The request does not displace any of the required parking that must be maintained for the other uses on the site. 8. There were no objections regarding the request during the 10-day posting period. With the following conditions: 1. Trucks parked on site must be registered at the front desk with the plate number and driver information. 2. Truck parking will only be for registered guests at the Howard Johnson hotel. 3. Trucks will not be allowed to idle their engines or any other mechanical component for any length of time when unoccupied. 4. REQUEST Case No. SUP-10-01 is an application by Steve Kim, requesting approval of a Special Use Permit to allow for parking of up to three semi-truck/trailers on property zoned C-1 located at 12100 West 44th Avenue (Exhibitl Letter of Request). Semi-truck and trailer parking is prohibited in the City of Wheat Ridge unless the truck is in the process of actively being loaded or unloaded. If a truck is not being loaded or unloaded, truck parking may only occur at the TA Travel Truck Stop located at 12151 West 44 h Avenue unless a Special Use Permit is approved. A Special Use Permit only allows for a maximum of three semi-trucks to be parked on any given property. Pursuant to 26-114 (Special Uses), the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can also impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. CASE ANALYSIS The property for which the Special Use Permit is being requested is 125,700 square feet or 2.88 acres in size and is zoned C-1. It is a corner lot with Van Gordon Street on the west and West 44'x' Avenue on the north. W. 441h is a major corridor through the City of Wheat Ridge. This particular area of the W. 44a' Ave corridor is even more heavily used as it is located at the convergence of Ward Road and Youngfield Street. In addition to Ward Rd. and Youngfield St, Interstate 70 is immediately adjacent to the corridor which has its on and off- ramps for eastbound traffic emptying directly onto W. 44 h Ave. As a result, the majority surrounding land uses are intended to provide services that are oriented for high traffic areas and highway travelers such as gas stations, restaurants, and hotels. The existing building on the site is a 4-5 story stucco, hotel with an attached restaurant. The hotel has approximately 108 rooms while the restaurant is approximately 4,500 square feet. The entire complex has a footprint of approximately 12,100 Square feet and is set back onto the site 187 feet (from W. 44 h Ave.) (Exhibit 21 ~riiprovement Locet:on Certif eater. In addition to the hotel and restaurant, a portion of the lot is used as a Case No. SUP-10-O1/ Howard Johnson 2 daily pick-up and drop-off location for charter busses to shuttle people to and from Blackhawk and Central City. A Special Use Permit was granted in 2007 to allow for a private transit station to operate from the parking lot of the hotel. Located to the north, directly across W. 44th Ave. from the hotel is the TA Travel Truck Stop. The truck stop has frontage along Interstate 70 and the eastbound on/off-ramps are immediately adjacent to the truck stop on the west side. The location of the truck stop in relation to the interstate and its on/off ramps generate a high volume of truck traffic in the corridor as the truck stop is the only location in the City of Wheat Ridge where semi-truck parking is allowed. The applicant would like to be able to accommodate some of the truck drivers and their trucks who do not want to rest in their trucks at the truck stop. They would like to the ability to provide some truck parking on site so the drivers will not have to leave their trucks off-site and unattended while they stay in the hotel. The parking lot associated with the hotel and restaurant surrounds the entire building and has 229 spaces. The proposed truck parking will be located along the east and south sides of the hotel and will provide parking for 3 trucks (Exhibit A, Site Plan). In order to accommodate truck parking for three trucks 33 of the existing parking stalls will need to be used. According to a parking analysis that was done only 178 of the parking spaces are required with the hotel and restaurant use leaving an excess of 51 parking spaces, excluding the 33 needed for the trucks (Exhibit4, IParkingAnalysis). If the truck parking is taken into account then there is an excess of 18 parking spaces. The patrons who utilize the bus service to Blackhawk and Central City use 15-20 spaces on the west side of the property that are located between hotel and Van Gordon Street (Exhibit 5, Aerial Photograph). No exterior modifications to the building or site modifications are proposed with this request. However, there are significant modifications to W. 44th Ave and the eastbound Interstate 70 on/off-ramps as part of the CDOT Interstate 70 ramp relocation project currently under construction. The on/off-ramps will be relocated from the west side of the truck stop to the immediate east side of the truck stop. In addition, a median will be constructed along W. 44`h Ave. that will extend for the entire length of the property. There will be a cut in the median for a left hand turn for westbound W. 44th Ave at Van Gordon St. (Exhibit-,6, W 44th'Avenue Construction Plans) The break in the median will allow the westbound traffic on W 44th Ave to turn south onto Van Gordon St and could prove to be difficult for a semi truck. All taffic coming out of the hotel will be restricted to a right turn only onto eastbound W. 44th Ave. III. SPECIAL USE PERMIT CRITERIA Staff has the following criteria to evaluate special use permit requests and shall determine that the majority of the "criteria for review" listed in Section 26-114.1) of the City Code have been met. Staff provides the following review and analysis of the special use criteria: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use will not affect the health or welfare of any person working or residing in the area. The proposed use also will not negatively affect the safety and convenience of people living and working in the area. The area already receives a high amount of truck and interstate traffic. Allowing 3 trucks to park at the hotel site will not increase the amount of traffic already generated in the area nor will it introduce any impact that is greater than what is already there. Staff finds this criterion has been met. Case No. SUP-10-01/ Howard Johnson 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The property is developed and is located within the W. 44`h Ave./Ward Rd. Urban Renewal Area The purpose of this area being in an Urban Renewal Area is to eliminate the existing "blighted" conditions in their various forms. The inclusion of certain areas and properties within the plan would provide for the elimination and prevention of blight and the development, redevelopment, and rehabilitation of the blighted areas. According to the blight survey that was conducted in conjunction with the urban renewal plan in June 2001, there were some minor conditions on the property that contributed to blight in the area such as dilapidated fences and parking lot repairs. The property has since been purchased by a new owner who has substantially invested in rehabilitating the property, including the building fagade upgrades, fence repairs, and parking lot repairs. Although the urban renewal area blight study does indicate that there are blighted conditions on the property parking lot striping is the only proposed change. The modification of the parking lot to accommodate truck parking will not contribute to blight or the creation of blight. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. No substantial impacts will be created by the proposed use. The current zoning on the property allows for general commercial uses. Typically, the types of businesses allowed in this zone district often provide parking or loading docks for semi-trucks that make regular deliveries to the businesses. In addition, the hotel has already been allowing trucks to park on site. The applicant is requesting this Special Use Permit to formalize and legitimize the actions that have already been taking place on the site. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. Approval of the special use will not create undue traffic congestion or hazards as the proposed use will not bring an increase of traffic to the area. The site has enough excess parking spaces that it will not take away from the required parking spaces. The site is also large enough that the circulation patterns, loading, and other site constraints should not be negatively impacted by the request. Staff finds this criterion has been met. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. Case No. SUP-10-O1/ Howard Johnson 4 As the parking is proposed on the south and east sides of the lot there should be limited impact on the site. The use will be compatible in nature with the surrounding land uses as they are generally commercial, many of which cater to truck drivers and the services they require. This includes the existing truck stop to the north. The area to the south of the hotel is a lake and open space. The general intent of this area is for walking and wildlife viewing. If the proper steps are taken to mitigate the parking of the semi- trucks, there may be only a visual impact on the open space. Staff finds this criterion has been met. 6. The special use will not over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Other utility agencies are already serving the property and should see no increase in usage. The existing network of streets has the ability to handle the capacity of the traffic generated by the uses in the area. The proposed parking will not increase the amount of traffic on the streets and should not overburden existing infrastructure. Schools will also not be impacted by the proposed use. However, the area where the truck parking is located is immediately adjacent to Tabor Lake and open space area. If the trucks idle their engines for sustained periods of time the noise pollution from the engines could negatively affect the wildlife in the area. A condition is being placed on this approval to mitigate this potential impact. Staff finds this criterion has been met. 7. There is a history of compliance by the applicant and/or property owner with Code requirements and prior conditions, if any, regarding the subject property. The property has had a history of code violations for allowing trucks to park on the property. The applicant is requesting the Special Use Permit to legitimize the actions that have been going on at the site for quite some time. Staff finds this criterion has not been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. There are no new buildings or additions being added to the property as a part of this request. Staff finds this criterion is not applicable. IV. NEIGHBORHOOD MEETING Prior to submittal of an application for a special use, the applicant is required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26-109A. Case No. SUP-10-O1/ Howard Johnson A meeting for neighborhood input was held on November 19, 2008 in accordance with Section 26-109A. There was no one in attendance other then the applicant and staff. V. AGENCY REFERRAL Due to the nature of the application, the request was put on a limited referral. Responses from the referral agencies are provided below: Public Works: No concerns or comments regarding the request. Wheat Ridge Police: No concerns or comments regarding the request. Wheat Ridge Parks and Recreation: Due to the proximity of the Howard Johnson hotel property to the Wheat Ridge greenbelt, it is not recommended that any semi-trucks/trailers be allowed to idle engines or compressors for any length of time. The noise and possible pollution from these engines could impact the wildlife at Tabor Lake, particularly during nesting season. All other responding agencies have indicated they have no issues with the expansion and have the ability to serve the property. VI. STAFF RECOMMENDATIONS/FINDINGS OF FACT Having found the application for Case No. SUP 10-01/Howard Johnson, approval of Special Use Permit to allow parking of up to 3 semi-trucks or trailers on the property located at 12100 West 44 h Avenue, to be in compliance with the majority of the applicable review criteria, staff recommends APPROVAL of the special use request with the following findings of fact: 1. The request for administrative approval for a special use permit meets all applicable conditions required by Section 26-114 of the Wheat Ridge Code of Laws. 2. Several guests that we have are truck drivers, and prefer to park at w our Hotel parking lot rather than the truck stop. Trucks will enter our parking lot from 44th Avenue, park on the East side of Hotel next to the fence and in the rear of our Hotel. These designated parking spots will accomodate three to four trucks & trailers, and will not interfere with our guests or neighbors. This report will compare the number of parking spaces on site with the parking requirements for the site uses including the proposed r , truck parking. The report will also look at the route the trucks will take to enter and exit the F+~1 site. PARKING REQUIREMENTS The site presently has 229 parking spaces. The required parking for the hotel and the restaurant and lounge is calculated as follows: Hotel: 1 space/room = 108 1 space/ employee= 10 Hotel spaces required = 118 Restaurant/Lounge: 1 space/ 75 square feet = 60 Total Spaces Required = 178 Spaces available = 229 Excess Spaces = 51 Howard Johnson Truck Parking Request February 19, 2009 Truck Parking: Tracks park on the east edge of the property across the existing parking spaces. If 3 trucks are parked along the east property they will utilize 33 parking spaces. With 3 trucks parking on-site, there are still 18 excess spaces (51-33). Casino Bus Parking: The lot also provides parking for the casino buses. The 18 excess spaces are available for patrons using the casino buses. Parking Summary There is adequate parking for all of the existing and proposed uses. One of the reasons that this truck parking proposal works well is that the hotel has the advantage of accepting the semi parking or not. If the lot is full due to full rooms and full restaurant, they can simply decline the truck parking and not rent a room to the truckers. The hotel has complete control of the parking at the site and thus can assure that adequate parking is available before accepting customers. TRUCKACCESS One of the City requests was to physically restrict the access of the trucks onto Van Gordon St using some type of diversion device. While we understand the City's desire to limit the number of trucks on Van Gordon, we feel that this is not a reasonable request. The owner agrees to ask the truckers to use 44th Ave to access the hotel as most truckers will ensure that they can park on-site before they bring their truck on to the property. Also during check-in when the truckers are instructed to park along the east side of the property and they will also be asked them to leave via 44th Ave. An attached sketch shows the route that the owner asks trucks to use when parking at the hotel. This route works well when the parking spaces near the 44th Ave are not being used. These spaces are empty most of the time as casino bus customers park on the western portion of the lot and hotel and restaurant customers park closer to the hotel. If this route is not available, the hotel owner has the option of not allowing the trucks to park in the lot. Howard Johnson Truck Parking Request February 19, 2009 A physical barrier prohibiting trucks from using Van Gordon should not be used for the following reasons. Any physical restriction to trucks leaving the site will also restrict trucks from entering the site. The access drives are not wide enough to only restrict the exit. The southern access of the hotel on Van Gordon was designed to provide truck access for hotel and restaurant deliveries. Some of these delivery trucks exit using the northern access on Van Gordon. The hotel and restaurant should be allowed to continue receiving deliveries as the property was designed. The Van Gordon accesses are used by buses to pick up and drop off casino passengers. The bus enters the southern access and exits the northern access on Van Gordon. The bus eliminates vehicles from driving to Black Hawk/ Central City and helps decrease air pollutants and helps save on energy usage. Restricting the accesses to trucks may also restrict the buses. • Restricting the access will be dangerous because trucks that might go south on Van Gordon would not be able to enter the hotel. Van Gordon does not have a Cul-de-sac at the end and thus does not offer a turn around. This situation would be force the trucks to turn around on private property on the west side of the street or back up to 44th Ave. None of the options are very safe. • Trucks cannot be prohibited on Van Gordon because the west side of Van Gordon consists of office warehouse units which typically use trucks for delivery of materials or products. • The small amount of truck traffic that the hotel would add to Van Gordon by allowing trucks to park on-site would cause minimal impact to the street. • It would be unfair to restrict the property on the east side of Van Gordon from having trucks, while still allowing the property on the west side of Van Gordon to have trucks. Because of all of the above reasons, we believe it would be better to control the truck traffic on Van Gordon by issuing instructions to the drivers when they come to the front desk asking for a room. A physical barrier would cause more problems than it would solve. Howard Johnson Truck Parking Request February 19, 2009 SUMMARY The Howard Johnson hotel site has adequate parking spaces to accommodate 3 trucks parking on site. These trucks would park along the east side of the property across the existing spaces. The site will still meet the City's parking requirements with the trucks. The owner agrees to instruct the truckers to use 44th Ave to access the site when the truckers come in to check in. He will also ask them to leave via 44th Ave when he instructs them where to park. It is believed that this will be much more effective than constructing a physical barrier that would also restrict delivery trucks and casino buses. Several guests that stay at the hotel are truck drivers and would like to be able to park their trucks at the hotel while they are there. The trucks will enter and exit the parking lot from W. 44th Ave and park on the east and south sides of the hotel in order to keep them out of view from W. 44th Ave. The trucks shouldn't interfere with traffic as the truck drivers usually get to the hotel late in the evening and leave very early in the morning. Will a neighborhood meeting need to be held prior to application submittal? A neighborhood meeting will be required to allow for parking of up to 3 semi-trucks. Planning comments: The property on which the application is being requested is zoned C-1, Commercial One. The area around the hotel is generally zoned C-1 as well as a result the proximity of W. 44th Ave to Interstate 70 in this location. The area directly to the south does have agricultural zoning as the City of Wheat Ridge retains the area for parks and open space. The TA truck stop is located directly to the north, across W. 44th Ave. The hotel currently has over 200 parking spaces for both the hotel guests and the patrons of the restaurant on site. The parking does meet current needs but several parking spaces will be lost due to the truck parking. A parking plan will be required to be submitted with this application. The parking plan will need to demonstrate that the minimum parking spaces required for both the hotel and restaurant can still be met after the parking for 3 trucks is added. The minimum required parking for a hotel is 1 space per room plus 1 space per employee. The required parking for a restaurant/lounge is 1 space per 75 square feet of leasable area. Public Works comments: Due to the high traffic counts on W 44th Ave. Public Works will require a traffic study prepared by licensed engineer in the State of Colorado be submitted with this application to show, how traffic will be impacted by trucks entering and exiting the hotel parking lot. The engineer who prepares this study should also conduct a parking study to see the impacts of the trucks on the parking lot. The Public Works Department will require that access to Van Gordon be restricted from truck traffic. The entrances off of Van Gordon St. will need some sort of traffic diversion device that will prevent trucks from using this road. A description of this device accompanied by a site plan of where it will be located will be required to be submitted along with the application for the special use permit. The Process: This request will require a special use permit. Only 3 trucks would be allowed to be parked on the site if the request for a special use permit is approved. The first step in the Special Use Permit process began with the pre-application meeting on October 9, 2008. The second step required by the Community Development Department will be to conduct a neighborhood meeting. For this meeting, the applicant must inform all property owners within a 600 foot radius of the property via mail or hand delivery of the meeting. The Community Development Department will supply the applicant with a list of the all property owners within the 600 foot radius. A sample of this letter can be found in the pre-application meeting packet and can be used as a template. However, changes to the letter should be made to suit the applicant, including the letterhead. The meeting should be coordinated with the assigned staff member who will also review the notification letter for content. A fee of $100 is required for staff to be present at this meeting. Meetings can be held at city hall or any location the applicant desires. All costs associated with meeting, its location, and mailings will be paid by the applicant. The meeting will be led by the applicant and should inform those who are in attendance what is being proposed. After the neighborhood meeting is held, the applicant may submit their application for the request. Upon the submittal of the application for the Special Use Permit, the application will be reviewed by the case manager and sent to outside agencies for review. A 15 day time period is given for the agencies to respond with and corrections or revisions to the application. Once the review of the application is complete, the property must be posted for a minimum of 10 consecutive days. If no legitimate complaints are received regarding the request within the 10 day period the application for a Special Use Permit will be reviewed administratively. If a complaint is received by the Community Development Department, then the request for the Special Use Permit will be decided upon at a public hearing before the City Council. If the application is reviewed administratively and denied, the applicant can be appeal the decision to the City Council. If a hearing before City Council is required for any reason, staff will present evidence to recommend the approval, approval with conditions, or denial of the Special Use Permit. The public will also be allowed to present evidence or give testimony in support or in opposition of the project. The City Council will approve, approve with conditions, or deny the project based on the testimonies given by staff, applicant and the public. If landscaping will be removed or added a landscape plan will be required with the building permit. Dave, The Public Works Department is concern with this proposal due to potential traffic impact to adjacent public streets such as 441h Avenue and Van Gordon. The hotel's existing driveways are narrow to accommodate semis. Thus, this will create stop conditions for through traffic especially on 44th Avenue when a semi trying to access the parking lot. This will be an unsafe condition for through traffic. In addition, it is questionable whether the parking lot configuration can handle semi turning without impacting the parking stalls as it circulates the parking lot to get in and out. Several guests that we have are truck drivers, and prefer to park at our Hotel parking lot rather than the truck stop. Trucks will enter our parking lot from 44th Avenue, park on the East side of Hotel next to the fence and in the rear of our Hotel. These designated parking spots will accomodate three to four trucks & trailers, and will not interfere with our guests or neighbors. The trucks will exit on to 44th Avenue and will not create any type of traffic problems.
