TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE
PERMIT IN R -3 AND R -1C ZONE DISTRICTS TO ALLOW A PUBLIC
UTILITY WITH OUTSIDE STORAGE ON LAND LOCATED AT 5260
WEST 29TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1_ Upon application by Denver Water Department for approval
of a Special Use Permit in Wheat Ridge, Colorado, Case No. SUP -92 -4,
and based upon a recommendation for approval from the Wheat Ridge
Planning Commission and pursuant to findings made based on testimony
and evidence presented at a public hearing before the Wheat Ridge City
Council. Wheat Ridge maps are hereby amended to designate approval of
a Special Use Permit to allow a public utility with outside storage on
the following described land:
Lots numbered one (1) through eleven (11) in Block number -d one (1) in
the Resubdivi.sion of Lakeside according to the map or plat thereof on
file and of record in the office of the Clerk and Recorder of said
Jefferson County, Colorado, in Book 2 of Plats at page 10.
2. Vgsted_ Prop y p 1g1ts_ Approval of this Special Use
Permit does not create a vested Property right. Vested property
rights may only arise and accrue pursuant to the provisions of Section
26(c) of Appen0j.x of the Code of Laws of the City of Wheat Ridge.
Section 3. Safety_Cl The City Council hereby firv! , determines,
and declares that this ordinance is promulgated under tl�r general
police power of the City of Wheat Ridge, that it is prcmnlgated for
the health, safety, and welfare of the public, and that this Ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the
proper legislative object sought to be attained.
5e4tion 4_ Severability. If any clause, sentence, paraii or paxt
of this ordinance or the application thereof to any perc;+•i c
circumstances shall for ar reason be adjudged by a couT.t �f competent
jurisdiction invalid, such judgment shall not affect, in;pair or
invalidate the remainder of this ordinance or its applir,,ti.on to nthc:
persons or circumstances.

Section 5. This Ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0
on this 2nd day of December , 1992, ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for
January 11 , 1993 , at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 8 to 0 , this 11th day of January , 1993.

Item 11 Council Bill 33 - An Ordinance providing for the approval. of a
Special Use Permit in R -3 and R -1C Zone Districts to allow a
Public Utility with outside storage on land located at 5260
West 29th Avenue, City of Wheat Ridge, County of Jefferson,

Council Bill 33 was introduced by Vance Edwards, title read by the
Clerk, Ordinance No 915 assigned
Glen Gilley presented the staff report and answered Council's questions
Paul. Snyder architect for the firm Pouw & Associates, 1860 Blake
Street, Denver, was sworn in by the Mayor He declined to make a
presentation at this time, but offered to answer questions
Mrs Brougham insisted that the applicants present their case to comply
with Council Rules and for the convenience of the TV audience
Paul Jesclnick 1860 Blake Street, Suite 200, Denver, Colorado,
explained that this land had been owned and used by Denver Water since
the late 18009 Prior to their involvement the pump station had been
pumping water for some time With the updated conduits and equipment
the pump station became obsolete and pumps were removed It has been
serving as a decentralization fauility for the past couple of years on a
small scale The purpose is to have Denver Water people in the
community for the convenience of customers
Mike Leister representing Denver Water, 1600 W 12th Avenue, was sworn
in by the Mayor and asked for approval. of this application
Motion by Vance Edwards that the request for a two -foot fence height
variance to allow a six- foot -high fence within the front setback at 5260
West 29th Avenue be approved for the following reasons
1 The criteria used to evaluate a variance support this request, and
2 Planning commission and Staff recommend approval,
seconded by Mr Selstal, carried 8 -0
Motion by Vance Edwards that Council Bill. 33 (Ordinance 915), a request
for approval of a Special Use Permit to allow the expansion of a public
utility with outside storage for property located at 5260 West 29th
Avenue be approved for the following reasons 1 The criteria used to
evaluate a Special Use Permit support this request, and 2 Planning
commission any staff recommend approval With the following condition
1 The property be redeveloped as shown on the submitted site plan,
seconded by Mr Selstal, carried 8 -0
Item 12 Council. Bill 34 - An Ordinance vacating a portion of Union
Street adjacent to 3365 Union Street, within the City of Wheat
Ridge, County of Jefferson, State of Colorado
(Case No WV -92 -2)
Council Bill 34 was introduced on second reading by Mir Shanley, title

Motion by Mr Eafanti that Council Bill 31 be approved on first reading,
ordered published, public hearing be set for Monday, January 11, 1993 at
7 30 p m in rity Council Chambers, Municipal Bldg , and if approved on
second reading, take effect 15 days after final publication, seconded by
Vance Edwards, carried 7 -0

Edition, copvright 1991 providing for certain amendments
thereto, and providing penalties for violation thereof
