A RESOLUTION MAKING CERTAIN FINDINGS OF FACT
REGARDING THE PROPOSED ANNEXATION OF A PARCEL OF
LAND LOCATED IN SECTION 17, TOWNSHIP 3, RANGE 69
WEST OF THE SIXTH PRINCIPAL MERIDIAN, COUNTY OF
JEFFERSON, STATE OF COLORADO.
WHEREAS, an annexation petition was tiled with the City requesting the annexation of
certain unincorporated territory located in the County of Jefferson and State of Colorado,
otherwise known as Baker Property and hereafter described in Exhibit A which is attached
hereto and made part hereof; and
WHEREAS, said petition was forwarded to the City Council; and
WHEREAS, the City Council of the City of Wheat Ridge, Colorado, found substantial
compliance of said petition with C.R.S. Section 313-12-107; and
WHEREAS, the City Council of the City of Wheat Ridge, Colorado, conducted a public
hearing as required b% law to determine the eligibility for annexation of that property described
in attached Exhibit A; and
WHEREAS, public notice of such public hearing was given as required by law; and
WHEREAS, the public hearing on said annexation was conducted in accordance with the
requirements of the law; and
WHEREAS, pursuant to C.R.S. Section 31-12-110, the City Council, sitting as the
governing body of the City of Wheat Ridge, Colorado, is required to set forth its findings of fact
and its conclusion as to the eligibility of that property described in attached Exhibit A for
annexation to the City of Wheat Ridge.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO, AS FOLLOWS:
Section 1. A plan for that area encompassing the property described on attached Exhibit
A has been adopted by the City Council pursuant to C.R.S. Section 31-12-105(t)(e).
Section 2. Not less than one-sixth of the perimeter of the area proposed to be annexed as
described on attached Exhibit A is contiguous with the existing boundaries of the City of Wheat
Ridge as required by law. Y
Section 3. A Connnunin' ol'interest exists between the area proposed to be annexed as
described Lill attached Exhibit A and the Cite of Wheat Ridge and that the area will be urbanized
in the near future.
Section 4. The area proposed to be annexed as described on attached Exhibit A is
integrated or capable of being,, integrated with the City of Wheat Rid,c.
Section 5. The limitations of the Municipal Annexation Act and the Constitution of the
State of Colorado do not prevent the annexation of the subject property of any part thereof since:
a. No land in the territory to be annexed which is held in identical ownership and
consists of either a single tract or parcel, or two or more contiguous tracts or parcels has
been divided or portion thereof excluded from the area to be annexed without the written
consent of the owners thereof: t
b. No land in the territory to be annexed which is held in identical ownership and
comprises twenty (20) or more acres, having an assessed valuation for ad valorem tax
purposes in excess of $200,000.00 in the year next preceding the annexation, has been
included in the area to be annexed without the written consent of the landowners;
c. No proceedings have been commenced by another municipality I'or the annexation of
all or part of the territory to be annexed by the City of Wheat Ridge: and
d. The annexation will not result in the detachment of the area from the school district in
which it is currently located.
Section 6. The petition for the annexation of that real estate described on attached
Exhibit A meets the requirements of law and is in proper order for annexation for the property
proposed to be annexed as described in attached Exhibit A.
Section 7. No election is required pursuant to C.R. S. Section 31-12-107(2) or any other
law of the State of Colorado or the City of Wheat Ridge.
Section . The proposed annexation will not have the effect of extending a municipal
boundary more than three miles in any direction from any point of the City boundary in any one
year.
Section 9. The entire width of any street or alley to be annexed is included within the
annexation.

Section 11. An ordinance annexim, that property described on attached Exhibit A to the
City of Wheat Ridge shall be considered by this City Council pursuant to C.R.S. Section 31-12-
111.

AN ORDINANCE ANNEXING TO THE CITY OF WHEAT RIDGE
UNINCORPORATED TERRITORY KNOWN AS THE BAKER
PROPERTY LOCATED AT 5220 SWADLEY IN JEFFERSON
COUNTY.
WHEREAS, pursuant to the laws of the State of Colorado, there was presented to the
City Council of the City of Wheat Ridge, Colorado, written petition for annexation to and by the
City of Wheat Ridge, Colorado, of that property described in attached Exhibit A, being
contiguous unincorporated territory contiguous to the City and situated, lying and being in the
County of Jefferson, State of Colorado (the Property); and
WHEREAS, the Property is further described on the Annexation Map attached hereto as
Exhibit B; and
WHEREAS, the owners of more than fifty percent (50%) of the Property have petitioned
for annexation; and
WHEREAS, the City Council of the City of Wheat Ridge, Colorado, has conducted a
public hearing as required by law to determine the eligibility for annexation.of the Property; and
WHEREAS, the City Council of the City of Wheat Ridge, Colorado, has satisfied itself
concerning the eligibility for annexation of the Property, and concerning the conformance of the
proposed annexation to the applicable law and the annexation policy of the City of Wheat Ridge,
Colorado.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. The annexation to the City of Wheat Ridge, Colorado, of that Property - -
described in attached Exhibit A, situated, lying and being in the County of Jefferson, State of
Colorado, meets all requirements of law and the annexation policy of the City of Wheat Ridge,
and therefore, and is hereby approved and made effective.
Section 2. Rezoning of the Property shall be completed simultaneously with the
annexation of the Property pursuant to the Home Rule Charter and Code of Ordinances of the
City of Wheat Ridge.
Section 3. The City Council hereby approves the Annexation Agreement which is
attached as Exhibit C.
Section 4. Upon the effective date of this Ordinance the Property shall become subject to
the laws of the State of Colorado pertaining to cities and to the Charter and all ordinances,
resolutions, rules and regulations of the City of Wheat Ridge.
Section 5. The City Clerk shall file for recording one certified copy of the Annexation
Ordinance and one copy of the Annexation Map with the Clerk and Recorder of the County of
Jefferson, State of Colorado.
Section 6. The City Clerk shall file one certified copy of the Annexation Ordinance and
one copy of the Annexation Map with the Secretary of the State of Colorado.
Section 7. This annexation shall become effective upon the filing for recording of the
certified copy of this Annexation Ordinance and the Annexation Map with the Clerk and
Recorder for the County of Jefferson, State of Colorado, which filing for recording shall be
accomplished no sooner than ninety (90) days from the date of adoption of this ordinance on
second reading.

general circulation in the City of Wheat Ridge and Public Hearing and consideration on final
passage set for March 23 , 1998, at 7:00 p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat.Ridge, Colorado.

ANNEXATION AGREEMENT
THIS ANNEXATION AGREEMENT made and executed this 23rd day of
march , 1993, by and between the CITY OF WHEAT RIDGE, COLORADO, a
Colorado home rule municipal corporation (hereinafter referred to as the "City"), and Walter and
Irene Baker or their assigns (hereinafter referred to as the "Landowners").
W ITNESSETH
Whereas, the City of Wheat Ridge, Colorado, is a Colorado home rule municipal
corporation, possessing all of the powers and authorities granted to it pursuant to Article XX of
the constitution of the State of Colorado, the Home Rule Charter of the City as adopted by the
residents and electors of the city, and those State Statutes applicable to the City, which statutes
include the Municipal Annexation Act of 1965, C.R.S. § 31-12-101, et seq.; and
Whereas, Walter and Irene Baker are owners of that certain real property which is
identified in Exhibit A, which is attached hereto and expressly incorporated herein, which
property is contiguous to the corporate boundaries of the City of Wheat Ridge, and which is
eligible for annexation into the City of Wheat Ridge; and
Whereas, the City wishes to annex the property described in Exhibit A, and the
Landowners, as owners of the property described in Exhibit A, wish to have the same annexed
into the City, subject to all of the terms and conditions set forth herein; and
Whereas, the City and the Landowners wish to set forth in this Annexation Agreement
all of the terms and conditions which shall be applicable to the annexation of said property into
the boundaries of the City, and which shall, pursuant to the terms hereof, govern certain aspects
of the relations between the parties from and after the time of said annexation.
NOW, THEREFORE, the parties hereto, for themselves, their heirs, successors and
assigns, do hereby covenant, warrant, and agree as follows:
Section 1: Agreement Regardi Zoning.. The property described in Exhibit A shall be
rezoned by the Wheat Ridge City Council in accordance with the provisions of this paragraph.
a. The property, which consists of 5 acres more or less, shall be zoned
Agricultural-Two (A-2) with all uses under this zone district as -
enumerated in the Wheat Ridge Code of Laws, as amended, permitted on
the property with the following exceptions:
(1) Dog kennels, catteries, and veterinary hospitals shall be prohibited.
(2) The keeping of swine shall be prohibited.
b. The existing uses on the property of three single-family residences shall be
allowed to remain until such time as the property is proposed for
development. The growing and harvesting of hay shall be permitted on
the property.
Section 2: Vested Rights. The Landowners agree to waive any and all rights which have
vested as to the annexed property prior to the date of annexation approval by the City Council of
the City of Wheat Ridge.
Section 3• Provision of Water and Sewer Services. The Landowners acknowledge and
understand that the City of Wheat Ridge does not provide water and/or sewer services. The
Landowners shall be solely responsible for obtaining such services through Colorado special
districts, or by private contract, and acknowledges that the City has no responsibility whatsoever
to provide said services.
Section 4: Contingent Nature of Agreement. This Agreement is expressly contingent
upon the fulfilling by both Landowners and the City of all actions which are necessary to annex
all of the property described in Exhibit A. If the annexation of all of said property, subject to all
of the terms and conditions of this Annexation Agreement, is not accomplished, the City shall be
obligated to disconnect any portion of the property previously annexed into the City upon receipt
of a written demand from the Landowners that said disconnection action take place. -
Section 5: Enforcement Remedies.
a. The Landowners may enforce against the City through any equitable
action, including the seeking of injunctive or mandatory injunctive relief,
all of the provisions of paragraphs 1,2,3,4 and 5 hereof.
b. Any Citywide ordinance which is not inconsistent with any of the
provisions of paragraphs 1 and 2 above shall be applicable to and
enforceable against the Landowners or their successor, in the same manner
as the same are enforceable against any other property owner within the
City.
Section 64 Agreement to be Recorded. This Annexation Agreement shall be recorded by
the City upon its adoption by the Wheat Ridge City Council.
Section 7: Binding on Successors. This Annexation Agreement, and each and every
provision thereof, shall be fully binding upon each of the parties hereto, as well as any heirs,
successors, or assigns of either party.
Section 8: Entire Agreement. This Annexation Agreement constitutes the entire
agreement between the parties, and supersedes any other written agreements or any verbal
understandings which may have been reached between the parties prior to the execution hereof.

. Section 9: Amendment. This Annexation Agreement may be amended only upon a
writing signed by each of the parties after proper and lawful approval thereof by the City Council
of the City of Wheat Ridge or the Landowners.

I. REQUEST
This is a City-initiated annexation and zoning on property in the process of being annexed to the City of
Wheat Ridge. There are three parcels of property being considered for annexation which are being
zoned pursuant to Case Nos. WZ-98-4 and WZ-98-5. The annexation case numbers are ANX-98-1 and
ANX-98-2.
Case No. WZ-98-4 relates to two parcels, with a combined area of 2.5 acres owned by Shelley and
Ronald Beyer located at 11721 West 52nd Avenue. The front portion of the property is used as a
residence, as well as the owners' landscape contractor's business with the rear parcel being utilized
agriculturally. Current zoning on the property is SR-1 (Suburban Residential-One) in Jefferson County.
The SR-1 zoning allows the contractor's business, the residence and the agricultural use with a one acre
lot size minimum. Please refer to Exhibit `A' which is a survey of the property
Case No. WZ-98-5 relates to property located at 5220 Swadley Street owned by Irene Baker. This
property contains five acres and has two single family residences on the southern portion. The rear
portion of the property is used agriculturally. Current zoning on the property is A-2 (Agricultural-Two)
in Jefferson County. Please refer to Exhibit `B' which is a survey of the property.
The City of Wheat Ridge is proposing a rezoning to Agricultural-Two which would allow current
utilization of all properties to continue with a one acre minimum lot size. It is the zone district within
the City of Wheat Ridge which is the equivalent of the existing Jefferson County zoning.
The City has initiated annexation to control development and usage of West 52nd Avenue due to
concerns over traffic impacts of the proposed development in Arvada to the east.

III. CRITERIA FOR EVALUATION
Staff has the following comments regarding the criteria used to evaluate a zone change or approval.
ZONING:
1. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies,
comprehensive land use plan and other related policies or plans for the area.
The City of Wheat Ridge has adopted the Jefferson County North Plains Community Plan as the
City's Three Mile Plan. In regard to the enclaves within or adjacent to jurisdictional boundaries,
the North Plains Plan indicates future land use as: 1) "Residential up to 4 dwelling units per acre
or existing zoning, whichever is greater; 2) if adjacent use in non-residential, then similar land
use could be reconsidered, provided adverse impacts are mitigated; and 3) Agricultural and
ranching land uses, if consistent with current zoning." Existing Jefferson County zoning is SR-1
and A-2 which allow one dwelling unit per acre minimum. Staff concludes that rezoning to A-2,
which also allows one unit per acre and permits the existing uses, provides consistency with the
City's Three Mile Plan.

2. That the proposed change of zone is compatible with the surrounding area and there will
be minimal adverse impacts considering the benefits to be derived.
Zoning and adjacent land use to the west and north is low density residential development zoned
PUD-R (Planned Unit Development - Residential) within the City of Arvada. To the east is
vacant property with PUD-I (Planned Unit Development - Industrial) zoning. Abutting the
property to the south is low density residential development within the City of Wheat Ridge with
R-2 zoning. The proposed A-2 zoning would allow the existing properties to be used as they
have historically. However, staff is concerned that some of the A-2 uses may not be appropriate
next to low density residential development. The more intensive uses such as dog kennels
should be eliminated from the list of allowed uses.
3. That there will be social, recreational, physical and/or economic benefits to the community
derived by the change of zone.
There will be physical benefits as a result of the annexation and rezoning as the City will have
control of development and usage of West 52nd Avenue.
4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the
change of zone, or that the applicant will upgrade and provide such where they do not exist
or are under capacity.
All service agencies are currently serving the property. The requirement for public improvements
on West 52nd Avenue and agency service facilities will have to be re-evaluated if future
development occurs.
5. That the proposed rezoning will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously reducing
light and air to adjacent properties.
No changes are proposed for the properties being annexed and zoned. Therefore, there should be
no affect on traffic on 52nd Avenue or on the amount of light and air to adjacent properties.
6. That the property cannot reasonably be developed under the existing zoning conditions.
Any property annexed into the City needs zoning approval. The A-2 zoning is equivalent to the
existing zoning in Jefferson County.

That the zoning will not create an isolated or spot zone district unrelated to adjacent or
nearby areas.
The A-2 zoning will allow historical use of the property to continue to be used for residential and
agricultural uses. There is other agricultural zoning and agricultural and residential uses in the
area, therefore, spot zoning is not an issue.
8. That there is a void in an area or community need that the change of zone will fill by
providing for necessary services, products or facilities especially appropriate at the
location, considering available alternatives.
There is no void in services that the zoning approval will fill. The annexation will allow the City
to have control of West 52nd Avenue.
ANNEXATION:
The Wheat Ridge Code of Laws does not contain criteria for review of an annexation, but state statute
provides criteria for eligibility for annexations. These criteria are:
Not less than one-sixth of the perimeter of the area is contiguous with the boundary of the
annexing municipality.
2. That a community of interest exists between the annexing area and the annexing municipality.
I The annexing area is urban or will be urban in the near future.
4. The annexing area is integrated with or capable of being integrated with the annexing
municipality.
It is necessary and desirable to annex the property
State statutes also state that meeting the requirement of contiguity "shall be a basis for a finding of
compliance with these requirements, unless the governing body finds that at least two of the
following are shown to exist:"
Less than 50% of the residents of the area to be annexed make use of part or all of the following
facilities of the municipality: recreational, civic, social, religious, industrial, or commercial; or
less than 25% of the area's adult residents are employed in the municipality.

2. One-half or more of the land to be annexed is agricultural.
3. It is not physically practicable to extend to the area those urban services which the annexing
municipality provides to all of its citizens.
Other than the contiguity requirement, these criteria are subjective. Certainly a community of interest
exists, the area is capable of being integrated into the City, and services are able to be extended because
the City is already serving the residential development to the south of West 52nd Avenue. Although
urban level development is not proposed at this time, it is possible that the area may be urban in the
future. It is reasonable to assume the property owners make use of the City's recreational, social,
religious and commercial facilities.
State statutes also require that a plan for the area extending three miles from the City's boundaries be in
place. The Planning Commission recommended adoption of the Jefferson County North Plains
Community Plan with modifications as the City's. Three Mile Plan at the February 12, 1998 hearing.
That plan shows the area under consideration for annexation as an enclave and under the plan, suitable
for residential development up to 4 dwelling units per acre or agricultural uses if consistent with current
zoning. The requested zoning of A-2 limits residential development to one dwelling unit per acre and
allows the current uses of the properties.
Annexation is a policy decision which rests more on the question of whether the City should annex an
area considering the positive and negative aspects of the annexation than on set criteria. In other words,
do the costs of providing services to the annexing area balance with the revenues anticipated? Can
services be provided in a, cost effective manner if there is nearby development also served? Is the
annexation a logical extension of the City's boundaries and service provision capabilities? Are there
other benefits or circumstances of annexing that outweigh these considerations?
IV. AGENCY REFERRALS
Arvada Fire Protection District can service the property. Any future development will require~re-
evaluation for compliance with the Uniform Fire Code. The District requests an emergency access be
provided through the 52nd Avenue right-of-way to access the adjacent Arvada development.
Valley Water District is currently serving the property by a 6" water main in 52nd Avenue. A 30' right-
of-way or at the very least, a non-exclusive easement must be retained in 52nd Avenue for current water
lines and use. Any future development may require additional main lines, taps and fire hydrants.
Public Works Department will not require any public improvements at this time. Future development
will be reassessed for all applicable development standards.

The areas are shown in the City of Arvada's growth area. Arvada is not opposed to the annexations if
the following conditions are required:
1. Maintain the 52nd Avenue right-of-way for emergency access to the adjacent Arvada
development. For a future permanent connection, require a dedication of 70 feet of right-
of-way (additional 40 feet to that being required).
2. Future development should respect the Arvada Comprehensive Plan designation of
suburban for this area.
V. STAFF CONCLUSIONS
Staff concludes that the annexations meet the state criteria for annexation eligibility, are logical
extensions of the City's boundaries, are able to be served by the City, and are in the best interest of the
City. Annexation of the West 52nd Avenue right-of-way allows the City to gain control of this street to
address concerns of the area residents about the impact of traffic from adjacent development in Arvada.
The requested zoning of the properties meets the City's criteria for rezoning. The requested A-2 zoning
is appropriate for the existing uses of the property. No impacts from the rezonings are anticipated;
however, staff recommends that the more intensive A-2 uses be eliminated (dog kennels, catteries, vet
hospitals, the keeping of swine) from the list of allowed uses.
VI. RECOMMENDED MOTIONS
ANNEXATIONS
Option A: "I move to recommend to the City Council that the request to annex property into the Wheat
Ridge Corporate limits pursuant to Case Nos. ANX-98-1 and ANX-98-2 for property located at 11721

The minutes of the February 19, 1998, Wheat Ridge Planning Commission were presented for
approval.
Commissioner SNOW requested the following amendments to the minutes:
1) The second paragraph of page 4 should state that the motion carried by a vote of 7-0
rather than 8-0.
2) On page 9, the second paragraph should contain the words "Animal Control
Commission" rather than "Agricultural Commission."
It was moved by Commissioner GOKEY and seconded by Commissioner THEANDER to

Alan White stated that a defect had been discovered in the public notice procedures for these
cases and, therefore, the Commission did not have jurisdiction to hear the cases. He requested
that the Planning Commission continue the public hearings until March 19, 1998, at 7:30 p.m.
He noted that the City Attorney had advised that no public testimony can be taken until that
date, and apologized to those in attendance who came to hear these specific cases.
Commissioner SNOW moved and Commissioner BRINKMAN seconded that Cases No. ANX-
98-11WZ-98-4 and No. ANX-98-2/WZ-98-5 be continued until March 19, 1998, at 7:30 p.m. in
the Council Chambers of the Wheat Ridge Municipal Building.

B. Case No. MS-98-1: Application by HC Properties, Ltd. for approval of resubdivision
of three parcels to allow for a lot line adjustment to accommodate the relocation of the Public
Service natural gas regulator facility located at 7605 West 44th Avenue and 4401 Wadsworth
Boulevard in the Commercial-One Zone District.
Meredith Reckert presented an overview of the case stating that the owners of this property are
V&M Rentals and Public Service Company of Colorado. The owners have requested a
resubdivision of approximately 2.8 acres at the northwest corner of West 44th Avenue and
Wadsworth Boulevard. She presented a map and slides of the property, and entered into the
record the subdivision regulations, case file, packet materials and exhibits. She advised that the
property is within the City of Wheat Ridge, all notification and posting requirements have been
met and there was jurisdiction to hear the case. She stated there are currently two structures on
four parcels of property (Vern's Restaurant and Lounge on parcel one and the Public Service
Company gas regulator structure on parcel four) and that the primary reason for the request was
to move the Public Service Company gas regulator structure to the back of the property to allow
redevelopment to take place.
Ms. Reckert advised that the right-of-way for both West 44th Avenue and Wadsworth is being
dedicated by this plat and a blanket cross access easement has been provided allowing free
movement through the drive aisles and parking areas on the property. She noted that all
requirements of the Subdivision Regulations have been met. She added that the Public Service
Company concurs with the proposed resubdivision, and the Colorado Department of
Transportation has approved the right-of-way width for dedication and has approved an access
permit.
Ms. Reckert informed that it was staff's conclusion that the resubdivision is required to allow
redevelopment of the property and, therefore, recommended approval.
Following discussion by the Commission, Chair Thompson asked if there were any individuals

I. REQUEST
This is a City-initiated annexation and zoning on property in the process of being annexed to the City of
Wheat Ridge. There are three parcels of property being considered for annexation which are being
zoned pursuant to Case Nos. WZ-98-4 and WZ-98-5. The annexation case numbers are ANX-98-1 and
ANX-98-2.
Case No. WZ-98-4 relates to two parcels, with a combined area of 2.5 acres owned by Shelley and
Ronald Beyer located at 11721 West 52nd Avenue. The front portion of the property is used as a
residence, as well as the owners' landscape contractor's business with the rear parcel being utilized
agriculturally. Current zoning on the property is SR-1 (Suburban Residential- One) in Jefferson
County. The SR-1 zoning allows the contractor's business, the residence and the agricultural use with a
one acre lot size minimum. Please refer to Exhibit `A' which is a survey of the property

This property contains five acres and has two single family residences on the southern portion. The rear
portion of the property is used agriculturally. Current zoning on the property is SR-1 (Suburban
Residential- One ) in Jefferson County. Please refer to Exhibit `B' which is a survey of the property.
The City of Wheat Ridge is proposing a rezoning to Agricultural-Two which would allow current
utilization of all properties to continue with a one acre minimum lot size. It is the zone district within
the City of Wheat Ridge which is the equivalent of the existing Jefferson County zoning.

III. CRITERIA FOR EVALUATION
Staff has the following comments regarding the criteria used to evaluate a zone change or approval.
ZONING:
1. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies,
comprehensive land use plan and other related policies or plans for the area.
The City of Wheat Ridge has adopted the Jefferson County North Plains Community Plan as the
City's Three Mile Plan. In regard to the enclaves within or adjacent to jurisdictional boundaries,
the North Plains plan indicates future land use as 1) "Residential up to 4 dwelling units per acre
or existing zoning, whichever is greater; 2) if adjacent use in non-residential, then similar land
use could be reconsidered, provided adverse impacts are mitigated; and 3) Agricultural and
ranching land uses, if consistent with current zoning." Existing Jefferson County zoning is SR-1
which allows one dwelling unit per acre minimum. Staff concludes that rezoning to A-2; which
also allows one unit per acre and permits the existing uses, provides consistency with the City's
Three Mile Plan.

2. That the proposed change of zone is compatible with the surrounding area and there will
be minimal adverse impacts considering the benefits to be derived.
Zoning and adjacent land use to the west and north is low density residential development zoned
PUD-R (Planned Unit Development - Residential) within the City of Arvada. To the east is
vacant property with PUD-I (Planned Unit Development - Industrial) zoning. Abutting the
property to the south is low density residential development within the City of Wheat Ridge with
R-2 zoning. The proposed A-2 zoning would allow the existing properties to be used as they
have historically. However, Staff is concerned that some of the A-2 uses may not be appropriate
next to low density residential development. The more intensive uses such as dog kennels
should be eliminated from the list of allowed uses.
3. That there will be social, recreational, physical and/or economic benefits to the community
derived by the change of zone.
There will be physical benefits as a result of the annexation and rezoning as the City will have
control of development and usage of West 52nd Avenue.
4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the
change of zone, or that the applicant will upgrade and provide such where they do not exist
or are under capacity.
All service agencies are currently serving the property. The requirement for public
improvements on West 52nd Avenue and agency service facilities will have to be re-evaluated if
future development occurs.
5. That the proposed rezoning will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously reducing
light and air to adjacent properties.
No changes are proposed for the properties being annexed and zoned. Therefore, there should be
no effect on traffic on 52nd Avenue or on the amount of light and air to adjacent properties.
6. That the property cannot reasonably be developed under the existing zoning conditions.
Any property annexed into the City needs zoning approval. The A-2 zoning is equivalent to the
existing zoning in Jefferson County.

7. That the zoning will not create an isolated or spot zone district unrelated to adjacent or
nearby areas.
The A-2 zoning will allow historical use of the property to continue to be used for residential and
agricultural uses.. There is other agricultural zoning and agricultural and residential uses in the
area, therefore, spot zoning is not an issue.
8. That there is a void in an area or community need that the change, of zone will fill by
providing for necessary services, products or facilities especially appropriate at the
location, considering available alternatives.
There is no void in services that the zoning approval will fill. The annexation will allow the City
to have control of West 52nd Avenue.
ANNEXATION:
The Wheat Ridge Code of Laws does not contain criteria for review of an annexation, but state statute
provides criteria for eligibility for annexations. These criteria are:
Not less than one-sixth of the perimeter of the area is contiguous with the boundary of the
annexing municipality.
2. That a community of interest exists between the annexing area and the annexing municipality.
3. The annexing area is urban or will be urban in the near future.
4. The annexing area is integrated with or capable of being integrated with the annexing
municipality.
5. It is necessary and desirable to annex the property.
State statutes also state that meeting the requirement of contiguity "shall be a basis for a finding of
compliance with these requirements, unless the governing body finds that at least two of the
following are shown to exist:"
1. Less than 50% of the residents of the area to be annexed make use of part or all of the following
facilities of the municipality: recreational, civic, social, religious, industrial, or commercial; or
less than 25% of the area's adult residents are employed in the municipality.

2. One-half or more of the land to be annexed is agricultural.
3. It is not physically practicable to extend to the area those urban services which the annexing
municipality provides to all of its citizens.
Other than the contiguity requirement, these criteria are subjective. Certainly a community of interest
exists, the area is capable of being integrated into the City, and services are able to be extended because
the City is already serving the residential development to the south of West 52nd Avenue. Although
urban level development is not proposed at this time, it is possible that the area may be urban in the
future. It is reasonable to assume the property owners make use of the City's recreational, social,
religious and commercial facilities.
State statutes also require that a plan for the area extending three miles from the City's boundaries be in
place. The Planning Commission recommended adoption of the Jefferson County North Plains
Community Plan with modifications as the City's Three Mile Plan at the February 12, 1998 hearing.
That plan shows the area under consideration for annexation as an enclave and under the plan, suitable
for residential development up to 4 dwelling units per acre or agricultural uses if consistent with current
zoning. The requested zoning of A-2 limits residential development to one dwelling unit per acre and
allows the current uses of the properties.
Annexation is a policy decision which rests more on the question of whether the City should annex an
area considering the positive and negative aspects of the annexation than on set criteria. In other words,
do the costs of providing services to the annexing area balance with the revenues anticipated? Can
services be provided in a cost effective manner if there is nearby development also served? Is the
annexation a logical extension of the City's boundaries and service provision capabilities? Are there
other benefits or circumstances of annexing that outweigh these considerations?
IV. AGENCY REFERRALS
Arvada Fire Protection District can service the property. Any future development will require re-
evaluation for compliance with the Uniform Fire Code.
Valley Water District is currently serving the property by a 6" water main in 52nd Avenue. A 30' right-
of-way or at the very least, a non-exclusive easement must be retained in 52nd Avenue for current water
lines and use. Any future development may require additional main lines, taps and fire hydrants.
Public Works Department will not require any public improvements at this time. Future development
will be reassessed for all applicable development standards.

V. STAFF CONCLUSIONS
Staff concludes that the annexations meet the state criteria for annexation eligibility, are logical
extensions of the City's boundaries, the areas are able to be served by the City, and are in the best
interest of the City. Annexation of the West 52nd Avenue right-of-way allows the City to gain control
of this street to address concerns of the area residents about the impact of traffic from adjacent
development in Arvada.
The requested zoning of the properties meets the City's criteria for rezoning. The requested A-2 zoning
is appropriate for the existing uses of the property. No impacts from the rezonings are anticipated,
however Staff recommends that the more intensive A-2 uses be eliminated (dog kennels, eatteries, vet
hospitals, the keeping of swine) from the list of allowed uses.
VI. RECOMMENDED MOTIONS
ANNEXATIONS
Option A: "I move that the request to annex property into the Wheat Ridge Corporate limits pursuant to
Case Nos. ANX-98-1 and ANX-98-2 for property located at 11721 W. 52nd Avenue and 5220 Swadley
Street, be APPROVED for the following reasons:
1. The annexations meet the state criteria for annexation eligibility.
2. They are logical extension of the City's boundaries.
3. The annexations will allow the City to gain control of the development and usage of West
52nd Avenue.
4. The annexations reduce the area of enclaves, which help clarify jurisdictional service
areas.
With the following condition:
Provisions be made in the annexation agreement that prohibit the extension of W. 52nd
Avenue to the east."
Option B: "I move that the request to annex property into the Wheat Ridge Corporate limits pursuant

the landowner or landowners thereof, unless such tracts or parcels are
separated by a dedicated street, road, or other public way.

and improvements situated thereon, has a valuation of assessment in
excess of $200,000.00 for ad valorem tax purposes for the year next
preceding the annexation, is included within the area proposed to be
annexed without the written consent of the landowner or landowners.
E. No annexation proceedings have been commenced for the annexation to
another municipality of part or all to the territory proposed to be annexed.
F. The annexation of the area proposed to be annexed will not result in the
detachment of the area from any school district and the attachment of same to
another school district.
G. The annexation of the area proposed to be annexed will not have the effect of
extending the boundary of the City of Wheat Ridge more than three miles in any
direction from any point of the City's boundary in any one year.
H. If a portion of a platted street or alley is to be annexed, the entire width of said
street or alley is included within the area to be annexed.
I. Reasonable access shall not be denied to landowners, owners of easements or
the owners of franchises, adjoining any platted street or alley to be annexed that
will not be bordered on both sides by the City of Wheat Ridge:

C. Within the annexation boundary map, a showing of the location of each
ownership tract of unplatted land, and, with respect to any area which is platted,
the boundaries and the plat numbers of plots or lots and blocks;
D. Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the City of Wheat Ridge and the contiguous boundary of
any other municipality abutting the area proposed to be annexed.
4. That the petitioners are the landowners of more than fifty percent (50%) of the area
sought to be annexed, exclusive of streets and alleys.
5. That all of the petitioners signed this Petition for annexation no more than 180 days
prior to the date of filing of this Petition for Annexation.
6. That this Petition for annexation satisfies the requirements of Article II, Section 30, of
the Constitution of Colorado in that it is signed by persons comprising more than fifty
percent (50%) of the landowners in the area proposed to be annexed who own more than
fifty percent (50%) of said area, excluding public streets and alleys and any land owned
by the City of Wheat Ridge.
7. That upon the Annexation Ordinance becoming effective, all lands within the area
sought to be annexed shall become subject to the ordinances, resolutions, rules and
regulations of the City of Wheat Ridge, except for general property taxes which shall
become effective on January 1 of the next succeeding year following passage of the
Annexation Ordinance.
Therefore, your petitioners respectfully request that the City Council of the City of Wheat
Ridge, Colorado, approve the annexation of the area proposed to be annexed.

The City of Wheat Ridge will be holding a neighborhood meeting to involve the public in the
proposal to annex and rezone property located at 11721 W. 52nd Avenue from County S-RI to
Agricultural-Two into the City of Wheat Ridge, and to annex and rezone property located at
5220 Swadley Street from County A-2 to Agricultural-Two into the City of Wheat Ridge.
The meeting will be held on February 24, 1998, at 6:30 p.m., in the Council Chambers of the
Municipal Complex at 7500 W. 29th Avenue.
The purpose of the meeting is to provide the opportunity for citizens to become aware of a
proposal in their neighborhood and to allow the City and staff to respond to citizen concerns.
All residents within 600 feet are required to be notified of the meeting.
A staff planner will attend the meeting to discuss City policy and regulations and the process
involved. However, the planner will remain impartial regarding viability of the project. Keep in
mind that this pre-application neighborhood meeting is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the public hearings in front of Planning
Commission and City Council where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public hearings.
