SUBJECT: Administrative Review of Plat Amendment
DATE: October 20, 1999
This memorandum shall serve to document that this case number was assigned to process the
vacation of a fire access easement (Easement E) on Lot 1 of the Onyx Park Subdivision. The case
was processed administratively due to the relatively minor nature of the request. Richard Gash,
owner of the property, made the application in order to satisfy conditions of a contract to sell Lot 1.
As a requirement for processing the case and recording the mylar, the applicant was required to
receive consent from the Arvada Fire Department for vacating the easement. Staff volunteered to
obtain the signatures of U.S. West and Public Service Company. There were no other changes to
the Onyx Park Subdivision associated with this Plat Amendment.
The processing fee for this application was $50.00 for review and recording fees. Being that the
mylar was not ready for signature or recording by the date of the property sale, staff was asked to
and did prepare a letter for the seller confirming that the Department of Planning and Development
would process this amendment.

West 43' Avenue, it is the opinion of our office that the proposed "Easement B" fire ingress
egress access designed to accommodate emergency vehicles be permitted to be vacated. Should
future construction be considered an additional fire hydrant may be required on 43' Ave.

Attached is a copy of the survey and the portion of the title
commitment. The reference we are concerned about is noted as
"EASEMENT E" on the survey. Our interest on behalf of the
land owner and the new buyers is to have this 50 foot ingress
egress for fire lane vacated. This plan was originally drawn
up to accommodate access from 43rd avenue through to 44th
avenue because their was no other way. Now 43rd and 44th
connect in three different places providing for easy turn
around space for fire and emergency vehicles.
Please advise us as soon as possible if this is possible and
we will find out from tht title company what is required to
delete it.
