7. PUBLIC HEARING
A. Case No. MS-99-06: Application by Legend Properties, LLC, for approval of a two-lot
subdivision for the purpose of developing a commercial building for small businesses
located at 9751 West 44th Avenue.
This case was presented by Martin Omer. He reviewed the staff report and presented
overheads of the property. All pertinent documents were entered into the record and
accepted by Chair MACDOUGALL. Mr. Omer advised the Commission that there was
jurisdiction to hear the case. Page A-1 contained an error concerning the property to the
west and should be corrected to read "residential land uses" rather than "undeveloped".
In response to a question from Commissioner SNOW, Mr. Omer stated that no street
dedications were required by the Public Works Department and there were no requirements
for an accel/decel lane on 44th Avenue.
Commissioner THOMPSON asked about access easement and expressed concern about
semi's entering the property. Mr. Omer replied that there is provision for a 22-foot wide
access easement dedication between lot one and lot two and is not available to the adjacent
Chado property at this time.
Commissioner BRINKMAN commented that drainage is a criteria and read from the
subdivision regulations as follows: "Drainage areas, wherever possible, should be left in
their natural state and no encroachment should be made in the natural channel areas." She
asked how the ditch on the property would be affected. Mr. Omer replied that the ditch
company had no comment regarding this subdivision and the Public Works Department had
determined that the drainage plan is approvable.
Commissioner SNOW expressed concern about lack of contours on the plan.
Tony Ficco

Mr. Ficco, the applicant, was sworn by Chair MACDOUGALL. He explained that
topographies, contours and drainage have been addressed in Lot 1, and there are no plans for
the owner of Lot 2 to develop at this time. A complete drainage report was prepared and is
approvable. He stated the purpose of the subdivision is to establish a lot line for his lot,
known as Lot 1. He stated that he would have no objection to an easement between Lot 1
and Lot 2, but would oppose an easement along the north property line. He did not believe
the property would be yielding to heavy semi use or daily trash removal.
In response to a question from Commissioner BRINKMAN concerning the ditch, Mr. Ficco
replied he spoke with a secretary at the ditch company who told him that when the adjacent
Chado property was farmed years ago, irrigation water passed through his property, but an
actual physical ditch with water running no longer exists.

Ms. Oman was sworn by Chair MACDOUGALL. She stated she was the real estate agent
for the property and had been the agent for the Chado property. She stated that she has files
on the subject property going back ten years and testified that all of Mr. Ficco's statements
were accurate and could be documented.
Commissioner COLLINS asked about the ditch. Ms. Oman stated that the ditch was
discontinued along the back of the property when Pennington Elementary School was
expanded. There are still some outlets from the Oulette Ditch along Kipling Street, but this
property is not and will not be affected by the development. She stated that the Chado
property is presently owned by Commercial Federal in California and the owners envision
high retail for the property.
James Cluck
9890 West 44th Avenue
Mr. Cluck stated that he was representing his father, James Cluck, who resides across the
street from the subject property. He was sworn by Chair MACDOUGALL. He had
reviewed the applicant's plan and believed it was a very good plan. He believed the access
from 44th Avenue was adequate.
Commissioner SNOW stated that since this has not gone before the Parks and Recreation
Commission, she would like to request a 5% park dedication subject to change by the Parks
Commission.
Commissioner BRINKMAN stated that since she has heard both that there is water in the
ditch and there is not water in the ditch, she would like to make sure there is an easement
sufficient for drainage and maintenance of the ditch. She requested additional wording
(shown in italics) to the wording "no encroachment shall be made to the channel areas--
specifzcally the ditch that runs across Lots 1 and 2. " Alan White explained that, under state
statute, older ditches have a prescriptive easement assigned to them and, even though it is
not recorded, the easement still exists.
It was moved by Commissioner SNOW and seconded by Commissioner THOMPSON
that Case No. MS-99-06, a request for a two-lot minor subdivision be approved for the
following reasons:
With the conditions approved, all requirements' of the City's Subdivision
Regulations will have been met.
2. Subdividing this property as proposed will legitimize a previous sale of the
individual parcels and thereby allow for redevelopment of the property.

1. A 22-foot cross access easement will be provided between the northwest corner
of Lot 1 and the northeast corner of Lot 2 and will be shown on the plat with
standard cross access easement language approved by the city attorney.
2. A 5% park land dedication will be required unless the Parks Commission
proposes an alternative to the required park dedication.
3. The language regarding utility easements requested by Public Service be shown
on the plat.
4. The plat will show contours, as required by the subdivision regulations.
5. The drainage plan which has been submitted will be made a part of the
subdivision and recorded with it.
6. An easement, as defined by state statute and Wheat Ridge subdivision
regulations sufficient for drainage and to allow for maintenance of the ditch and
as approved by the Oulette Ditch Company, will be shown on the subdivision
plat.
The motion passed by a vote of 7-0 with Commissioner GOKEY absent.
(Chair MACDOUGALL declared a brief recess at 8:55 p.m. The meeting was reconvened at 9:10
P.M.)
B. Case No. WZ-99-15: Application by Legend Properties, LLC, for approval of a zone
change from Residential-Two and Restricted-Commercial to Planned Commercial District
(PCD) for the purpose of developing a commercial building for small businesses located at
9751 West 44th Avenue.
This case was presented by Martin Omer. He reviewed the staff report and presented slides
and overheads of the property. All pertinent documents were entered into the record and
accepted by Chair MACDOUGALL. Mr. Omer advised the Commission that there was
jurisdiction to hear the case. Staff recommendation was for approval of the application with
conditions as outlined in the staff report.
Commissioner COLLINS pointed out an error on the subdivision plat previously approved
by the Commission this evening., There is a small strip that is shown as R-2 but should be
C-1.
Commissioner THOMPSON expressed concern about the type of traffic that would be
generated by this development, especially the. generation of semi traffic and indicated she
would like to have a condition that no semi traffic could service this development at any
time. She also expressed concern about traffic circulation and whether or not there would be
room for vehicles to pass by a parked vehicle if there were two-way traffic circulation. She
was also concerned about the lack of an accel/decel lane. She didn't want to see the
residential neighborhood impacted by traffic.

The property is within the City of Wheat Ridge, and all notification and posting requirements have been met,
therefore, there is jurisdiction to hear this case.
I. REQUEST
This is an application for a Minor Subdivision to create Lot 1 and Lot 2 of the 44`h Avenue Business Park,
located at 9751 West 44`h Avenue. This application is related to Case No. WZ-99-15, a request to rezone
1.10 acres from R-2, Residential-Two and 0.79 acres from R-C, Restricted Commercial to PCD, Planned
Commercial Development. Minor Subdivisions require Planning Commission action only.
II. CASE HISTORY
This application is for property which is currently improved with a duplex residential dwelling and
undeveloped land. The property is located just east of and in close proximity to the northeast corner of
44`h and Kipling and the large undeveloped acreage (12.5 acres) known as the Chado property. Since
the application for planned commercial development of the 44`h Business Park precedes any other recent
application for development in this area, the 40 Business Park is important in that it sets the standard
for anticipated future development in the area. Exhibit A is the site location map, Exhibit B is the zoning
location map, and Exhibit D is the subdivision map.
III. AGENCY REFERRALS

1. The District provided seven comments which are included in Exhibit C.
Valley Water District :
1. Water lines, fire hydrant and fire sprinkler lines will be needed to meet AFPD
requirements.
New water taps and service lines will be needed for each separate building structure.
Easements for fire hydrants that meet Denver Water and Valley Water District
requirements will be needed.
Public Service Company:
Public Service Company submitted a general request that the following language or plat note be
placed on the preliminary or final plats for the subdivision:
Ten foot (10) wide utility easements are herebygranted on private property adjacent to all public
streets, and around the perimeter of each lot in the subdivision or platted area. These easements
are dedicated for the installation, maintenance, and replacement of electric, gas, television cable,
and telecommunications facilities. Utilities shall also bepermitted within any access easements
and private streets in the subdivision. Permanent structures and water meters shall not be
permitted within said utility easements.
The subdivision does incorporate this language.

The City's Subdivision Regulations provide an extensive list of review criteria which is essentially a
check list designed to ensure a standardized description of the property which meets all recording
information requirements. Staff has reviewed this criteria and has found that the minor subdivision
application meets the review criteria.
VI. STAFF CONCLUSIONS AND RECOMMENDATION
The subject property has never been subdivided. The owner of the property is in the process of selling
the land as two parcels, one of 1.89 acres and the other of 1.865 acres. The purchaser of proposed Lot
1 has submitted a rezone application for Planned Commercial Development on the 1.89 acres. It is
anticipated that the purchaser of proposed Lot 2 will also submit a rezoning application to the City.
Legally subdividing this property as proposed will enable the seller to transfer the individual parcels and
thereby allow for the redevelopment/redevelopment of the property. Traffic impacts and access are part
of the rezoning case, WZ-99-15.
VII. RECOMMENDED MOTIONS
Option A: "I move that Case No. MS-99-06, a request for a two lot minor subdivision be APPROVED
for the following reasons:
1. All requirements of the City's Subdivision Regulations have been met.
2. Subdividing this property as proposed will enable the seller to transfer the individual parcels
and thereby allow for the redevelopment/redevelopment of the property.
3. Approval of this subdivision will facilitate the approval of associated Case NumberWZ-99-15
and thereby set the standard for anticipated future development in the area
subject to the following conditions:
1. A cross access easement between the northwest corner of Lot 1 and the northeast comer of Lot
2 will be shown on the plat with the City's standard cross access easement language."

1. Fire protection is provided to this site by Station 1, 7900 W 57' Avenue, and Station 2,
12195 W 52nd Avenue.
2. All weather fire. dept access roadways, minimum of 24 feet of unobstructed width, capable
of supporting the imposed loads of 52, 000 lb fire apparatus need to be provided to within
150 feet of all portions of the buildings prior to above grade construction.
UFC 97 901.3, 8704.2. Amended.
3. All buildings classified by the Codes Administrator as the following occupancies:
B,F-1,F-2,S-1,S-2,S-3, or S-5, exceeding 18,000 square feet shall have an approved
automatic fire suppression sprinkler system installed throughout in accordance with NFPA-13.
Section 1003.2.2 amended.
4. Water lines and fire hydrants will need to be installed and operational and capable of
supplying the minimum required fire flows prior to above grade construction.

5. A fire hydrant needs to be installed and maintained within 150 feet of a fire department
connection serving a sprinkler or standpipe system.

This is to inform you that Case Nos. WZ-99-15 and MS-99-06, being requests for approval of a
two-lot minor subdivision and a zone change from Residential-Two and Restricted-Commercial
to Planned Commercial Development (PCD) for the purpose of developing a commercial
building for small businesses located at 9751 W. 44" Avenue will be heard by the Wheat Ridge
Planning Commission in the Council Chambers of the Municipal Complex at 7500 West 29th
Avenue. The meeting will be held on January 6, 2000 at 7:30 p.m.
All owners and/or their representative of the parcel under consideration must be present at this
hearing. As an area resident or interested party, you have the right to attend this Public Hearing
and/or submit written comments. It shall be the applicant's responsibility to notify any other
person whose presence is desired at this hearing.

Notice is hereby given that a Public Hearing is to be held before the City of Wheat Ridge
PLANNING COMMISSION on January 6, 2000 at 7:30 p.m. at 7500 West 29th Avenue,
Wheat Ridge, Colorado. All interested citizens are invited to speak at the Public Hearing or
submit written comments. The following petitions shall be heard:
1. Case No. MS-99-06: Application by Legend Properties, LLC, for approval of a two-lot

described as follows:
Commencing at the northwest corner of said Section 22: thence south 00°09'00" West, on
an assumed bearing, along the West line of the Northwest one-quarter of said Section 22,
a distance of 2048.62 feet to a point on the Westerly extension of the North right-of-way
line of West 44`h Avenue; thence South 89°43'01" East along said Westerly extension a
distance of 661.63 feet to the southeast comer of Block 1 of Chado Subdivision, a
subdivision recorded in the office of the Jefferson County Clerk and Recorder in Plat
Book 105 at page 18 and the true point of beginning; thence continuing South 89°43'01

Public Service Company of Colorado (PSCo) has reviewed 44TH Ave Business Park Minor
Sub MS-99-06. To ensure that adequate utility easements are available within this
development, PSCo requests that the following language or plat note, be placed on the
preliminary and final plats for the subdivision:
Ten-foot (10) wide utility easements are hereby granted on private
property adjacent to all public streets, and around the perimeter of each lot
in the subdivision or platted area. These easements are dedicated for the
installation, maintenance, and replacement of electric, gas, television
cable, and telecommunications facilities. Utilities shall also be permitted
within any access easements and private streets in the subdivision.
Permanent structures and water meters shall not be permitted within said
utility easements.
PSCo also requests that these utility easements be depicted graphically on the preliminary and
final plats. While these easements should accommodate the majority of utilities to be installed
in the subdivision, some additional easements may be required as planning and building
progresses.
As a safety precaution, PSCo would like to remind the developer to call the Utility Notification
Center, at 1-800-922-1987, to have all utilities located prior to construction. If PSCo has
existing gas or electric distribution facilities in this area, the developer should contact PSCo's
Engineering Department at (303) 425-3867 regarding the use or relocation of these facilities.

CONDITIONS
1. DEFINITIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument.
(b) "Public Records" means title records that give constructive notice of matters affecting the title
according to the state law where the land is located.
2. LATER DEFECTS
The Exceptions in Schedule B - Section 2 may be amended to show any defects, liens or
encumbrances that appear for the first time in public records or are created or attached
between the Commitment Date and the date on which all of the Requirements of Schedule B
- Section 1 are met. We shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B,
we may amend Schedule B to show them. If we do amend Schedule B to show these defects, liens
or encumbrances, we shall be liable to you according to Paragraph 4 below unless you knew of this
information and did not tell us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you
have met its Requirements. If we have any liability to you for any loss you incur because of an error
in this Commitment, our liability will be limited to your actual loss caused by your relying on
this Commitment when you acted in good faith to:
comply with the Requirements shown in Schedule B - Section 1
or
eliminate with our written consent any Exceptions shown in Schedule B - Section 2.
We shall not be liable for more than the Policy Amount shown in Schedule A of this
Commitment and our liability is subject to the terms of the Policy form to be issued to you.
5. CLAIMS MUST BE BASED ON THIS COMMITMENT
Any claim, whether or not based on negligence, which you may have against us concerning the
title to the land must be based on this Commitment and is subject to its terms.

policy amount and your name as the proposed insured in Schedule A, this Commitment becomes eff ec-
tive as of the Commitment Date shown in Schedule A.
If the Requirements shown in this Commitment have not been met within six months after the
Commitment date, our obligation under this Commitment will end. Also our obligation under this Commit-
ment will end when the Policy is issued and then our obligation to you will be under the Policy.
Our obligation under this Commitment is limited by the following:
The Provisions in Schedule A.
The Requirements in Schedule B-1
The Exceptions in Schedule B-2.
The Conditions on page 1-A.
This Commitment is not valid without SCHEDULE A and Sections 1 and 2 of SCHEDULE B.

(c) Obtain a certificate of taxes due from the county treasurer or the county

Paragraph 3, Schedule A of this Commitment and notarized.
4e) The following documents satisfactory to us must be signed, delivered and
recorded:
1. Warranty Deed sufficient to convey the fee simple estate or interest in the
land described or referred to herein, to the Proposed Insured, Schedule A,
Item 2A.
2. Deed of Trust sufficient to encumber the fee simple estate or interest in the
land described or referred to herein for the benefit of the Proposed Insured,
Schedule A, Item 2 B.
Exceptions numbered 2-5 will not appear on the Mortgagee's Policy provided the
attached Affidavit and Agreement is properly executed and returned to this
office.
NOTE: IF THE SALES PRICE OF THE SUBJECT PROPERTY EXCEEDS $100,000.00 THE SELLER
:SHALL BE REQUIRED TO COMPLY WITH THE DISCLOSURE OR WITHHOLDING PROVISIONS OF C.R.S.

Any policy we issue will have the following exceptions unless they are taken care of
to our satisfaction:
1. Taxes and Assessments not certified to the Treasurer's Office.
2. Any facts, rights, interests or claims which are not shown by the public records
but which could be ascertained by an inspection of the land or by making inquiry
of persons in possession thereof.
3. Easements, or claims of easements, not shown by public records.
4. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and
any facts which a correct survey and inspection of the land would disclose, and
which are not shown by the public records.
5. Any lien, or right to a lien, for services, labor or material heretofore or
hereafter furnished, imposed by law and not shown by the public records.
6. Taxes and assessments for the current year, including all taxes now or
heretofore assessed, due or payable.
7. An easement for utility and incidental purposes granted to Public Service
Company of Colorado, by the instrument recorded July 6, 1984 at Reception
No. 84063186.
8. Terms, conditions, provisions, agreements and obligations specified under the
Agreement by and between Barbara Joan Kibbey and J. Robert Chado, et al

The policy is hereby amended by adding the following to Schedule A following
the policy amount:
The Policy amount will automatically increase by 10% of the amount shown above
on each of the first five anniversaries of the policy date.
The endorsement is effective only when attached to an ALTA Plain Language
Policy insuring a 1-to-4 family residence.
This endorsement is made a part of the Policy and is subject to all of the
terms and provisions thereof and of any prior endorsements thereto. Except to

reflected as recorded items under the subject commitment for title insurance.
6. We further represent that there are no unpaid charges and assessments that could result
in a lien in favor of any association of homeowners which are provided for in any document
referred to in Schedule B.
The undersigned affiant(s) know the matters herein stated are true and indemnifies FIRST
AMERICAN TITLE INSURANCE COMPANY against loss, costs, damages and expenses of every kind
incurred by it by reason of its reliance on the statements made herein.
This agreement is executed with and forms a part of the sale and/or financing of the

Said Commitment is hereby amended by deleting Paragraph 2 of the Conditions.
The company hereby insures against loss or damage by reason of there being recorded
any deeds, mortgages, lis pendens, liens or other title encumbrances which first appear in
the public records subsequent to the effective Date of Commitment, but prior to the
effective Date of Policy. "Public records" as used herein means those records in which
under statutes deeds, mortgages, judgment liens or lis pendens must be recorded in order
to impart constructive notice to purchasers of the land for value without knowledge.
This endorsement does not insure against such loss or damage if the existence of such
deeds, mortgages, lis pendens, liens or other title encumbrances is actually known to the
proposed insured prior to or at the time of the closing. The closing is defined herein as
-being the time of the execution and delivery to the proposed insured of the documents
creating the interest of the proposed insured.
Protection under this endorsement is conditioned by the following requirement:
a. We must conduct the closing of the transaction to be insured under this
Commitment or properly executed instruments creating the estate or interest to
be insured must be delivered to the title company issuing the Commitment within
24 hours of the closing.
b. Affidavit and Indemnity attached hereto must be fully executed by the party or
entity described in Paragraph 3 of Schedule A.
The Commitment is hereby amended further by the deletion of items 2-5 inclusive,
appearing on Schedule B - Section 2 Exceptions. An ALTA Plain Language Policy will be
issued.
A Colorado Form 130.3 Endorsement will be attached to the ALTA Plain Language Policy
automatically increasing the policy amount by 108 of the face amount on each of the first
five anniversaries of the policy date.
Protection under this endorsement is to be afforded to the proposed insured owner
shown on Schedule A when the land is a 1-to-4 family residential lot.
This endorsement is made a part of the policy and is subject to all of the terms and
provisions thereof and of any prior endorsements thereto. Except to the extent expressly
stated, it neither modifies any of the terms and provisions of the policy and any prior
