REMARKS:
I believe you could remove the word adjust from Note 5 and simply say
remove. Then identify the new lot line on the graphic portion of the
plat with the Bearing and distance.
Since there are extra pins on the western boundary, some leaders may
help clarify the new lot dimensions. Are the extra pins for the adioiner?

Case No. LLA-99-02, an application by B-H-B Partnership, which is a request for a lot line
adjustment to consolidate 3 lots down to 2 lots at 3825, 3845 3875 Pierson Court and 11125 W.
38th Avenue.
Pursuant to the departmental administrative process for lot line adjustments, the Zoning
Administrator is empowered to decide upon application for a lot line adjustment since the
following conditions apply:
1. Lot line adjustments are exempt from the subdivision replatting process.
2. The lot line will consolidate the existing three properties into two lots, thereby not
creating additional building sites through this process.
3. The Development Review Engineer and the City Surveyor had no concerns with the
adjustment.
4. No easements of record have been affected by the adjustment.
The administrative process has been followed. Staff has received no comments regarding this
request from either the Development Review Engineer, the City Surveyor or the public.
Therefore, staff recommends approval and recordation of Case No. LLA-99-02.

Paragraph 20. ADDITIONAL PROVISIONS
TO THE VACANT LAND/FARM AND RANCH
CONTRACT TO BUY AND SELL REAL ESTATE
1. The parties agree to cooperate in obtaining the consent
of affected land owners in the modification of that
existing roadway easement extending south from the
north lot line (approximate) of Lot 3, (3875 Pierson
Ct.) approximately 200 feet to maximize and increase
the depth of Lot 3, from west to east and allow the
existing brick roadway to remain as access to Lot 3.
2. Seller and Purchaser shall cooperate in obtaining funds
from First Bank of Westland to construct and complete a
gated entrance way which shall functionally allow
ingress and egress from the Biehl Property and Lot 3
(3875 Pierson Ct.) as well as the owners of Lot 4 and
Lot 5, Applewood Village Estates.
3. Seller shall complete at the sole cost and expense as a
condition precedent to closing the following
improvements:
A. Demolition of existing structure and removal of
all debris resulting therefrom now existing on
11125 West 38th Avenue, and Lots 1, 2 and 3 of
Applewood Village estates being purchased by the
Purchaser.
B. The construction and bringing to appropriate site
grade Lots 1, 2 and 3 of Applewood Village Estates
which shall include the supply and delivery of
clean fill dirt together with all compaction
necessary.
(NOTE: The parties will cooperate in reaching
agreement as to the modification of the present
site grade of the property known as 11125 West
38th Avenue, Wheat Ridge, Colorado 80033)
C. This contract and purchaser's performance thereon
is specifically contingent upon the Seller's
completion of the development of the subject
sites, at its sole cost and expense including but
not limited to the construction and installation
of streets, curbs and gutters, water, sewer, gas,
telephone, cable and all electrical utilities in
accordance with county and municipal regulations
and specifications.
D. Should construction work, design work or other
work be commenced by Purchaser prior to the
closing of this transaction, Purchaser shall hold
the Seller harmless from and against loss or
damage resulting from mechanic's or materialman
liens being filed or encumbering Seller's
property.
E. Seller shall complete a Phase I Environmental
Study on the development, the results of which
shall certify the subject sites to be free from
contamination.

This will acknowledge your.correspondence dated April 2, 1999
regarding the above referenced property.
Please be advised that the above referenced property is in an
area served by The Consolidated Mutual Water Company by
virtue of a Distributor's Contract, with Denver Water.
Domestic water service may continue to be provided to this
property subject to compliance with the Company's rules,
regulations and requirements for' such service as well as the
water tap allocation policies as established by Denver Water.
The Company's rules, regulations and requirements further
state that each separate structure be served by a separate
tap and meter, and in order to receive domestic water
service, the property must also front a Company main.
Our records indicate that the properties addressed as 3825
and 3845 Pierson Street are currently stubbed into these lots
for future domestic use. They can be activated once the
additional fees- are paid and the meter setting has been
installed.
The property addressed as 3875 Pierson Street is currently
receiving domestic water from Consolidated through a 3/4-inch
