DATE: Monday, April 19,1999 SUBJECT: Lot line adjustment map for 4901 and 4975 Robb St. The following are comments from the Public Works department: These parcels are not in a previously platted subdivision, therefore it is technically not a Lot line adjustment. 2. If the purpose of this is to correct title to the property because of an existing encroachment, a quit claim deed may have been adequate and no review or involvement by the City would be necessary. After this document is filed the legal descriptions will remain meets and bounds descriptions and any reference to this document will be meaningless. However, a minor subdivision plat would correct and define the property boundaries permanently and the parcels could be defined as Lots within that subdivision. The quit claim deeds will still need to be filed. We would prefer that the term Lot line adjustment not be used for these type of documents in the future unless they are in an existing subdivision and can be referred to such subdivision. A recommended title for this map would be Capra/Portie Parcel Adjustment Survey. MEMORANDUM I Approved Date TO: Seam McCartney, Planner FROM: Greg Knudson, Development Review Engineer DATE: April 19, 1999 SUBJECT: 4901/4975 Robb Street, LLA-99-03, Lot Line Adjustment The Public Works Department has reviewed the Planning Department referral dated April 13, 1999 for the above referenced site, and has the following comments: 1. The proposed Lot Line Adjustment Map has been forwarded to the City Surveyor, John McGuire, P.L.S. for review. Subsequent comments will be forwarded in writing to Marsh Land Surveying, Inc. See also memorandum dated 4/19/99 2. Based upon the described purpose of this referral, no additional development standards will be required at this time. 3. Marsh Land Surveying 8120 Sheridan Boulevard, suite B-201 Westminster, CO 80030 Re: Lot Line Adjustment / 4901 Robb Street Dear Mr. Marsh, This letter is in reference to the lot line adjustment request submitted on April 12, 1999. Although the process is considered administrative, the case must be referred to the Public Works Department for comments, as well as reviewed by the Planning and Development Department. I have attached a copy of the comments received from John McGuire, City Surveyor. Please see the attached memo. As we discussed, the Planning and Development Department found that the proposed lot line adjustment will not allow for the adequate setback required detached garages in the Agricultural- One zone district. Staff measured the distance and concluded that the northeast corner of the existing garage will only be located approximately 5' from the adjusted property line. This proposed measurement is 10' less than the 15' side yards setback requirement for detached garages in the Agricultural-One zone district. Therefore, the lot line adjustment may not be approved as presented. To achieve compliance, the following would need to take place: Further adjust the property line 10' north to allow for 15' separation between the property line and the existing garage. Apply to the Board of Adjustment to request a 10' side yard setback variance. However, this option is not a guaranteed approval and costs an additional $135.
