SUBJECT: 3601 Kipling Street, WZ -99 -02 - Rezone
The Public Works Department has reviewed the Planning Department referral dated January 20, 1999
for the above referenced site, and has the following comments:
1. A Subdivision Improvement Agreement will need to be executed by the developer /owner.
2. We will need a final drainage report based upon the City's drainage criteria, and prepared by a Colorado
licensed professional engineer.
3. We will need engineered construction plans based upon the City's street construction plan criteria, and
prepared by a Colorado licensed professional engineer, for the public improvements required to be
constructed along the West 35"' Avenue and Kipling Street frontages. Please note that the Kipling Street
improvements will need to be reviewed and approved by Colorado Department of Transportation.
4. We will need a completed Application for Minor Dumping /Landfill Permit, along with fees due. In
conjunction with the requirements of this permit, an erosion control plan may need to be submitted for
review and approval.
5. In conjunction with the execution of the Subdivision Improvement Agreement required,, an irrevocable
letter of credit, in which the City is designated as beneficiary, for one hundred twenty -five percent
(125 %) will need to be submitted by the developer /owner to serve as guarantee for the value of those
public improvements (as determined by the itemized cost estimate prepared by the project's civil
engineer -of- record), that are required to be constructed per item 3 above.
6. The City will not support the circle drive fronting Kipling Street. The entrance driveway from Kipling
Street is too narrow as proposed. This will create a hazardous condition for south bound traffic on Kipling
street. Attached is a suggested site access and circulation sketch. This alternative offers additional parking
and safer access.
7. This parcel is only a portion of Lot 5 of Eller Subdivision. A copy of the recorded deed and legal
description of this parcel will need to be provided.

Dear Mr. McCartney:
This will acknowledge your correspondence dated January 20,
1999 regarding the above referenced property.
Please be advised that the above referenced property is in an
area served by The Consolidated Mutual Water Company by
virtue of a Distributor's Contract with Denver Water.
Domestic water service may continue to be provided to this
property subject to compliance with the Company's rules,
regulations and requirements for such service as well as the
water tap allocation policies as established by Denver Water.
The Company's rules, regulations and requirements further
state that each separate structure be served by a separate
tap and meter, and in order to receive domestic water
service, the property must also front a Company main.
Our records indicate that the property addressed as 3601
Kipling Street is currently receiving domestic water from
Consolidated through a 5/8 -inch meter (CMWCo Tap Number
3101 /Account Number B- 07969).
Fire protection requirements should be obtained from Wheat
Ridge Fire Department and those requirements forwarded to
this office by the Fire District at the earliest possible
time. We can then determine if additional system
improvements would be required to meet the demands set forth
by the Fire District.

Rezone from Rwesidential -1 to Restricted Commercial -1.
Dear Sean,
After a review of the request for rezoning of the
property at 3601 Kipling, I am submitting the following
comment /requirements:
1. The turn radius's' shown on the plan are inadequate
for the entry of fire equipment into the property.
They will need to be widened to accommodate the
trucks.
2. The 13 foot access way will need to be increased to 26
feet per 1997 Uniform Fire Code.
3. A fire hydrant will need to be installed on the north
west corner of 35 Ave. & Kipling. Developer /Owner
will need to contact Consolidated Water to arrange for
hydrant installation.
4. Complete plans will need to be submitted prior to
change of occupancy. Change of occupancy will require
the installation of an addressable fire alarm system
installed through out the occupancy.
The parties involved can contact the Fire Marshal
Office with their concerns in order to resolve any issues
as a result of these requirements. They can contact the
office at (303) 424 -7323 to set an appointment as
necessary.

On April 8, 1998, we purchased the property located at 3601 Kipling to use as a home
office for psychotherapy. I found it very difficult to live in and run my business out of the
home. In addition most of my client base is Northeast and Southeast of Denver.
We now wish to sell the property. To resell the property we believe that the "highest and
best use" of the property is commercial. We are therefore asking for a rezoning from R -1
to RC -1. We envision the property to be a medical or dental office or other general
business use. We feel that we would be better able to sell the property if it were rezoned to
it's "highest and best use ". We could not imagine selling the property as a single family
residence with children given it's location and traffic patterns.
In June 1998 we had a pre - application telephone meeting with the City. On September 22,
1998, at 5:30 p.m. we had a neighborhood meeting. We sent out 72 letters to the neighbors
(one was returned) informing them of the meeting. There were four neighbors present; a
minister from the New Aspistolic Church, a neighbor to the south, a neighbor to the East
across YofiRg and the owner of the vacant land.
The major concern was the possibility of another heavy commercial type business. The
neighbors were very upset about the process for the rezoning when Auto Zone was allowed
to open.
We understand that this requested zoning for this property s not in the City's master plan.
We feel however, that residential R -i is not appropriate for this particular property given
the traffic and exposure that the property enjoys. We have attached proof of ownership, a
copy of our neighborhood meeting letter, and a before and after site plan.
