provided using the same nine questions referenced above.-.One freestanding sign is allowed containing 67 square feet of area. The sign you have shown is 205 square-feet in size. 4. The City will require the installation of curb, gutter and sidewalk across the frontages of Lots 3 and 4 with this development. 5. Very questionable due to the location next to Camping World and a small sales office the operation could be viewed by people on I 70 as a rental outlet, a storage lot, or part of Camping World. For proper identity from I70 and Hwy. 58 of a separate sales operation from Camping World a large sign the size of Camping World's sign will be needed. 2. Yes, by being right next door to Camping World and visibility from two freeways with 55 MPH speed limits. 3. No 4. Yes 5. Camping World currently has a sign the size requested. 6. Prior to application for rezoning or special use permit, the developer is responsible for holding an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of a proposed development in their neighborhood and to allow the developer to respond to citizen concerns in the design of their project. All residents within 600 feet are required to be notified of the meeting. A staff planner will attend the meeting to discuss City policy and regulations and the process involved, however, the planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Planning Commission Staff Report Page 2 Case No. WZ-93-8/Casement I. REQUEST The applicant requests approval of a final development plan within the Youngfield Plaza planned development at 4120 Youngfield. The purpose of the approval is for construction of a recreational vehicle sale lot. II. -OUTLINE DEVELOPMENT PLAN There is some .question as to whether the proposed use is allowed in the development. When the first phase of the development was approved in 1981, there was no mention of allowing vehicle sales lots. The list of allowed uses went so far as indicting that outside storage and display are not allowed. See attached Exhibit 'A'. The same list of uses was adopted when the second phase of the project was rezoned in 1991. Staff believes that it was the City's intent not to allow used car lots, recreational vehicle storage and the like since they were not specifically mentioned. If an amendment to the outline development plan is approved to allow recreational vehicle sales, it would be only for Lot 3 and not-the other two lots within this phase of the development. III. FINAL DEVELOPMENT PLAN - SITE DESIGN The applicant is proposing an approximate 2000 square .foot building at the rear of the lot as a sales office.. .The display of vehicles for sale occurs on the western 180 feet. The lot will be surrounded by a six-foot-high chain link fence tapering down to four feet towards the front. The fence is being shown as having barbed wire on the top. Staff believes that this would give the area an "industrial" look and recommends it be removed. The site-plan needs-to be amended to show the. fence tapering to four feet at a point 50 feet from the western property line. Staff would recommend that the chain link fence be revised to a decorative fence including brick columns and wrought iron fencing. Site data breakdown indicates that there would be 2.4% building coverage, 56.2% paved surfaces, and 37% in landscaping (including the lake). The developer .would like to deed the lake to the City. This will be discussed by the Parks and Recreation Commission on October 20, 1993. If this occurs, the site data. breakdown will change. Staff has picked an arbitrary line which would allow the building a 20 foot rear setback and has recalculated the breakdown. It appears that there would be 3.2% building coverage, 77% in paved surfaces and roughly 17% landscaped coverage. Staff concludes that if the dedication of the lake occurs, the site would still be in conformance with the outline plan and minimum requirements in the C-1 zone district.. Planning Commission Staff Report Page 3 Case No. WZ-93-8/Casement Pedestrian and emergency access with the lot to the south occurs at the easterly drive aisle. A roller gate needs to be added to the plan. Staff would also request a pedestrian access at the western .drive aisle. This must also be added to the plan. All minimum landscape requirements have been met except that 15 additional trees and shrubs need to be added. The signage allowed on the property would be 67 square feet for a freestanding design. The applicant is proposing a sign containing 205 square feet which is consistent with what is on the Camper World property. This is a specific design variance and must be voted on separately. IV. CRITERIA - SIGN VARIANCE Staff has the following comments regarding the criteria used to evaluate .the sign variance. The applicant has submitted a written justification included under Exhibit 'B'. 1. Can the property in question yield a reasonable return in -- use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? signage allowed on the property is applied consistently throughout the City. The business is allowed a sign area bonus as it is-close to 1-70. 2. Is the plight of the owner due to unique circumstances? Circumstances are .not unique. 3. If the variation were granted, would it alter the essential character of the locality? If the variance is granted, it would not alter the character of the area. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience, if the strict letter of the regulations were carried out? Inconvenience. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? A precedent for similar requests could be established. Planning Commission Staff Report Page 4 Case No. WZ-93-8/Casement 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property? This request is economically motivated as the applicant is hoping for increased visibility. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? No. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? Granting of the variance would not be detrimental to the public welfare or injurious to adjacent property or the neighborhood, although, it might add visual "clutter" in the area. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood? Granting of the variance would not affect light and air, increase street congestion, increase fire danger, endanger the public safety or impair property values. _ IV. AGENCY REFERRALS All agencies can provide service to the property. Wheat Ridge Fire District will require a fire hydrant at the entrance to the property. Emergency access. from the south should occur at the easterly drive aisle. The applicant has agreed to install a roller .gate. Both items should be added to the plan. Public Works is requesting the installation of curb, gutter and sidewalk along the frontages of Lots 3 and 4. A drainage plan and report will be required. Parks and Recreation Commission is reviewing the proposal on October 20 to discuss dedication of the lake for park purposes. V. CONCLUSIONS AND Staff concludes that the proposed use is inconsistent with those allowed originally on the outline development plan. An amendment to the Youngfield Plaza outline development plan is required. specifically for recreational vehicles sales on this lot only.k This would be a modification to the underlying PCD zone. We would not support any other type of vehicle sales lot or recreational vehicle storage. Staff concludes that .all minimums within the C-1 zone district ' have been met by the site plan and therefore gives a recommendation of Approval with the following conditions: 1. The fence be shown tapering down to four feet at a point 50 feet east of the western property line. 2. Barbed wire be removed from the fence and that it be revised as a decorative fence including brick pillars and wrought iron. 3. An emergency vehicular access with a roller gate be shown. 4. A fire hydrant be shown at the entrance of the property. 5. Prior to presenting the staff report, Ms. Reckert provided Commission a memo from Gary Wardle, Director of Parks and Recreation containing the recommendation from Parks and Recreation Commission, who met October 20. Entered and accepted into the record were the Comprehensive Plan, Zoning Ordinance, case file, packet materials, slides and exhibits. Commissioner JOHNSON asked if Ms'. Reckert attended the Parks and Recreation Commission meeting. He had some confusion about the meaning of the memo. Ms. Reckert answered she did not attend that meeting. Commissioner ECKHARDT asked Ms. Reckert if Camping World had set a precedent with sign size. Ms. Reckert stated that due to the size of the Camping World building, the sign size was allowed. Mr. Gidley stated that the case before Commission is a Planned Commercial Development, all owned by the same property owner. A PCD is normally considered to be a unified development with only one freestanding. sign per street frontage for the entire development. Therefore, not only the requested sign size an issue, but the fact they are requesting additional signage is an issue. Commissioner QUALTERI asked if the proposed development would be competing with Camping World. Mr. Gidley stated he did not believe the two would compete. Camping World sells only accessory items for recreational. vehicles. Mr. Casement intends to sell recreational vehicles. Commissioner QUALTERI was concerned that the existing development might have an advantage with larger signage. Mr. Gidley stated that would be up to the applicant to prove. Janice Thompson, 12290. West 42nd Avenue was sworn in. Ms. Thompson, Chairperson of the Parks and Recreation Commission was present and agreed to speak about Commission`s recommendation regarding Mr. Casement's proposal. She added that she was also present to speak about the case before Commission as a resident of the area. Ms. Thompson stated Parks Commission had concerns about the steep banks, erosion and possible liability connected with the lake behind the proposed development (i.e., Youngfield Planning Commission Minutes Page 13 October 21, 1993 Plaza Phase I). She thought perhaps the City would be forced to fence the lake for safety reasons. Pollution could be introduced. into the lake from runoff from this development. Parks Commission also had a concern that the exterior of the proposed structure would not be compatible with the natural surroundings of the greenbelt. They wanted the right to review any plans regarding the lake at a later time. The liability issue was their major concern. Stephen J. Casement, 6665 Youngfield Court, Arvada was sworn in. Mr. Casement informed Commission that if his request is approved and he can proceed with his.plans, he will purchase the property from Lee Kunz. He plans to sell vehicles exclusively, he'll not provide service or accessories, as Camping world does. He added that plans for the exterior of the building are similar to the color and design o£ the Kunz development. Staff's recommended change to the fencing, he said, would be no problem and his. architect had designed a fence that might be acceptable. His insurance company has required "security fencing". Mr. Casement noted that landscaping would be added to the development in an effort to blend with the surrounding greenbelt. Kelly Oliver, 9602 East Orchard Drive, Englewood was sworn in. Mr. Oliver was the architect for the proposed project. Mr. Oliver is recommending a chain link fence coated with black vinyl material, which he felt would cut the visual appearance of the chain link fencing, but provide security. He stated that a chain link fence would be much more secure than a decorative fence, such as the brick columns that staff recommended. Mr. Oliver felt that a small building should allow a larger sign. He noted that the sign proposed is only 12 feet high, not the 35-foot high signage o£ Camping World.. Mr. Oliver stated that the small building with the planned landscaping would not be visible from the Interstate. He thought that the proposed fencing around the project would prevent individuals falling into, the lake from their property. Regarding oil spills, the vehicles offered for sale would be new or nearly new and should leak minimally, if at all. Commissioner ECKHARDT felt that the lake could be used as an asset rather than a detriment to the project. He explained some options. Mr. Oliver stated he agreed_completely. He added that the building had been designed to take advantage of the view o£ the lake. However, he added that severe site modifications would have to take place before they could utilize the lake, as it is significantly below grade of the project. Commissioner ECKHARDT elaborated how Estes Park had taken advantage of the river flowing through town, when the town was rebuilt following the flood. Planning Commission Minutes October 21, 1993 Page 14 Mr. Cas meat stated he felt the City should own the entire lake perimeter. He stated they would give their cooperation. Commissioner ECKHARDT thought perhaps such a large sign would not be necessary, since the recreational vehicles would be displayed out-of-doors. He added that landscaping might act as a deterrent to thieves and suggested some thorned varieties that 'could be utilized. Mr. Cas mont stated he agreed with the suggested fencing between Lots 3 and 4. He has an option to purchase Lot 4. He added that he felt the requested sign variance was necessary, as those .traveling on the interstate may not be able to see he has a sales operation. He felt he was being penalized because his building size is only 2000 square feet. Mr. Casement stated he needs a large lot to properly display his campers. Mr. Casement stated his building will blend with the greenbelt and surrounding area. He added that the smallest sign he could accept would be 160 square feet, or ten feet by 16 feet. He requested that he be granted a variance for that size sign. Janice Thompson, stated that economic development is important to Wheat Ridge, however this development can be seen from her backyard and she has several concerns. When the development was originally approved, no outside storage was allowed. If outside storage is permitted a precedent would be set. Ms. Thompson suggested the area be developed for enjoyment by Kunz employees. She was concerned about the lack of aesthetically-pleasing developments viewed when entering the City. Also, she felt it would be dangerous to allow people to test drive campers on Youngfield Street. Instead of a security-type fence, Ms. Thompson suggested the use of guard dogs. Signage, she £elt, should be kept to a minimum. Mr. Gidley reemphasize that when Planning Commission/City Council approved the Outline Development Plan in 1980, auto-sales related businesses was an excluded use. Therefore, it is contrary to the underlying zoning to allow auto-sales related businesses. Mr. Gidley added that if Commission intended to support this request, he highly suggested that they be very specific that only RV sales, camper and motor home sales only, and that RV storage or any other type of vehicular sales be allowed. Stephen Cas mant stated he had no plan for RV storage whatsoever. It will be strictly a sales operation. He added that there will be no fence across the front of the lot. The front of the property will be attractively landscaped and a chain will secure the entrance at night. Mr. Casement hopes that within two years he can purchase Lot 4. He would not request additional Signage' at that time. Mr. Casement asked for Mr. Kunz if the curb and gutter requested by Public Works had to be installed. Planning Commission Minutes October 21, 1993 Page 15 Ms. Reckert stated that Public Works requested that curb and gutter be installed across both Lots 3 and 4 however, Planning Commission/City Council may not agree with the request. She added in her opinion that it made no sense not to install this curb and gutter on both lots. Mr. Gidley stated that staff is suggesting that it be a requirement. It would be Mr. Kunz's responsibility as the land owner. Mr. Kunz receives certain economic development incentive benefits from the City to help offset the cost of such improvements. Commissioner ECKHARDT stated that the curb and gutter must be installed either now or in the future. He added that it should be now, not later. ,Mr Casement stated he was not arguing the fact. Chairperson LANGDON stated that in order for Mr. Casement to sell, he must have outside storage. He asked if the majority of his business would be new or used? Mr. Ca em n stated the majority of his business would be new. Chairperson LANGDON said he had a problem restricting business from expanding in Wheat Ridge. He stated he did not know how much the City of Wheat Ridge would profit from taxes collected. Mr. Gidley stated that buyers would pay taxes to the community where they reside. Mr. Gidley also noted that there are many business which would be allowed on the property in question. The question before Commission is whether this specific business should be allowed on the property. Commissioner LANGDON stated he had a problem with the City restricting a business person from operating at a certain location. Commissioner ECKHARDT stated that Mr. Kunz, owner of the property, agreed to the stipulations made on the property at the time the Outline Development Plan was approved. He added that Mr. Casement could comply with the restriction if all units were within a building. Commissioner JOHNSON gave a brief history of the immediate area. His question was if the City wanted the land to lay vacant, or to be developed? He noted that this parcel sits next to the trail head parking lot and wondered what was the difference r~etween that lot and the proposed development? Mr. Casement stated that regarding the tax situation, ramping World sales would exceed $4 million in 1993. She asked Chairperson LANGDON how he would like having a grocery/gas station-next door to him? Chairperson LANGDON answered he does not live on a street that would support such a development. However, if a gas station/grocery went in at West 38th and Miller Street, he would not fight it. Ms. Thompson stated she felt Commission would be setting a negative precedent if this amendment is approved. Commissioner RASPLICKA moved that the request for an amendment to an outline development plan and approval of a final development plan (Case No. WZ-93-8) be forwarded to City Council with a recommendation for Approval with the following conditions: 1. The fence be tapered down to four feet at a point 50 feet east of the western property line. 2. An emergency vehicular access with roller gate be shown. 3. A fire hydrant be indicated at the entrance to the property. 4. A pedestrian access be shown at the westerly drive aisle. 5. Landscaping be installed as per staff recommendation. 6. That the barbed wire be removed from the fence. 7. This amendment to the Outline Development plan to allow RV sales pertain only to Lot 3. 8. Conversion to any other type of auto-related sales would be prohibited. 9. The deceleration lane in front of Lots 3 and 4 be constructed . at this time. Commissioner JOHNSON seconded the motion. REQUEST The applicant requests an amendment to the outline development plan and approval of a final development plan within the Youngfield Plaza planned development at 4120 Youngfield. The purpose of the approval is for construction of a recreational vehicle sale lot. II. OUTLINE DEVELOPMENT PLAN In order-for the recreation vehicle sales lot to be built, an amendment to the original outline development plan is required. When the first phase of the development was approved in 1981, there was no mention of allowing vehicle sales lots. The list of allowed uses went so far as indicting that outside storage and display are not allowed. See attached Exhibit 'A'. The same list of uses was adopted when the second phase of the project was approved in 1991. Staff believes that it was the City's intent not to allow used car lots, recreational vehicle storage and the like since they were not specifically mentioned. If an amendment to the outline development plan is approved to allow recreational vehicle sales, it would be only for Lot 3 and not the other two lots within this phase of the development. III. FINAL DEVELOPMENT PLAN - SITE DESIGN The applicant is proposing an approximate 2000 square foot building at the rear of the lot as a sales- office. The display of vehicles for sale occurs on the western 180 feet. The lot will be surrounded by a six-foot-high chain link fence tapering down to four feet towards the front with intermittent brick pillars. Site data breakdown indicates that there would be 2.4$ building coverage, 56.2$ paved surfaces, and 37$ in landscaping (including the lake). The developer would like to deed the lake to the City. This was discussed by the Parks and Recreation Commission on October 20, 1993. If this occurs, which is not likely, the site data breakdown will change. Staff has picked an arbitrary line which would allow the building a 20 foot rear setback and has recalculated the breakdown. It appears that there would be 3.2$ building coverage, 77$ in paved surfaces and roughly 17$ landscaped coverage. Staff concludes that if the dedication of the lake occurs, the site would still be in conformance with the outline plan and minimum requirements in the C-1 zone district. Pedestrian and emergency access with the lot to the south occurs at the easterly drive aisle. A roller gate needs to be added to the plan. A pedestrian access at the western drive aisle has been included per the Planning Commission recommendation. The applicant will erect a sign consistent with the allowance. IV. CRIT$RIA TO SUPPORT A REZONING In accordance with Wheat Ridge Code before a change of zone is approved, City Council shall find: of Laws, Sec. 26-6(C.), the applicant shall show and 1. That the change of zone is in conformance, or will bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies Comprehensive Land Use plan and other related policies or plans for the area. The Comprehensive Plan designates this areas as multiple use. The amendment to the original PCD zoning would be consistent with this designation. Based on testimony at the original zoning hearing, Staff would support only RV sales and no other type of vehicle sales and no RV storage on Lot 3 only. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. The proposed use is somewhat compatible with the existing facility to the south. However, Staff has concern about the aesthetics of the property, particularly the view from the greenbelt. The applicant has tried to mitigate the negative visual impacts by providing additional landscaping behind the building and upgrading the fence materials to a colored fence with brick pillars. 3. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. There could be economic benefits to the City by increased sales tax generated. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. There is infrastructure to serve the property. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic City Council Staff Report Page 4 Case No. WZ-93-8/Casement congestion, create drainage problems, or seriously reduce light and air to adjacent properties. The rezoning should not negatively affect public health, safety and welfare by creating excessive traffic congestion, creating drainage problems or reducing the light and air to adjacent properties. 6. That the property cannot reasonably be developed under the existing zoning conditions. The property could be developed under current zoning, however, a recreational vehicle sales lot would not be allowed. 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Spot zoning is not an issue. 8. That there is a void in an area or community need that the change of zone w311 fill by providing for necessary services, products or facilities especially appropriate at the 'location, considering available alternatives. The industry related to recreational vehicles sales is expanding, therefore one could conclude that development is filling a need. V. PLI~NNING COMMISSION ACTION Planning Commission reviewed this request at a public hearing held on October 21, 1993. A recommendation of approval was made for the following reasons: 1. The applicant had also requested a sign size variance which was denied. He has chosen not to appeal the variance denial. VI. AGENCY REFERRALS All agencies can provide service to the property. Wheat Ridge Fire District will require a fire hydrant at the entrance to the property. Emergency access from the south should occur at the easterly drive aisle. The applicant has agreed to install a roller gate. Both items have been added to the plan. Public Works is requesting the installation of curb, gutter and sidewalk along the frontages of Lots 3 and 4. A drainage plan and report will be required. Parks and Recreation Commission reviewed the proposal on October 20. See attached. VII. CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the proposed use is inconsistent with those allowed originally on the outline development plan. An amendment to the Youngfield Plaza outline development plan is required specifically for recreational vehicles sales on this lot only. This would be a modification to the underlying PCD zone. Staff would support the amendment to allow recreational vehicle-sales- on this lot only. We would not support any other type of vehicle sales lot or recreational vehicle storage on this or any of the other lots in the planned development. Staff concludes that all minimums within the C-1 zone district have been met by the site plan and therefore gives a recommendation of Approval. VIII. We are long time residents of Arvada having lived in the same home for 20 years. I have been in the RV and auto related industry since 1963, and since 1971 have performed all levels of management up to and including ownership. In 1988 Casey Motors and Recreational Sales was started at 2540 Kipling in Lakewood, and has grown to a business that went over $3.5 million in 1993 selling new and used recreational vehicles. We belong to the Better Business Bureau and in 5 years have never had a complaint. All used recreational vehicles are totally reconditioned to exceptionally high standards which has resulted in repeat and referral sales. All units are competitively priced and no delivery or handling fees are charged, which makes it a pleasant buying experience for the customer. All of the above practices will be continued at the new location using friendly, knowledgeable, and low key sales people. The other key to making this business successful is the right products to sell. I have been very fortunate in that area and have secured an excellent line up of products. There will be no service department as all service and warranty work will be done by Recreational Vehicle Accessories and Camping World. Sales projections for 1994 should definitely exceed $7,000,000.00 and 1995 should be close to $10,000,000.00. Camping World will experience a significant increase in sales due to extra business generated by Casey Motors Recreational Sales, plus every customer that buys a unit will be given a President's Club membership at Camping World.
