CITY COUNCIL. MINUTES: August 10, 1998- Page - 7 - Motion by.Mrs. Shaver to amend that if the land use for the entire property is changed, the applicant property owner shall apply for a PCD;.seconded by Mrs. Dalbec; failed 5-3 with Councilmembers Dalbec, Shaver, and Worth voting yes'. Mr. Siler voted against the amendment because he feels we are singling out this property owner and requiring him to do things other developers don't have to do; putting a restriction of this can make this property difficult to sell in the future; we already have codes and ordinances in place to take care of commercial property. Motion by Mrs. Shaver to amend that the applicant property owner shall stripe the rear parking lot; parking stalls shall be clearly striped with the handicapped symbol as required by the Americans with Disabilities Act; a total of 48 striped parking spaces shall be established and maintained; seconded by Mrs. Worth; failed 5-3 with Councilmembers Shaver, Worth, and DiTullio voting yes. Motion by Mrs. Worth to amend that handicapped parking be provided on the site in accordance with the ADA; seconded by Mr. Siler, carried 8-0. Vote on original motion as amended carried 6-2 with Mrs. Shaver and Mrs. Dalbec voting no. Motion by Mrs. Dalbec that we suspend the Rules and combine Items 2 and 3 for public hearing purposes; seconded by Mr. Siler; failed 5-3 with Councilmembers DiTullio, Worth, and Mancinelli voting no. This needed a super majority to pass. Motion by Mrs. Dalbec to suspend the Rules and hear Item 3 before Item 2; seconded by Mr. Siler; failed 4-4 with Councilmembers Donnelly, Shaver, Siler, and Dalbec voting yes. Motion by Mrs. Shaver to suspend the Rules that Councilmembers can only speak two times on Items 2 and 3; seconded by Mrs. Worth; failed 5-3 with Councilmembers Shaver, Worth, and Dalbec voting yes. Item 2. Approval of a Street Width designation for West 43"' Drive for the Industrial Park located at approximately 13500 West 44'h Avenue. (Case No. SW-98-01) (44 Eldridge LLC, c/o Tom Hartley) Item 2 was introduced by Mrs. Dalbec; title read by the Clerk. Applicant, Tom Hartley, was sworn in by the Mayor and asked for approval. Martin Omer was sworn in by the Mayor and presented the staff report. Alan White stated that evidence was in the file that notices were mailed and in fact were received by the property owners. Motion by Mrs. Dalbec that Case No. SW-98-1, West 43'° Drive Street Width Designation, for a street design width of 52 feet from flow line to flow line at the intersection with West 44'h Avenue, 100 feet from flow line to flow line at the cul-de-sac bulb, and 36 feet from flow line to flow line between the intersection and the cul-de-sac, to be the internal roadway for the project known as the 44'" Industrial Park, be approved for the following reasons: 1. Approval of the Street Width Designation is an integral element in the design and functioning of the 44h Industrial Park Planned Industrial Development (Case No. WZ-98-11). 2. Approval of the Street Width Designation is required if the intersection design for West 43° Drive at West 44m Avenue, as discussed and agreed at the July 2, 1998 Planning Commission meeting for Case No. WZ-98-11 (preliminary and final plat and development plan), is to function in a safe and effective manner. 3. Approval of the Street Width Designation is not expected to create a negative impact to City residents, surrounding property owners, or future users of West 43'' Drive. 4. Martin Omer gave the staff report. Flora Andrus, 4790 Easley Road, Golden, was sworn in by the Mayor; she is concerned that if Lot 2 is being built.on, the mountain view will be gone. Feels that we don't need another service station, especially a 24 hour one. Asked that Council be respectful of the cemetary, the neighbors to the east along 44 and the fact that this is really the entrance to Fairmount. City of Wheat Ridge Planning and Development Department DATE: August 3, 1998 In regard to the 44d' Industrial Park project with corresponding Case No. WZ-98-11, with said case having been heard by the Planning Commission on July 2, 1998, City of Wheat Ridge Charter Section 21-4 mandates that formal approval be granted by the City Council for Street Width Designations. The subject designation pertains to the new project roadway known as West 43`d Drive, which was created as part of the platting of the property simultaneously with the approval of the Preliminary and Final Development Plans for the project. The right-of-way width of this roadway was part of the platting of the project as Case No. WZ-98-11. After conferring with the City Attorney's office, it has become apparent that a separate and distinct approval by City Council for the street width is a requirement of the City's charter. Therefore, this Street Width Designation Case No. SW-98-1 is submitted for City Council Hearing. West 43`d Drive is platted as extending from its intersection with West 44th Avenue and continuing southerly and westerly for a distance of 3,500 feet with a cul-de-sac termination. The designed width of this street is 52 feet from flow line to flow line at the intersection with West 44th Avenue, 100 feet from flow line to flow line at the cul-de-sac bulb, and 36 feet from flow line to flow line between the intersection and the cul-de-sac. It should be noted that as a condition of Planning Commission approval, no on-street parking will be permitted on West 43`d Drive. Also to be noted is the Fairmount Fire Protection District approval for West 43rd Drive with conditions for fire safety. Finally, as part of the July 2 Planning Commission hearing, a variance approval was recommended for West 43`d Drive for a cul-de-sac length of 3,500 feet in length. The City Charter does not contain any required review criteria for Street Width Designation. Being that Planning and Public Works Staff have reviewed the overall platting and development plans for this case and have recommended approval with conditions for both, staff also recommends approval for this Street Width Designation case. Street Width Designation: The City Council shall have the sole authority and responsibility to determine the width of all City streets within the boundaries of the City of Wheat Ridge. Such authority and responsibility cannot be delegated to any other body or individual(s), the only exception being the election procedure specifically set forth in this Charter section. Street width shall be determined by the flowline of the street. Flowline is defined as the measurement from the inside edge of one curb to the inside edge of the opposite curb. Where no curb is planned to be constructed, flowline shall be defined as the measurement from the outside edge of one side of the driving surface of the street, to the outside edge of the opposite side of the driving surface of the street. Within one (1) year prior to construction or reconstruction of a street, the City Council shall hold a public hearing to determine the flowline of such street. Following the public hearing, the Council shall adopt such flowline as the street's official Street Width Designation. In the event of a protest against such proposed Street Width Designation signed by the owners of: (1) Twenty (20) percent of the property immediately adjacent or contiguous to either side of such street; or, (2) Ten (10) percent of the property lying within three hundred (300) feet of either side of such street, such proposed Street Width Designation shall not become effective except by the favorable vote of three-fourths (3/4) of the entire City Council. Property does not need to be entirely contained within the three hundred (300) foot area to be used in the computation of the ten (10) percent necessary to file a protest. Only the portion of the property that actually lies within the three hundred (300) foot area is used to compute the ten (10) percent required to file a protest. Where the City of Wheat Ridge owns property or has right-of-way within three hundred (300) feet of either side of the street, then such city-owned land or right-of-way shall be excluded from the computation of the required percentage of properties needed to file a protest to the proposed Street Width Designation. Owners of non-city land shall be considered immediately adjacent or contiguous to the street, or within three hundred (300) feet of either side of such street, despite such intervening city-owned land or right-of-way. The written protest to such proposed Street Width Designation shall be submitted to the City Council no later than the conclusion of the public hearing on the proposed Street Width Designation. At least fifteen (15) days' notice of the time and place of the hearing shall be published in the newspaper used by the City to publish legal notices, and notice of such public hearing shall be mailed by certified letter to all property owners within three hundred (300) feet of both sides of such street. Said notice shall contain: (1) A description of the proposed Street Width Designation, and a statement that the specific plans for the proposed Street Width Designation are available for inspection at the Wheat Ridge Municipal Building; and, (2) An explanation of the right of the property owners to protest such proposed Street Width Designation, and how to exercise such right; and, (3) The full and complete text of this Charter section. All publication and notification requirements set forth in this Charter section shall be performed by the City Clerk. If at any time within forty five (45) days after a favorable vote by City Council of such proposed Street Width Designation, a petition signed by at least five (5) percent of the registered electors of the City Council district(s) immediately adjacent or contiguous to such street be presented to the Council against the going into effect of such proposed Street Width Designation; the same shall thereupon be immediately suspended and the Council shall publish notice of and call an election upon the proposed Street Width Designation. Said election shall be held not less than thirty (30) days nor more than one hundred eighty (180) days after publication of the notice thereof. Only registered electors in the City Council district(s) immediately adjacent or contiguous to such street shall be eligible to vote on the proposed Street Width Designation. If a majority of the registered electors in the City Council district(s) immediately adjacent or contiguous to such street voting thereon vote for such proposed Street Width Designation, the proposed Street Width Designation shall be deemed approved. For purposes of ballot tabulation, the total votes of all electors who cast ballots from one or more City Council district(s) shall be counted together. If any provision of this Charter section or the application in any particular case, is held invalid, the remainder of this Charter section and its application in all other cases shall remain unimpaired. Anything in the Charter or ordinances of the City of Wheat Ridge in conflict or inconsistent with the provisions of this Charter section is hereby declared to be inapplicable to the matters and things covered and provided for by this Charter section. This Charter section shall take effect immediately upon passage.
