The property is owned by Eileen and Emanuel Valentino. The zoning reflected on the City's zoning map is A-2, Agriculture-Two. The zoning should be I, Light Industrial. We have reviewed records and consulted with the City Attorney and have arrived at the decision that the current zoning map is in error and the correct zoning is I. Section 26-119 of the zoning and development code prescribes the process for correcting a verifiable error on the zoning map. Staff is required to inform the property owners of the intent to make the map correction. If within thirty days of this notice, the owner fails to submit a written protest to the correction, the error will be corrected and a legal notice of the correction will be published. Staff must also notify City Council of the proposed correction. The property owners have been notified via certified mail and they have not objected to the correction; therefore, the official zoning map will be corrected. A legal notice has been published in Wheat Ridge Transcript. § 26-ll8 WHEAT RIDGE CITY CODE H. Vesting of title. When a right-of-way is vacated, title to the vacated right-of-way shall vest with adjacent property owners or the 'original grantor or its successors-in-interest as provided by C.R.S. § 43-23-01, at seq. Procedures for correcting errors contained on the official zoning map or within rezoning ordinances or resolutions:' 1. Administrative correction: a. Where a verifiable error is discovered in the zone classification of any particular parcel as displayed on the official zoning map, or as represented in a rezoning ordinance, the director of community development shall notify the current property owner by certified mail of the error and shall inform the owner of the intent to correct the error based upon the record of the last rezoning action. The director shall also notify city council of the proposed correction by memorandum, including documentation which supports the corrective action. If within thirty (30) days of said notice the owner fails to submit a written protest to the correction, the director is authorized to cause the error(s) to be corrected and shall publish a legal notice of the correction. However, if the owner does file a written protest, a rezoning action shall be initiated. -The rezoning action shall be subject to the provisions of section 26-112 except that no fee shall be assessed. b. My understanding of the situation is that you purchased the property in 1992 with the intent of relocating your concrete contracting business, Citywide Enterprises, Inc., onto it. At the time of purchase, you checked with the City and was informed that the property was zoned Industrial. Neither you nor the city has written verification of this occurring. A miscellaneous building permit was issued on October 28, 1992 for installation of a concrete driveway and parking lot. Another building permit was issued on November 12, 1992 for construction of a freestanding garage. In the section of the permit for planning sign-off was a note indicating that the property is zoned Industrial. There was also a note indicating that prior to an issuance of a certificate of occupancy that "landscaping and parking standards for commercial uses" must be met. You have recently had the existing tenant move their business to another location and are wondering what types of tenants are allowed to use the property. After review of historic documents and in consultation with the City Attorney, we have arrived at the conclusion that the property is zoned A-2, Agricultural-Two. There is no evidence in the City's records that a zone change to Industrial was processed or approved. Although permits were issued for Industrial development, these actions do not constitute a rezoning action. The minimum lot size for Agricultural-Two properties is one acre. Your parcel contains approximately 12,000 square feet, limiting the use of the property under existing zoning conditions to a single-family residence. Other uses, for which the original permits were issued for in 1992, will also be allowed. Those permitted commercial/industrial uses include concrete contracting businesses, building contractor service shops and storage yards, landscape contractor offices and shops, electrical supplies and service shops, plumbing and heating supply stores and shops, warehouse/office uses, and woodworking and carpentry shops. To permanently rectify the situation, I would suggest you pursue a zone change application process to rezone the property from A-2 to I. Because your property is less than an acre in size, it would be possible to rezone to a straight Industrial zone district. The zone change process is public hearing process, which would take roughly six months to complete. The process includes a mandatory pre-application neighborhood meeting plus public hearings in front of Planning Commission and City Council. Staff, who makes a recommendation to the deciding bodies, would support the request. Fees required for a zone change application would be around $1000. The Community Development Director has indicated he would look into the possibility of fee waiver should you decide to pursue a zone change. No action should be taken to change or correct the zoning map. The property simply was not rezoned. • We should treat the previously permitted use as a legal non-conforming use. Permitted uses on the property include permitted uses in the A-2 district, the one for which the building permit was issued, and uses similar to the one for which the permit was issued. Please prepare a list of uses we will allow for my review. • The proper way to correct the situation is for the Valentino's to request a rezoning. We would support such a request. I will look into the possibility of waiving the fees if they apply. The owners, Eileen and Emanual Valentino, purchased the property in 1992 with the intent of relocating their concrete contracting business, Citywide Enterprises, Inc., onto it. At the time of purchase, they checked with the City who informed them the property was zoned Industrial. Neither the owners nor the city have written verification of this occurring. A miscellaneous building permit was issued on October 28, 1992 for installation of a concrete driveway and parking lot. Included as a note was "Landscape buffer must be 10' wide" (Attachment 1, approved permit application). Attached to the permit is a site plan, which illustrates the proposed commercial improvements (Attachment 2, site plan). Another building permit was issued on November 12, 1992 for construction of a freestanding garage. In the section of the permit for planning sign-off was a note indicating that the property is zoned Industrial. There was also a note indicating that prior to an issuance of a certificate of occupancy that "landscaping and parking standards for commercial uses" must be met (Attachment 3, approved permit application). It is indicated on the permit to "see attached". There is no attachment in the file. According to the property owner, the structure was converted from a house to a commercial office when the garage and site improvements were completed. This included removal of the kitchen and conversion of the bathroom to be handicapped accessible. A concrete ramp was poured to allow handicapped access into the only door into the building. A field visit conducted on October 29, 2003, verified that these improvements occurred and are still in place. There are no copies of certificates of occupancy for the structure conversion or garage construction. In 1999, the owners relocated their concrete contracting business to the 44th Avenue Industrial Park, at 12951 W. 43`d Drive. The property on W. 52nd Avenue was leased to Rocky Mt. Tree Care, Inc. In 2002, the tree company applied for a business license. It was approved with a zoning designation of A-2. The approved license also indicates that the use is in a commercial structure and that there are seven employees (Attachment 4, business license). The City's zoning map designates the property as being zoned Agriculture-Two (Attachment 5, existing zoning map). A copy of the zoning map in place in 1992 designates adjacent land on all sides, except to the west, as being zoned Industrial. The written "A-2" designation covers the property to the west and extends slightly on to the subject site (Attachment 6, previous zoning map). The existing tenant on the property is moving to a new location so they can expand their business. The property owner, Eileen Valentino, is desirous of renting the property. She contacted the Community Development Department in mid-October to verify allowed uses. It was at that point that we became aware of the zoning discrepancy. The owner has been very cooperative but is getting impatient, as she needs to lease the property to generate income. Issues for consideration: Is there liability on the part of the city for issuing permits with inaccurate information? The owner has spent considerable amounts of money based on the city issuing permits for construction, which the owners believed to be legal. Should the property be considered a non-conforming use? If so, what would allowed uses be? The original use acknowledged by the city as being allowed was for a concrete contracting company. How do we correct the problem with the zoning map? Would an administrative correction be appropriate? Or, should the owner rezone? Per the Zoning and Development Code, if the property is less than one acre it can be rezoned to industrial. The property in question is roughly 12,000 square feet in size; therefore a zone change to I would be possible. Would the city be willing to waive fees? In the interim, how should the owner advertise allowed uses on the property? As A-2 or I? When a right-of-way is vacated, title to the vacated right-of-way shall vest with adjacent property owners or the original grantor or its successors-in-interest as provided by C.R.S. § 43-23-01, et seq. Procedures for correcting errors contained on the official zoning map or within rezoning ordinances or resolutions: 1. Administrative correction: a. Where a verifiable error is discovered in the zone classification of any particular parcel as displayed on the official zoning map, or as represented in a rezoning ordinance, the director of community development shall notify the current property owner by certified mail of the error and shall inform the owner of the intent to correct the error based upon the record of the last rezoning action. The director shall also notify city council of the proposed correction by memorandum, including documentation which supports the corrective action. If within thirty (30) days of said notice the owner fails to submit a written protest to the correction, the director is authorized to cause the error(s) to be corrected and shall publish a legal notice of the correction. However, if the owner does file a written protest, a rezoning action shall be initiated. The rezoning action shall be subject to the provisions of section 26-112 except that no fee shall be assessed. b. At any time minor corrections to the official zoning map which do not affect the zoning of any parcel may be made with the approval of the community development director and with a note added under the "revisions" box on said map, indicating that an "administrative correction" has been made, a case file shall be created with a case number assigned for each correction, with information contained in the file which gives the location and nature of the correction. 2. Minor corrections: a. Subdivisions: Corrections to name of subdivisions, locations of lot lines and boundary lines, location and names of streets and alleys and railroads. b.
