Owner is solely responsible for the material and color selection of all products utilized by EA Roofing and agrees to insure that all such selections shall meet or exceed any neighborhood, city, homeowners association, zoning, master leases, building code or any other requirements. Owner shall indemnify, defend and hold EA Roofing harmless from any action brought by any person, group or entity concerning the quality, type, color or other characteristic of the material selected by Owner. All excess materials remain the property of EA Roofing. 4. Accounts. Accounts are considered past due if full payment is not received ten (10) days after work is completed for "cash bid" jobs or two weeks after insurance company has issued payment. Owner must take all steps necessary to pay all accounts in a timely manner. Any amount past due for thirty (30) days will accrue interest -at the rate often percent (10%) per month. Owner acknowledges that it shall be responsible for any and all expenses incurred by EA Roofing for collection of any past due amounts, including, but not limited to, all attorney fees, costs, expert fees, etc. If full payment is not received after this time, EA Roofing may place a lien or encumbrance on the contract property. 5. Final Inspection. In the event a final inspection is required before the Owner chooses to pay, the Owner shall agree to pay the total balance due less 10% as hold -back until the final inspection and any subsequent punch list is completed. 6. Agent. Owner acknowledges that EA Roofing is appointed as Owner's agent and representative in working on their behalf to assist in Owner's insurance claim negotiation. Owner agrees to fully cooperate with EA Roofing in this regard and shall share any and all documents or correspondence received to Owner's insurance claim with EA Roofing. Owner appoints EA Roofing and its authorized representatives as its attomey-in-fact to take any action necessary to effectuate the terms of this Contract. 7. Performance of Work. EA Roofing shall perform all specified work in substantial compliance with all generally accepted industry standards and guidelines, adhering where applicable to local building codes and ordinances. 8. Failure to Perform. Owner acknowledges that EA Roofing will not be responsible for any failure to perform its obligations due to labor strikes, acts of nature or inclement weather, material shortages, labor shortages, eminent domain actions, court or any other government agency or authority declaration, or any other circumstance beyond the control of EA Roofing. 9. Owner's Acknowledgment of Work. Owner hereby acknowledges that EA Roofing shall not be responsible for minor inconveniences and damages resulting from EA Roofing work at the contract property in accordance with all generally accepted industry standards and practices generally associated with such work. These include, but are not limited to: scratches on gutters, oil in driveway, cracks in concrete, landscaping damages, scratched or dented fascia, siding, flashing, etc., rotted broken or falling molding, stucco or plaster cracks or chips, noise, vibration, vehicles in driveway, any interior damaged resulting from any work, etc. Owner waives and agrees to hold EA Roofing harmless from such minor inconveniences and damages. IL Additional Work. Costs for the replacement or repair of any roofing system components (including, but not limited to, decking, fascia, swamp coolers, solar panels, vents, exhaust, HVAC, components, chimney or chimney flashing, step or headwall flashing, drip edge, ice & water shield, windows, etc.) or additional work not specifically stated in this contract are not included. In addition any work or damage uncovered during the repair or replacement process that was unforeseen is not included in the contract. Such work will be billed separately as an extra and billed according to fair market prices. Fairly to remit such payment will result in that EA Roofing work being unreasonably delayed, therefore Owner agrees to pay such amounts in a timely manner. 12. Access. Owner shall warrant and guaranty that EA Roofing, its subcontractors, agents or assigns, shall have unrestricted and reasonable access to the contract property at all times. Owner shall notify any tenants, subtenants, leaseholders or other third -party of EA Roofing work at the contract property and shall indemnify, defend and hold EA Roofing harmless from any claim or liability brought by any third -party against EA Roofing related in any way to EA Roofing work. 13. LIMITED WARRANTY. EA Roofing shall provide a limited warranty against leaks on total roof installations performed by EA Roofing should such leaks be a result of EA Roofing faulty installation. Such warranty does not extend to leaks or water damage below the roofline or any damage resulting from lightning, snow, excessive wind, ice or hail during the warranty. Owner hereby acknowledges that no other warranties, express or implied. are being provided by EA Roofing and hereby waives any such express or implied warranties. EA Roofing does not provide any warranty, either express or implied, for repair or layover work. 14. Paid in Full. EA Roofing will not honor our warranty on agreements that are not paid in full 15. Cancellation. If this contract is cancelled by Owner after three days of signing, Owner agrees to pay EA Roofing as liquidated damages either (a) twenty-five percent (25%) the estimate or actual contract price (whichever is greater) or (b) the actual amount of services and material provided by EA Roofing at the time of cancellation, whichever is greater. Owner also agrees to pay a material re -stocking fee of twenty (20%) the estimate or actual contract price (whichever is greater), in addition to the liquidated damages provision above. If this contract is cancelled by Owner before three days of signing, The Owner will obtain a full refund of any deposit and money will be return within 10 days after cancelling. Contract may be cancelled within 72 hours after the property owner receives written notice that its insurance claim has been denied in whole or in part. 16. Dispute Resolution. The parties agree that the provisions of the Colorado Construction Defect Action Reform Act, codified at C.R.S. 13-20-801, et. seq. shall apply to any dispute resulting from this Contract. 17. Deductible. EA Roofing cannot pay, waive or rebate the insurance deductible in part or in whole. The deductible is the homeowners responsibility to pay. This type of permit is ONLY being processed online --do not come to City Hall to submit an application in person. Permits are processed and issued in the order they are received and due to the volume of requests, time to process varies and is subject to change.
