Approval of Special Use Permit
WHEREAS, an application for a special use 9 ermit was submitted for a 457.5 square foot tenant
space on the property located at 6890 W. 44 Avenue; and
WHEREAS, City staff found basis for approval of the special use permit, relying on criteria listed
in Section 26 -114 of the Wheat Ridge Code of Laws and on information submitted in the case file;
and
WHEREAS, the Community Development Department has properly notified pursuant to Section
26 -109 of the Wheat Ridge Code of Laws; and
WHEREAS, there were no registered objections regarding the application;
NOW THEREFORE, be it hereby resolved that a special use permit is granted for the property
located at 6890 W. 44 Avenue for the purpose of allowing a body art establishment in an R -C
(Restricted - Commercial) zone district based on the following findings of fact:
1. This request for an administrative Special Use meets all applicable conditions as
required by Section 26 -114 of the City of Wheat Ridge Code of Laws.
2. There will be no detrimental effect on health, safety, welfare, or convenience to the
public in the area.
3. The special use will not create adverse impacts greater than allowed under existing
zoning for the property.
4. There will be no impact on the light, air, or water to adjacent property owners.
5. The special use will not create or contribute to blight in the neighborhood and will
not over burden the capacities of the existing streets, parks, schools, and other public
facilities and services.
6. No formal objections were received during the 10 -day noticing/comment period.
With the following conditions:
1. The special use for this establishment shall be issued to the applicant and may not be
inherited.
2. The applicant may employ others to perform body art as defined in City Code
Section 26 -123 under the regulation of this Special Use Permit.
3. No more than 2 artists may perform work at any given time.
4. All work performed shall be consistent with the definition of a body art
establishment as specified in City Code Section 26 -123.
5. Operation hours of the business shall cease by 9 p.m., Sunday through Thursday and
10 p.m., Friday and Saturday.
6. The business shall operate in compliance with all State and County regulations
regarding safe and sanitary practice of body art, the safe and sanitary physical
environment where body art is performed, and the safe and sanitary conditions of
equipment utilized in body art procedures.
7. Approval from the Jefferson County Health Department must be obtained and
submitted in order for the City of Wheat Ridge to issue a Certificate of Occupancy.
8. Multiple documented complaints for the business shall be grounds for initiating
enforcement procedures of City Code Section 26- 114(F).

All notification and posting requirements have been met; therefore, an administrative decision
may be made.
I. REQUEST
Case No. SUP -10 -05 is an application by Nick McDaniel requesting approval of an
administrative Special Use Permit to allow a body art establishment on property zoned R -C
located at 6890 W 44 Avenue. The R -C zone district allows body art establishments as a
special use.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without a public hearing, provided the
following conditions have been met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners
by letter and the site has been posted for at least ten (10) days.
3. No written objections have been received in such ten day period.
4. The Community Development Director concludes that the criteria for approval, as
set forth below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure
compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity;
2. Whether the SUP is personal to the applicant and may or may not be inherited;
and/or,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to all of the requirements of this section.
II. CASE ANALYSIS
The applicant Nick McDaniel is requesting the Special Use Permit for a vacant unit located
at 6890 W. 44' Ave. (Exhibit 1, Letter of Request)'. The property is zoned R -C, a
commercial district established to accommodate various types of office uses performing
administrative, professional and personal services, and to provide for a limited range of retail
uses that are neighborhood oriented.
The majority of the area is zoned commercially, whether it is N -C, or R -C, as it is along W. 44
Avenue, a major commercial corridor through the City of Wheat Ridge (Exhibit 2, Zoning Map).
This area of W 44` Ave has a large mix of small churches, insurance agencies, banks, and auto

repair facilities that do not generate large amounts of traffic. There are some residential zone
districts and uses immediately to the south and the west of the shopping center, as well.
The property is fully developed and is approximately 16,117 square feet or .37 acres in size. It
contains a single story brick building with multiple units that was constructed in 1967. The
structure has approximately 4,155 total square feet of leasable space while the area to be leased
for the proposed body art studio is approximately 487.5 square feet. The site is located at the
southeast corner of W. 44 h Avenue and Quay Street in the Rose Building (Exhibit 3, Aerial
Photograph). All of the existing businesses on site are comprised of commercial and retail uses.
The units are accessed directly from the parking lot. The site was developed with enough
parking to accommodate the businesses in the center and their customers.
The applicant will be renovating the interior space of the unit to meet the needs of the business.
It will include a front waiting area, two separate studios, a cleaning room, and a restroom
(Exhibit 4, Inte_ rior Building Plan). The two studios will be separated from the front waiting area
by a half -wall to keep the main areas of the unit open. One of the studios will be occupied by the
applicant while the other studio will be occupied by another tattoo artist. The front area will
contain seating for waiting customers and will also sell miscellaneous items that are accessory to
the business, such as jewelry for piercings, cleaning solutions and other related products. The
applicant has expressed that he will employ no more than 2 additional artists and there will never
be more then 2 artists working in the studio at any given time.
The applicant has been doing body art for several years and most of the clientele has been
established. Work is rarely done on walk -in customers since most of the work is done by
appointment only. Though most of the work is done by appointment there will be set hours
when a person would be able to walk -in to have work done if work is not already being done on
someone else. Normal business hours would typically begin at 12:00 p.m. and would operate no
later than 9:00 p.m., Sunday through Thursday. Friday and Saturday the studio would have
extended hours and be open from 12:00 p.m. to 10:00 p.m.
Before any interior renovations begin, the Jefferson County Health Department requires a plan
review application with the proposed floor plan be submitted for approval. Once approval from
the county is obtained, the applicant must submit the approval along with all other documents
that are required by the building division in order to obtain building permits from the City of
Wheat Ridge, if applicable. Once the renovations are complete, all subsequent inspections will
be required to completed and passed in order to obtain a Certificate of Occupancy, including any
and all state and county inspections.
All medical or biohazard waste produced by the body art establishment is also regulated by the
Jefferson County Health Department. The needles used are one -time use, disposable needles.
Once the needles have been used and discarded they will be stored in a medical waste container
until the container is full and ready for pick -up. The needles and other medical waste are picked -
up by a medical waste disposal company and disposed of properly by them. All additional waste
that is not required to be picked up by the medical waste disposal company is safe for normal
trash pick -up.

III. SPECIAL USE PERMIT CRITERIA
Staff has the following criteria to evaluate special use permit requests and shall determine that
the majority of the "criteria for review" listed in Section 26 -114.1) of the City Code have been
met. The applicant has provided their analysis of the applications compliance with the variance
criteria (Exhibit 5).
Staff provides the following review and analysis of the special use criteria:
1. The special use will not have a detrimental effect upon the general health,
welfare, safety and convenience of persons residing or working in the
neighborhood.
The proposed special use will not affect the health, welfare, safety, or convenience of
any person working or residing in the area. The property is already developed and
has the ability to accommodate all renovations and parking required to accommodate
the new business.
Jefferson County Health will review and approve all proposed plans for health related
codes. Prior to a Certificate of Occupancy being issued, the applicant will have to
submit all approvals and inspections that are required by the Jefferson County Health
Department or other State or County entities requiring inspections.
Staff finds this criterion has been met.
2. The special use will not create or contribute to blight in the neighborhood by
virtue of physical or operational characteristics.
The property is developed but does not contribute to blight in the neighborhood. The
building was built in 1967 and has had minimal updates to the exterior since. The
applicant does not own the property and therefore does not have the ability to
renovate the building.
The unit that will be leased is currently vacant. A vacant unit would be more likely to
contribute to blighting in the Wheat Ridge Center then the proposed use from an
operational standpoint. The establishment of a viable business should be a benefit to
the neighborhood.
Staff finds this criterion has been met.
3. The special use will not create adverse impacts greater than allowed under
existing zoning for the property.
Staff has not identified any adverse impacts greater than are allowed under existing
zoning. There will be no impact to the light, air and water to the adjacent properties
as no expansions or other development is being proposed. There will also be no

adverse impacts as the R -C zone district allows for businesses that generate similar
amounts, if not more, traffic.
Staff finds this criterion has been met.
4. The special use will not result in undue traffic congestion or traffic hazards, or
unsafe parking, loading, service or internal traffic conflicts to the detriment of
persons whether on or off the site.
The use will not create undue traffic congestion or hazards. All parking and loading
areas are currently existing on the property.
Staff finds this criterion has been met.
5. The property is appropriately designed, including setbacks, heights, parking,
bulk, buffering, screening and landscaping, so as to be in harmony and
compatible with the character of the surrounding areas and neighborhood,
especially with adjacent properties.
The property is already developed. No changes to the exterior of the building are
being proposed. As a result, all setbacks from surrounding structures will remain the
same and the height will remain unchanged. The impervious surfaces are not being
increased and no grading will be done so site drainage will remain unchanged. The
parking and landscaping will also remain unchanged as the change in use does not
require there to be an increase from what is already provided.
Staff finds this criterion is not applicable
6. The special use will not over burden the capacities of the existing streets,
utilities, parks, schools, and other public facilities and services.
Parks, schools and other public facilities will not be negatively impacted. The
existing network of streets has the ability to handle the capacity of traffic that is
already using the streets. There will be insignificant increases to traffic on the streets
generated by this use. There is an existing building on site already being served by
outside utility companies. Any improvements required by the utility companies must
be completed during the building permit process, if applicable.
Staff finds this criterion has been met.
7. There is a history of compliance by the applicant and /or property owner with
Code requirements and prior conditions, if any, regarding the subject property.
Neither the applicant nor the property in question has a history of code violations.
Staff finds this criterion has been met.

8. The application is in substantial compliance with the applicable standards set
forth in the Architectural and Site Design ManuaG
The Architectural and Site Design Manual applies to all new construction except
single and two family residential structures and those existing structures undergoing
major additions. No new buildings or additions are being proposed for this site.
Staff finds this criterion is not applicable.
IV. NEIGHBORHOOD MEETING
Prior to submittal of an application for a special use, the applicant is required to hold a
neighborhood meeting in accordance with the requirements set in City Code, Section 26 -109A.
A meeting for neighborhood input was held on April 27, 2010 in accordance with Section 26-
109A. Other than the staff and applicant, nine residents of the area were present. Their concerns
are outlined in the neighborhood meeting minutes (Exhibit 6, Neighborhood Meeting Minutes).
No formal objections were filed during the 10 -day noticing/comment period
V. AGENCY REFERRAL
All affected service agencies were contacted regarding the ability to serve the property. Their
specific referral responses follow:
Public Works: No comments or objections.
Jefferson County Health Department: Before any renovations begin the Jefferson County
Health Department will require the applicant to submit a plan review application with the
proposed floor plans for their review. Once the renovations are complete all state and county
inspections will be required to completed and passed before the establishment may open.
Wheat Ridge Fire Department: No comments or objections.
All other agencies to which the referral was sent either did not respond or have indicated they
have no issues with the proposed use and that they have the ability to serve the property.
VI. STAFF RECOMMENDATIONSMINDINGS OF FACT
Having found the application for Case No. SUP 10- 05/McDaniel, a Special Use Permit for a
body art establishment on R -C zoned property, to be complete and in compliance with the
majority of the applicable review criteria, staff is granting APPROVAL of the special use request
based on the following findings of fact:

site, which is approximately 16,117 SF in area, contains an existing one -story commercial
structure with 7 units in it. The site contains a paved parking area in front of the building 18
parking spaces.
Applicant's Proposal:
The applicant, Nick McDaniels is proposing convert one of the existing units that is currently
vacant in the shopping center into a small body art studio. The unit is approximately 480 square
feet. The applicant will renovate the interior of the unit to have space to allow for two areas for
body artists. The applicant will have no more than 2 artists working at the same time but may
employ a third artist so there can always be 2 artists working.
The following issues were discussed regarding the Special Use Permit request:
Other than the applicants and staff, 9 members of the public were in attendance at this
neighborhood meeting. The people that were present represented areas of the surrounding
neighborhood within the 600 foot noticing.

Staff discussed the site, its current zoning, the recently adopted comprehensive plan and how
it affects the property, and the process that will be required to obtain a Special Use Permit on
the property.
The applicant, Nick McDaniels briefly described what is being proposed and the nature of
the business. Mr. McDaniels indicated that most of the work he does is not on walk -in
customers since most of his work is done by appointment. Though his work is mostly done
by appointment there will be set hours when a person would be able to walk -in to have work
done if Mr. McDaniels is not already working on someone.
The members of the public were informed of their chances to make comments in the SUP
process and at the public hearing that will be required before City Council.
The following questions and concerns were voiced by of the members of the public present
at the meeting.
Several people were concerned with the type of clientele that would be attracted to the
business.

For the time being the only signage proposed is a window sign. There is an existing sign
for the entire center on the property that may be utilized by the applicant. The sign will
be similar in size to the signage for the other business in the center. The sign will contain
the name of the business.
• Is this an appropriate use for this location?
As West 44' Avenue is today, there is a mix of businesses and homes on the corridor
between Sheridan all the way to Youngfield Street as W. 44' is one of the primary
commercial corridors through the City. This area in particular, has a large mix of
small medical, dental, accounting, mortgage, and other similar office, and auto
oriented businesses that do not generate large amounts of traffic. This use will be
similar in nature in that it will generate very little traffic.
• Have there been any other locations that have been looked at?
No. No other location has been considered as this is the location that fits the business,
and financial needs and limits of the applicants.
• What is there to prevent less desirable land uses that are associated with body art
establishments from locating in the area?
If the land use is a questionable use due to the impacts on the surrounding neighborhood,
typically a special use permit is required to ensure the surrounding area isn't disrupted.
• What will the hours of operation be?
Sunday through Thursday the hours of operation will be from 12: 00pm to 9: 00 pm and
on Friday and Saturday from 12: 06pm to 10: 06pm
• If the operation got too large or too busy, would you expand or bring in additional artists?
There are strict standards in place by the health department that regulate the amount of
space that is needed for each artist and their equipment. With the size of the proposed
studio there would be enough room for an additional artist. For the time being the
applicant will begin the business by himself and may add one or two artists once
established. If there are 3 artists no more than 2 artists will be working at the same time.
• How are the needles and other waste disposed of?

The needles used by Mr. McDaniels are one time use, deposable needles. The used
needles are not disposed of outside. They are stored in a sterile room in a medical waste
container until the container is full and ready for pick -up. The needles and other medical
waste are picked -up by a Medical Waste collector and disposed of properly by them.
This procedure is regulated by the Jefferson County Health Department.
All additional waste that is not required to be picked -up by the medical waste disposal
company will be taken to the dumpster.
• Will there be piercings done at this studio?
There maybe a piercing component added to the business at a later date but for the time
being, there will be no piercing on site.
• Are tattoo artists and body piercing specialist required to have licenses?
Yes, both have to be licensed and are required to meet regulations that are set by the
State of Colorado.
• Does the shop have to meet any health codes?
Yes, before the establishment will be allowed to open, an inspector from the Jefferson
County Health Department will inspect the shop to make sure it meets all health
requirements. It will also require yearly inspections. The business can also be inspected
at any given time to ensure that all health codes continue to be met.
• What types of chemicals are used and how is it disposed or.
All chemicals that are used for the sterilization of tools, surfaces, and other items are
non - toxic. All needles used for tattooing and other uses are disposed of in the proper
biohazard receptacles.
• What if a child or minor would walk in to get a tattop?
Mr. McDaniels must abide by all laws set in the State of Colorado or risk his license
being revoked. Mr. McDaniels sets his on personal standards that are more strict than
the state requirements and does abide by them. He has indicated that he will not allow
any person under the age of 18 in the studio. Although the State does allow for minors to
enter body art establishments and get tattoos with parental consent, the applicant will not
tattoo anyone under the age of 18 even if parental consent has been given.

The property is zoned Restricted Commercial (R -C), a commercial district established to
accommodate various types of office uses performing administrative, professional and personal
services, and to provide for a limited range of retail uses that are neighborhood oriented. The
site, which is approximately 16,117 SF in area, contains an existing one -story commercial
structure with 7 units in it. The site contains a paved parking area in front of the building 18
parking spaces.
Applicant's Proposal:
The applicant, Nick McDaniels is proposing convert one of the existing units that is currently
vacant in the shopping center into a small body art studio. The unit is approximately 480 square
feet. The applicant will renovate the interior of the unit to have space to allow for two areas for
body artists. The applicant will have no more than 2 artists working at the same time but may
employ a third artist so there can always be 2 artists working.
The following issues were discussed regarding the Special Use Permit request:
Other than the applicants and staff, 9 members of the public were in attendance at this
neighborhood meeting. The people that were present represented areas of the surrounding
neighborhood within the 600 foot noticing.
Staff discussed the site, its current zoning, the recently adopted comprehensive plan and how
it affects the property, and the process that will be required to obtain a Special Use Permit on
the property.

The applicant, Nick McDaniels briefly described what is being proposed and the nature of
the business. Mr. McDaniels indicated that most of the work he does is not on walk -in
customers since most of his work is done by appointment. Though his work is mostly done
by appointment there will be set hours when a person would be able to walk -in to have work
done if Mr. McDaniels is not already working on someone.
The members of the public were informed of their chances to make comments in the SUP
process and at the public hearing that will be required before City Council.

Applicant /Owner Preliminary Proposal:
The applicant would like to lease a vacant space located in an existing commercial building at 6890
W. 44' Ave, at the southeast comer of W 44' Ave and Quay Street. The proposed use is a body art
shop, including a lobby, restroom, and work area. The applicant will be the main employee, with the
potential for 1 -2 additional employees to join the operation in the next year.
Will a neighborhood meeting need to be held prior to application submittal?
Yes, a neighborhood meeting will be required for the special use permit.
Existing Conditions:
The property is zoned Restricted Commercial (R -C), a commercial district established to
accommodate various types of office uses performing administrative, professional and personal
services, and to provide for a limited range of retail uses that are neighborhood oriented. The site
contains an existing one -story commercial structure and a surface parking area with 19 spaces and 1
ADA accessible parking space.
To the east and north of the site are other commercial uses, zoned R -C. Across Quay Street to the
west is another commercial property, zoned N -C. To the south, there are residential uses zoned R -2.

SPECIAL USE PERMIT CRITERIA
What is a special use? Special uses are discretionary uses which, if properly designed,
developed, operated and maintained, may be approved in a zone district where the special
use is permitted. The primary issues to be addressed are those related to justification of
need and special design and operational considerations which mitigate potential
detrimental impacts on surrounding land uses, the street system, or public services or
facilities.
A special use permit can be granted administratively by the Community Development
Director or by City Council.
Before a special use permit is approved, the applicant will demonstrate that the
following criteria have been met:
I. Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood.
2. Will not create or contribute to blight in the neighborhood by virtue of
physical or operational characteristics of the proposed plan.
3. Will not create adverse impacts greater than allowed under existing for the
zoning for the property.
4. Will not result in undue traffic congestion or traffic hazards, or unsafe
parking, loading, service of internal traffic conflicts to the detriment of
persons whether on or off the site.
5. Is appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible
with the character of the surrounding areas and neighborhood, especially with
adjacent properties.
6. Will not overburden the capacities of the existing streets, utilities, parks,
schools and other public facilities and services.
7. If there is a history of compliance by the applicant and /or property owner with
Code requirements and prior conditions, if any, regarding the subject property.
8. Will be in compliance with the applicable standards set forth in the
Architectural and Site Design Manual.
Grant of use: It shall also be determined if the special use is dependent upon design,
management or operational aspects which can be a personal grant of use to the owner and
not a grant which transfers with the property. Therefore, City Council must also decide, if
granted whether the special use: Runs with the land in perpetuity; is personal to the
applicant and may or may not be inherited; and /or shall be granted only for a defined
period, after which time the special use shall expire.

• Hazardous Waste Disposal:
I will be using all disposable supplies ( needles and tubes ) and will be using sharps containers for the
needles and will be using a hazardous waste disposal company to dispose of such materials. The preferred
method for the management of used needles and other sharps is to collect them in a sharps container and
send them to a commercial medical waste disposal company for disposal. There are many commercially
available mail -in programs available, as well as a few medical waste disposal companies that you can
contract with to pick up and dispose of these wastes for you. If available in your area, pick up service
providers may be found in your local yellow pages under "Waste Disposal - Medical."
• Chemicals:
MadicideFd will be used to clean, sanitize and disinfect all work areas and equipment used for tattooing.
Tincture of Green soap will be used to clean the clients skin before, during and after the completion of
tattoo. The MadacideFd and Tincture of Green soap will be stored on premises along with the MSDS.
There will be a fire extinguisher on site and will have periodic inspections done to ensure it's proper
working condition.
• Exterior:
There are 18 parking spaces including 1 space for handicapped parking which are shared within the 7
units and there are 2 driveway accesses to parking lot, one on W.44 h Ave. and the other on Quay St.
• Interior:
There will be a lobby separate from all work area(s) and will include furniture for client(s). There is a
restroom on premise with 1 toilet, 1 sink, commercial paper towel dispenser and will be available for all
clients. All areas will have non -porous surfaces to ensure a clean, sterile environment while being easy to
