After the most recent review of the documents for the Planned Building Group (PBG), I do not have any
outstanding issues with the PBG at 4089 Ames Street. The plan has been reviewed it has been found that the
plan is approvable. The plan can now be recorded with the Jefferson County Clerk and Recorder. Once the plat is
recorded, the consolidation of the three lots will be complete and will become official.
In order for the plat to be recorded, the approved plat must be photographically reproduced on Mylar paper that is
at least .004 of an inch thick and has a matte finish on both sides. The Mylar paper must be signed by all the
required persons in the owners certification block including a notary along with the notary's seal. A signature and
wet stamp will also be required by the surveyor. Once all the signatures are obtained, the Mylar should be
submitted to the City of Wheat Ridge Community Development Department. The Mylar will then be signed by
all the necessary personnel from the City and then be taken to the County to be recorded.

I have reviewed the information that you have provided (attached) and see that it differs greatly from
the summary provided on the Community Development Referral Form for Case No. PBG -10-
01 /Loveland. It is my understanding that you wish to make 4089 Ames Street a single family
residence, and keep the duplexes at 5306/5308 West 41st Avenue as such, resulting in three (3)
separate residences. 4089 Ames Street was being billed as a duplex as the District was made aware
of its use as two separate units, however, it was originally permitted as a single family residence. The
District has no objection to returning this structure to a single family residence. 5306/5308 West 41st
Avenue was originally permitted as a duplex, so the District has no objection for this use to continue.

This letter is in response to your request for confirmation of the availability of sanitary sewer service and
related concerns for the above property. By supplying this information, the Wheat Ridge Sanitation
District (District) is not liable for the misidentification or misrepresentation of the property. The location
of the property is based solely on the description provided by the requestor, and the District is not
responsible for the way in which this information is used or disseminated.
The property is entirely within the boundary and service area of the District. The District has 8 -inch
sanitary sewer main lines within Ames Street to the east of the property. Treatment of sewage generated
within the District is provided by the Metro Wastewater Reclamation District (Metro). The District will
be able to serve the property with respect to sanitary sewer service. The District's Rules and Regulations
are available to the owner upon request.
The District has the following comments specific to this request.
1. Duplexes are required to have individual service lines to the sanitary sewer main. The applicant
must confirm that separate service lines are in place in order for the structure to be converted into
two units. If an additional service line needs to be installed, there is an inspection fee of $100.
2. The property has previously been charged sanitary sewer tap fees for two (2) single family
residential equivalents (SFREs). Conversion of the structure into two units will result in three (3)
SFREs on the property, and an additional tap fee will be assessed. The current tap fees for 2010
are $1,900 for the District and $2,600 for Metro, for a total tap fee of $4,500.

SUBJECT: PBG- 10-0 1 /Loveland —4089 Ames Street
I have completed the review of the request received on April 26, 2010 to legitimize the
illegal conversion of an accessory structure into two units in addition to the SFR for the
property located at 4089 Ames Street. I have the following comments:
1. Per Section 26 -501 of the Municipal Code of Laws, which pertains to driveway
connections with the public roadway for all one or two - family dwellings, the first
twenty -five (25) feet of the existing driveway shall be a hard surface such as
asphalt or concrete. The 25 foot length is to be measured from the existing asphalt
roadway edge southward towards the subject property.
2. Since the access driveway to the proposed PBG lies within an easement rather
than the applicant holding Fee Simple title to the driveway area, prior to
commencement of the work the applicant will need to obtain written permission
from the underlying landowner to perform the paving.
3. A copy of the written approval mentioned in comment 3 above must be submitted
to the City for review prior to approval of the Planned Building Group.
4. The area of driveway pavement must be shown on the Planned Building Group
Site Plan and include a Note stating, "Written approval from the landowner shall
be obtained prior to commencement of driveway paving activities."

Request: The applicants are proposing to legitimize the illegal conversion of an accessory
structure at the rear of the lot into two units in addition to a single family home at
the address listed above. The property is zoned R -3 which does allow for multi-
family residential if the lot is 12,500 square feet or larger. Please see the
attached plans and applicant proposal for the proposed uses.
Please respond to this request in writing regarding your ability to serve the property or with
related concerns pertaining to this application. Please specify any new infrastructure needed or
improvements to existing infrastructure that will be required. Include any easements that will be

Applicant /Owner Preliminary Proposal:
The applicant purchased the property at 4089 Ames Street in January 2010 and would like to bring
it up to building code and zoning regulations to make it legal and conforming. To do this, they are
proposing to convert the main structure on the property, built as a single family home in 1963 and
later illegally converted to a duplex, back to a single family use. They are also proposing to make
renovations to an accessory structure, illegally used as a duplex today, so that it meets building
code. Finally, they would like to complete the Planned Building Group (PBG) process so that the
two occupiable structures (the single family home and duplex) can legally exist on one lot.
Existing property conditions:
The structures that are part of this proposal are all on one lot at 4089 Ames Street, which is
approximately 13,022 SF in area. The lot contains three structures: (1) a single family home, built
in 1963 and later illegally converted to a duplex; (2) an accessory structure in the northwest corner
of the lot, which was in existence at least by 1949 (when a sewer permit was issued) but for which
there is no building permit and which is illegally used as a duplex; and (3) a detached garage,
located in the southwest corner of the lot. Both the duplex and detached garage receive access off
of 41" Avenue to the north, via a 10' wide drive made of dirt and grass. This access is formalized
through a cross access easement with the property to the north (5300 W 41 Ave). The main house
contains an attached 2 -car garage with driveway that is accessed from Ames Street.
The property is zoned Residential Three (R -3). The surrounding properties are all residential uses
— some single family and some multi - family — which are also zoned R -3.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will not be required for a Planned Building Group.
Planning comments:
The property is zoned Residential Three (R -3), a district established to provide high - quality, safe,
quiet and stable medium to high- density residential neighborhoods. There are currently a few
issues that make the property illegally nonconforming. First, the structure at the front of the lot,
originally built as a single family home, was illegally converted to a duplex. Second, the Wheat
Ridge zoning code does not allow for accessory structures to contain dwelling units. This means
that the duplex in the northwest corner is an illegal use and it does not currently meet building
code. The applicant's plans to convert the main structure back to a single family home and bring
the duplex up to code — per the comments from the Wheat Ridge building inspector who has
assessed the building — will resolve building code issues.
Per zoning regulations, the lot size of approximately 13,000 SF is large enough to allow for the 3
units that will result once the modifications are complete. However, zoning does not allow for an
accessory structure with dwelling units. Thus, to legitimize the duplex a Planned Building Group
(PBG) will be required. According to the zoning code, the purpose of the PBG is to allow
"flexibility and diversification in the location of structures" by permitting more than one main
structure to be built on a single lot. The PBG will legitimize the duplex by allowing two main
structures on the lot — the single family home and duplex — with one accessory structure (the
detached garage).
In terms of site improvements, the driveway that provides access to the duplex should be
improved. Currently, soil is brought out onto the public sidewalk and the street from cars using the
dirt drive. The applicant has agreed to improve the driveway with road base for the entire length of
the drive.
The - applicant would like to receive a permit as soon as possible to replace the roof on the duplex
structure. The applicant will be allowed to pull a permit for the roof only prior to the PBG
approval. All other work to bring the duplex up to code, and the issuance of any certificates of
occupancy for the single family home and duplex, shall not occur until the PBG has been
approved.
Once the PBG is approved and recorded, and the single family home and duplex have been issued
certificates of occupancy, the property will be legal conforming under the existing R -3 zoning.
The Process:
The first step in the PBG process began with the pre - application meeting on April 1, 2010.
For PBGs in the R -3 district with fewer than four main structures, the review is an administrative
process. The applicant should prepare a PBG application, with site plan, and submit the
application to the Community Development Department. Please make an appointment with a
planner to submit the application. Incomplete applications will not be accepted. The PBG
application should include:

I received your E -mail and everything is there on your list except when we mentioned fire separation in the
attic. This would need to be 5/8" type X drywall from the ceiling at the party wall to the underside of the roof
deck. The smoke detectors for the bedrooms would need to be hardwired along with the C/O detector for the
gas furnace and water heater and for the other unit it would need to be hardwired in with the detector for just
the water heater. And finally, if you do nothing to the existing kitchens or bathrooms the do not require any
additional updating.

The following things need to be done to the duplex property located at 5306 and 5308 W
41 Ave. to bring it up to code for an existing building, based on my inspection of March 8,
2010.
Install water heater drip legs.
Protect metallic cable.
Protect the gas line.
Cover any exposed wiring with molding.

Install carbon monoxide detectors 15 feet from water heaters and furnace.
Install 5/8 inch sheet rock on the section of adjoining wall that is not plaster as a firewall.
Vent heat into the bedroom of 5308.
No improvements to kitchen or bath required as long as they are not being remodeled.
No outlet required in bathroom.
Skylights that open in bathroom serve as vents.
