Also present: City Clerk, Wanda Sang; City Manager, Scott Staples; City Attorney, Gerald Dahl; Director of Planning, Alan White; staff; and interested citizens. APPROVAL OF MINUTES OF June 11, 2001 Motion by Mr. DiTullio for the approval of the Minutes of June 11, 2001; seconded by Mrs. Worth; carried 8 -0. PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1, Public Hearing on Case No. WZ- 00 -13, request for an amendment to the Final Development Plan with setback variance to allow an additional freestanding sign, for property located at 9500 West 49 Avenue. Case No. WZ -00 -13 was introduced by Mrs. Worth, who also read the title. Tim Rogers, Leasing and Marketing Manager for First Industrial Realty Trust, was sworn in by the Mayor. They asked for a new monument sign that would provide signage for multi- tenant use. He showed slides of the property and asked for approval of the plan. CITY COUNCIL MINUTES: June 25, 2001 Page - 2 - Alan White was sworn in by the Mayor and presented the staff report. David Murphy was sworn in by the Mayor; he asked how many more big signs will be put up. When he drives down 1 -70, he does not want to look at signs. Motion by Mrs. Worth to approve Case No. WZ -00 -13 for the following reasons: 1. RESOLUTIONS, AND MOTIONS Item 2. Motion to accept the 2000 Audit. Mr. DiTullio introduced Item 2 and read the summary and background. Motion by Mr. DiTullio that the audit of the general purpose financial statements for the City of Wheat Ridge, for the year ended December 31, 2000, be accepted; seconded by Mr. Edwards. Motion by Mr. Mancinelli to amend the motion to include changes suggested by the auditing firm, such as evaluating the fund structure before the next budget cycle; submitting grant reimbursements on a timely basis so the City can use, and earn interest on these monies, rather than subsidizing the grant programs; updating the building permit system and integrating it with the general ledger; seconded by Mr. DiTullio. Mr. Edwards does not support this amendment because he would like for Mr. Staples to have the opportunity to work with the Treasurer's Office to deal with these issues. . Mr. DiTullio urged Council to support this amendment. He sees no need to postpone this since the Treasurer and Mr. Staples are willing to work on this. Mrs. Shaver is not against the recommendations, but they are so general in nature; she would prefer to let Mr. Staples address those and bring something more specific to Council. There might be other suggestions that Mr. Staples and Mr. Patera might have. Motion tied 4-4 with Councilmembers Shaver, Edwards, Figlus and Worth voting no. Mayor broke the tie by voting yes. REQUEST The applicant is requesting approval of an amendment to Pacifica Development Properties II, LLC, PID Final Development Plan to allow an additional freestanding sign with a 23' foot setback variance (Planning Commission Report Exhibit 1, Applicant Application and Exhibit 2, Applicant Letter). Pursuant to Section 26 -709, a freestanding sign over 25 feet in height must be set back 30 feet from the edge of street right of way. This proposed sign will be 48 feet high and setback from the street right of way 7 feet. II. CASE ANALYSIS The property in question is approximately 303,619 square feet in area, and is zoned Planned Industrial Development. The lease space for Parcel B is approximately 48,897 square feet, and is located in the southeast corner of the Development. The building square footage is approximately 16,402 square feet (Exhibit 4, Vicinity Map). On August 24, 1998, City Council approved an amendment to the PID allowing Bolle the additional freestanding sign and 23 foot setback variance. Pursuant to case number WZ- 98 -15, when Bolle vacated the building in the summer of 2000, the sign and all appurtenant equipment must be removed. This additional freestanding sign will be located where Belle had their sign,7 feet from the street right of way. This amendment will increase the total sign square footage from 137 square feet tol89 square feet (Exhibit 5, Sign Detail). The entire Planned Development is allotted 357 square feet of signage based upon the total square footage of all four buildings. There is one existing freestanding sign located in the southwestern corner of the planned development. It measures 24 feet 11 inches high and is 164.2 square feet in area. If this amendment is approved, the total area for freestanding signs will be 353.2 square feet, 3.8 feet under the allowable freestanding sign allocation. III. PLANNING COMMISSION ACTION The Planning Commission heard this case on Thursday, May 17', 2001. Planning Commission voted 6 -1 to approve this additional sign with a seven foot front yard setback. The approval included a condition that the proposed sign not exceed 189 square feet. There were no major concerns from either staff or Planning Commission. IV. VARIANCE CRITERIA The Code requires variances to be evaluated using the following criteria: Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? City Council Page 2 WZ- 00- 1 3/First Industrial 2. If the variance were granted, would it alter the essential character of the locality? 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? 6. If criteria a through a are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Section 26 -112 of the Code of Laws dictates that any change to a preliminary or final planned development should follow the rezoning criteria. Most of the rezoning criteria do not apply to this amendment, however, a few of the items should be considered: 1. The proposed change of zone (or change to a planned development) is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. 2. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. V. Pursuant to Section 26 -709, a freestanding sign over 25 feet in height must be set back 30 feet from the edge of street right of way. This proposed sign will be 48 feet high and setback from the street right of way 7 feet. This amendment would allow a future tenant to keep the sign in the previously approved location and increase the square footage of the sign to 189 square feet. II. CASE ANALYSIS The property in question is approximately 303,619 square feet in area, and is zoned Planned Industrial Development. The lease space for Parcel B is approximately 48,897 square feet, and is located in the southeast corner of the Development. The building square footage is approximately 16,402 square feet (Exhibit 4, Vicinity Map). Bolle vacated the premises sometime in the late summer of 2000. This proposed amendment would allow an additional freestanding sign to be located exactly where Bolle had located their sign,7 feet from the street right of way. This amendment will also increase the total square footage of the freestanding sign from 137 square feet to189 square feet. The entire Planned Development is allotted a combined area of 357 square feet of signage based upon the total combined square footage of all four buildings. If the sign code was to be applied in respect to the lease area for Building B (Toshiba lease area), the property would be allowed a maximum of 188 square feet for a freestanding sign based upon the square footage of the building envelope (Exhibit 5, Sign Detail). There is one existing freestanding sign located in the southwestern corner of the planned development. This sign measures 24 feet 11 inches high, and is approximately 164.2 square feet in area. If this proposed amendment to the planned development is approved, the total area for freestanding signs will be 353.2 square feet, approximately 3.8 feet under the allowable freestanding sign allocation. III. NEIGHBORHOOD MEETING The meeting for neighborhood input was held on October 12, 2000 in the Municipal Building located at 7500 West 29` Avenue. People in attendance were: Planning Commission Page 2 WZ -00 -13 /First Industrial Tim Rogers - representative from First Industrial Alan White - Director of Planning and Development for the City No interested parties attended this meeting. IV. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property. The City's Traffic Engineer has reviewed the proposal and had one comment concerning the maintenance of the sight distance triangle. Staff has reviewed the sight distance triangle criteria, and found that the requirements will all be met. V. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the proposed sign with a setback variance is not granted, the property may continue to be used in accordance with the PID as an office /warehouse facility. There is an existing freestanding sign located in the southwest corner of the development. This sign has adequate space to accommodate all tenants in the development. In addition, each tenant is allowed a wall sign to help identify the business. 2. If the variance were granted, would it alter the essential character of the locality? The potential variance will not alter the essential character of the locality. The property is north of I -70, and this type of freeway oriented sign is very common. The design of the sign is compatible with the character of the PID, and does not detract from the surrounding area. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot is situated behind the sound barrier on the north side of I -70. The lot is also considerably lower than the other properties in the PID. The obstructed view coupled with the lower base elevation create a situation of decreased visibility. Moving the sign towards the Planning Commission Page 3 WZ- 00- 13/First Industrial interstate (to the south) will increase the visibility of the sign. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship has not been created by anyone having interest in the property. The hardship is a combination of the location and height of the sound wall, as well as the lowered elevation of the property. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The potential variance would not be detrimental the public welfare or injurious to other property improvements. Since the support poles are to be 1 square foot in measure, the sight distance triangle requirements would be met. The proposed sign would not potentially impair the adequate supply of light or air, nor cause any congestion in the street. It would not likely increase the danger of fire nor impair property values. 6. If criteria a through a are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The proposed variance could potentially result in a benefit or contribution to the neighborhood. The expected tenant will be Toshiba, a nationally recognized name brand, and could generate some interest both economically and create job opportunities for the area. This type of business will provide sales tax to the City based upon where the products are received. If the product is purchased and picked up at the store, the City of Wheat Ridge will collect sales tax revenue. If the product is delivered, the City which receives the delivery will collect the sales tax revenue. The potential variance would not result in a reasonable accommodation of a person with disabilities. Section 26 -112 of the Code of Laws dictates that any change to a preliminary or final planned development should follow the rezoning criteria. Most of the rezoning criteria do not apply to this amendment, however, a few of the items should be discussed: 1. The proposed change of zone (or change to a planned development) is compatible with Planning Commission Page 4 WZ- 00- 1 3/First Industrial the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. This amendment to the PID is compatible with the surrounding area. Since this property has visibility from the highway, many other developments have 50' tall signs oriented towards the freeway. 2. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. As stated above, there is a potential for economic benefit to the community in the form of increased job opportunity and a possible increase in sales tax revenue. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that due to the decreased visibility from the highway, granting the variance would provide a major retailer much needed exposure. The former tenant, Bolle, was approved for a sign in the same location. The Planned Development is allowed a total sign square footage of 357 square feet. Therefore, staff recommends APPROVAL of Case No. WZ- 00 -13. VII. Specifically, we are requesting that the existing square tube support structure originally approved, permitted and erected for Bolle Sunglasses be maintained. The existing TX 23' -10" oval cabinet would be removed from the square tube structure. A new 10' X 21' D/F (189 sq. ft.) internally illuminated sign would be mounted on the existing supports at an overall height of 48' above grade with a 7' setback. The proposed design with the arched top would complement the architecture of the building, unlike the Bolle oval logo which was a part of their trademark. The proposed design would lend itself to a "permanent" development identification sign Therefore, we are requesting that the proposed sign cabinet, amendment and variance be granted for the development with the following stipulations: Current and /or any future tenant copy could be changed as driven by tenant turnover leasing incentives, and marketing efforts. The size and height of the proposed freestanding sign would be in compliance with the current zoning regulations for freestanding signs in non - residential districts for businesses located within one - quarter (1/4) mile of 1 -70. The sign code states two (2) freestanding signs per development (one per street front) are permitted with one (1) sign up to 50' high. Based on the square footage of the buildings, the sign code would permit an additional 230 square foot sign. Our request for a setback of 7' rather than the required 30' setback is necessary due to the 10' barrier fence along 1 -70 which impacts the visibility for westbound traffic. A 30' setback would place the sign in the middle of the parking lot. Case No. WZ- 00 -13 An application submitted by First Industrial, LP, for approval of an amendment to Pacifica Development Properties II, LLC, PID Final Development Plan with a setback variance to allow an additional freestanding sign with a 7 -foot setback. The property is zoned PID and located at 9500 West 49` Avenue. Planning Commission Pane 7 May 17, 2001 This case was presented by Travis Crane. He reviewed the staff report and presented slides and overheads of the application. All pertinent documents were entered into the record and accepted by Chair McNamee. He advised the Commission that there was jurisdiction to hear the case. He reviewed the criteria involved in evaluation of a variance request. Staff recommended approval of the applications with conditions as outlined in the staff report. In answer to a question from Commissioner SNOW, Mr. Crane stated that the size of the requested sign would leave approximately 3.5 feet for freestanding sign space in the development. Tim Rogers 2064 Creighton Drive, Golden Mr. Rogers, leasing and marketing manager for First Industrial Realty, was sworn in by Chair McNAMEE. He stated that he was involved in the original PID for this project. He would like to have the sign available to the landlord to enhance leasing opportunities to attract major and significant tenants. Signage along I -70 is extremely important. He was not comfortable with having a lot of signs on the fronts of the buildings. He clarified that Toshiba is not yet a tenant in this building. Toshiba was seriously considering this location in November and the sign played a great part in their interest. BOIld's lease is still in effect for five more years and they are presently subleasing one of the two buildings which they previously occupied. It was first thought that the tenant's needs could be accommodated through the use of a monument sign; however, the monument sign is not presently visible from I -70. There was discussion about the conditions placed on the Bolld sign which was to be removed if Bolls left the development. Travis Crane explained that Bolls was requested by the city to remove the sign last November. Since then, there was an agreement to cover up the letters and the subject amendment was filed. In answer to a question from Commissioner SNOW, Mr. Rogers stated that the two additional panels would accommodate two smaller tenants and would be visible from I -70. The largest panel would be reserved for the major tenant of the development. It was moved by Commissioner THOMPSON and seconded by Commissioner SNOW that Case No. WZ- 00 -13, a request for approval of an amendment to the Final Development Plan with a setback variance to allow an additional freestanding sign, for property located at 9500 West 49` Avenue, be APPROVED for the following reasons: 1. The property has decreased highway visibility due to the location and height of the sound wall and lowered elevations. 2. The sign could bring a renewed economic interest to the area. 3. The second sign would not alter the character of the area. 4. The sign would not be detrimental to the public welfare nor impair the adequate supply of light and air. 5. Chair McNAMEE asked for clarification as to whether a super- majority vote would be required on this matter. Alan White stated that it would not, since it is an amendment to a final development plan. Case No. ZOA- 01 -01 An ordinance amending Article II of Chapter 26 of the Wheat Ridge Code of Laws concerning the addition of a Conservation Zoning District. This case was presented by Alan White. He reviewed the staff report and asked for Commission's discussion which included: • Should nesting boxes be included in natural habitat areas under primary uses. • Should bridges be included along with equestrian/pedestrian trails under accessory uses. • Should bike racks be included under accessory uses. • Should pavilions be included with benches and picnic tables. • Criteria should be developed for determining the amount of parking spaces. Commissioner THOMPSON made a request that the city address a noxious weed ordinance at some time in the future. It was moved by Commissioner SNOW and seconded by Commissioner THOMPSON that this matter be continued to the meeting on June 7, 2001, in order for staff to clarify the difference between what belongs in the public facilities district, what belongs in the conservation district, and whether all kinds of activities and structures have been covered that would be properly included in a conservation district; and further that the section on weeds not exempt noxious weeds as defined in state statutes. REQUEST The applicant is requesting approval of an amendment to Pacifica Development Properties II, LLC, PID Final Development Plan to allow an additional freestanding sign with a 23' foot setback variance (Exhibit 1, Applicant Application and Exhibit 2, Applicant Letter). The location and square footage for the sign was originally approved pursuant to Case number WZ- 98 -15. This case granted the additional sign and the 23' setback variance, however, City Council approval included a condition that once the former tenant ( Bolle) vacated the building, the sign must be removed. The Bolle sign was located in the southeastern comer of the property (Exhibit 3, Site Plan). Pursuant to Section 26 -709, a freestanding sign over 25 feet in height must be set back 30 feet from the edge of street right of way. This proposed sign will be 48 feet high and setback from the street right of way 7 feet. This amendment would allow a future tenant to keep the sign in the previously approved location and increase the square footage of the sign to 189 square feet. II. CASE ANALYSIS The property in question is approximately 303;619 square feet in area, and is zoned Planned Industrial Development. The lease space for Parcel B is approximately 48,897 square feet, and is located in the southeast corner of the Development. The building square footage is approximately 16,402 square feet (Exhibit 4, Vicinity Map). On August 24` 1998, City Council approved an amendment to the PID allowing Bolle the additional freestanding sign and 23 foot setback variance. Pursuant to case number WZ- 98 -15, once Bolle vacated the building, the sign and all equipment appurtenant to the sign must be removed. Bolle vacated the premises sometime in the late summer of 2000. This proposed amendment would allow an additional freestanding sign to be located exactly where Bolle had located their sign,7 feet from the street right of way. This amendment will also increase the total square footage of the freestanding sign from 137 square feet tol89 square feet. The entire Planned Development is allotted a combined area of 357 square feet of signage based upon the total combined square footage of all four buildings. If the sign code was to be applied in respect to the lease area for Building B (Toshiba lease area), the property would be allowed a maximum of 188 square feet for a freestanding sign based upon the square footage of the building envelope (Exhibit 5, Sign Detail). There is one existing freestanding sign located in the southwestern corner of the planned development. This sign measures 24 feet 11 inches high, and is approximately 164.2 square feet in area. If this proposed amendment to the planned development is approved, the total area for freestanding signs will be 353.2 square feet, approximately 3.8 feet under the allowable freestanding sign allocation. III. NEIGHBORHOOD MEETING The meeting for neighborhood input was held on October 12, 2000 in the Municipal Building located at 7500 West 29 Avenue. People in attendance were: Planning Commission _ page 2 WZ- 00- 13/First Industrial Tim Rogers - representative from First Industrial Alan White - Director of Planning and Development for the City No interested parties attended this meeting. IV. AGENCY REFERRALS All outside service agencies that currently serve the property will continue to serve the property. The City's Traffic Engineer has reviewed the proposal and had one comment concerning the maintenance of the sight distance triangle. Staff has reviewed the sight distance triangle criteria, and found that the requirements will all be met. V. VARIANCE CRITERIA Staff has the following comments regarding the criteria used to evaluate a variance: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the proposed sign with a setback variance is not granted, the property may continue to be used in accordance with the PID as an office /warehouse facility. There is an existing freestanding sign located in the southwest comer of the development. This sign has adequate space to accommodate all tenants in the development. In addition, each tenant is allowed a wall sign to help identify the business. 2. If the variance were granted, would it alter the essential character of the locality? The potential variance will not alter the essential character of the locality. The property is north of I -70, and this type of freeway oriented sign is very common. The design of the sign is compatible with the character of the PID, and does not detract from the surrounding area. 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The lot is situated behind the sound barrier on the north side of I -70. The lot is also considerably lower than the other properties in the PID. The obstructed view coupled with the lower base elevation create a situation of decreased visibility. Moving the sign towards the Planning Commission - Page 3 WZ- 00- 13/First Industrial interstate (to the south) will increase the visibility of the sign. 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship has not been created by anyone having interest in the property. The hardship is a combination of the location and height of the sound wall, as well as the lowered elevation of the property. 5. Would the granting of the variance be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or substantially diminishing or impairing property values within the neighborhood? The potential variance would not be detrimental the public welfare or injurious to other property improvements. Since the support poles are to be 1 square foot in measure, the sight distance triangle requirements would be met. The proposed sign would not potentially impair the adequate supply of light or air, nor cause any congestion in the street. It would not likely increase the danger of fire nor impair property values. 6. If criteria a through a are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? The proposed variance could potentially result in a benefit or contribution to the neighborhood. The expected tenant will be Toshiba, a nationally recognized name brand, and could generate some interest both economically and create job opportunities for the area. This type of business will provide sales tax to the City based upon where the products are received. If the product is purchased and picked up at the store, the City of Wheat Ridge will collect sales tax revenue. If the product is delivered, the City which receives the delivery will collect the sales tax revenue. The potential variance would not result in a reasonable accommodation of a person with disabilities. Section 26 -112 of the Code of Laws dictates that any change to a preliminary or final planned development should follow the rezoning criteria. Most of the rezoning criteria do not apply to this amendment, however, a few of the items should be discussed: The proposed change of zone (or change to a planned development) is compatible with Planning Commission - - Page 4 WZ- 00- 1 3/First Industrial the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. This amendment to the PID is compatible with the surrounding area. Since this property has visibility from the highway, many other developments have 50' tall signs oriented towards the freeway. 2. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. As stated above, there is a potential for economic benefit to the community in the form of increased job opportunity and a possible increase in sales tax revenue. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that due to the decreased visibility from the highway, granting the variance would provide a major retailer much needed exposure. The former tenant, Bolle, was approved for a sign in the same location. The Planned Development is allowed a total sign square footage of 357 square feet. Therefore, staff recommends APPROVAL of Case No. WZ- 00 -13. VII. The existing 7'X 23' -10" oval cabinet would be removed from the square tube structure. A new 10'X 21' D/F (189 sq. ft.) internally illuminated sign would be mounted on the existing supports at an overall height of 48' above grade with a 7' setback. Specifically, we are requesting that the existing square tube support structure originally approved, permitted and erected for Bolle Sunglasses be maintained. The existing 7'X 23' -10" oval cabinet would be removed from the square tube structure. Anew 10'X21' D/F (189 sq. ft.) internally illuminated sign would be mounted on the existing supports at an overall height of 48' above grade with a 7' setback. The proposed design with the arched top would complement the architecture of the building, unlike the Bolle oval logo which was a part of their trademark. The proposed design would lend itself to a "permanent" development identification sign Therefore, we are requesting that the proposed sign cabinet, amendment and variance be granted for the development with the following stipulations: Current and /or any future tenant copy could be changed as driven by tenant turnover leasing incentives, and marketing efforts. The size and height of the proposed freestanding sign would be in compliance with the current zoning regulations for freestanding signs in non - residential districts for businesses located within one - quarter (1/4) mile of 1 -70. The sign code states two (2) freestanding signs per development (one per street front) are permitted with one (1) sign up to 50' high. Based on the square footage of the buildings, the sign code would permit an additional 230 square foot sign. Our request for a setback of 7' rather than the required 30' setback is necessary due to the 10' barrier fence along 1 -70 which impacts the visibility for westbound traffic. In particular, you have expressed interest in knowing exactly what the necessary process is to keep the sign structure and sign square footage on the property after Bolle'vacates their leased space. I present the following for your consideration: 1- Case No. WZ -97 -10 was heard and approved by City Council on September 15, 1997. During this hearing, City Council approved the re-zone from Commercial -One to Planned Indu5tri at Development (PID). Outline and Final Development Plan, and a setback variance for the freestanding sign. As ps - t of the hearing, testimony and motions were made specifically regarding the freestanding signage. Council minutes from the hearing (copy enclosed) show that Council specifically limited the development to one freestanding sign. 2. Case No. WZ -98 -15 was heard by City Council on August 24,1998 to amend the Outline and Final Development Plan to allow one additional freestanding sign on the premises specifically for Bolle', with associated specific maximum square footage, height and setbacks, and materials. A variance for the setback for this sign was part of the case. Council approved the amendment to the Final Development Plan with the condition that the sign was for the Bolle' Company only and, if and when Belle' vacated the premises, that the sign and the associated structure must be removed. A copy of these City Council minutes are enclosed for your reference. 3. We have been unable to locate any documentation that the amended plan for Case No. WZ -98 -15 was officially recorded at the County Clerks office. The City's development regulations state that recording of City Council actions, including actions regarding land development cases, must be recorded within 60 days of the final approval action- If this procedure is not satisfied, the action is null and void. This process is estimated to take approximately four months from the date a complete application package is submitted to the Planning and Development Department. The option of an administrative amendment to the PID and/or Outline and Final Development Plan for the sign is not provided in the City's regulations.
