SUBJECT: Correction to legal description
On April 14, 2009, annexation Ordinance No. 1437 with an accompanying annexation map were
recorded and became effective which annexed 32.984 acres of land into the City of Wheat Ridge.
This annexation essentially incorporated portions of Highway 58 and the right-of-way for W.
44`x' Avenue. Subsequent to this annexation, the city became aware that there was a portion of
the W. 44`x' Avenue right-of-way missing from this legal description.
It is the intent of the case to correct this legal description error. A revised annexation plat with
correction ordinance have been approved administratively and recorded.

Hi, Jerry
I have been working with Dave Brossman on a correction ordinance for the Long's Peak Metro District annexation
which was approved by CC pursuant to case No. ANX-08-03 due to non-inclusion of a portion of the 44th Avenue
right-of-way. The surveyor has provided a correction map and I'm in the process of preparing a correction
ordinance with a new legal to the original ordinance which was recorded in 2009. 1 am hoping that this can all be
done administratively because it is essentially a housecleaning measure.
If my take on this is incorrect, please let me know. I will let you review the ordinance prior to finalization just so
we're all on the same page since you'll have to sign it, as will the mayor. If we have to go to Council for some sort
of blessing, I'm okay with it too as long as it doesn't become a public hearing.

+Ll CERTAIN TERRITORY TO THE CITY OF WHEAT RIDGE,
h~ COLORADO (CASE NO. ANX-08-03/LONG'S PEAK
METROPOLITAN DISTRICT)
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT l
RIDGE, COLORADO:
Section 1.
That a Petition for Annexation, together with four (4) copies of the annexation
map as required by law, was filed with the City Council on December 12, 2008, by the
owners of over fifty percent (50%) of the area of the territory hereinafter described,
exclusive of public streets and alleys, and comprising more than fifty percent (50%) of
the landowners of the property to be annexed. The City Council, by resolution at a
properly noticed meeting on January 26, 2009, accepted said Petition and found and
determined that the applicable parts of the Municipal Annexation Act of 1965, as
amended, have been met and further determined that an election was not required under
the Act and that no additional terms and conditions were to be imposed upon said
annexation.
Section 2. Annexation Approved.
That the annexation to the City of the following described property is hereby
