(WZ-98-15)(BoI16) Item 1 was introduced by Mrs. Worth; title read by the Clerk. Tom Reed was sworn in by the Mayor; he is the Chief Financial Officer and Chief Operating Officer for Bolle Sun Glasses; he asked for approval of their sign. Martin Omer, Planning Department, was sworn in by the Mayor and presented the staff report. Motion by Mrs. Worth - Amendment to PID - that Case No. WZ-98-15, Amendment to the Final Development Plan for Pacifica Development Properties II, LLC., Planed Industrial Development, for the erection of one additional freestanding freeway oriented sign, internally lit, with a maximum height of 45 feet and a maximum sign face square footage of 137 feet per sign face, for property located at 9500 West 49th Avenue, be approved for the following reasons: 1. Approval of the amendment, along with the Recommended Conditions of Approval, is not expected to cause a substantial negative impact to City services or residents. 2. Approval of the amendment will not change the overall nature, intent or character of the approved PID or the Final Development Plan. 3. The City, the property owner, and the applicant will benefit from the approval of this case, which approval is expected to result in the retention of this user at this location with related employment and economic benefits to the City. Approval of the amendment is subject to the following conditions: 1. Per the Public Works Department, sign placement shall meet the sight distance triangle requirements as specified in the City Code. 2. Mr. Dahl answered Mrs. Worth and stated this type of meeting is not encouraged and Case Law states that there cannot be a bias. As a challenger to this meeting bias would have to be proved. REQUEST This is an application to amend the existing and approved Pacifica Development Properties 11, LLC Planned Industrial Development Final Development Plan for the erection of one additional freestanding freeway oriented sign, including a setback variance. The sign as proposed will be internally lit, 45 feet high, with a sign face dimension of seven feet by 23 feet 10 inches. The sign is pro osed to be oval in shape, which would put the actual square footage calculation at approximately quare feet per sign face. The application also includes a request for variance of 23 feet from the minimum 3 setback from property line for an actual setback of seven feet. II SUMMARY On August 11, 1997, the Wheat Ridge City Council approved Case No. WZ-97-10, being the Pacifica Development Properties 11, LLC Planned Industrial Development Final Development Plan. Said PID entitled the developer to construct a 106,524 square foot commercial/industrial project generally adjacent to Interstate 70. As part of the approval, one freeway oriented sign was permitted at a height of 24 feet 11 inchesand a size of 260 square feet per sign face, to be located at the western-most part of the project area, and visible from Interstate 70. Since that time the project has been fully constructed and all buildings in the western half of the project (71,006 square feet) have been occupied, with the eastern-most buildings (35,518 square feet) remaining unoccupied. The southeastern portion of this development remained vacant largely because it is not visible from Interstate 70. This is due to physical limitations of the site relative to the highway as well as the Colorado Department of Transportation's sight obscuring and noise reducing fence located directly in front of this portion of the development only. In July of 1998, the international eye wear company Bolle' moved its North American headquarters and distribution facilities into the majority of remaining building space available in the eastern portion of the site. The applicant has stated that this site was chosen due to its location next to Interstate 70 and the name recognition opportunities available to the traveling public using the highway. The applicant has submitted this amendment and variance case in order to project the corporate image it requires to the traveling public and outdoor enthusiasts traveling I-70. f O The City of Wheat Ridge Zoning Regulations Seevelopments 10 e)(5) permits a maximum of 400 square feet of sign face area per sign face for multi-us located adjacent to the highway. The existing signage measures approximately 17 square feet of signage per sign face, and the proposed sign measures approximately' r24 square feet of signage per sign face, for a proposed total ofd"square feet of signage per sign face. This is 75 square feet less than the maximum permitted by the Zoning Regulations. ( f l c-,260415?:- ~ , C/49 ~L III AMENDM ~L~ PID AND FINAL DEVELOPMENT PLAN / U The eastern portion he` tgnifrcant visual limitations and a second sign is proposed for visual identity from the interstate highway for a user with prominent national and international name recognition. A second freeway oriented sign, with interior lighting, to be 45 feet high, with a maximum sign area of 1'`' square feet per sign face will not create a significant negative impact to surrounding residents, bus esse r property owners. Staff also believes the sign face design is simple and easily 3 City Council Page 2 WZ-98-15/Bolle read, and is therefore not expected to create a hazard to the traveling public or to have negative impacts to safety type issues. IV VARIANCE REVIEW CRITERIA Staff has prepared the following responses to the standard review criteria used to evaluate variance requests: Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Yes. If a different tenant had leased the property who didn't need viability from the freeway, the property could yield a reasonable return in use, service or income. Nonetheless, the subject address was not leased by such a different tenant. The subject leasable area is part of an overall Planned Industrial Development for commercial, retail and light industrial uses. It is located on the eastern-most portion of the project area, which has physical limitations significantly impacting the site's visibility from Interstate 70. A sight obscuring and noise reducing fence erected by the State Department of Transportation is located directly in front of this portion of the development only. A major international business concern predominantly catering to outdoor recreational enthusiasts needs visual identity to traffic using Interstate 70 heading to and from the C mountains as an essential element of their business needs. Other users would not need such high visibility. Therefore, the subject sign which has been expressly designed for visual identification from Interstate 70, is necessary. The variance itself is to erect the sign seven feet from the project's property line. Since this site is fully developed, no other reasonable locations for the sign are available. 2. Is the plight of the owner due to unique circumstances? Yes. As stated in 1. above, the subject address is considerably lower than the adjacent portion of Interstate 70 and the Department of Transportation's sight obscuring fence. The combination of these elements makes the address invisible from the highway. The site is fully constructed with very limited options of the location of the sign. 3. If the variation were granted, would it alter the essential character of the locality? No. Other freeway oriented signs are located regularly along both sides of Interstate 70. Locating this sign seven feet from the property line is not expected to alter the essential character of the locality. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? City Council Page 3 WZ-98-15/Bolle Yes. As stated above, the applicant has located their international business offices and distribution facilities at this location. The physical condition and topography of the site lies below and outside of visual range of Interstate 70 traffic. The proposed location of the sign is the most sensible one available due to the existing parking area, drive areas, landscaping and buildings located on the site. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? No. This is a site and use specific variance application. There presently exists a deficit of suitably zoned constructed leasable space along this portion of Interstate 70 with this amount of available square footage for office and industrial uses. This particular location/address meets all the applicant's needs but is greatly impacted by site specific visual limitations to the highway. The site is already fully improved with landscaping, parking, drive areas, and buildings. The proposed location of the sign seven feet from the property line is the most sensible location for this sign. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property? No. This site is completely constructed per the approved RID and Final Development Plan. Drive areas, parking, buildings and landscaping are all installed. No other reasonable location exists for the erection of the sign, resulting in the variance request of 23 feet the minimum setback in order to erect the sign seven feet from the property line. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? No. The hardship is inherent in the physical aspects of the subject property, and the approved and constructed business/industrial park. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? No. The proposed sign location will not be injurious or detrimental to the public welfare and is not expected to pose a hazard to vehicular traffic. The proposed sign does not create significant visual impacts to neighboring residential users. No one from the public attended the neighborhood meeting and no concerns have been received from neighboring landowners and/or users. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Yes. The approval of this application will create an economically viable corporate location for the applicant, which in turn means increased employment opportunities for local residents, and significant overall economic benefits to the community as a whole. The essential character of the PID and the Final Development Plan will not be altered with the approval of the amendment and the variance. Council is being requested to approve the additional sign with a setback variance. The sign will be either black or red with final determination made by the applicant. The red sign is the sign the applicant prefers, pending approval by the landlord. If not approved, the black sign will be constructed. Staff recommends approval of this case. Mrs. Norton stated that their property did not abut Ms. Emily's property but had a clear view of the property. She stated that she and her husband would like to see the subject property be kept as office use and that no commercial use be allowed down the side street. She also asked that no daycare facility be allowed on the property. She was also in favor of a 6-foot fence behind Ms. Emily's property. Commissioner SNOW asked if Mr. White could envision this property being used for retail. Mr. White replied that he could possibly see something like an antique store, but certainly nothing like a convenience store. Chair_THOMPSON asked if there were other individuals present who wished to address this issue. There was no response. It was moved by Commissioner SNOW and seconded by Commissioner BRINKMAN that Case No. WZ-98-14, a request for approval of a rezoning from Residential-Two to Restricted Commercial-One for property located at 6410 West 44th Avenue, be recommended to the City Council for APPROVAL for the following reasons: 1. There have been significant changes in the neighborhood since prior zoning was established. 2. The plan and rezoning is consistent with both the existing and draft Comprehensive Plan. 3. Parcels to the northwest are zoned Restricted Commercial-One. 4. Minimal impacts are anticipated with the rezoning. With the following conditions: All uses in the Restricted Commercial One zone district be allowed with the exception of preschools and day nurseries. A six-foot screening fence be constructed between the proposed office building and the adjacent residential structure along the south property line to Lamar Street. The existing two-car garage is to be used for required on-site parking spaces only. No additional leasable business space will be permitted within the current garage area. The motion carried by a vote of 5-0 with Commissioner SHOCKLEY abstaining and Commissioners DUNN and GOKEY absent. Commissioner SNOW asked if the applicant was charged for the new application. Mr. White informed the Commission that Ms. Emily was not charged for this application.. B. Case No. W7 X98-15: An application by Bolle, Inc., for approval of an amendment to Pacifica. Development Properties II, LLC, PID Final Development Plan with a setback variance to allow Planning Commission Page 4 08/20/98 an additional freeway-oriented, freestanding sign with a 7-foot setback. The property is zoned PID and located at 9500 West 49th Avenue. This case was presented by Martin Omer. He reviewed the staff report and presented slides and overheads of the subject property. He entered the comprehensive plan, zoning ordinance, case file, packet materials, slides and exhibits into the record which were accepted by Chair THOMPSON: Mr. Ornet stated that the staff report indicated that the square footage of the sign face is 150 square feet when, in fact, the actual size is 137 square feet. He also referred to a letter of concern from the City of Arvada (contained in the staff report), and informed the Commission that after the letter was received, the City of Arvada verbally requested that their letter be withdrawn. In conclusion, he stated that it was staffs recommendation for the application to be approved with conditions as outlined in the staff report. Commissioner SNOW expressed concern about the 45-foot height of the proposed sign and asked if there would be a retail business associated with Bolle's facility as the sign code prohibits signs over 25 feet unless retail is involved. Mr. Omer replied that the applicant would address this issue. Commissioner COLLINS asked about the maximum sign criteria for the Pacifica development. Mr. White replied that there is a maximum of 400 square feet for the entire development. The proposed sign would leave 75 square feet for any additional businesses in the development should Bolle's request be approved. Commissioner BRINKMAN asked what would happen to the existing light pole which provides light for the entryway should the application be approved. Mr. Omer replied that the applicant would address that question. Chair THOMPSON expressed concern about visual impacts which would be placed upon the adjacent apartment units. She was concerned that the sign would shine directly into the windows of those apartments. Mr. Omer stated that notices were sent to the owner of the apartments and there was no response. He noted that no negative response had been received in response to any notices sent out regarding this application. Chair THOMPSON expressed concern about setting a precedent along the I-70 corridor. Mr. Omer replied that he didn't believe there were very many sites in the City of Wheat Ridge with the unique limitations involved in this situation. He also stated that should CDOT make changes to I-70 in this area, the City will want to make sure that economic viability of businesses along the corridor will not be affected. Planning Commission 08/20/98 Mr. White also pointed out that, if this were not a PID, the zoning code would allow a 50-foot tall si;n and, therefore, did not believe there would be a concern with setting a precedent. Commissioner MnDOUGALL asked if all the buildings in the development were occupied. Mr. Orner replied that the applicant plans to address this question. Mr. Orner st ated for the record that he believes Belle is an exceptional new arrival to the City of Wheat Ridge in that it is a well recognized international company, and the suggested condition that provides the sign.tobe removed should Bolle vacate the development, provides some protection to the city. He stated that the requested sign would be extremely beneficial to the company in order to let people know where they are located. He stated that the company plans to lease the only remaining space in the Pacifica Development for a retail outlet; however, such retail space lease would be contingent upon receiving approval of the sign. Commissioner BRINKMAN asked if they planned to maintain the landscaping around the sign. Mr. Reed replied that their company represents a premier product and they have no intention of letting the property look umnaimaitied. BRINKMAN asked about the existing light pole. Mr. Reed showed the drawing of the proposed sign to the Commission pointing out that the light will be mounted on one of the poles of the new sign. Chair THOMPSON asked if the sign could be less than 45 feet in height. Mr. Reed stated that this is the minimum height needed to gain visibility from west-bound 1-70. Commissioner BRINKMAN asked that, if the sign is approved, were there plans to have the Bolle name on the existing monument sign on the west end of the development. Mr. Reed replied that they did not plan to place their name on the sign. He also advised that the colors for the sign have been finally determined to be black and white. Commissioner SHOCKLEY asked if they planned to add any additional signs such as "retail facility on location" to the proposed sign. Mr. Reed replied that there would be no additions to the sign as proposed. Jim Liley 2930 West Ninth Avenue, Denver Mr. Liley was sworn in by Chair THOMPSON. He stated that he has been with the Gordon Planning Commission 08/20/98 Sign Company for the past twenty years. While he expressed appreciation for concerns raised by the Commission regarding the PID, he pointed out that regular zoning would allow a 230- square foot sign based upon Bolle's occupied space. He felt they have complemented existing signs along this corridor and as well as existing signs in the development. In regard to the concern expressed about lighting impact on the adjacent apartments, he stated that only the white "Bolle" letters would be illuminated at night and should not present a hardship to the -tenants: He also noted that notices of the sign application were sent to 156 property owners in the area and he only received one call from a person who did not object to the sign. He also noted that the sign would not be visible to residents to the north. Commissioner SNOW expressed concern about the height of the sign. Luanne Williams 7305 Grandview, Arvada Ms. Williams was sworn in by Chair THOMPSON. She stated that she represented the Northwest Metro Chamber of Commerce and expressed support of the application. She stated that Bolle was also considering locating in the Coors Technology Center in Jefferson count-. but chose the Pacifica location specifically because of the I-70 frontage. Commissioner SNOW again expressed concern about the height of the sign. Mr. White advised the Commission that a separate motion would be required for the variance and would require a super-majority vote. The applicant appeared before the Commission. Ken Darcy 9500 West 49th Avenue Mr. Darcy was sworn in by Chair THOMPSON. He stated that he was vice president and general manager of Bolle. Chair THOMPSON asked Mr. Darcy to address Commissioner SNO W's comment. Mr. Darcy stated that the lease for the retail space is in the process of being finalized but will not be signed unless the company receives approval for the sign. He expressed concern about entering the company into $600,000 debt without the signage necessary to operate from that building. Mr. Reed and Mr. Darcy also pointed out to the Commission that Bolle is a service business and that the 45-foot sign would therefore meet Code requirements for a service or retail oriented business. Commissioner SNOW offered the following amendment: That the requirements of Section 26- 410 E(1) be satisfied prior erection of the sign. The amendment was acceptable to Commissioner BRINKMAN and Commissioner SHOCKLEY. The motion passed by a vote of 6-0, with Commissioners DUNN and GOKEY absent. Said PID entitled the developer to construct a 106,524 square foot commercial/industrial project generally adjacent to Interstate 70. As part of the approval, one freeway oriented sign was permitted at a height of 24 feet 11 inches high and a size of 260 square feet per sign face, to be located at the western-most part of the project area, and visible from Interstate 70. Since that time the project has been fully constructed and all buildings in the western half of the project (71,006 square feet) have been occupied, with the eastern-most buildings (35,518 square feet) remaining unoccupied. The southeastern portion of this development remained vacant largely because it is not visible from Interstate 70. This is due to physical limitations of the site relative to the highway as well as the Colorado Department of Transportation's sight obscuring and noise reducing fence located directly in front of this portion of the development only. In July of 1998, the international eye wear company Bolle' moved its North American headquarters and distribution facilities into the majority of remaining building space available in the eastern portion of the site. The applicant has stated that this site was chosen due to its location next to Interstate 70 and the name recognition opportunities available to the traveling public using the highway. The applicant has submitted this amendment and variance case in order to project the corporate image it requires to the traveling public and outdoor enthusiasts traveling I-70. III AMENDMENT TO THE PID AND FINAL DEVELOPMENT PLAN The eastern portion of the has significant visual limitations and a second sign is proposed for visual identity from the interstate highway for a user with prominent national and international name recognition. A second freeway oriented sign, with interior lighting, to be 45 feet high, with a maximum sign area of 150 square feet per sign face will not create a significant negative impact to surrounding residents, businesses or property owners. Staff also believes the sign face design is simple and easily read, and is therefore not expected to create a hazard to the traveling public or to have negative impacts to safety type issues. IV VARIANCE REVIEW CRITERIA Staff has prepared the following responses to the standard review criteria used to evaluate variance requests: Planning Commission WZ-98-15/Bolle Page 2 6,J , 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? Yes. If a different tenant had leased the property who didn't need viability from the freeway, the property could yield a reasonable return in use, service or income. Nonetheless, the subject address was not leased by such a different tenant. The subject leasable area is part of an overall Planned Industrial Development for commercial, retail and light industrial uses. It is located on the eastern-most portion of the project area, which has physical limitations significantly impacting the site's visibility from Interstate 70. A sight obscuring and noise reducing fence erected by the State Department of Transportation is located directly in front of this portion of the development only. A major international business concern predominantly catering to outdoor recreational enthusiasts needs visual identity to traffic using Interstate 70 heading to and from the mountains as an essential element of their business needs. Other users would not need such high visibility. Therefore, the subject sign which has been expressly designed for visual identification from Interstate 70, is necessary. The variance itself is to erect the sign seven feet from the project's property line. Since this site is fully developed, no other reasonable locations for the sign are available. 2. Is the plight of the owner due to unique circumstances? Yes. As stated in 1. above, the subject address is considerably lower than the adjacent portion of Interstate 70 and the Department of Transportation's sight obscuring fence. The combination of these elements makes the address invisible from the highway. The site is fully constructed with very limited options of the location of the sign. 3. If the variation were granted, would it alter the essential character of the locality? No. Other freeway oriented signs are located regularly along both sides of Interstate 70. Locating this sign seven feet from the property line is not expected to alter the essential character of the locality. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? Yes. As stated above, the applicant has located their international business offices and distribution facilities at this location. The physical condition and topography of the site lies below and outside of visual range of Interstate 70 traffic. The proposed location of the sign is the most sensible one available due to the existing parking area, drive areas, landscaping and buildings located on the site. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? Planning Commission WZ-98-15/Bolle Page 3 3 No. This is a site and use specific variance application. There presently exists a deficit of suitably zoned constructed leasable space along this portion of Interstate 70 with this amount of available square footage for office and industrial uses. This particular location/address meets all the applicant's needs but is greatly impacted by site specific visual limitations to the highway. The site is already fully improved with landscaping, parking, drive areas, and buildings. The proposed location of the sign seven feet from the property line is the most sensible location for this sign. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property? No. This site is completely constructed per the approved PID and Final Development Plan. Drive areas, parking, buildings and landscaping are all installed. No other reasonable location exists for the erection of the sign, resulting in the variance request of 23 feet the minimum setback in order to erect the sign seven feet from the property line. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? No. The hardship is inherent in the physical aspects of the subject property, and the approved and constructed business/industrial park. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? No. The proposed sign location will not be injurious or detrimental to the public welfare and is not expected to pose a hazard to vehicular traffic. The proposed sign does not create significant visual impacts to neighboring residential users. No one from the public attended the neighborhood meeting and no concerns have been received from neighboring landowners and/or users. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. No. The approval of the 23 foot setback variance is not expected to cause any of the negative impacts as listed above. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? VII REFERRALS Responding With Concerns: City of Arvada Planning Department In a letter dated August 7, 1998, the Department states that the erection of this sign would not be fair to other tenants on the site. The letter states the Department's opposition to the amendment and the variance. Wheat Ridge Planning Staff Note: The Arvada Planning Department letter does not provide any factual information indicating whether this application would negatively impact the City of Arvada or residents/businesses thereinto support the position of opposition. Wheat Ridge staff called the author of said letter to inquire of any negative impacts to Arvada, but none were provided. City of Wheat Ridge Police Department In a memorandum dated August 8, 1998, the Department recommended that the base of the sign be finished with an anti-graffiti sealant. City of Wheat Ridge Department of Public Works In a memorandum dated August 10, 1998, the Department states that the sign placement shall meet the sight distance triangle requirements specified in the City Code. Staff believes that the additional freeway oriented sign, internally lit, 45 feet high and a maximum of 150 square feet of area per sign face will not create significant negative impacts to nearby residents, and will not create negative impacts to neighboring property owners or businesses. Staff has inspected the site and has concluded that actual locational choices for the sign is restricted to the area chosen by the applicant and that a hardship exists in said locational choices and overall in achieving a visual presence to the traveling public on Interstate 70. Granting a 23 foot variance from the 30 foot minimum setback requirement in order to erect this sign seven feet from the property line will not create negative impacts to the public, neighboring residents, businesses or property owners. The essential character of the PID and the Final Development Plan will not be altered with the approval of the amendment and the variance. Staff recommends approval of this case. Bolle is an internationally known maker of eyeware (predominantly sunglasses). As indicated, they have moved to Wheat Ridge as their new corporate headquarters, which will include a distribution facility and a retail outlet. In order to keep the business we will need to entertain a request for a new sign at their location, which is in the Pacifica Development on the I-70 frontage road, east of Kipling. An amendment to the PID will be needed to add a sign to the location. The sign in question is approximately 50' high and adjacent to the frontage road. It is an attractive and relatively simple design that uses the appearance of their business logo. We have not yet received the official application, but expect it soon. The issue for us is whether we can get the request processed in a fashion that can address a very tight timetable. The business needs the sign for a planned grand opening on October 2 to which you will all be invited. They have some 900 athletes under contract for their products and expect some of them to be present for the opening. In order to meet this time line we can hear the matter at the August 20 Planning Commission and then at the August 24 City Council meeting. While we can meet the necessary steps for legal publication and the hearing process, having the two meetings so close together will not allow us to have minutes of the Planning Commission meeting in your Council materials. We should be able to have an excerpt for the 8/24 meeting. I do not anticipate that there will be concerns on the project at this point. I will plan to expedite the processing of the application for Bolle unless there are concerns expressed by the Council. I present the following for your consideration: 1. Case No. WZ-97-10 was heard and approved by City Council on September 15, 1997. During this hearing, City Council approved the re-zone from Commercial-One to Planned Industrial Development (PID), Outline and Final Development Plan, and a setback variance for the freestanding sign. As part of the hearing, testimony and motions were made specifically regarding the freestanding signage. Council minutes from the hearing (copy enclosed) show that Council specifically limited the development to one freestanding sign. 2. Case No. WZ-98-15 was heard by City Council on August 24, 1998 to amend the Outline and Final Development Plan to allow one additional freestanding sign on the premises specifically for Bolle', with associated specific maximum square footage, height and setbacks, and materials. A variance for the setback for this sign was part of the case. Council approved the amendment to the Final Development Plan with the condition that the sign was for the Bolle' Company only and, if and when Bolle' vacated the premises, that the sign and the associated structure must be removed. A copy of these City Council minutes are enclosed for your reference. 3. We have been unable to locate any documentation that the amended plan for Case No. WZ-98-15 was officially recorded at the County Clerks office. The City's development regulations state that recording of City Council actions, including actions regarding land development cases, must be recorded within 60 days of the final approval action. If this procedure is not satisfied, the action is null and void. This process is estimated to take approximately four months from the date a complete application package is submitted to the Planning and Development Department.
