conditions for flood plain alterations were received and submitted to FEMA for a flood insurance
map revision.

Dear Mr. Wehrdt:
I writing to follow-up on the status of the fence that is located within the 100 year floodplain at
the address indicated above. Over the course of 3 years, City staff has been working with you to
have the fence that was constructed in the floodway removed and the fence in the flood storage
district designed to standards that the City Floodplain Administrator finds amenable.
On July 20, 2009, your engineer submitted a letter and supporting calculations to the Floodplain
Administrator for his review of the breakaway configuration to the lower portion of the fence. On
July 30, 2009, the Floodplain Administrator found the design submitted by your engineer to
acceptable. In order for the floodplain permit to be approved, a check for $300 will be required as
the check that accompanied the original floodplain permit application in December of 2008 was
voided due to a lack of information being supplied with the application. A check must be received
and approval of the floodplain permit must be received before any building permits are issued. A
building permit is required before any construction of the fence may begin.
Since this issue has been outstanding for several years with no action taken by you, the City will
establish a timeline to correct the issues if no response is received from you by November 15,
2009. In your response, you should provide a timeline that you will follow in order to complete
the fence by January 1, 2010. The timeline will need to include specific dates for providing a
check to the City for the review of your Class I Floodplain Exception Permit, removal of the
existing fence that is located in the floodway, application for a building permit for the new fence
with breakaway design, and a date of completion.
Once the project is complete the fence will be inspected to ensure it meets the design supplied to
the Floodplain Administrator by Martin/Martin Engineering.

Dear Tim,
Please find the attached details and supporting calculations for the breakaway configuration of
the lower portion of the fence for the subject fence replacement at 4401-4411 Everett Drive. Per
the meeting held on May 6`h, 2009 at the City of Wheat Ridge, two requirements were agreed
upon for the breakaway portion of the fence
1) The fence needs to provide for the floodplain depth (1 foot) plus 1 foot of freeboard of
opening during a flood event.
2) The breakaway portion of the fence needs to be tethered so that it does not float
downstream.
The enclosed information shows the detail of how the replacement fence will have a lower
portion that will provide for the two feet (24") of clear opening. This will be accomplished by
providing two lower rails with specifically sized screws that will fail during the anticipated loads
put on them during a flood event. In addition the lower rail will be stiffened by adding an
additional 2"x4" member along its length to ensure it doesn't break during the flood event
loadings. The lower portion of the fence will be separated by sawing the pickets at the 24"
height. In addition a chain tether will be installed that will connect the lower breakaway portion
of the fence to the metal posts to avoid having the panel float downstream.

With my departure from the city, I can provide the following summary and history of this case.
• Land use application/floodplain exception permit applied for on May 1, 2006 for a 6'
solid cedar fence. Site plan was provided and indicated desired location of fence was in
the 100 year floodplain, and mostly in the floodway. The fence was not approved by the
floodplain administrator.
• The fence was constructed without any approval of a building permit or floodplain
exception permit in 2006.
• Subsequent letters were sent by Travis Crane indicating that the fence must be removed
with no action taken.
• Letter sent by me on August 12, 2008 requesting that the fence either be removed or
relocated to be out the floodway, and allowable in the 100 year floodplain only with an
approved breakaway design.
• Multiple letters were sent back and forth between August 2008 and October 2008.
• An additional floodplain exception permit was received by Community Development on
December 12, 2008 that did not provide adequate information to illustrate compliance
with applicable floodplain standards.
• A meeting was held on Wednesday, May 6 with Henry Werdt of the Jefferson County
Housing Authority, an engineer from Martin/Martin designing the proposed breakaway
fence, Tim Paranto, Mark Westberg, and myself. The conclusion from this meeting was
that a revised breakaway fence and a new site plan showing the fence as out of the
floodway was to be submitted.
• The engineer from Martin/Martin was intending to submit the revised plans the week of
June 22 but nothing has been submitted as of this date. Please also note that the check
with the 12/11/08 floodplain exception permit was voided, as there was not enough
information to process the case at that time. A new check for $300 must be received.

Dear Mr. Hirt,
Please find the attached details and supporting calculations for the breakaway configuration of
the lower portion of the fence for the subject fence replacement at 4401-4411 Everett Drive. Per
the meeting held on May 6`h, 2009 at the City of Wheat Ridge, two requirements were agreed
upon for the breakaway portion of the fence.
1) The fence needs to provide for the floodplain depth (1 foot) plus 1 foot of freeboard of
opening during a flood event.
2) The breakaway portion of the fence needs to be tethered so that it does not float
downstream.
The enclosed information shows the detail of how the replacement fence will have a lower
portion that will provide for the two feet (24") of clear opening. This will be accomplished by
providing two lower rails with specifically sized screws that will fail during the anticipated loads
put on them during a flood event. In addition the lower rail will be stiffened by adding an
additional 2"x4" member along its length to ensure it doesn't break during the flood event
loadings. The lower portion of thefence will be separated by sawing the pickets at the 24"
height. In addition a chain tether-will be installed that will connect the lower breakaway portion
of the fence to the metal posts to avoid having the panel float downstream.

Henry,
I received some feedback from Tim this afternoon regarding the fence posts. He has informed
me that the metal breakaway posts are designed for open chain link fencing - therefore they
would likely fail with a solid wood fence. With this, a breakaway post designed for a solid wood
fence needs to be provided. He did not have a sample design to provide for this type of
breakaway design. A structural engineer must design a breakaway fence for this location and for
the specific type of fence for him to be able to review it. Please also be aware that a detail must
be provided indicating how the fence sections will be kept from floating downstream.
These are comments that would have emerged from the review process of his, but he cannot
review the application without these basic floodproofing measures. Please let me know the steps
you intend to take and the timeline you intend to get the required breakaway design. I would like
to get this resolved as much as you so the quicker the better.

441 1 Everett Drive reviewed at the site. I still do not feel comfortable with this
proposal without a site review. How am I to know if this proposed fence
relocation will fit your parameters. If it could be worked out by a simple site visit,
it would ease my questions. Again, I see no reason for you or the Flood Plain
Administrator to meet me to discuss this proposal.

We have received your application for a Class II Special Exception Permit to relocate the existing
fence in the 100 year floodplain and there are the following comments:
1. The information presented does not show a relocation of the existing fence out of the
floodway. Per multiple previous letters sent, the fence cannot be approved in the
floodway.

specific type of breakaway design. The new fence must be out of the floodway, and will only be
allowed if constructed of breakaway design. The Special Exception Permit will then be referred
to the Floodplain Administrator for review.
As this has been an outstanding issue for a significant period of time, please submit the revised
plans to accompany the Special Exception Permit by Friday, March 13, 2009 to avoid further
action. If the plans do not show a proposed fence in compliance with the applicable floodplain
regulations as mentioned in several prior letters and this letter, or intent to remove the fence with a
reasonable timeline, a summons to municipal court will be issued.

I received your letter dated October 17, 2008 in which you propose an approximately 5 month
timeframe to bring the previously discussed fence into compliance (March 2009 for construction).
You also asked some questions to clarify what needed to take place to correct the violation. The
circumstances have not changed so I would reiterate the items discussed in letters sent on
September 22 and August 12, 2008.
I have viewed the location of the fence on site. To reiterate, it is the responsibility of the property
owner to comply with floodplain regulations. How precisely this is done is the responsibility of
the property owner. Compliance includes removal of all portions of the fence that were built
without a building permit in 2006 as mentioned in previous letters. This includes the fence and
the posts. Any existing structures or concrete slabs not part of this permit do not have to be
removed. Maintenance of all areas of the subject property is the responsibility of the property
owner. Gates may be installed as long as the fence is constructed in accordance with applicable
floodplain regulations. Regarding the construction of the fence, please refer to the September 22,
2008 letter that set forth the options and attached a sample design of such a fence. Regarding any
temporary fences in the flood storage district, we would have to see a specific proposal to refer to
the floodplain administrator for approval.
Regarding the timeframe proposed, we do not see that a bid process and construction of a fence
will take 5 months. If at the time of construction for the fence there are weather obstacles we will
work with you to revise the deadline. This may entail receipt of an escrow for the cost of the
fence until it may be completed.
With this letter and previous letters the City has given sufficient information to bring the fence
into compliance with floodplain regulations. We expect to have this matter closed in a timely
manner to avoid further action, which may include a summons to municipal court. Please provide
either a complete building permit application for the work with an accompanying Class I
Floodplain Exception Permit (with supporting documentation) or a written request for an
extension by Friday, December 5, 2008. A written request for an extension needs to include an
explanation of how long the bid process takes and why the deadline cannot be met.

I again ask to meet you on-site to come to an agreement as to location of
Floodway and Flood Storage zones and to explore potential solutions when the
fence will be moved to comply with your request. I feel that location, height of
new fence, whether the old posts need to be removed or left behind, if gates
may be installed to allow access to restricted area, who is to maintain the
abandoned areas and material to be used during construction are paramount
to the resolution of the issue.
I also remember during the meeting with Travis, Alan White and Tim, there
were concerns over tethering the sections to the posts to address his concern;
will this also be required when the fence is reconfigured? There were no
drawings included to clarify this matter.
When you address structures in your letter, does that include the existing
ones already within the areas of concern? There is a concrete slab used for
basketball and resident gatherings and a smaller slab used for grilling and
picnics one of which has existing fencing.
As you are aware, a change such as this will require a bid package to be
developed and let for formal bids, them to be received then awarded exclusive
of the permit process. All of which may take some time to finalize then to ask
our Board of Directors for approval before any work can be started. I would not
think this project to be completed until March of 2009 especially since weather
will play a part in this undertaking. Is this a workable timeframe?

As mentioned in my last letter, is the Flood District or the City willing to share in
the cost involved in this change? We hope to be able to remove the sections,
install new posts and re-install the six foot cedar pickets and rails on any new
posts needed. Will a temporary fence or barrier be allowed for the move to
take place? All-in-all more points needing clarification before the removal can
take place. The safety and security of the residents of the complex are still my
most important consideration.
I am open to discuss a time convenient to Tim, you and I to meet on-site

Dear Mr. Wehrdt:
The purpose of this letter is to confirm receipt of your letter dated August 25, 2008 regarding the
fence in the floodplain on the subject property. Although we understand the safety issues, the fact
that the contractor may have built the fence prior to approval of the permit, and the uncertainty as
to the exact location of the floodplain at that time (2006) - as of this date the floodplain boundary
has been established and the City's Code of Laws is very clear in the requirements for fences in
the floodplain and there are no allowances for waivers from these standards. The current fence
was not approved as part of any building permit application and continues to be in violation of the
floodplain ordinance, as it was when it was built in 2006.
Section 26-805 of the Code of Laws relating to the Floodway District clearly states that no
structures are allowed in this area. For the purposes of the City's floodplain ordinance, a structure
does include a fence per Section 26-802. This Floodway District is distinguished from the Flood
Storage District in that it represents the most flood-prone area along Clear Creek, and is
characterized as having "hazardous and significant depths and velocities" per Section 26-802.
With this, having any type of structure impede the flow of water in this area is potentially
dangerous not only to the subject property, but to all properties in the vicinity in the event of a
flood. Further, this is precisely the reason why the Code of Laws does not allow any structures in
this area or any waivers to this standard in spite of any affects on one specific property.
In order to comply with the City's floodplain ordinance, the fence must be entirely out of the
Floodway District. While much of the backyard accessible to the tenants would be eliminated, the
new fence could be entirely in the backyard behind the principle structures with certain measures.
A fence may be constructed with a breakaway design in the Flood Storage District. I have
attached a sample design of such a fence. In consultation with the Floodplain Administrator, it is
my understanding that the costs associated with such a fence are not a significant increase from a
standard fence.
As this issue has been outstanding for over two years based on the documented letters, we would
like to have this addressed as soon as possible. Given this, please either submit a building permit
application for the new fence in compliance with the City's floodplain ordinance (indicating
removal of the existing fence) or notify us of your intent to move toward compliance in writing,

more clarity as to why the Code of Laws does not provide the City or the Housing Authority the

As I am sure you are aware, this existing fence has been in place since
early 2006. The original contract with the vendor, as always, specified that
permits must be obtained prior to commencing work and is the responsibility of
the contractor not the housing Authority to secure the permit. In this case
application for the permit was made prior to the start of the project but the
permit process had taken an extended period to be reviewed and the
contractor started prior to receipt.
Subsequently, letters were sent and meetings were held with the flood
administrator, Alan White and Travis Crane. The new flood maps were due out
and it was decided to delay any changes until those were received.
When received, modifications as suggested by Tim were to use a modified
breakaway post similar to the ones used for light poles and traffic lights, no
mention of the cost involved. If modifications or improvements would have
been made to the existing fence (exactly the same configuration as the new
fence except for steel posts and in the same exact location as when the original
had been built over 36 years ago), it is my understanding, that no changes had
to be made or permits applied for if only repairs were made.
If the fencing is to be removed and relocated out of the Floodway and or
the Flood Storage District, 2/3rds of the fence would be located in front of the
existing buildings as documented by your provided map. There are
approximately 11 children below the age of 15 that live at this site, can you
imagine no fencing separating the rear of the property from Clear Creek. The
risk of an incident would increase dramatically without the fence as it is
constructed now.

I propose to leave the fence as it is installed and cut the lower twelve
inches of cedar pickets off to allow free flow of the water and install some type
of wire fencing to deter children from the river. Perhaps there is a force sensitive
bolt that would allow the sections to be tethered to the posts. I have not
investigated that option nor the potential costs.
Perhaps a compromise could be negotiated where the City and the
Housing Authority share in the cost to accommodate your request. It could be a
joint effort that would be used as a benchmark for other possible end users. I
am sure that there are numerous variances along the river that are similar to this
one. In fact just across the river there is and has been a chain link six foot fence
with inserts for privacy or to shield the property.
We would be willing to discuss all options at a time convenient to all,
perhaps even on-site to see first hand how no fence would impact this

The purpose of this letter is to inform you that a 6 foot fence constructed without a permit on the subject
property is in violation of the city's floodplain ordinance. A permit was applied for to replace an existing 6
foot fence on April 26, 2006. In response, the Community Development Department informed you that the
fence could not be constructed as shown as it is entirely in the floodway. Subsequently, a Class I
Floodplain Permit was applied for to allow this fence. In regards to this permit, a letter from Travis Crane
dated June 1, 2006 was sent to you that also referenced comments from the Public Works Department and
the necessity to remove the fence. Per Section 26-805 of the Code of Laws, no fence may be constructed
in the floodway. Fences may be constructed in the flood storage district with a breakaway design. I have
attached a map delineating the floodway and flood storage district at this location. I have also attached
copies of the above referenced letter and memo.
To the best of our information, no action has been taken to correct this violation since the initial notice.
We understand the safety concerns related to the fence and Clear Creek so we would like to work with you
to come up with a solution. As the floodway represents the most flood prone area within the flood storage
district, the only option is to construct a fence outside of the floodway. If the fence is in the flood storage
district, then it must be of breakaway construction to not impede the flow of water in a flood situation.
Please notify us in writing of your intent between the two options below:
1. Remove the fence in the floodway, and apply for a permit to construct a new breakaway style fence
in the flood storage district, or a standard fence entirely out of the flood storage district.
2. Provide information indicating that the existing fence is in compliance with the floodplain
ordinance.

To Whom It May Concern
Please consider this as a written request to remove and replace the existing six-
foot wood privacy fence with a like and kind security fence. The replacement is
needed in order to remove the safety issue of ownership's concern for the safety
of the children on-site and for the on-going deterioration of the existing structure.
It has missing pickets, rotted wooden posts and failing rails not to mention
appearance. Continuous and constant maintenance is the only way to
safeguard the children at this location.
It will be built consistent with the existing fence and will allow for the structure to
break away with the potential flood-water that may be applicable. If the lower
level of the fence is removed, it would not deter children from gaining access to
the rushing water behind the property.
Your understanding and approval with this request would be greatly
appreciated. We look for H & F Services, Inc. to install this fence.

SUBJECT: Flood Plain Exception Permit, 4401-4411 Everett Drive
I have reviewed the information provided in the Community Development Referral Form for
Case No. WF-06-03/Jefferson County Housing Authority. A Special Exception Permit cannot
be approved for the following:
1. The Floodway is not noted on the site plan. The data available in the 1979 Flood
Hazard Area Delineation study indicates that most of the existing fence is in the
floodway. Fences are not allowed in the floodway.
2. If the fence is not in the floodway a break-away designed fence is allowed. There is
insufficient information to determine if the fence design qualifies as a beak-away
fence.
3. If the fence proposed is a break-away design, the fence must be designed to tether the
fence to prevent movement downstream in the event of the break-away occurring.
4. An application for a Special Exception Permit has not been submitted.

Colorado and to the Zoning Regulations and Building Codes of Wheat Ridge, Colorado or any other applicable ordinances of

WHEREAS, a special meeting of the Jeffco Housing Corporation (the "Corporation's Board of
Directors was duly held by notice thereof on April 28, 1997 at 12:00 noon at 60-25 W. 38th
Avenue, Wheat Ridge, Colorado.; and
WHEREAS, a quorum was present for the meeting, and also present was Henry Wehrdt,
designated as Recording Secretary for purposes of this meeting; and

WHEREAS, full discussion was held regarding the purchase by the Corporation of the twenty
(20) unit property known as 4401 4411 Everett Drive, Wheat Ridge Colorado to be owned- - -
and operated by the Corporation, the grant monies being provided for the downpayment for this
purchase, the HOME program requirements related to this transaction, the loan to the
Corporation from the Jefferson County Housing Authority (the "Authority") for the balance of
the purchase price in an amount not to exceed $525,000, the arrangement between the Authority
and FirstBank of Wheat Ridge to pursue tax-exempt financing in order to fund the loan between
the Corporation and the Authority and the requirements therefor, and related issues regarding
these transactions,

George Aucoin to negotiate on behalf of the Corporation all terms and conditions of the purchase, the
loan, and all related agreements and certifications necessary to effeciuate these transactions, and
to execute all documentation needed in connection with these transactions on behalf of the
Corporation and to fully bind the Corporation.
