The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 5 Supersession Clause. If any provision, requirement or standard established by this Ordinance is found to conflict with similar provisions, requirements or standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede and prevail. Section 6. This ordinance shall take effect 15 days after final publication. Council Bill 03 -2001 - An Ordinance providing for the approval of a rezoning from Residential -One C to Residential -Three for property located at 8400 West 46'" Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado. (Case No. WZ- 00 -14) (Dona & Paul Thompson) Council Bill 03 -2001 was introduced on second reading by Mr. Hanley, who also read the title and summary. Clerk assigned Ordinance No. 1217. Dona Thompson, applicant, was sworn in by the Mayor. She explained that they bought the property in 1963 and when her father died in 1973, they put in an apartment for her mother; her mother died in 1984 and they rented out the apartment, not knowing that the property was not properly zoned. She asked for approval of the rezoning. Meredith Reckert was sworn in by the Mayor and presented the staff report. She distributed 3 letters in favor of the application from residents in the neighborhood. Gerry Dungan and Ann Dungan, 8420 West 46'" Avenue, were sworn in by the Mayor and spoke in favor of the rezoning. They have lived next to the Thompson's for 23 years and have never had any problems with their renters. The Thompson's are very selective as to who they rent to. Motion by Mr. Hanley for approval of Council Bill 03 -2001 (Ordinance 1217) for the following reasons: 1. It will provide a land use transitional between the small lot single family neighborhood to the west and North West and the industrially zoned and utilized property to the east. 2. It will not constitute spot zoning as the property to the south has R -3 zoning. 3. There have been no apparent negative affects on the surrounding neighborhood; seconded by Mrs. Worth. Mrs. Shaver will vote against this not because she has anything against the Thompson's, but because she thinks it's not necessary. CITY COUNCIL MINUTES: March 19, 2001 Page - 4 - Motion by Ms. Figlus for a substitute motion that action on this case be postponed until the Council has received and acted upon a recommendation from the Planning Commission and the City Affairs Committee for an amendment to the Code of Laws to provide for a mechanism for regulation of accessory dwelling units in the following zone districts: R -1, R -1 A, R -1 B, and R -1 C; seconded by Mrs. Shaver; failed 2 -6 with Councilmembers Shaver and Figlus voting yes. Original Motion carried 5 -3 with Councilmembers Edwards, Figlus, and Shaver voting no. Mr. Edwards has concerns about the issue of changing the character of this community one rezoning at a time. This is nothing against the Thompson's. Ms. Figlus is concerned that when the property gets sold, this becomes then potentially a double rental; this is not the right mechanism for solving the problem. Item 3. Application by Ojala & Company for the Kaiser Foundation for approval of a four- lot minor subdivision plat on property zoned Commercial -One (C -1) and located at 4865, 4875, 4885 and 4895 Ward Road. He then presented his case and asked for approval of this project; he also asked that the condition of the extra 10 feet of roadway not be made a condition. The property is within the City of Wheat Ridge, and all notification and posting requirements have been me. Therefore, there is jurisdiction to hear this case. 4 I. REQUEST The applicant requests approval of a zone change from Residential -OneC (R -1C) to Residential -Three (R -3) for the purpose of legalizing a secondary living unit on the property at 8400 West 46' Avenue. y` The applicants purchased the property in 1963 and applied for a building permit for a first floor addition with a second story over a portion of it in May of 1974. See attached Exhibit 'A'of the Planning Commission report which is a copy of the original building permit. A copy of the plumbing permit has been attached as Exhibit '13' of the Planning Commission report which shows, in addition to typical bathroom fixtures, installation of a sink and garbage disposal, a water heater and a washing machine hook -up within the second story addition. However, the certificate of occupancy (Exhibit 'C'of the Planning Commission report) issued in October of the same year indicates it is for a single family residential structure. In 1975 a building permit was issued for a second story porch with outside stairway (see Exhibit 'D' of the Planning Commission report). Staff has not. been able to locate a separate C.O. for this addition. The applicants' explanation of the request is included as Exhibit 'E' of the Planning Commission report. A visual inspection of the property revealed that in addition to the outside stairway, there is an interior stairway which connects the bottom unit from the top porch area. A door at the bottom of the stairway can be closed and locked. The following definition for "dwelling, two- family" is included within the zoning code: "A building designed for occupancy by two (2) families living in separate dwelling units as tenants from month to month or for a term longer than one ( i) month." No physical changes are proposed for the property. See the cotTespondence submitted in support of the project as Exhibit 'H' of the Planning Commission report. III. AGENCY REFERRALS All outside service agencies are already providing service to the property. Wheat Ridge Water District has recently expanded their service area to include this property. It was previously served by Arvada Water and the old tap records indicate that there is one 3!4" tap serving two units. IY. REZONING CRITERIA The criteria used to evaluate a zone change request are as follows: The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. 2. A change in the character in the area has occurred due to the installation of public facilities, other zone changes, new growth trends, deterioration or development transitions. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of «'heat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. S minimal adverse impacts considering the benefits to be derived. . 5. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. 6. That adequate infrastructure /facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. 7. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. S. That the property cannot reasonably be developed under the existing zoning conditions. 9. That the zoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. 10. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. VI. PLANNING COMMISSION ACTION Planning Commission reviewed this case at a public hearing held on January 4, 2001. Case No. WZ- 00 -14 An Application by Dona and Paul Thompson for approval of a rezoning from Residential -One -C (R - IC) to Residential -Three (R -3) for property located at 8400 West 46 Avenue to allow an existing illegal dwellin__ to come into conformance. Meredith Reckert was sworn in b% Chair McNAMEE. She reviewed the staff report, presented slides and overheads of the subject property and entered all pertinent documents into the record. The documents were accepted by Chair lv1cNAMEE. She advised the Commission there was jurisdiction to hear the case. Staff recommended approval of the application for reasons outlined in the staff report. In response to a question from Commissioner SNOW. Ms. Reckert explained that the situation came to the attention of the city when a code enforcement officer was in the area on another matter and the owner of the property asked the officer if she was aware of anyone wishing to rent an apartment. ` Commissioner SNOW inquired about property tax desienation of the propertv. Ms. Reckert replied that Jefferson County records indicate that the property is taxed as a single residence. Comissioner THOMPSON commented that. according to the Comprehensive Plan, this would be a good transitional use for this piece of land. Commissioner COLLINS pointed out that the adjacent area is in a flood plain. Ms. Reckert stated that construction could take place through the flood plain exemption process. There w as discussion about possible uses on the vacant property to the north which is owned b% the City of Arvada. Commissioner SNOW expressed concern that rezoning of the subject property could set a precedent for the Arvada propertv if it should be developed. Dona Thompson 8400 «'est 46" Avenue Mrs. Thompson. the applicant. was sworn in b% Chair McNA,�,IEE. She stated that the apartment was originally built to accommodate her mother. After her mother's death, she and her husband continued to rent the unit because they were unaware that the situation was illegal. In response to a question from the Commission regarding the previous use of the vacant propertv owned by Arvada, Mr. Thompson explained that the property originally contained an artesian well. When the well collapsed approximately fift een years ago, the pipes were removed and it was closed down. Ann Dungan 8420 1N'est 26'" Avenue Plannin, Commission Page January d. '_001 Ms. Dungan was sworn in b% Chair :McNAMEE. She testified that she and her husband hu%e lived next door to the applicants for tnventy -three years and they have been exemplar% neighbors. She urged the Commission to approve the application. Commissioner THOMPSON asked Ms. Dunean how she would feel if the Thompson"s sold the property and it continued as a rental. NIs. Dungan replied that it would make no difference because most of the houses in the area were rentals. Commissioner SNOW asked how she would feel if the property to the north were developed as apartments. Ms. Dungan stated she had no feeling one way or the other about additional rental property in the area. Ralph Bonner 4692 Cody Street Mr. Bonner was sworn in by Chair McNAMEE. He testified that he has lived in the neighborhood since 1972 and spoke in favor of the application. He stated that. although there are occasional problems with other rental properties in the area, there has never been a problem with the Thompson's rental unit. Commissioner COOPER explained that. while she has no concern with the Thompson's. rental, the concern lies with possible uses in the future if the property changes hands. It was moved by Commissioner MacDOUGALL and seconded by Commissioner GOKEY that Case No. WZ- 00 -14, a request by Paul and Dona Thompson for a zone change from RAC to R -3 for property located at 8400 West 46" Avenue, be APPROVED for the following reasons: 1. It will provide a land use transition between the small lot single family neighborhood to the west and northwest and the industrially zoned and utilized property to the east. 2. It will not constitute spot zoning as the propem to south has R -3 zoning. 3. There have been no apparent negative effects on the surrounding neighborhood. Commissioner SNOW stated that she would not support the motion for the following reasons: (1) allowing someone to convert a single family home to aduplex without clear city approval and then changing the zoning to match the new' use would set a precedent for homeowners throughout the city to do the same thine: ('_) it clearly violates the Comprehensive Plan: (3) she w ould be in favor of R -?A or R -3A zoning, considering the industrial area to the east: and (4) R -3 zoning- has greater potential to set a precedent for other R -3 in the neighborhood. In 1973 a building permit was issued for a second story porch with outside stairway (see Exhibit `D'). Staff has not been able to locate a separate C.O. for this addition. A visual inspection of the property revealed that in addition to the outside stairway, there is an interior stairway which connects the bottom unit from the top porch area. A door at the bottom of the stairway can be closed and locked. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. The property is currend% zoned Residential -OneC. There is no mistake on the zoning map. 2. A change in the character in the area has occurred due to the installation of public facilities, other zone changes, new growth trends, deterioration or development transitions. There have been very few changes to the area which is predominately developed with small lot single - Camih residences and duplexes further to the north and west. The property to the east is zoned Industrial with land uses which include a roofing company and a semi -truck driving school. The property to the N north was historically used in support of a public utility by the city of Arvada. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. The Comprehensive Plan future land use map designates this property as Single Family Detached Residential and Existing Two Family Conforming Structures and Lots (Not to exceed 6 dwelling units per acre). Based on property size, density would compute to about 7.6 dwelling units per acre. 4. That the propos minimal adverse impacts considering the benefits to be derived. Zoning and corresponding land use surrounding the ed change of zone is compatible with the surrounding area and there will be property include single family residences to the west and northwest zoned R - IC. To the north is a vacant lot owned by the City of Arvada zoned R -1C historically used for water storage (a public utility). Abutting the property to the south is City-owned open space with R -3 zoning. On the east is industrially zoned and used property. The additional unit has been occupied on a rental basis since 1985, therefore, there will be no new impacts to the neighborhood. 5. That there will be social, recreational, physical and /or economic benefits to the community by the change of zone. Approval of the zone change w ill eliminate an illegal, non - conforming use and allow historic use of the propem to continue. 6. That adequate infrastructure /facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such N here they do not exist or are under capacity. There is adequate on -site parking for the ancillan unit. The tin's code enforcement records indicate no prior code complaints tiled against the property. 8. That the property cannot reasonably be developed under the existing zoning conditions. The majority of the lots in the Cleanale Subdivision. which was platted in 1955, are from 6000 to 6600 square feet in size. This propem is the largest one in the subdivision with over 11,000 square feet. This property could be considered as providing a land use transitional as there is Industrial zoning and land use direcd% to the east. That the zoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. >'C 3 :3 Prior to formal application, staff worked with the applicant to determine which zone would be appropriate given the lot size of 11,400 square feet. The R -2A, R -3 and R -3A zone districts require a minimum of 9000 square feet of lot area for a duplex. Staff recommended R -3 zoning since the land to the south (Clear Creek greenbelt area) is also zoned R -3 eliminating the potential for spot zoning. Based on lot size, no additional units could be added if the zone change is approved. 10. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. There is no void in services, products or facilities which the zone change would fill. It would allow historic use of the property to continue. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that the zone change will allow the property to be used as it has since 1974 with no apparent negative affects on the neighborhood. Staff has further concluded that it would provide a land use transition between the small lot single family neighborhood to the west and northwest and the industrially zoned and used land to the east and that it would not result in spot zoning. This addition was completed through the building permit process. Within a few years, a large screened porch was built above the ground floor addition connecting to the mother -in -law apartment. This addition was also completed through the building permit process. The mother -in -law apartment is comprised of one - bedroom, full bath, kitchen and living room. The total area is 24' x 28'. It has a separate outside entrance through the screened porch as well as access through an interior stairway. The screened porch is 12' x 24'. In 1984 my mother passed away, in 1985 we began to rent the apartment, unaware that this was not within zoning as many rental units (duplexes) are in the neighborhood within two to three blocks. Our property allows off - street parking for our vehicles as well as the vehicles of our renter. Reason for the Request We have rented the apartment for the past fifteen years. During this time period none of our neighbors has made a complaint. Additionally, directly to the east of our property is a commercial or industrial use area that extends from our property he to Wadsworth Blvd. Directly next door a lot of heavy equipment is moved in and out on a daily basis both day and night. To the east are a truck driving school, and many small industrial/warehouse businesses. We were never aware that we would have to rezone our property to accommodate the apartment as a rental. The apartment was empty for six - months after my mother died and we rented it to help with the costs of upkeep on the house. Case No. WZ- 00 -14 An Application by Dona and Paul Thompson for approval of a rezoning from Residential -One -C (R -1C) to Residential -Three (R -3) for property located at 8400 West 46 " Avenue to allow an existing illegal dwelling to come into conformance. Meredith Reckert was sworn in by Chair McNAMEE. She reviewed the staff report, presented slides and overheads of the subject property and entered all pertinent documents into the record. The documents were accepted by Chair McNAMEE. She advised the Commission there was jurisdiction to hear the case. Staff recommended approval of the application for reasons outlined in the staff report. In response to a question from Commissioner SNOW, Ms. Reckert explained that the situation came to the attention of the city when a code enforcement officer was in the area on another matter and the owner of the property asked the officer if she was aware of anyone wishing to rent an apartment. Commissioner SNOW inquired about property tax designation of the property. Ms. Reckert replied that Jefferson County records indicate that the property is taxed as a single residence. Comissioner THOMPSON commented that, according to the Comprehensive Plan, this would be a good transitional use for this piece of land. Commissioner COLLINS pointed out that the adjacent area is in a flood plain. Ms. Reckert stated that construction could take place through the flood plain exemption process. There was discussion about possible uses on the vacant property to the north which is owned by the City of Arvada. Commissioner SNOW expressed concern that rezoning of the subject property could set a precedent for the Arvada property if it should be developed. Dona Thompson 8400 West 46 " Avenue Mrs. Thompson, the applicant, was sworn in by Chair McNAMEE. She stated that the apartment was originally built to accommodate her mother. After her mother's death, she and her husband continued to rent the unit because they were unaware that the situation was illegal. In response to a question from the Commission regarding the previous use of the vacant property owned by Arvada, Mr. Thompson explained that the property originally contained an artesian well. When the well collapsed approximately fifteen years ago, the pipes were removed and it was closed down. She testified that she and her husband have lived next door to the applicants for twenty -three years and they have been exemplary neighbors. She urged the Commission to approve the application. Commissioner THOMPSON asked Ms. Dungan how she would feel if the Thompson's sold the property and it continued as a rental. Ms. Dungan replied that it would make no difference because most of the houses in the area were rentals. Commissioner SNOW asked how she would feel if the property to the north were developed as apartments. Ms. Dungan stated she had no feeling one way or the other about additional rental property in the area. Ralph Bonner 4692 Cody Street Mr. Bonner was sworn in by Chair McNAMEE. He testified that he has lived in the neighborhood since 1972 and spoke in favor of the application. He stated that, although there are occasional problems with other rental properties in the area, there has never been a problem with the Thompson's rental unit. Commissioner COOPER explained that, while she has no concern with the Thompson's rental, the concern lies with possible uses in the future if the property changes hands. It was moved by Commissioner MacDOUGALL and seconded by Commissioner GOKEY that Case No. WZ- 00 -14, a request by Paul and Dona Thompson for a zone change from R- 1C to R -3 for property located at 8400 West 46" Avenue, be APPROVED for the following reasons: 1. It will provide a land use transition between the small lot single family neighborhood to the west and northwest and the industrially zoned and utilized property to the east. 2. It will not constitute spot zoning as the property to south has R -3 zoning. 3. There have been no apparent negative effects on the surrounding neighborhood. Commissioner SNOW stated that she would not support the motion for the following reasons: (1) allowing someone to convert a single family home to a duplex without clear city approval and then changing the zoning to match the new use would set a precedent for homeowners throughout the city to do the same thing; (2) it clearly violates the Comprehensive Plan; (3) she would be in favor of R- 2A or R -3A zoning, considering the industrial area to the east; and (4) R -3 zoning has greater potential to set a precedent for other R -3 in the neighborhood. Commissioner THOMPSON stated she was not opposed to the property being used for a duplex because there are many rentals in the area. She was in favor of the best rezoning category to give the Planning Commission Page 3 January 4, 2001 neighborhood some protection. She asked if fees could be waived if the applicant were to reapply for a lesser zoning. Mr. White explained that the Council is the only body with authority to waive fees. Commissioner GOKEY asked if there was a utility easement on the vacant property owned by Arvada. Ms. Reckert replied that she could find no record of an easement. Therefore, there is jurisdiction to hear this case. /o I. REQUEST The applicant requests approval of a zone change from Residential -OneC (R -1C) to Residential -Three (R -3) for the purpose of legalizing a secondary living unit on the property at 8400 West 46' Avenue. The applicants purchased the property in 1963 and applied for a building permit for a first floor addition with a second story over a portion of it in May of 1974. See attached Exhibit `A' which is a copy of the original building permit. A copy of the plumbing permit has been attached as Exhibit `B' which shows, in addition to typical bathroom fixtures, installation of a sink and garbage disposal, a water heater and a washing machine hook -up within the second story addition. However, the certificate of occupancy (Exhibit `C') issued in October of the same year indicates it is for a single family residential structure. In 1975 a building permit was issued for a second story porch with outside stairway (see Exhibit `D'). Staff has not been able to locate a separate C.O. for this addition. The applicants' explanation of the request is included as Exhibit `E'. A visual inspection of the property revealed that in addition to the outside stairway, there is an interior stairway which connects the bottom unit from the top porch area. A door at the bottom of the stairway can be closed and locked. The following definition for "dwelling, two- family" is included within the zoning code: "A building designed for occupancy by two (2) families living in separate dwelling units as tenants from month to month or for a term longer than one (1) month." No physical changes are proposed for the property. II. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on October 11, 2000. Attached as Exhibits `F' and `G' are a synopsis of the meeting and the sign up sheet. Attached under Exhibit `H' are eight letters of support from area property owners which have been designated on the attached vicinity map (Exhibit `I'). Also designated are property owners attending the neighborhood meeting who voiced support of the request. III. AGENCY REFERRALS All outside service agencies are already providing service to the property. Wheat Ridge Water District has recently expanded their service area to include this property. It was previously served by Arvada Water and the old tap records indicate that there is one 3/4" tap serving two units. IV. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a zone change request. The existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is in error. The property is currently zoned Residential -OneC. There is no mistake on the zoning map. 2. A change in the character in the area has occurred due to the installation of public facilities, other zone changes, new growth trends, deterioration or development transitions. There have been very few changes to the area which is predominately developed with small lot single - family residences and duplexes further to the north and west. The property to the east is zoned Industrial with land uses which include a roofing company and a semi -truck driving school. The property to the a �� north was historically used in support of a public utility by the city of Arvada. 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. The Comprehensive Plan future land use map designates this property as Single Family Detached Residential and Existing Two Family Conforming Structures and Lots (Not to exceed 6 dwelling units per acre). Based on property size, density would compute to about 7.6 dwelling units per acre. 4. That the propos minimal adverse impacts considering the benefits to be derived. Zoning and corresponding land use surrounding the ed change of zone is compatible with the surrounding area and there will be property include single family residences to the west and northwest zoned R -1C. To the north is a vacant lot owned by the City of Arvada zoned R -1C historically used for water storage (a public utility). Abutting the property to the south is City -owned open space with R -3 zoning. On the east is industrially zoned and used property. There are duplexes and multi- family development three blocks (800') to the west and 700' to the north adjacent to the southern frontage road. The additional unit has been occupied on a rental basis since 1985, therefore, there will be no new impacts to the neighborhood. 5. That there will be social, recreational, physical and /or economic benefits to the community derived by the change of zone. Approval of the zone change will eliminate an illegal, non - conforming use and allow historic use of the property to continue. 6. That adequate infrastructure /facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. All agencies are currently serving the property. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. Since there are no changes proposed to the existing structure or property, there should be no resulting drainage problems or impact on light and air to the adjacent properties. There is adequate on -site parking for the ancillary unit. The city's code enforcement records indicate no prior code complaints filed against the property. 8. That the property cannot reasonably be developed under the existing zoning conditions. The majority of the lots in the Clearvale Subdivision, which was platted in 1955, are from 6000 to 6600 square feet in size. This property is the largest one in the subdivision with over 11,000 square feet. This property could be considered as providing a land use transitional as there is Industrial zoning and land use directly to the east. 9. That the zoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. 3 Prior to formal application, staff worked with the applicant to determine which zone would be appropriate given the lot size of 11,400 square feet. The R -2A, R -3 and R -3A zone districts require a minimum of 9000 square feet of lot area for a duplex. Staff recommended R -3 zoning since the land to the south (Clear Creek greenbelt area) is also zoned R -3 eliminating the potential for spot zoning. Based on lot size, no additional units could be added if the zone change is approved. 10. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. There is no void in services, products or facilities which the zone change would fill. It would allow historic use of the property to continue. VI. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that the zone change will allow the property to be used as it has since 1974 with no apparent negative affects on the neighborhood. Staff has further concluded that it would provide a land use transition between the small lot single family neighborhood to the west and northwest and the industrially zoned and used land to the east and that it would not result in spot zoning. For these reasons, a recommendation of approval is given. VII. This addition was completed through the building permit process. Within a few years, a large screened porch was built above the ground floor addition connecting to the mother -in -law apartment. This addition was also completed through the building permit process. The mother -in -law apartment is comprised of one - bedroom, full bath, kitchen and living room. The total area is 24' x 28'. It has a separate outside entrance through the screened porch as well as access through an interior stairway. The screened porch is 12' x 24'. In 1984 my mother passed away, in 1985 we began to rent the apartment, unaware that this was not within zoning as many rental units (duplexes) are in the neighborhood within two to three blocks. Our property allows off - street parking for our vehicles as well as the vehicles of our renter. Reason for the Request We have rented the apartment for the past fifteen years. During this time period none of our neighbors has made a complaint. Additionally, directly to the east of our property is a commercial or industrial use area that extends from our property line to Wadsworth Blvd. Directly next door a lot of heavy equipment is moved in and out on a daily basis both day and night. To the east are a truck driving school, and many small industrial/warehouse businesses. We were never aware that we would have to rezone our property to accommodate the apartment as a rental. The apartment was empty for six - months after my mother died and we rented it to help with the costs of upkeep on the house. The income generated through the rental provides a large portion of our retirement income. The existing zoning on your property is Residential - One C (R -1C). The R -1C zone district allows single family development and appropriate accessory uses. According to the survey provided, your property appears to be about 11,400 square feet in size. My understanding of the situation is that you were cited by our code enforcement division for having an illegal rental unit. According to the records in the building department, there was a building permit issued for a first floor addition with a second story in 1974. In 1975, a permit was issued for construction of an outside stairway. The certificate of occupancy issued for the addition indicates it is for single family residential use. In order to resolve the discrepancy between zoning of the property and the existing land use, either the illegal use must cease or an application for rezoning to a zone district that allows duplexes must occur. Based on the estimation of existing lot size, it appears that an R -2A or R -3 zoning would be appropriate. The rezoning process takes roughly six months to complete and involves public hearings in front of both the Planning Commission and City Council. There is also the requirement for a pre - application neighborhood meeting. You as the applicant would be responsible for notifying all of the property owners and residents within a 600' radius of this meeting so those desiring to attend can comment on your proposed land use application. The date, time and place of the neighborhood meeting must be coordinated with a city staff member who will attend the meeting. While the submittal requirements for a rezoning application are minimal, the processing fee can run from $500 to $1000. When staff processes a rezoning request, there are specific criteria in the Wheat Ridge Code of Laws used to evaluate and make a recommendation. Two of the most crucial criteria are compatibility with adjacent land use and zoning and conformance with the Comprehensive Plan. The Comprehensive Plan is a document used to guide growth and land use decisions in the city. Compatibility with adjacent land use and zoning: Zoning and corresponding land use surrounding your property include single family residences to the west and northwest zoned R -1 C. To the north is a vacant lot owned by the City of Arvada zoned R -1C. Abutting the property to the south is City -owned open space with R -3 zoning. On the east is industrially zoned and used property. While your property is in somewhat of a transitional area, there is no duplex zoning in the immediate area. There are duplexes and multi - family three blocks (800') to the west and 700' to the north adjacent to the southern frontage road. Conformance with the Comprehensive Plan: The Comprehensive Plan future land use map designates your property as Single Family Detached Residential and Existing Two Family Conforming Structures and Lots (Not to exceed 6 dwelling units per acre). Based on your property size, density would compute to about 7.6 dwelling units per acre. So while not in conformance with density figure given (6 dwelling units per acre), your proposal would not be that far off. We are requesting it be rezoned Q t >wits Backeround In 1974 an addition was made to the home to include a mother -in -law apartment (upper level) and a family room (ground floor). This addition was completed through the building permit process. Within a few years, a large screened porch was built above the ground floor addition connecting to the mother -in -law apartment. This addition was also completed through the building permit process. The mother -in -law apartment is comprised of one - bedroom, full bath, kitchen and living room. The total area is 24' x 28'. It has a separate outside entrance through the screened porch as well as access through an interior stairway. The screened porch is 12' x 24'. In 1984 my mother passed away, in 1985 we began to rent the apartment, unaware that this was not within zoning as many rental units (duplexes) are in the neighborhood within two to three blocks. Our property allows off - street parking for our vehicles as well as the vehicles of our renter. Reason for the Request We have rented the apartment for the past fifteen years. During this time period none of our neighbors has made a complaint. Additionally, directly to the east of our property is a commercial or industrial use area that extends from our property line to Wadsworth Blvd. Directly next door a lot of heavy equipment is moved in and out on a daily basis both day and night. To the east are a truck driving school, and many small industrial/warehouse businesses. We were never aware that we would have to rezone our property to accommodate the apartment as a rental. The apartment was empty for six - months after my mother died an d we rented it to help with the costs of upkeep on the house. The income generated through the rental provides a large portion of our retirement income. The existing zoning on your property is Residential - One C (R -1 Q. The R -1 C zone district allows single family development and appropriate accessory uses. According to the survey provided, your property appears to be about 11,400 square feet in size. My understanding of the situation is that you were cited by our code enforcement division for having an illegal rental unit. According to the records in the building department, there was a building permit issued for a first floor addition with a second story in 1974. In 1975, a permit was issued for construction of an outside stairway. The certificate of occupancy issued for the addition indicates it is for single family residential use. In order to resolve the discrepancy between zoning of the property and the existing land use, either the illegal use must cease or an application for rezoning to a zone district that allows duplexes must occur. Based on the estimation of existing lot size, it appears that an R -2A or R -3 zoning would be appropriate. The rezoning process takes roughly six months to complete and involves public hearings in front of both the Planning Commission and City Council. There is also the requirement for a pre - application neighborhood meeting. You as the applicant would be responsible for notifying all of the property owners and residents within a 600' radius of this meeting so those desiring to attend can comment on your proposed land use application. The date, time and place of the neighborhood meeting must be coordinated with a city staff member who will attend the meeting. While the submittal requirements for a rezoning application are minimal, the processing fee can run from $500 to $1000. When staff processes a rezoning request, there are specific criteria in the Wheat Ridge Code of Laws used to evaluate and make a recommendation. Two of the most crucial criteria are compatibility with adjacent land use and zoning and conformance with the Comprehensive Plan. The Comprehensive Plan is a document used to guide growth and land use decisions in the city. Compatibility with adjacent land use and zoning: Zoning and corresponding land use surrounding your property include single family residences to the west and northwest zoned R -1C. To the north is a vacant lot owned by the City of Arvada zoned R -1C. Abutting the property to the south is City-owned open space with R -3 zoning. On the east is industrially zoned and used property. While your property is in somewhat of a transitional area, there is no duplex zoning in the immediate area. There are duplexes and multi - family three blocks (800') to the west and 700' to the north adjacent to the southern frontage road. Conformance with the Comprehensive Plan: The Comprehensive Plan future land use map designates your property as Single Family Detached Residential and Existing Two Family Conforming Structures and Lots (Not to exceed 6 dwelling units per acre). Based on your property size, density would compute to about 7.6 dwelling units per acre. So while not in conformance with density figure given (6 dwelling units per acre), your proposal would not be that far off. It is impossible for staff to speculate as to whether an application to rezone will be successful or not. In addition to the evaluation criteria, much of it depends on the reaction of the adjacent property owners. If property owners in the area are not supportive of the zone change, it is unlikely that it will be approved by Planning Commission and City Council.
