AVENUE,(CASE NO. WV-98-1) WITHIN THE CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO, ADJACENT TO 3294 PIERSON STREET
AND 3295 PARFET STREET
WHEREAS, right-of-way was previously dedicated for W. 33rd Avenue between Parfet
Street and Pierson Street; and
WHEREAS, said part of said W. 33`d Avenue lies within the City of Wheat Ridge,
County of Jefferson, State of Colorado, and a portion of the dedicated right-of-way is not needed
for pedestrian or emergency access.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The following portion of W. 33`d Avenue, a dedicated street within the City of
Wheat Ridge, County of Jefferson, State of Colorado, is hereby vacated to wit:
The northern 20 feet of Deffert Subdivision as recorded in the official records of
Jefferson County, State of Colorado at Plat Book 44, Page 38; and, the northern 20 feet of
Applewood Hills Subdivision as recorded in the official records of Jefferson County,
State of Colorado at Plat Book 95, Page 7.
Section 2. Vested Property Rights. Upon the vacation accomplished hereby, title to the
property vacated shall revert to the adjacent property owner of record pursuant to C.R.S. 43-2-30,
etc. seq.
Section 3. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power-of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or
the application thereof to any person or circumstances shall for any reason be adjusted by a court
of competentjurisdiction invalid, suchjudgment shall not affect application to other persons or
circumstances.
Section 5. Supersession Clause. If any provision, requirement or standard established by
this Ordinance is found to conflict with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which are in existence as of the date
of adoption of this Ordinance, the provisions, requirements and standards herein shall supersede
and prevail
Section 6. This ordinance shall take effect 15 days after final publication.

on this 13th day of April , 1998, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set

Regarding: Case UN-98-1 Vacation of Pedestrian Easement
Good Evening,
I live in the neighborhood of this easement and would like to make my feelings known. A family
commitment prevents me from appearing tonight. I am against vacating this easement because
the original use as intended by the developers and Planning Commissions of years past is still
needed and valuable for foot traffic in the neighborhood. In particular:
1. At the Planning Commission meeting in which this was discussed, the motion was to support
the vacation if the Jefferson County School District would agree to provide a permanent
pedestrian access from Parfet to Pierson across school property. If the school district did not
provide such a letter, then the Commission would not recommend the vacation. The School
District has not sent such a letter and has no interest in providing permanent public access across
school property, according to a telephone call my wife had with Mr. Don Cross of the School
District. For this reason alone the Commission is morally bound to recommend not vacating.
2. One of the biggest arguments presented at the Commission meeting is that the easement is not
currently in use by pedestrians. This is because for at least the last 6 years, to the best of my
recollection, there has been one or more fence across the easement. At present there is a 6' high
wood fence that prohibits foot traffic. In addition, the homeowners on the South side of the
easement have used the property as if it was private. Thus, the law-abiding neighborhood citizens
did not trespass and climb fences on what was perceived to be private property. It is morally
repugnant to me to think that the illegal act of fencing off a pedestrian easement will be rewarded
by vacating this easement.
3. At the Commission meeting both staff and Commission members stated they felt there was a
need for pedestrian access at this location. This wise statement reflects the care with which foot
traffic is attended by the City of Wheat Ridge. There seems to be no need for a street, but a
gravel footpath or similar would ease travel from the little island of Pierson and Quail Streets.
Not vacating the easement will not take anything away from the homeowners to the South, as the
easement has been in place since development started. The concrete masonry unit wall on the
North edge of 3295 N. Parfet, right at the South edge of the easement, indicates that the
homeowners understood the existence of the easement.

One of the goals of the Transportation Section of the Comp Plan is for adequate pedestrian
access, particularly on school routes. Jefferson County School District has already built a
pedestrian connection between Pierson and Parfet along the south side of the school. In 1998,
the City will build curb, gutter and sidewalk along Parfet Street from 32nd Avenue to 38th
Avenue as a capital improvements project. In spite of the proposed vacation, with
improvements in the area, Staff concludes that this objective will be met.
3. That the proposed vacation will not have a negative impact on the infrastructure of the
City of Wheat'Ridge.
Although most of utility companies did not respond to Staff `s referral, we feel it is important to
reserve the potential for future utility line installation in this area. Therefore, Staff recommends
a non-exclusive utility easement be reserved over the entire 20'.
4. That adequate easements have been reserved for use and/or maintenance by the City or
other utility agencies.
There is an existing street light adjacent to Parfet Street which appears to fall within this right-
of-way. If there are other existing utilities within the r-o-w being vacated, utility companies
would be allowed access for use and maintenance by way of easement reservation.

The property in question is zoned R-1 and measures 278.50' by 20'. Abutting the property are two
single family homes on the south and Prospect Valley Elementary School on the north. The right-of-
way is currently undeveloped but most of it has been incorporated into the adjacent yards to the south
by fencing. There is an existing street light within the right-of-way adjacent to Parfet Street.

Staff would note that at the time of the Planning Commission hearing, it was unclear as to whether this
sidewalk was fully completed, therefore, condition #3 was added to the motion. Subsequent
conversations with the school district and site inspections have confirmed that the connection is in
place. Staff believes that Condition #3 is unnecessary.

PUBLIC HEARING
A. Case No. WV-98-1: An application by the City of Wheat Ridge for approval of
a right-of-way vacation for property located at 33rd Avenue between Pierson &
Parfet Streets adjacent to 3294 Pierson Street and 3295 Parfet Street.
Ms. Reckert presented an overview of the case. She entered into the record the
Comprehensive Plan Zoning Ordinance case file, packet materials, and exhibits. The property
is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction by Planning Commission to hear this case. This is a City
initiated right-of-way vacation for a piece of land that has been reserved for pedestrian, fire
access and utility access between Pierson and Parfet. The access was never constructed and
the land is currently zoned R-1. This property runs adjacent to two single-family residences
and has been incorporated into their yards. This is 5500 square feet of land. The City recently
initiated code enforcement action due to the fact that the residences installed fences on this
right-of-way and were essentially blocking emergency/fire access. As the City proceeded
through the code enforcement action, it was determined with the help of the Wheat Ridge Fire
District, that there is not a need for emergency access at this location. Thus, the request for
right-of-way vacation. The Jefferson County School District has voiced no objection to the
request for vacation.
Ms. Reckert reviewed the criteria for evaluating a right-of-way vacation. She stated that staff
concludes that pedestrian access is to be constructed on school property, staff recommends
that a non-exclusive utility easement be reserved over the entire 20'. Ms. Reckert further
concluded that all of the evaluation criteria have been met in order to approve the vacation,
and that the vacated property should be vested with the property owners to the south.
Commissioner GOKEY asked if each of the properties already have constructed dwellings.
Ms. Reckert further explained the aerial slide, described the fence and explained that the
shadow being seen was a private storage shed that has since been removed pursuant to the
code enforcement action over the summer.
Commissioner THOMPSON asked a question about the proposed pedestrian path and where it
will be constructed and whether the connection would be straight.
Ms. Reckert explained that the right-of-way is the only straight, level portion of the parcel.
North of the right-of-way it dips down and possibly has a drainage detention area. There are
also several fairly large trees. An alternate location for the pedestrian access makes sense.
Commissioner SNOW asked what would happen if the school district changed its mind and

decided not to construct this pedestrian access.
Ms. Reckert explained that this concern was the reason for her pursuing contact with Jefferson
County Schools. She wanted the school district to know that the City was not going to support
the vacation unless the pedestrian path was built and that it needed to be done with the 1 st
phase of improvements. Ms. Reckert stated that if the Planning Commission recommended
approval of this vacation, she would get the commitment from Jefferson County Schools in
writing.
Commissioner SNOW suggested not making the vacation effective until the path is built. She
stated that the letter is not specific about the plans to build the path. She also asked about the
law in regard to giving the vacated property back to the owners.
Ms. Reckert responded that it depended on how it was dedicated. Her interpretation of the
vesting law was that it goes back to the property from which it was dedicated. Both parcels of
the right-of-way were dedicated from the property to the south. Therefore, it would vest back
with those properties.
Commissioner THOMPSON asked about the situation if the school became private property.
Ms. Reckert pointed out that there were no guarantees that a private owner wouldn't come in
and fence off any pedestrian access.
Commissioner BRINKMAN asked if the utility easement is enough to preclude that from
happening?
Ms. Reckert explained that the utility easement would allow the utility companies to come in
and do maintenance on the easement but would not allow general foot traffic.
Commissioner THOMPSON voiced concern and also pointed out that City Council is
concerned about vacating property because of its permanence.
Commissioner GOKEY asked if the area is presently used for any foot traffic. Ms. Reckert
responded that it is not used for foot traffic and that there is a fence.
Commissioner SNOW asked about when the fences were constructed?
Ms. Reckert stated that she is unsure when the fences were built. But that both property
owners were in the audience and could probably answer that question.
Commissioner THOMPSON asked for names of people signed up to speak. Ms. Reckert
explained that there is no one signed up to speak. But that the Fire Marshal was in the
Planning Commission

audience and the adjacent property owners were also in the audience.
Commissioner THOMPSON asked the Commission for questions or comments.
Commissioner WILLIAMS commented that this parcel has been dedicated for 24 years and
has not been used. He felt that it would make good sense to return it to the owners.
Commissioner THOMPSON asked for comments, from the land owners.
Commissioner THOMPSON swore in George Feeny and Laura Leprino of 3295 Parfet.
Commission asked questions regarding the fence, when it was constructed and about
pedestrian activity.
George Feeny and Laura Leprino responded to all of the questions, stating that the fence was
there when they moved into the house 3 years previous, and that there is minimal pedestrian
activity due to the size of the school yard. Ms. Leprino also stated that they would appreciate
the consideration of the Commission for this vacation because they are trying to be good
neighbors to the school but that they would also like to be able to control the parcel which
becomes a weed patch and a snake haven in the summer time.
Commissioner THOMPSON asked for further questions or comments.
Commissioner SNOW had the same question for the other home owner.
Commissioner THOMPSON swore in Augusta Faehnrich of 3294 Pierson.
Commissioner SNOW asked how long the fence had been on Ms. Faehmich's property?
Mrs. Faehmich stated that they put the fence up 20 years ago, but that it didn't extend as far as
the other fence. She then explained her concern with putting a sidewalk right by her bedroom
window.
Motion:
A motion was made by Commissioner SHOCKLEY, seconded by Commissioner WILLIAMS,

Commissioner SNOW asked for consideration of adding a condition that this does not become
effective until the school puts a walkway in.
Commissioner SHOCKLEY clarifies waiting until the City has it in writing from the school.
Discussion followed regarding the sidewalk, whether the school needs it or wants it, and
whether the City wants to give up the parcel if an access is never completed.
There was discussion of rewording the amendment and options. Commissioner SHOCKLEY
says yes until confirmation in writing is received.
Staff explained other options for the Commission to consider.
Commissioner SHOCKLEY added, " or until the City received confirmation from the school
district that the property would not be needed for a cut through or connecting sidewalk."
Commissioner THOMPSON asked a question regarding improvements paid for by the owners
and who would be responsible for reimbursement if the City did take it back what if the
property owners do a lot of improvements along there, and we decided that we wanted the 10
feet, do we reimburse them for the improvements or do they lose all of that money? Ms.
Reckert responded that it would be at the home owners risk.
Discussion continued on the need for a sidewalk connection and whether vacation was
advisable or not possible for a future consideration.
Commissioner THOMPSON asked for additional discussion. There being none, she called for
a vote.
Motion carried 7-0
Commissioner THOMPSON relayed to the audience that the vacation was approved, but that
the Commission was asking R-1 school district to respond in writing within 60 days to the
City, that they will in fact put a pedestrian path onto the school property. If they respond and
state that they will not put the path in, then the vacation will not be approved. It will also go
to City Council for final approval.

This letter is a Fire District request that the City of Wheat Ridge vacate the Fire Lane that
exists on the south property line of Prospect Elementary, 3400 Pierson St., Wheat Ridge,
Colorado. Please be advised that the fire lane exists between Pierson Street on the West and
Parfet Street on the east. Do to the expansion and redesign of the elementary school, the fire lane
is no longer useable and is no longer necessary. It would be beneficial to all parties concerned for
the City to vacate the aforementioned property.

Dear Bob:
Jefferson County R-1 School District does not object to vacation of the referenced Right of Way.
It is not anticipated that an improved drive through this ROW would be of significant benefit to
the District. The site master plan for the school indicates an improved walkway through this
ROW. However other routes can be provided for access to the school and a walkway at this
location is not considered necessary. Without evidence of other benefits to the District, we could
not recommend that the District participate in the cost of constructing a drive in this location.

AVENUE (CASE NO. WV-98-1) WITHIN THE CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO, ADJACENT TO 3294 PIERSON STREET
AND 3295 PARFET STREET
WHEREAS, right-of-way was previously dedicated for W. 33`d Avenue between Parfet
Street and Pierson Street; and
WHEREAS, said part of said W. 33`d Avenue lies within the City of Wheat Ridge,
County of Jefferson, State of Colorado, and a portion of the dedicated right-of-way is not needed
for pedestrian or emergency access.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The following portion of W. 33rd Avenue, a dedicated street within the City of
Wheat Ridge, County of Jefferson, State of Colorado, is hereby vacated to wit:
The northern 20 feet of Deffert Subdivision as recorded in the official records of
Jefferson County, State of Colorado at Plat Book 44, Page 38; and, the northern 20 feet of
Applewood Hills Subdivision as recorded in the official records of Jefferson County,
State of Colorado at Plat Book 95, Page 7.
Section 2. Vested Property Rights. Upon the vacation accomplished hereby, title to the
property vacated shall revert to the adjacent property owner of record pursuant to C.R.S. 43-2-30,
etc. seq.
Section 3. Safety Clause. The City Council hereby finds, determines, and declares that
this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it
is promulgated for the health, safety, and welfare of the public and that this ordinance is
necessary for the preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this Zoning Code or
the application thereof to any person or circumstances shall for any reason be adjusted by a court
of competent jurisdiction invalid, such judgment shall not affect application to other persons or
circumstances.

This letter is in regard to a right-of-way vacation being considered by the City of Wheat Ridge
for a portion of West 33rd Avenue extended just south of the Prospect Valley Elementary School
(Wheat Ridge Case No. WV-98-1).
This case was heard by Planning Commission at a meeting held on January 8, 1998. Planning
Commission recommended approval of the vacation with conditions. One of the conditions was
that the case not be forwarded to City Council until written confirmation is received from the
school district that the pedestrian access around the south side of the school will be built with
the first phase expansion. The previous correspondence from Donald Oatman dated August 20,
1997, indicated no objections to the vacation but didn't specifically address alternate pedestrian
access around the school. Attached please find a copy of the minutes from the January 8 public
hearing.
By this writing, please respond as to the timing for construction of the sidewalk improvements
around the school. If the school district cannot commit to construction within a reasonable tine
frame, Staff will be recommending denial of the request.

7. PUBLIC HEARING
A. Case No WV-98-1: An application by the City of Wheat Ridge for approval of
a right-of-way vacation for property located at 33rd Avenue between Pierson &
Parfet Streets adjacent.to 3294 Pierson Street and 3295 Parfet Street.
Ms. Reckert presented an overview of the case. She entered into the record the
Comprehensive Plan Zoning Ordinance case file, packet materials, and exhibits. The property
is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction by Planning Commission to hear this case. This is a City
initiated right-of-way vacation for a piece of land that has been reserved for pedestrian, fire
access and utility access between Pierson and Parfet. The access was never constructed and
the land is currently zoned R-1. This property runs adjacent to two single-family residences
and has been incorporated into their yards. This is 5500 square feet of land. The City recently
initiated code enforcement action due to the fact that the residences installed fences on this
right-.of--way and were essentially blocking emergency/fire access. As the City proceeded
through the code enforcement action, it was determined with the help of the Wheat Ridge Fire
District, that there is not a need for emergency access at this location. Thus, the request for
right-of-way vacation. The Jefferson County School District has voiced no objection to the
request for vacation.
Ms. Reckert reviewed the criteria for evaluating a right-of-way vacation. She stated that staff
concludes that pedestrian access is to be constructed on school property, staff recommends
that a non-exclusive utility easement be reserved over the entire 20'. Ms. Reckert further
concluded that all of the evaluation criteria have been met in order to approve the vacation,
and that the vacated property should be vested with the property owners to the south.
Commissioner GOKEY asked if each of the properties already have constructed dwellings.
Ms. Reckert further explained the aerial slide, described the fence and explained that the
shadow being seen was a private storage shed that has since been removed pursuant to the
code enforcement action over the surnmer.
Commissioner THOMPSON asked a question about the proposed pedestrian path and where it
will be constructed and whether the connection would be straight.
Ms. Reckert explained that the right-of-way is the only straight, level portion of the parcel.
North of the right-of-way it dips down and possibly has a drainage detention area. There are
also several fairly large trees. An alternate location for the pedestrian access makes sense.
Commissioner SNOW asked what would happen if the school district changed its mind and
decided not to construct this pedestrian access.

Ms. Reckert explained that this concern was the reason for her pursuing contact with Jefferson
County Schools. She wanted the school district to know that the City was not going to
support the vacation unless the pedestrian path was built and that it needed to be done with the
1 st phase of improvements. Ms. Reckert stated that if the Planning Commission
recommended approval of this vacation, she would get the commitment from Jefferson
County Schools in writing.
Commissioner SNOW suggested not making the vacation effective until the path is built. She
stated that the letter is not specific about the plans to build the path. She also asked about the
law in regard to giving the vacated property back to the owners.
Ms. Reckert responded that it depended on how it was dedicated. Her interpretation of the
vesting law was that it goes back to the property from which it was dedicated. Both parcels of
the right-of-way were dedicated from the property to the south. Therefore, it would vest back
with those properties.
Commissioner THOMPSON asked about the situation,if the school became private property.
Ms. Reckert pointed out that there were no guarantees that a private owner wouldn't come in
and fence off any pedestrian access.
Commissioner BRINKMAN asked if the utility easement is enough to preclude that from
happening?
Ms. Reckert explained that the utility easement would allow the utility companies to come in
and do maintenance on the easement but would not allow general foot traffic.
Commissioner THOMPSON voiced concern and also pointed out that City Council is
concerned about vacating property because of its permanence.
Commissioner GOKEY asked if the area is presently used for any foot traffic. Ms. Reckert
responded that it is not used for foot traffic and that there is a fence.
Commissioner SNOW asked about when the fences were constructed?
Ms. Reckert stated that she is unsure when the fences were built. But that both property
owners were in the audience and could probably answer that question.
Commissioner THOMPSON asked for names of people signed up to speak. Ms. Reckert
explained that there is no one signed up to speak. But that the Fire Marshal was in the
audience and the adjacent property owners were also in the audience.
Commissioner THOMPSON asked the Commission for questions or comments.

Commissioner WILLIAMS commented that this parcel has been dedicated for 24 years and
has not been used. He felt that it would make good sense to return it to the owners.
Commissioner THOMPSON asked for comments from the land owners.
Commissioner THOMPSON swore in George Feeny and Laura Leprino of 3295 Parfet.
Commission asked questions regarding the fence, when it was constructed and about
pedestrian activity.
George Feeny and Laura Leprino responded to all of the questions, stating that the fence was
there when they moved into the house 3 years previous, and that there is minimal pedestrian
activity due to the size of the school yard. Ms. Leprino also stated that they would appreciate
the consideration of the Commission for this vacation because they are trying to be good
neighbors to the school but that they would also like to be able to control the parcel which
becomes a weed patch and a snake haven in the summer time.
Commissioner THOMPSON asked for further questions or comments.
Commissioner SNOW had the same question for the other home owner.
Commissioner THOMPSON swore in Augusta Faehnrich of 3294 Pierson.
Commissioner SNOW asked how long the fence had been on Ms. Faehmich's property?
Mrs. Faehmich stated that they put the fence up 20 years ago, but that it didn't extend as far as
the other fence. She then explained her concern with putting a sidewalk right by her bedroom
window.
Motion:
A motion was made by Commissioner SHOCKLEY, seconded by Commissioner
WILLIAMS, that case number Case No WV-98-1: A request for approval of a right-of-way
vacation for property located at 33rd Avenue between Pierson & Parfet Streets be approved
for the following reasons:
It is not needed for emergency vehicle access.
The pedestrian connection between Pierson and Parfet will occur on school
district property.
The evaluation criteria support approval.
With the following conditions:
1. A non-exclusive utility easement be reserved over the entire 20 feet.
2. Vesting occur with the property owners to the south.

Commissioner. SNOW asked for consideration of adding a condition that this does not become
effective until the school puts a walkway in.
Commissioner SHOCKLEY clarifies waiting until the City has it in writing from the school.
Discussion followed regarding the sidewalk, whether the school needs it or wants it, and
whether the City wants to give up the parcel if an access is never completed.
There was discussion of rewording the amendment and options. Commissioner SHOCKLEY
says yes until confirmation in writing is received.
Staff explained other options for the Commission to consider.
Commissioner SHOCKLEY added, " or until the City received confirmation from the school
district that the property would not be needed for a cut through or connecting sidewalk."
Commissioner THOMPSON asked a question regarding improvements paid for by the owners
and who would be responsible for reimbursement if the City did take it back what if the
property owners do a lot of improvements along there, and we decided that we wanted the 10
feet, do we reimburse them for the improvements or do they lose all of that money? Ms.
Reckert responded that it would be at the home owners risk.
Discussion continued on the need for a sidewalk connection and whether vacation was
advisable or not possible for a future consideration.
Commissioner THOMPSON asked for additional discussion. There being none, she called for
a vote.
Motion carried 7-0
Commissioner THOMPSON relayed to the audience that the vacation was approved, but that
the Commission was asking R-1 school district to respond in writing within 60 days to the
City, that they will in fact put a pedestrian path onto the school property. If they respond and
state that they will not put the path in, then the vacation will not be approved. It will also go
to City Council for final approval.
B. Case number 7OA-97-4: An application by the City of Wheat Ridge for
approval of an amendment to section 26-6(B) of the Wheat Ridge Code of laws
relating to special uses.
Alan White explained that this is something that was in the works when he came on board
with the City of Wheat Ridge. He gives an overview of the proposed amendment, explaining
that what this proposed amendment does is create two categories of special use approval: 1)
Land Vested, and 2) Owner Grant of Use. He explained that the concept of the two is simple.

I. REQUEST
This request is a City-initiated right-of-way vacation for an unneeded parcel of land located at
West 33rd Avenue extended between Pierson and Parfet.
The property in question is zoned R-1 and measures 278.50' by 20'. Abutting the property are
two single family homes on the south and Prospect Valley Elementary School on the north. The
right-of-way is currently undeveloped but most of it has been incorporated into the adjacent
yards to the south by fencing. There is an existing street light within the right-of-way adjacent to
Parfet Street.
The right-of-way was dedicated by two separate subdivision approvals. Attached under Exhibits
`A' and `B' are reductions of these plats. The western half was dedicated 35' in width for
roadway purposes by the Deffert Subdivision platted in 1974. A subsequent partial vacation of
the southern 15' occurred in 1987, leaving 20' in place. See Exhibit `C'. The eastern half was
dedicated pursuant to the Applewood Hills Subdivision (Case No. WS-87-1). This right-of-way
was 20' wide and reserved for utilities, pedestrian and emergency access.
The City had recently initiated Code Enforcement action to get the fences moved off the right-
of-way for emergency access. The Wheat Ridge Fire Protection District requested the City to
pursue vacation of the right-of-way instead as emergency vehicle access is not needed at this
location. See correspondence from WRFPD included under Exhibit `D'.
The Jefferson County School District supports approval of the vacation. See attached Exhibit `E'.
In their Phase II Master Plan for the school, a pedestrian path is shown running inside their
property line just to the north of the land being vacated. The path construction will occur in
1999 at thier expense.
The City of Wheat Ridge gave up the possibility for any future street connection for 33rd Avenue
between Pierson and Parfet in 1987 when the Applewood Hills Subdivision was approved and
the partial vacation to the west. City staff feels strongly that there needs to be a pedestrian
connection at this location. Staff supports the vacation as long as the path is built by Jefferson
County.
II. VACATION EVALUATION CRITERIA
Before street right-of way vacation is approved the applicant shall show and the Planning
Commission and City Council shall make the following determinations:
1. That the proposed vacation will not leave any adjoining land without an established
public road connecting said land with another established public road.
All adjacent, potentially affected properties have access from Parfet or Pierson, therefore, no
properties would be landlocked as a result of the vacation.
2. That the proposed vacation is in conformity with the goals and policies of the
Transportation Section of the Comprehensive Plan of the City of Wheat Ridge.
One of the goals of the Transportation Section of the Comp Plan is for adequate pedestrian
access, particularly on school routes. Jefferson County School District will be building a
pedestrian connection between Pierson and Parfet. In 1998, the City will build curb, gutter and
sidewalk along Parfet Street from 32nd Avenue to 38th Avenue as a capital improvements
project. In spite of the proposed vacation, with improvements in the area, Staff concludes that
this objective will be met.
3. That the proposed vacation will not have a negative impact on the infrastructure of the
City of Wheat Ridge.
Although most of utility companies did not respond to Staff's referral, we feel it is important to
reserve the potential for future utility line installation in this area. Therefore, Staff recommends
a non-exclusive utility easement be reserved over the entire 20'.
4. That adequate easements have been reserved for use and/or maintenance by the City or
other utility agencies.
There is an existing street light adjacent to Parfet Street which appears to fall within this right-of-
way. If there are other existing utilities within the r-o-w being vacated, utility companies would
be allowed access for use and maintenance by way of easement reservation.
Staff concludes that the criteria used to evaluate a right-of-way vacation support approval of the
request.
III. AGENCY REFERRALS
Public Works will support the vacation as long as a pedestrian connection occurs between
Pierson and Parfet on the school property and if a utility easement is reserved.
Wheat Ridge Fire Protection District does not need the right-of-way for emergency access.
WRFPD requested that the vacation be initiated.
Jefferson County R-1 Schools does not object to the vacation.
IV. STAFF CONCLUSIONS
Staff concludes that the right-of-way is not needed for emergency vehicle access and that a
pedestrian connection between Pierson and Parfet will occur on the school district's property.
Staff further concludes that the evaluation criteria support approval of this request. For these
reasons, a recommendation of Approval is given for Case No. WV-98-1 with the conditions that
a non-exclusive utility easement be reserved over the entire 20' and the vacated property vest
with the property owners to the south.
V. RECOMMENDED MOTIONS
Option A: "I move that Case No. WV-98-1, a request for approval of a right-of-way vacation for
West 33rd Avenue extended between Pierson Street and Parfet Street, be APPROVED for the
following reasons:
1. It is not needed for emergency vehicle access.
2. A pedestrian connection between Pierson and Parfet will occur on school district
property.
3. The evaluation criteria support approval.
With the following conditions:
1. A non-exclusive utility easement be reserved over the entire 20'.
2. Vesting occur with the property owners to the south."

Section 1. Upon application by Josef and Augusta Faehnrich for

WV-87=l and upon recommendation for approval from the Wheat Ridge
Planning Commission; and purs,aantto findings made based upon

Dear Glen,
This letter is a Fire District request that the City of Wheat Ridge vacate the Fire Lane that
exists on the south property line of Prospect Elementary, 3400 Pierson St., Wheat Ridge,
Colorado. Please be advised that the fire lane exists between Pierson Street on the West and
Parfet Street on the east. Do to the expansion and redesign of the elementary school, the fire lane
is no longer useable and is no longer necessary. It would be beneficial to all parties concerned for
the City to vacate the aforementioned property.

Dear Bob:
Jefferson County R-I School District does not object to vacation of the referenced Right of Way.
It is not anticipated that an improved drive through this ROW would be of significant benefit to
the District. The site master plan for the school indicates an improved walkway through this
ROW. However other routes can be provided for access to the school and a walkway at this
location is not considered necessary. Without evidence of other benefits to the District, we could
not recommend that the District participate in the cost of constructing a drive in this location.

Executive Summary
Prospect Valley Elementary School was originally constructed in 1967 as an open classroom
facility with a capacity of 351 students. The school was later modified in 1986 and
transformed into a more traditional classroom organization. Enrollment for the 1995-96
school year is 430 students, and is expected to remain stable for the next four years. The
Jefferson County School District retained HumphriesPoliArchitects, P.C. to prepare a site
assessment and site master plan report for the school site. The design firm also prepared
construction drawings for a new four classroom addition to be constructed in 1996.
HumphriesPoliArchitects conducted a site inventory and analysis and met with Jefferson
County School District staff to create a program of proposed site improvements. Two
preliminary site plans were prepared and presented to School District staff and the Design
Advisory Group and Parent/Teachers Association representatives for comments and
feedback. A final illustrative site master plan indicating three phases of development with an
estimate of probable construction costs was then prepared with recommendations for
prioritized site improvements.
The immediate need at Prospect Valley Elementary School is to :
construct new and safer play areas.
reorganize the vehicular circulation and parking system to improve student safety.
The Jefferson County School District has indicated it will match a $25,000 grant from the City
of Wheat Ridge to construct the new play structure in 1996. The City of Wheat Ridge has
also agreed to contribute $100,000 to site improvements in 1997 which will also reportedly
be matched by the School District. This latter funding has not been designated for specific
improvements. However, it is acknowledged the entire scope of improvements proposed by
this Masterplan exceeds those available monies.
Recommended site improvements to be funded through these and other sources include:
reorganize vehicular circulation and parking system.
new landscaping along the perimeter of the site in addition to upgrading current
landscaped areas.
• provide wheelchair accessibility to the lower play fields.
new irrigation system.
expand/upgrade playfields.
• drainage improvements.
• enhance student drop-off and service area.
Introduction
Background
Prospect Valley Elementary School opened in 1967. The original school featured an open
classroom module on the west end of the building with a multipurpose/lunchroom/gymnasium
on the east end of the building. The facility was renovated in 1986 to provide a traditional
closed classroom setting. A four classroom addition commenced construction in the spring
of 1996 located adjacent to the multipurpose portion of the building. There are currently two
temporary buildings on the site, one of which is to provide space during the construction of
the additional classrooms. Enrollment for the 1995-96 school year is 430 students, and is
expected to remain stable for the next several years.
The site master plan study is being completed to identify site improvements for the
schoolgrounds. Other planned improvements include renovation and upgrade to the
building's mechanical, air conditioning, plumbing and electrical systems.
The 8.3 acre school site is located at West 33rd Avenue bounded by Parfet Street on the east
and Quail Street on the West. It is bordered on the east, south and west sides with
residential developments. The land to the north has been designated for open space. The
main entry and vehicular access is from Pierson Street connecting to West 32nd Avenue,
the primary east/west artery. A parking area of approximately 39 spaces is located
southwest of the school off 33rd Avenue. This area also serves as the bus drop-off/pick up
area. Currently the school is served by two school buses and approximately four day-care
vans. Most of the students walk or are brought to school in private vehicles. Service access
to the facility is off Parfet Street. The site is approximately 20% smaller than typically planned
for an elementary school of this size.
In investigating the original design documents for the school it is interesting to note the site
improvements were substantially altered during the final stages of the design. The original
site drawings illustrate a student drop-off zone on the western edge of the site off Quail St.
and two parking areas, one to the north and one to the south of the multi-purpose facility. It
is unknown why this site layout was not pursued. However, it appears that many of the
current vehicular circulation patterns would have been minimized had this original concept
been implemented. Due to subsequent site development it is not feasible to pursue this
concept at this time.
Master Plan Process
The Jefferson County School District retained HumphriesPoliArchitects, P.C. to prepare a site
assessment and Master Plan Report for Prospect Valley Elementary School as a part of the
architect's contract to design the four classroom addition. The Site Master Plan will identify
site problems, opportunities and design solutions that can be implemented over time by the
School District for the improvement of the school site.
HumphriesPoliArchitects began the process by conducting an inventory of site features such
as vehicular and pedestrian circulation, drainage, the condition of existing walks, paving,
accessibility issues for physically and sensory impaired, and adjacent land uses. This
inventory was then used as a base for a Site Inventory and Analysis Plan which identifies site
problems and opportunities. This plan was presented to staff members of the School District
and representatives of the PTA and Design Advisory Group for comments and feedback.

contacted for comments and feedback. This information was utilized to create a list of
proposed site improvements.
Two preliminary site plans were prepared showing alternative design solutions to solve
problems identified earlier. The site plans were presented to staff of the School District and
representatives of the PTA and Design Advisory Group for comment and feedback. A final
illustrative site master plan illustrating three phases of development with an estimate of
probable construction costs was then prepared with recommendations for prioritized site
improvements.
Site Inventory and Analysis
Information about existing site conditions was compiled from site visits and discussions with
parents, teachers, various agencies and the Design Advisory Group. A boundary and
topographic survey base map was prepared by C. R: Moore Land Surveying. A site
inventory and analysis was conducted for the Prospect Valley Elementary School site. The
results of the analysis are described below and and shown on the Site Inventory and
Analysis Plan.
Site Condition Survey
The school grounds and parking areas have served well over the years, but there is a need
for rehabilitation and upgrading of many of the facilities. Primary concerns are listed below.
Parking and Circulation
• Significant conflict exists between busses and vehicles picking up and
dropping off children around the school.
Poorly defined travel routes, insufficient parking areas and drop-off areas
create potential for accidents.
Asphalt pavement is generally in fair condition with minor to significant
cracking and alligatoring.
Existing access does no meet ADA guidelines.
Chain link fences are in good condition.
Concrete pavement and curbs are in fair to good condition with occaisional
cracking and minor settling and displacement.
The existing bike parking area at the southwest corner of the site should be
closer to the school entrance and visually improved.
Main Entry
Landscape areas are in good condition with a manual irrigation system.
Plant materials need selective pruning.
Concrete pavement is generally in good condition with minor cracking and
weathering.
The entry will be upgraded as a part of the new classroom addition and will
comply with ADA standards.
Service Area
Asphalt pavement is in fair condition with minor alligatoring.
Concrete curbs are in fair to good condition with occaisional cracking and
minor displacement.
Service area is not large enough to accomodate vehicles without excessive
movements.
Trash enclosures are in fair condition.
Landscaping area next to buidling wall create maintenance difficulties and
potential drainage problems against the building.
Play Pads
Asphalt pavement is in fair condition with minor alligatoring.
Play equipment is in satisfactory condition.
Timber edging between grass areas and asphalt pavement need minor
repairs.
Apparatus Area
Gravel surface is inconsistent in depth exposing equipment foundations in
several areas.
Apparatus area is not ADA accessible.
Play structures are illustrate age but are in satisfactory condition with the
exception of the wood climbing structure.
Gravel play surface does not provide an adequate safety buffer at swings.
Grass adjacent to play equipment is worn with minimal a manual irrigation
system. Appropriate edging between the two areas does not exist.
Existing slide faces northwest absorbing hot afternoon sun resulting in skin
burns.
Grass Playfields
Quality of the playfields is substandard due to an uneven ground surface
and weed patches.
Lack of mowing strips along the fence make maintenance difficult.
Access to the lower playfields for maintenance equipment is awkward.
Area requires manual irrigation.
Existing soccer fields are not regulation size.
Access from the upper playfields does not comply with ADA.
Other
The open space along the southern edge of the site has been taken over
by adjacent property owners and fenced off.
Parent pick-up area for kindergarten students does not exist.
Improvement were recenty made to drainage problems in the area south of
the multipurpose room. However, it appears from evaluating the existing
survey conditions the slope of the drainage pipe is minimal and should be
lowered to provide more positive drainage.
Parking for the soccer practice fields is limited. The City of Wheat Ridge will
not sanction league games to occur due to parking concerns.

3. Site Improvements
A. Drainage: The site improvements will be designed to drain positively to the existing storm
sewer system. Existing drainage problem areas should be improved by cleaning out existing
storm sewers, redirecting flows away from walks and the building, and connecting roof
drains to the storm sewer system.
B. Landscaping: Low water type sod or seed should be installed at the playfields and the
new landscape areas which act as a continuation of the "front yard". Native drought-
resistant grasses and plant materials should be installed at the rest of the site. Steep slopes
and swales subject to erosion must comply with R-1 technical specification. A complete,
fully automatic, underground irrigation system should be provided for all playfields, lawns
and planting areas. Quick connect hose couplers should be included to allow for remedial
watering. Plantings shall be used to extend the "front yard" of the school and also to visually
improve the new bus drop-off area.
C. Fencing: The damaged chain link fencing should be removed, repaired, and reset with
a concrete mowing strip. The existing backstops will be retained.
Site Master Plan
Site Master Plan- Phase 1
Phase 1 of the Site Master.Plan is essentially the development of two new play areas on
the west side of the site. The following summarizes the development of this phase:
The first development is a new play structure related site development proposed
between the Primary and Intermediate play pads. The new play area is to be an
accessible play area and replaces the existing wood play structure. A new sidewalk
will connect the play area with the existing play pods. The actual design of this play
area is being coordinated by staff and parents.
The second component of this Phase is the development of a new "TeenCluster".
This play area is intended to facilitate play activities for older children who find that
traditional playgrounds are no longer cool. The structure has been developed by
Landscape Structures ( a firm specializing in the design and construction of play
equipment) and offers teens the opportunity to socially interact and be part of a
larger group. The development of this play structure is also being coordinated by
staff and parents. (Refer to the diagram included in the Appendix).

Site Master Plan- Phase 2
Phase 2 of the Site Master Plan is essentially the re-development of the landscape features
on the site. The work can be summarized in the following fashion:
The development of a new soccer field 150' x 300' on the northern portion of the
site. The proposed field crosses the area used for the two practice fields and will
include portable goals.
The development of a ramp from the upper school yard to the lower playfield to
provide ADA accessibility to the playfields.
New sidewalk and gates along Quail Street. This development will provide safer
access to the playfields from the west and allow for additional parent drop-off zone
on Quail Street.
New sidewalk and gates along Parfet Street. This construction will provide safer
access to the school for children living to the north and also provide maintenance
access to the lower playfields from Parfet Street.
The development of a new sidewalk along the "pedestrian open space" at the
southern edge of the site. This work will offer a pedestrian connection between
Pierson Street and Parfet Street. The existing area has been enclosed by a fence
by the adjacent home owners. The area is presently being used for storage of
construction materials and recreational vehicles. This new development will
provide an enhanced visual buffer between this residential development and the
school.
New landscaping around the playground area on the western, southwestern and
northwestern edges of the site. This development will provide a wind break to play
areas from the northwest winter winds and offer a visual buffer from the residential
development along Quail Street.
Re-development of the playground apparatus areas. This work will include the
specification of an appropriate base material under the apparatus and
reconditioning of the equipment. It is not anticipated that new equipment beyond
the new play structures proposed in Phase 1 will be required. New edging between
the landscape areas and apparatus areas will be included in this work.
Re-development of the grass landscape areas. This will include the installation of
bluegrass sod in the areas near the school and the installation of native drought
resistant grass in the playfields to the north. A fully automated irrigation system for
all landscape areas will be included in this work.

Site Master Plan- Phase 3
Phase 3 of the Site Master Plan is essentially the re-development of parking, drop-off and
service areas for the school. The work can be summarized in the following fashion:
Revising the parking lot configuration on the south edge of the site. The existing
configuration consists of 39 parking spaces and includes the bus drop-off area with
extremely tight maneuvering space. The revised configuration will provide 43
parking spaces and relocation of the bus drop-off area to the east edge of the site.
A landscape buffer and sidewalk along 33rd Avenue is included as a part of the
scope of this work.
The creation of a parent waiting zone for the kindergarten pick-up. This
development will include landscape improvements with benches adjacent to the
kindergarten classroom entrance.
Relocation of the bike parking area. There are currently two bike parking areas- a
secured area in the southwest corner of the site adjacent to the existing
parking/drop-off zone; and an open area to the north of the multi-purpose room.
The consolidation of the bike parking area will provide easier supervision and
separation from the auto parking area for safety purposes.
The creation of a new bus drop-off area on the east edge of the site. The area will
facilitate two full size school buses and vans from daycare providers. A new service
area will also be included separate from the bus drop-off zone. The re-configuration
of the service area will necessitate re-construction of the existing storage shed.

Elementary Site Development Standards
1. Gene-al
Si'e development should allow for maximum utilization of passive solar
design alternatives - both for structures and site amenities - minimize
northern exposure and building shading of main site circulation routes and
amenities.
The building and site amenities should generally follow existing
contours so that all building exits are on grade.
For security reasons, configure the building to minimize areas not exposed
to general public view.
School District Standards suggest a site of ten (10) developable acres is
adequate for an elementary school.
2. Site Components
A. Program Site Facilities
a. Bus loading. Number of buses varies widely. Average = 8
b. Auto parking - 1 paved staff/visitor space per 10 students
65). Increase capacity up to 100 autos at sites
where adjacent off-street parking is unavailable. Ratio stalls
for the disabled according to applicable regulations.
c. Outdoor school community area - Provide seating and wind screening
whenever possible. Seating for up to 100 students may be
retaining walls or raised planters.
d. Bike pad and enclosure = 1,000 sq. ft. Omit or reduce at sites
with no sidewalks or limited potential for bicycle travel.
e. Ecology area - Natural streams and drainage areas, rock
outcroppings, native grass and trees for student study and passive

Where no natural area exists, construct with plantings and
fencing. This area may be off-site and not require development.
f. Temporary classroom area - Most schools will be overcrowded for a
period of years sometime during their useful life. This is
alleviated by the use of 24' x 40' temporary relocatable wood
frame classroom buildings.
Provide space for four to eight such buildings and direct access
for moving buildings in and out with minimal disturbance to site
improvements.

3. Site Relationship
A. The building and grounds should be arranged to provide maximum safety
and visual observation of all site components.
B. Main school entrance should be adjacent to and visible from the
parking lot. Ideally, the parking lot, bus unloading and loading
area, parent/visitor unloading/loading area should all be separate.
Good visual supervision of these areas from the office area is
essential.
C. Locate bicycle enclosure to maximize supervision and safety.
0. A separate service drive to the kitchen and outside equipment storage
should be provided to minimize vehicular conflict in the student
loadinq/unloading area.
E. After-hour facilities such as gymnasium and performance areas should
have direct lighted access to the parking lot.
F. Areas adjacent to the educational areas should be reserved for
playground activities (the closer to the building the more passive the
play). General playfields should be located far enough away from the
building to prevent accidental damage to window areas and landscaping.I
G. Locate P.E. fields directly accessible to gymnasium with concern for:
(1) noise generated and its effect on building users and neighbors,
(2) minimizing errant balls landing on neighbor's property, parking
lots, building roofs and window areas.
(3) traffic flow between gymnasium, cafeteria, and playfields

a Orient and group Temporary Classrooms to minimize distances to core
and support facilities. To the greatest extent possible, Temporary
Classrooms are to function as permanent instructional areas.
J. Locate and landscape temporary classroom areas to minimize visual
impact on adjacent residential properties.
a. Site Circulation
A. Site safety is paramount. Intersections between pedestrian, bicycle
and vehicular traffic should be minimized.
B. Pathways and/or sidewalks are required to connect all building exits
with fire refuge areas, parking lots, bike enclosures, service areas,
play pads, site pedestrian access points and along street frontages.
C. Bus loading: off-street with counterclockwise circulation.
0. Design site to provide access for service and deliveries to the
kitchen/cafeteria, office, custodial facilities, gymnasium and P.E.
fields and structures. Delivery vehicles need a turn-around space to
avoid long backing distances. Trash compactor trucks require a
concrete loading pad with minimum grade and no curbs. Trash trucks
will back up to trash area.
E. Barrier-free accessability is required for all site amenities.
5. Site Imorovements
A. Drainage - Discharge over sidewalks is prohibited. Provide necessary
site drainage improvements as required by design concept. Where
quantities of water are discharged to earth surfaces, provide
structures to control erosion. Conduct to storm drains where
possible.
Protect headwalls by appropriate planting or structures for safety.
When required by governing agencies, prepare storm drainage studies.
On-site retention ponds should be avoided, to the greatest extent
possible.
B. Landscaping - Turf grasses or sod are restricted to designated play
fields and high traffic areas.
Native drought-resistant grasses and plant materials (xeriscape) are
preferred for unpaved decorative, non-assigned and utility areas of
the site.
Steep slopes, embankments, and.swales subject to erosion mus comply
with R-1 Technical Specifications.
Provide a complete, fully automatic, underground irrigation system
to cover all playfields, lawn and planting areas. Also provide quick-
connect hose couplers to allow for remedial waterinq.
Elementary Site Development Standards
On sites where irrigation water rights exist, develop the system
to utilize these right to the fullest extent possible.
Provide a complete landscape design.
Plantings such as shade and ornamental trees, shrubbery and ground
criers shall be used judiciously to provide shading, visual screeninc
and wind protection for the building and to place the site in harmon;
with the community. Plantings shall be of such type and size to
survive the school environment and require minimal care.
C. Fencing - In general, chain link fencing is required at all property
lines and adjacent to existing or future private development (usually
residential) and those portions of active playground adjacent to
street frontages or parking areas. Fencing is usually not required
where school property abuts public park land.
Fencing is required to prevent student movement through private
property, to prevent dangerous accidental running into hazardous
areas, to restrict foot traffic up steep banks, control balls from
rolling down banks and to prevent access of horses and non-authorizec
motor vehicles to the play fields.
Pedestrian access ways are required to public use of the grounds,
however, these access ways shall be protected by free standing fencir
posts spaceU4 to prevent entry by horses and motor vehicles. Gates ai
required for passage of grounds equipment, service vehicles and snow
plows.
Consider use of ornamental wood fencing for site-specific purposes
such as to protect planting and lawn areas from damaging foot traffic
D. Miscellaneous Items - Incorporate into the site plan a flagpole,
benches for informal seating in patios and at main entrances,
firefiweather resistant and non-portable trash receptacles at main
building entrances, and a sturdy masonry, concrete or wood timber
enclosure for meters, transformers and trash dumpsters.
Provide signage for building identification, direction and traffic
control.
