TITLE: AN ORDINANCE AMENDING CHAPTER 26 OF THE WHEAT
RIDGE CODE OF LAWS PERTAINING TO THE
AGRICULTURAL AND PUBLIC FACILITIES TABLE OF USES
AND ACCESSORY USES
WHEREAS, governmental buildings with outside storage are currently special
uses in the Public Facilities zone district;
WHEREAS, the City of Wheat Ridge is desirous of allowing governmental
facilities with outside storage permitted uses in the Public Facilities (PF) zone district;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO THAT:
Section 1. Section 26-204 of the Code of Laws, Agriculture and Public
Facilities Table of Accessory Uses is hereby amended as follows:

Section 3. Safety Clause. The City of Wheat Ridge hereby finds, determines,
and declares that this ordinance is promulgated under the general police power of the City
of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public
and that this ordinance is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further determines that
the ordinance bears a rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this
Zoning code or the application thereof to any person or circumstances shall for any
reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not
affect application to other persons or circumstances.
Section 5. Supersession Clause. If any provision, requirements or standard
established by this Ordinance is found to conflict with similar provisions, requirements or
standards found elsewhere in the Code of Laws of the City of Wheat Ridge, which are in
existence as of the date of adoption of this Ordinance, the provisions, requirements and
standards here shall supersede and prevail.
Section 6. Effective Date. This ordinance shall take effect 15 days after final
publication.

this 11th day of September, 2006, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final
passage set for October 23, 2006, at 7:00 o'clock p.m., in the Council Chambers, 7500
West 29`h Avenue, Wheat Ridge, Colorado.

Mayor DiTullio called the Regular City Council Meeting to order at 7:00 p.m. Councilmembers
present: Karen Adams, Karen Berry, Dean Gokey, Lena Rotola, Wanda Sang, Larry Schulz,
Mike Stites, and Terry Womble. Also present: City Clerk, Pamela Anderson; City Manager,
Randy Young; City Attorney, Gerald Dahl; Director of Community Development, Alan White;
Director of Public Works, Tim Paranto; staff; and interested citizens.
APPROVAL OF MINUTES OF October 9, 2006
Motion by Mr. Stites for approval of the Minutes of October 9, 2006; seconded by Mrs. Sang
and Mrs. Rotola; carried 8-0.
CITIZENS' RIGHT TO SPEAK
David Kuehn, District Manager for Prospect Park and Recreation District, requested
that the City Council consider waiving the use tax of $5,095.00.

amount of $29,889.00.

Mayor DiTullio opened the joint public hearing for Items 2 and 3.
Council Bill 22-2006 was introduced on second reading by Mr. Womble. City Clerk
Pamela Anderson read the executive summary and assigned Ordinance No. 1375.
Council Bill 23-2006 was introduced on second reading by Mr. Womble and he read the
executive summary. City Clerk Pamela Anderson assigned Ordinance No. 1376.
Meredith Reckert, Senior Planner, presented a PowerPoint staff presentation for both
items.
No one from the public was present to speak to the items.
Mayor DiTullio closed the public hearing.
Motion by Mr. Womble to approve Council Bill 22-2006 (Ordinance 1375), Case No.
ZOA-06-06 and that it take effect 15 days after final publication; seconded by Mr.
Schulz; carried 8-0.
Motion by Mr. Womble to approve Council Bill 23-2006 (Ordinance 1376), Case No.
ZOA-06-04, order it published and that it take effect 15 days after final publication;
seconded by Mrs. Sang; carried 8-0.

EXECUTIVE SUMMARY:
This request is for an amendment to Section 26-204 pertaining to the Agriculture and Public Facilities
Table of Uses. Government facilities with outside storage are currently special uses in the A-1, A-2
and PF zone districts. Staff is recommending that those facilities with outside storage become
permitted uses in the PF zone.
Staff is also recommending modified language relating to the keeping of heavy equipment as a
permitted accessory use. The parking of heavy equipment is a permitted accessory use for
agriculturally zoned properties but not public maintenance facilities. This change would permit the
parking of equipment on sites used for public maintenance.
Planning Commission recommended approval of this request.
This City Council action is related to Goal 1 of the Strategic Plan of creating a sustainable city
government and Goal 2, planning for growth and opportunities.
COMMISSION/BOARD RECOMMENDATION:
Planning Commission reviewed this request at a public hearing held on August 3, 2006. A
recommendation of approval was given.
There was no one in attendance in the audience who spoke to this request.
STATEMENT OF THE ISSUES:
The proposed modification will allow government facilities with outside storage as permitted uses in
the PF zone district. The justification for this request is it will allow outside storage within the police
evidence impoundment area at the public works shops. These facilities would remain special uses in
A-1 and A-2.
The modification to allow heavy equipment as an accessory use will allow the storage of heavy
equipment at the public works maintenance shop.
ALTERNATIVES CONSIDERED:
Do not approve the zoning code amendment
FINANCIAL IMPACT:
There will be no direct financial impact related to this request.
RECOMMENDED MOTION:

There are two changes being proposed with this zoning code amendment, both of which relate to
Case No. WZ-06-04 (zone change for the public works shop).
The first component of this request is an amendment to the Section 26-603 of the zoning and
development code (fencing regulations). The current regulations allowed barbed wire fencing in the
agriculture, commercial and industrial zone districts. The public works department would like to
install barbed wire fencing around the police evidence building and impoundment lot to secure crime
evidence. This type of fencing is not currently permitted in the PF zone. The modification as
recommended by staff would allow the evidence area to be secured.

Divisional fences and divisional walls are permitted in any zone district with the issuance
of a fence permit approved by the community development department in accordance
with the requirements of this section.

6. Barbed wire:
a. Barbed wire shall be permitted only in the Agricultural One (A-1) zone district or

three (3) feet inside of another permitted fence and that the other fence is at least forty-
two (42) inches high; or
b. Barbed wire shall be permitted in commercial, a , industrial Public Facilities (PF)
zone districts where placed on top of a six-foot-high fence or higher where permitted.
Barbed wire placed on top of a fence shall not be counted toward the height of a fence.
The barbed wire placed on top of a fence shall not be greater than two (2) feet in height
and shall point inwards towards the property.
