Case No. WZ-90-1: An application by the City of Wheat Ridge for approval of a change of zone from Hospital-One (H-1 ), Hospital-Two (H-2), Residential-One (R-1), Residential-Two (R-2), and Planned Commercial Development (PCD) to Planned Hospital District (PHD). This City initiated rezoning process is intended to bring hospital related properties currently designated a variety of districts, some of which are obsolete as a result of the recent changes to the Wheat Ridge Zoning Ordinance, into conformance with the current zoning ordinance. Mr. Foreman explained that slides had been taken of the properties, but would not be shown to avoid confusion. Commissioner WINGER asked what Lutheran would be allowed to do with the property zoned R-2. Mr. Gidley answered currently it can be used for any use specifically permitted in an R-2 zone district. Commissioner WINGER was concerned for the property owner of the middle portion, between the two owned by the hospital. Mr. Gidley stated there currently was no plan to change the use of the land. Chairman KILLIAN called £or the owner or representative of Lutheran Medical to come forward. Dick Scheurer o£ Robinson and Scheurer, 6610 W. I4th Ave. was sworn in as the representative for Lutheran Medical Center. He noted a letter contained in the file from Dr. Traylor which indicated that LMC is in agreement with and consents to the City- initiated rezoning to PHD zone district. REQUEST PAGE 2 The City of Wheat Ridge has requested a rezoning in order to eliminate the obsolete zone classification of Hospital-Two (H-2) and with a secondary purpose, at the request of the owner, to bring the entire property into one consolidated zone district, Planned Hospital Development. II. CASE HISTORY The north, east, west and south boundaries of Lutheran Medical Center are adjacent to one and two-family dwelling units, which are officially zoned Residential-Two. Staff concludes that the proposal would be compatible with adjacent residential homes, as no change in use or development is being proposed: - III_ COMPREHENSIVE PLAN The Comprehensive Plan designates preferred use of this parcel as public and semi-public land, more specifically a medical center, would meet this designation. IV. DESCRIPTION The holdings of Lutheran Medical Center are bounded generally by West 33rd Avenue, extended; West 38th Avenue; Dudley Street and Allison Street, extended. The approximate 94 acres is comprised of Hospital- Two, Planned Commercial Development, Residential-Two and Residential- One zonings, with several primary structures and multiple parcels. A Planned Building Group (PBG) Site Plan was approved for this area on July 27, 1987. That plan covered all of the land, including the H-2, R-1, R-2 and PCD zoned areas. Currently, there are no plans to modify the use or the existing developed conditions on this site. Any site modifications in the future must be in compliance with the previously approved Planned Building Group Plan, otherwise approval of a Site Development Plan, after public hearings held by the Wheat Ridge Planning Commission and City Council, pursuant to Wheat Ridge Code of Laws, Zoning Ordinance, will be required. V. CRITERIA FOR REVIEW 1. The change of zone is in conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies. 2. The proposed change of zone is compatible with the surrounding area and there will be no adverse impacts. CITY COUNCIL STAFF REPORT PAGE 3 CASE NO. WZ-90-1.1 3. The benefits obtained from the rezoning will remain constant with the attributes presently associated with the Lutheran Medical Center. 4. The existing facilities will not be enlarged or altered as a function of this rezoning. 5. There should be no detrimental affects upon the general public if this rezoning is approved. 6&7.The purpose of this rezoning is to bring the entire property into one consolidated zone district (PHD) as the Hospital-Two zone district was eliminated by Ordinance No. 796. 8. Lutheran Medical Center has .provided a service to the community £or several years, this proposed rezoning will. help legitimize. the zoning for the center, it will not change or alter the service now offered by the medical center. VI. PLANNING COMMISSION ACTION Planning Commission reviewed the requested rezoning at a public hearing held on April 19, 1990. After consideration, they voted 5-0 to forward this case to City Council with a recommendation for APPROVAL to rezone the property at 8300 W. 38th Avenue to Planned Hospital Development for the following reasons: 1. The property is within the City of Wheat Ridge and all notification and posting requirements have been met, therefore there is jurisdiction to hear this case. 2. All requirements for zoning have been met. 3. The purpose of this rezoning is to bring entire property into one consolidated zone district, PHD, as the H-2 zone district was eliminated by Ordinance No. 796, effective June 15, 1989. 4. There are no plans to modify the use or the existing ground conditions on this site. -Any site modifications in the Future must be in compliance with the previously-approved plan. 5. This zoning will not adversely affect public health, safety or welfare nor will it create a negative impact for adjacent property owners. VII. Reasons follow: 1. These Rezonings were not requested by the property owners. They apparently had no problems with the existing zonings. 2. The properties-as per statement ^f Mr. Gidley_ to the Planning Commission-would not 6e without zoning if no action is taken. The existing zoning simply continues until such time as 'a rezoning takes place. 3. The existing zoning of fords better protection to the surrounding neighborhood hegause it does-not Have as an allowed use either high density residential or office commercial, both of which are allowed uses in PHD. 4. The Council, 6y the action ^f the past council, is not prevented from reenacting the H-1 and H-2 provisions. This can he done by simple ordinance procedure. This can he done without repealing the new PHD portion of the Law. The zoning can remain as it is and the enormous amount of property- nearly 118 acres total- can remain in the public benefit zoning as opposed tc adding that amount to_the commercial dist. If you have read the new law you are aware of what it allows but if you are new on the council and have not seen the law that was repealed you may not be aware of the. changes these rezanings will create. We will attempt to explain the changes and the reasons for our concern. Case WZ-90-1 94 Acres awned by Lutheran Medical Center H-2 to PHD 1. This was initiated by the City Staff and agreed to by but' not requested by the Hospital. 2. The largest portion ^f the property is H-2 which .allows Public General Hospital, Private Hospitals and Sanitariums. 3. H-2 does not allow offices which are commercial as opposed to Public Benefit Uses. 4. It requires a 50 acre mimimum lot size. 5. Nothing precluded the rezoning of 2 areas for office devel- opment nor additional ones so long as they d^ not encroach into the 50 acres reserved far hospital purposes. 6. !H-2 is compatible with the residential neighborhood. REQUEST PAGE 2 The City of Wheat Ridge has requested a rezoning in order to eliminate the obsolete zone classification of Hospital-One (H-1) and to rezone the property to the newly-established zone classification of Planned Hospital Development (PHD). II. CASE HISTORY The subject site was rezoned from Agriculture-One, Residential-Two and Residential-One A districts to a combination of Hospital-One and Residential-One A in July of 1986, and a Planned Building Group (PBG) plan was approved for the site. III. COMPREHENSIVE PLAN The Comprehensive Plan designates preferred use of-this parcel as public and semi-public land and a small portion of land in question is designated as parks and open space land. More specifically, a sanatorium/nursing home would meet this designation. IV. DESCRIPTION The subject site is the Wide Horizons Sanatorium property located at 8900 W. 38th Avenue. The property encompasses 22 acres and is bounded by West 38th Avenue on the north, West 35th Avenue on the south, Everett Street on the east and the Garrison Gardens Subdivision on the west. Zoning on the subject site is currently Hospital-One with the exception of a portion of land on the southern boundary which is currently zoned Residential-One A. The portion of land zoned Residential-One A shall not be considered as part of this rezoning. V. CRITERIA FOR REVIEW 1. The change of zone is in conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies. 2. The proposed change of zone is compatible with the surrounding area and there will be no adverse impacts. 3. The benefits obtained from the rezoning will remain constant with the attributes presently associated with Wide Horizons, Inc. 4. The existing facilities will not be enlarged or altered as a function of this rezoning. 5. There should be no detrimental affects upon the general public if this rezoning is approved. 6&7.The purpose of this rezoning is to bring the H-1 zoned property into an appropriate zone district (PHD) as the Hospital-One zone district was eliminated by Ordinance No. 796. After consideration, they voted 4-1 to forward this case to City Council with a recommendation for APPROVAL to rezone the property at 8900 W. 38th Avenue to Planned Hospital Development for the following reasons: 1. The property is within the City of Wheat Ridge and all notification and posting requirements have been met, therefore there is jurisdiction to hear this case. 2. All requirements for rezoning have been met. 3. The purpose of this rezoning is to bring entire property into one consolidated zone district, PHD, as the H-1 zone district was eliminated by Ordinance No. 796, effective June 15, 1989. 4. There are-no plans to modify the use or the existing developed conditions on this site. Any site modifications in the future must be in compliance with the previously-approved development plan. 5. This rezoning will not adversely affect public health, safety or welfare nor will it create a negative impact for adjacent property owners. 6. Wide Horizons was notified, and verbal consent was given to the City, but no written agreement was received by the City of Wheat Ridge. Therefore, Planning Commission feels it had jurisdiction to hear this case. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the review criteria has been met as it relates to this proposed rezoning. Staff further concludes that the owner of the property has been notified of the rezoning and that a representative for the owner (corporation) has given the City written consent for the rezoning. Staff's recommendation is that Case No. WZ-90-1.2 be APPROVED. _._ VIII. CASE HISTORY The Johnstone Developmental Center is a private non-profit corporation that was founded in 1981 to assist persons with developmental disabilities, and existed prior to that as a nursing home type of facility predating the City of Wheat Ridge incorporation. III. COMPREHENSIVE PLAN The Comprehensive Plan designates preferred use of this parcel as public and semi-public land, more specifically a non-profit facility for individuals with developmental disabilities would meet this designation. IV. DESCRIPTION The subject site is the Johnstone Developmental center located at 5361 W. 26th Avenue. The property is 332.00 feet deep by 300.00 feet wide and is bounded on the south by West 26th Avenue, Ames Street on the East, Benton Street on-the West and the Richard Hart Estate Park on the North. Zoning on the site is currently Hospital-One (H-1). Although this property lacks an approved Site Development Plan, existing conditions will be accepted for this rezoning process, however, any future physical changes will require submittal of a Site Development Plan which complies with the provisions of Wheat Ridge Code, Zoning Ordinance, Sec. 20. V. CRITERIA FOR REVIEW 1. The change of zone is in conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies. 2. The proposed change of zone is compatible with the surrounding area and there will be no adverse impacts. 3. The benefits to the community will remain constant with the attributes presently associated with the Johnstone Developmental Center. 4. The existing facilities will not be enlarged or altered as a function of this rezoning. 5. There should be no detrimental affects upon the general public if this rezoning is approved. CITY COIINCIL_STAFF REPORT CASE NO. WZ-90-1.3 PAGE 3 6&7.The purpose of this rezoning is to replace the obsolete Hospital- One zoning on this site with the newly legislated Planned Hospital District (PHD). 8. Johnstone Developmental Center has provided a service to the community for several years, this proposed rezoning will legitimize the zoning. It will not change or alter the service now offered. by the facility. VI. PLANNING COMMISSION ACTION Planning Commission reviewed the requested rezoning at a public hearing held on April 19, 1990 after consideration, they voted 5-0 to forward this case to City Council with a recommendation for approval to rezone the property at 5361 W. 26th Avenue to Planed Hospital Development for the following reasons: 1. The property is within the City of Wheat Ridge and all notification and posting requirements have been met, therefore there is jurisdiction to hear this case. 2. All requirements for zoning have been met. 3. The. purpose of this rezoning is to bring entire property into one consolidated zone district, PHD, as the H-1 zone district was eliminated by Ordinance No. 796, effective. June 15, 1989. 4. There are no plans to modify the use of the existing development on this site, any changes from the existing conditions will require development plan approval by Planning Commission and City Council. 5. This zoning will not adversely affect public health, safety or welfare nor will it create a negative impact for adjacent property owners. VII. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that all review criteria have been met in this case. Staff recommends that Case No. WZ-90-1.3 be APPROVED. VIII. RECOMMENDED MOTION OPTION A: I move that Council Bill No. a request for approval of a rezoning from Hospital-One to Planned Hospital Development for the property located at 5361 W. 26th Avenue in Wheat Ridge, Colorado be approved for the following reasons: 1.
