INTRODUCED BY COUNCIL MEMBER Eafanti Council Bill No. 5 Ordinance No. 1155 Series of 1999 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A REZONING FROM RESIDENTIAL -ONE B TO AGRICULTURAL -ONE ON LAND LOCATED AT 4000 NELSON, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO (WZ99 -04) BE IT ORDAINED BY THE CITY COUNCIL OF.THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application by the City of Wheat Ridge, approval of a rezoning in Wheat Ridge, Colorado, Case No. WZ -99 -04 and based on recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the R -18 zone district and to include in the A -1 zone district the following described land: The South 100 feet of the West 148.91 feet of the East 165.45 feet of the North 471.4 feet of the NW 1/4, SW 1/4 of Section 21, Township 3 South, Range 69 West of the 6' P.M. except the West 20 feet thereof deeded to the County of Jefferson in instrument recorded March 6, 1957, in Book 1048 at page 457, according to the recorded plat thereof, County of Jefferson, State of Colorado. Section 2. Vested Property Rights. Approval of this rezoning does not create a vested property right. Vested property rights may only arise and accrue pursuant to the provisions of Section 26(c) of Appendix A and the Code of Laws of the City of Wheat Ridge. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is Ordinance No. Page 1 WZ -99 -04 necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 5. Supersession Clause. If any provision, requirement or standard established by this Ordinance is found to conflict with similar provisions, requirements or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede and prevail. Section 6. This Ordinance shall take effect upon final passage. Gary Wardle was sworn in by the Mayor and showed overhead of the Denning property and Recreation Center. Motion by Mrs. Shaver for approval of Council Bill 6 (Ordinance 1154); seconded by Mr. DiTullio; carried 7 -1 with Mrs. Dalbec voting no. Motion by Mrs. Shaver that the Mayor and City Attorney be authorized to enter into an agreement with the Denning family for right -of -way access for the Recreation Center in substantially the form presented subject to final review and approval by the City Attorney as to form and content; seconded by Mr. Siler; carried 7 -1 with Mrs. Dalbec voting no. Council Bill 5 - An Ordinance providing for the approval of a rezoning from Residential -O gricultural -One on land located at 4000 Nelson, City of Wheat R' e, Cou Jefferson, State of Colorado. (Case o.. WZ- 99 -04) Council Bill 5 was introduced on second reading by Mr. Eafanti; title read by the Clerk; Ordinance No. 1155 assigned. Meredith Reckert was sworn in by the Mayor and presented the staff report. Motion by Mr. Eafanti that Council Bill 5 (Ordinance 1155) a City initiated rezoning of property at 4000 Nelson Street from Residential -One B to Agricultural -One, be approved for the following reasons: 1. The property was rezoned to R -1 B without the property owners consent. 2. It will be a substandard sized A -1 lot which can only be used for single family. Council Bill 7 was introduced by Mr. DiTullio, who also read the title. Summary was read by the Clerk and Ordinance No. 1156 assigned. City Attorney Dahl presented the staff report. Approval of agreement for engineering services for noise abatement at the Skateboard facility and a corresponding appropriation. Motion by Mrs. Worth that the City Manager be authorized to enter into a contract with the firm, Engineering Dynamics, for noise abatement analysis at the Skateboard Park at Anderson Park consistent with their proposal to the City of Wheat Ridge and that an amount not to exceed $5,000 be appropriated from the General Fund fund balance and transferred to Acct. I. REQUEST This is a City- initiated zone change request for property located at 4000 Nelson Street. The property is 13,000 square feet in size and has a single - family residence and accessory buildings on it. II. CASE HISTORY This neighborhood was subject to a City - initiated mass rezoning earlier this year as Case No. WZ -98- 07. The zoning action was to rezone properties from R -3 and A -1 to R -113 and R -1C. As part of the negotiations with the property owners, the City allowed owners with A -I zoning the option of exempting their properties from the zone change. Of the six properties zoned A -1, two participated in the rezoning (4040 Oak and 4088 Oak), two responded by mail and did not want to rezone (10840 W. 41 Ave. and 4086 Oak). One never responded after repeated attempts by staff to contact; however, was exempted by City Council (4090 Nelson) at the public hearing. One (4000 Nelson) responded verbally, but not by mail, and was rezoned by City Council. The owners of 4000 Nelson Street wanted to retain their A -1 zoning. The City Council held the public hearing regarding Case No. WZ -98 -07 on December 22, 1998. It would have been possible for Council to reconsider their decision and amend the map to exclude this property if it had been done at the next regular Council meeting (January 11, 1999). However, the property owner did not contact City staff to discuss the problem until January 18, 1999. Because the reconsideration period was missed, the City Attorney directed staff to process this case as a regular rezoning. The property owners have authorized staff to act on their behalf. III. NEIGHBORHOOD MEETING A meeting for neighborhood input was not held pursuant to Section 26- 6(C)(2)(a): "Prior to submitting any application for a change of zone of property to a higher use than is currently permitted that is an increase in residential density, intensity, impact, or character, the applicant shall be required to hold a neighborhood meeting." IV. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zoning (change of zoning conditions): 1. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. The property was zoned A -1 when the City was incorporated. Ordinance No. 1145 rezoned the property to R -113. There is no mistake in the map. City Council /April 12, 1999 Page 2 WZ -99 -04 /City of Wheat Ridge 2. A change in the character in the area has occurred due to the installation of public facilities, other zone changes, new growth trends, deterioration or development transitions. There are no obvious changes to the character of the neighborhood which is developed with small lot single family residences. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. The Comprehensive Plan designates this property as Single - Family Detached (not to exceed 9 dwelling units per acre). Lot size of the property in question is 13,000. Since this would be non - conforming A -1 property, it can only be used for single - family. The A -1 zoning will not be inconsistent with the Comprehensive Plan. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. There will be no physical changes to the property which is developed as a single - family residence. There will be no adverse impacts as a result of the rezoning to A -1. 5. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. There will be no obvious social, recreational, physical and /or economic benefits to the community as a result of the rezoning. 6. That adequate infrastructure /facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. All utilities are currently in place. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. There will be no physical changes to the property as a result of the rezoning. Because this will be a substandard sized A -1 lot, it can only be used for single - family. 8. That the property cannot reasonably be developed under the existing zoning conditions. The property can be used as it currently is under the existing R -1B zoning. The property was overlooked and rezoned to R -1 B without consent of the property owner as part of the mass rezoning procedure in 1998. There are three other A -I zoned properties in the vicinity. 10. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. The rezoning will not fill a void in services, products or facilities. V. PLANNING COMMISSION ACTION A public hearing regarding this case was held by Planning Commission on February 18, 1999. A recommendation of Approval was given for the following reasons: The property was rezoned to R -1B without the property owners consent. With the following condition: 4000 Nelson will be considered a substandard size A -1 lot which can only be used for single - family uses including all other uses which are allowed in single - family districts. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that the property was rezoned without the property owner's consent as part of the mass rezoning process. Because there will be no physical changes to the property and because it can only be utilized for single - family residential uses, a recommendation of approval is given. VII. Case No. WZ- 99 -04: An application by the City of Wheat Ridge for approval of a rezoning from Residential 1 -B to Agricultural I for property located at 4000 Nelson Street. The case was presented by Meredith Reckert. She reviewed the staff report and presented slides and overheads of the subject property. All pertinent documents were entered into the record and accepted by Chair BRINKMAN. Ms. Reckert stated that there was jurisdiction for the Commission to hear the case and that staff's recommendation was for approval . In response to a question from Commissioner THOMPSON, Ms. Reckert stated that the property owners were not present and had authorized the City to act on their behalf. It was moved by Commissioner THOMPSON and seconded by Commissioner SNOW that Case No. WZ- 99 -04, a City - initiated rezoning of property at 4000 Nelson Street from Residential 1 -B to Agricultural 1, be recommended to the City Council for approval for the following reason: The property was rezoned to Rl -B without the property owners' consent. Commissioner GOKEY offered the following amendment: That the application be approved on the condition it will be a substandard size A -1 lot which can only be used for single family uses and all other uses which are allowed in single family districts. The amendment was accepted by Commissioners THOMPSON and SNOW. In response to a question from Commissioner THOMPSON, Ms. Reckert replied that, to her knowledge, there were no uses other than those indicated in the motion on the property at this time. i The motion passed by a vote of 6 -0 with Commissioner SHOCKLEY absent. B. Case No. WPA- 99 -01: An application by the City of Wheat Ridge to adopt the revised Comprehensive Plan for the City. The Comprehensive Plan establishes the development goals and policies and the future land use map for the City and, once adopted, will be utilized in the review of any proposed development proposal/application or land use change brought before the City. Prior to staff presentation, Chair BRINKMAN stated that the hearing would pertain to districts three and four asked that public comment be limited to approximately three minutes per speaker. Ms. Reckert advised that she had maps available for members of the audience. I. REQUEST This is a City- initiated zone change request for property located at 4000 Nelson Street. The property is 13,000 square feet in size and has a single - family residence and accessory buildings on it. II. CASE HISTORY This neighborhood was subject to a City- initiated mass rezoning earlier this year as Case No. WZ -98- 07. The zoning action was to rezone properties from R -3 and A -1 to R -113 and R -1C. As part of the negotiations with the property owners, the City allowed owners with A -1 zoning the option of exempting their properties from the zone change. Of the six properties zoned A -1, two participated in the rezoning (4040 Oak and 4088 Oak), two responded by mail and did not want to rezone (10840 W. 41 Ave. and 4086 Oak). One never responded after repeated attempts by staff to contact; however, was exempted by City Council (4090 Nelson) at the public hearing. One (4000 Nelson) responded verbally, but not by mail, and was rezoned by City Council. The owners of 4000 Nelson Street wanted to retain their A -1 zoning. The City Council held the. public hearing regarding Case No. WZ -98 -07 on December 22, 1998. It would have been possible for Council to reconsider their decision and amend the map to exclude this property if it had been done at the next regular Council meeting (January 11, 1999). However, the property owner did not contact City staff to discuss the problem until January 18, 1999. Because the reconsideration period was missed, the City Attorney directed staff to process this case as a regular rezoning. The property owners have authorized staff to act on their behalf. III. NEIGHBORHOOD MEETING A meeting for neighborhood input was not held pursuant to Section 26- 6(C)(2)(a): "Prior to submitting any application for a change of zone of property to a higher use than is currently permitted that is an increase in residential density, intensity, impact, or character, the applicant shall be required to hold a neighborhood meeting." IV. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zoning (change of zoning conditions): 1. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. The property was zoned A -1 when the City was incorporated. Ordinance No. 1145 rezoned the property to R -1B. There is no mistake in the map: Planning Commission Page 2 WZ -99 -04 /City of Wheat Ridge 2. A change in the character in the area has occurred due to the installation of public facilities, other zone changes, new growth trends, deterioration or development transitions. There are no obvious changes to the character of the neighborhood which is developed with small lot single family residences. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. The Comprehensive Plan designates this property as Single- Family Detached (not to exceed 9 dwelling units per acre). Lot size of the property in question is 13,000. Since this would be non - conforming A -1 property, it can only be used for single - family. The A -1 zoning will not be inconsistent with the Comprehensive Plan. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. There will be no physical changes to the property which is developed as a single- family residence. There will be no adverse impacts as a result of the rezoning to A -1. 5. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. There will be no obvious social, recreational, physical and /or economic benefits to the community as a result of the rezoning. 6. That adequate infrastructure /facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. M I. REQUEST This is a City- initiated zone change request for property located at 4000 Nelson Street. The property is 13,000 square feet in size and has a single - family residence and accessory buildings on it. II. CASE HISTORY This neighborhood was subject to a City- initiated mass rezoning earlier this year as Case No. WZ -98- 07. The zoning action was to rezone properties from R -3 and A -1 to R -113 and R -1C. As part of the negotiations with the property owners, the City allowed owners with A -1 zoning the option of exempting their properties from the zone change. Of the six properties zoned A -1, two participated in the rezoning (4040 Oak and 4088 Oak), two responded by mail and did not want to rezone (10840 W. 41' Ave. and 4086 Oak). One never responded after repeated attempts by staff to contact; however, was exempted by City Council (4090 Nelson) at the public hearing. One (4000 Nelson) responded verbally, but not by mail, and was rezoned by City Council. The owners of 4000 Nelson Street wanted to retain their A -1 zoning. The City Council held the public hearing regarding Case No. WZ -98 -07 on December 22, 1998. It would have been possible for Council to reconsider their decision and amend the map to exclude this property if it had been done at the next regular Council meeting (January 11, 1999). However, the property owner did not contact City staff to discuss the problem until January 18, 1999. Because the reconsideration period was missed, the City Attorney directed staff to process this case as a regular rezoning. The property owners have authorized staff to act on their behalf. III. NEIGHBORHOOD MEETING A meeting for neighborhood input was not held pursuant to Section 26- 6(C)(2)(a): "Prior to submitting any application for a change of zone of property to a higher use than is currently permitted that is an increase in residential density, intensity, impact, or character, the applicant shall be required to hold a neighborhood meeting." IV. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a change in zoning (change of zoning conditions): 1. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. The property was zoned A -1 when the City was incorporated. The Comprehensive Plan designates this property as Single - Family Detached (not to exceed 9 dwelling units per acre). Lot size of the property in question is 13,000. Since this would be non - conforming A -1 property, it can only be used for single - family. The A -1 zoning will not be inconsistent with the Comprehensive Plan. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. There will be no physical changes to the property which is developed as a single - family residence. There will be no adverse impacts as a result of the rezoning to A -1. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. There will be no obvious social, recreational, physical and /or economic benefits to the community as a result of the rezoning. 6.
