As of this writing, we still have not received mylars of the official development plan for recording with the Jefferson County Recorders' Office. A Certificate of Occupancy for the building will not be issued until plan recording is completed Prior to submission of the mylars, please make changes to the document as specified below: 1. Add the following note: "Adequate parking for employees must be provided at a rate of one space per 1,000 square feet of lot area, plus one space per employee on maximum shift.". 2. Add the following note: "Lighting shall be shielded to minimize effects on nearby residential properties.". 3. Loading areas be designated. 4. The cross access points with the property to the east be specified north and south of the building envelope for building B. Please include the following note on the front sheet: "The owner, his successors or assigns grants limited rights and privilege of access to, and free movement through those areas indicated as "Cross access easements" with the property to the east.". 5. Add the following note: "Construction and/or employee parking shall be allowed on Parfet Street only during construction and shall be limited to the area between the I-70 Frontage Road north to the northern driveway of the carlot on Parfet. No parking shall be allowed adjacent to the existing residences on the east side of Parfet Street. Any additional access to the carlot on the west side of Parfet shall be located south of the existing residential properties on the east side of the street a distance of at least 30'.". 6. Please designate the right-of-way vacation as being vacated by Ordinance No. 1126 (Case No. WV-98-02). 7. Please be aware of the following items regarding the construction of the project: 1. The proposed drainage facilities shall be constructed and approved by the City of Wheat Ridge prior to issuance of the Certificate of Occupancy. 2. Erosion control for the project shall be placed in conformance with the approved drainage/erosion control plan and shall be maintained as needed during the course of construction. 3. All drainage improvements shall be constructed in conformance with the approved drainage report and plan. 4. It will be the responsibility of the contractor for the project to repair any damage to the existing public improvements on I-70 North Frontage Road as a result of related construction traffic in the area. Also, the contractor will be responsible for maintaining the I-70 North Frontage Road on a regular basis such they it is free of construction debris and tracking from construction traffic accessing the site. 5. Upon completion of the drainage improvements the engineer, Mr. Stephen Hammond, P.E., Carroll & Lange, Inc. shall provide to the City of Wheat Ridge a letter of certification stating that the various improvements, as defined in the drainage report and plan, have been accurately surveyed to confirm that their construction is in accordance with these documents. The certification letter shall be written and stamped by the engineer who prepared the drainage report, and shall be submitted for review and approval by the City prior to issuance of the Certificate of Occupancy. Motion by Mr. Donnelly that Council Bill 23 (Ordinance 1126) be amended to reflect a 10 foot Right Of Way vacation on the southerly edge of 50th Avenue and adjacent to property at 11201 West 1-70 Frontage Road North; seconded by Mr. Mancinelli. Victor Boog, Attorney for Robb Street Ventures,. Inc. at 5000 Robb Street, statedahat the property owner has procedure concerns regarding the action of this Council Bill by vacating 40 feet on July 13, 1998 without notice to the public. Mr. Boog stated that the property owner considered and recommends a 10 foot Right of Way. Richard Todd, Owner of Robb Street Ventures, Inc. 5000 Robb Street, stated that he started construction on the street in October of 1996, with Plat approval in October of 1994. Dennis Polk, representing Mr. Medved, stated that he wants to proceed and go forward and suggested to vacate 10 feet and have the City reserve the 30 feet. Sparky Shriver, 6503 Simms St., Arvada Fire Dept./Fire Marshall, addressed the Fire Departments access to Mr. Todd's Property.. WHEAT RIDGE.CITY C'^'.'NCIL MINUTES: JULY 27,199P : PAGE -5- Frank Wehling, 5006 Parfet, stated that the Right of Way Vacation notice, which was pasted for the July 13, 1998 meeting, did not mention 15 feet or 40 feet. Mr. Wehling gave numerous reasons why 50th Ave. should not be built. Chuck Stiesmeyer, 4996 Parfet, stated-that the public should have more advance notice and input on the issues of this property. - John Medved, owner of Medved Autoplex, doesn't want to build 50th Ave. (road that goes no where); and stated that for a compromise to Mr. Todd, he would be willing to build a Cul de Sac. Mr. Medved took offense to the statement " it's his nickel that was made at the prior meeting and that he does not want to do this because of the money." Mr. Medved stated that he has made numerous improvements without the City prodding, and begged Council to let sanity persevere. Mr. Donnelly restated the Motion. Mr. Siler declared to Council and City Attorney that he knows Mr. Todd and doesn't feel it's a conflict of interest and he will vote on this matter. He stressed that this is just a reconsideration: Mr. Middaugh stated that space is limited for the Cul de sac (40 feet is one-half of a Cul de sac); and if Mr. Medved would consider giving 90 feet, the City could build a Cul de sac at his expense. Mr. Siler declared to Council that Mr. Todd is a client of somebody who works on a part time basis out of his office. Mr. Todd is not Mr. Siler's client, but he does receive compensation less than $ 75.00 per year from Mr. Todd's account. Motion by Mr. DiTullio that there is,a conflict of interest with Mr. Siler on this Agenda Item and as a consequence Mr. Siler will not be allowed to vote under Charter Section 3.14; seconded by Mrs. Worth; failed 5-3 with Mrs. Shaver, Mr. DiTullio and Mrs. Worth voting yes. Motion by Mrs. Worth to postpone the-vacation from 40 feet to 10 feet until Mr. Medved, Mr. Todd, the Arvada Fire Department and staff can come back to Council with a reasonable solution to the problem; seconded by Mr. DiTullio. After further discussion, Mr. DiTullio withdrew his second. Mr. Siler asked Mrs. Worth for a friendly Amendment that this in no way detracts from Mr. Medved's ability to start planning for the rest of the development, it just affects the vacation. and the area in the vicinity of 50th Avenue and that a date certain be set to be brought back to City Council as August 24, 1998. Mr. Donnelly accepted the friendly amendment. Motion by Mrs. Dalbec for a friendly amendment to Mr. Donnelly's original Motion that this should only be built clear through if the residential properties to the east on Parfet or per the Charter agree. Motion by Mrs. Worth for an Amendment to the Motion that the road be constructed according to the Charter. Mr. Dahl stated that this issue is in the PBG paperwork. Mdtion by Mr. Mancinelli to divide the question. Motion failed due to lack of second. Restated Motion carried 8-0. Motion by Mr. Donnelly that Council Bill 23 (Ordinance 1126) be approved, as amended, to provide for approval of a 10 foot right of way vacation for West 50th Avenue abutting the rear property located at 11201 West 1-70 Frontage Road North be approved for the following reasons: 1) The designation for West 50th Ave. be changed from an arterial to an collector. 2) A half width section of 30 foot is adequate fora collector status. 3) The criteria used to evaluate a vacation supports approval of their request with the following conditions; a). A utility and slope easement be reserved over the entire 10 feet and an affidavit of amendment be recorded removing the plat note per Section II of the staff report of this case; seconded by Mr. Siler. Motion by Mrs. Worth for an Amendment to the Motion that Charter requirements under 5.20 be followed; seconded by Mr. DiTullio; carried 8-0. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this Ordinance Code or the application thereof to any person or circumstances shall for any reason be adjusted by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 6. Effective Date. This ordinance shall take effect 15 days after final publication. Dennis Polk, 1667 Cole Blvd., attorney representing Medved, and Steve Hammond, Civil Engineer and consultant for the project, were sworn in by the Mayor. Motion by Mr. DiTullio that we combine the public hearing on Items 2 and 3; seconded by Mr. Siler; carried 5-3 with Councilmembers Shaver, Worth, and Dalbec voting no. Steve Hammond and Dennis Polk presented the applicant's case and answered questions. Meredith Reckert was sworn in by the Mayor and presented the staff report. Bob Goebel was sworn in by the Mayor and gave history of the area. Frank Wehling, 5006 Parfet Street, and Chuck Stiesmeyer, 4996 Parfet, were sworn in by the Mayor; they had some questions regarding the vacation. Mr. DiTullio stated that he is running for State Office and has received contributions from Medved and asked that he be allowed to abstain from voting. Motion by Mrs. Worth that Mr. DiTullio be required to vote on this; seconded by Mr. Siler; carried 7-1 with Mr. DiTullio voting no. Motion by Mrs. Dalbec that Council Bill 23 (Ordinance 1126), be amended, Section 1 and Section 2 to reflect the motion that a request for approval of a 40' right-of-way vacation for West 501h Avenue abutting the rear of property located at 11001 and 11201 West 1-70 Frontage Road North, be approved for the following reasons: 1. The need for a West 501h Avenue has not been shown. 2. The criteria used to evaluate a vacation support approval of the request. With the following conditions: a. A utility easement be reserved over the entire 40 feet. b. An affidavit of amendment be recorded removing the plat note per Section II of this staff report; seconded by Mrs. Worth. Mrs. Shaver asked for an amendment to add condition c. That bicycle and pedestrian easement be preserved on the northern portion. Mrs. Dalbec and second accepted this as a friendly amendment. Mr. DiTullio rebutted with the comment that there are 402 apartments in Terra Village with people moving in and out every six months and that the studies do not reflect everything. Within the plan, West 50th Avenue is designated as a Class 5 street (minor industrial collector). Thirty feet is sufficient half-width for this type of classification. The applicant has requested the 10' vacation based on the current street classification and right-of-way dedication on the property to the west. Included as a note on the original Craig Chevrolet plat is the following language: City Council Page 2 WV-98-02: Medved south line of Lots I and 2, and furthermore, the owner agrees to move and redevelop landscaping, parking, and access at the owner's expense." Staff concludes that this is no longer a valid condition and should have been removed from the plat notes. REQUEST The applicant requests approval of a right-of-way vacation for excess right-of-way along West 50th Avenue which abuts the rear of property addressed as 11001 and 11201 West I-70 Frontage Road North (Medved Autoplex property). The applicant is requesting that the southern 10' of the 40' total right-of- way for 50th Avenue be vacated, leaving 30' in place for roadway purposes. The City is currently reviewing street construction drawings for the public improvements on 50th Avenue as it abuts both parcels. II. CASE HISTORY The property was rezoned from Agricultural-One and platted pursuant to the Craig Chevrolet Minor Subdivision (Case Nos. WZ-86-10 and MS-86-3). See attached Exhibit `A' which is a reduced copy of the platting document. At the time of zoning and subdivision, the West 50th Avenue corridor between Kipling and Ward Road was classified as an arterial requiring a half-width roadway section of 40' to centerline. Case No. WPA-90-1, approved a Comprehensive Plan amendment which removed the arterial classification from West 50th Avenue. This amendment allowed for circulation and connection in the City's northwest area by local streets including reclassification of 50th Avenue as a collector street. When the property directly to the west of the Medved Autoplex property was rezoned and platted in 1992, the City required a 29' dedication for West 50th with a F wide tract which may also be used for street purpose. See attached Exhibit `B' which is a reduction of the Plaza 5000 Business Center Planned Commercial Development. The purpose of the 1' strip was for access control. The property directly to the north is located within the City of Arvada who will require half-width construction when this land . develops. The road improvements for 50th Avenue adjacent to Plaza 5000 were completed last fall. The Wheat Ridge City Council recently approved and adopted the City's Neighborhood Traffic Management Program which will be an addendum to the new Comprehensive Plan. That the proposed vacation will not leave any adjoining land without access to an established public road. If the vacation request is approved, there will still be 30' of right-of-way in place for West 50th Avenue. No properties will be landlocked as a result of the partial vacation. 2. That the proposed vacation is in conformity with the goals and policies of the Transportation Section (Neighborhood Traffic Management Plan) of the Comprehensive Plan of the City of Wheat Ridge. Upon vacation approval, 30' of right-of-way will remain which is consistent with the section for a Class 5 street (minor industrial collector). 3. That the proposed vacation will not have a negative impact on the infrastructure of the City of Wheat Ridge. . There should be no negative affect on the City infrastructure as adequate right-of-way will remain for street circulation and utility installation, if needed. 4. That adequate easements have been reserved for use and/or maintenance by the City of other utility agencies. To ensure access and maintenance of existing or future utilities, Staff is recommending that a utility and slope easement be reserved over the entire 10'. V. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that the designation of West 50th Avenue has changed from an arterial to a collector status on the Comprehensive Plan. A collector status street requires 30' of right-of-way where 40' is existing. Staff concludes that the criteria used to evaluate a right-of-way vacation supports approval of the request. For these reasons, a recommendation of approval is given for a 10' vacation with the condition that a utility and slope easement be reserved over the entire 10'. VI. REQUEST The applicant requests approval of a right-of-way vacation for excess right-of-way along West 50th Avenue which abuts the rear of property addressed as 11001 and 11201 West I-70 Frontage Road North (Medved Autoplex property). The applicant is requesting that the southern 10' of the 40' total right-of- way for 50th Avenue be vacated, leaving 30' in place for roadway purposes. The City is currently reviewing street construction drawings for the public improvements on 50th Avenue as it abuts both parcels. II. CASE HISTORY The property was rezoned from Agricultural-One and platted pursuant to the Craig Chevrolet Minor Subdivision (Case Nos. WZ-86-10 and MS-86-3). See attached Exhibit `A' which is a reduced copy of the platting document. At the time of zoning and subdivision, the West 50th Avenue corridor between Kipling and Ward Road was classified as an arterial requiring a half-width roadway section of 40' to centerline. Case No. WPA-90-1, approved a Comprehensive Plan amendment which removed the arterial classification from West 50th Avenue. This amendment allowed for circulation and connection in the City's northwest area by local streets including reclassification of 50th Avenue as a collector street. When the property directly to the west of the Medved Autoplex property was rezoned and platted in 1992, the City required a 29' dedication for West 50th with a 1' wide tract which may also be used for street purpose. See attached Exhibit `B' which is a reduction of the Plaza 5000 Business Center Planned Commercial Development. The purpose of the 1' strip was for access control. The property directly to the north is located within the City of Arvada who will require half-width construction when this land develops. The road improvements for 50th Avenue adjacent to Plaza 5000 were completed last fall. The Wheat Ridge City Council recently approved and adopted the City's Neighborhood Traffic Management Program which will be an addendum to the new Comprehensive Plan. Within the plan, West 50th Avenue is designated as a Class 5 street (minor industrial collector). Thirty feet is sufficient half-width for this type of classification. The applicant has requested the 10' vacation based on the current street classification and right-of-way dedication on the property to the west. III. AGENCY REFERRALS Public Works concurs with the request for vacation with the condition that the property being vacated have an easement on it for slope and utilities. (See attached Exhibit `C'.) Arvada Fire Protection District has no objection to the vacation as long as 20' of access lane with an all- weather surface is provided. Planning Commission WV-98-02/Medved Page 2 C/~ IV. VACATION CRITERIA Staff has the following comments regarding the criteria used to evaluate a right-of-way vacation request. That the proposed vacation will not leave any adjoining land without access to an established public road. If the vacation request is approved, there will still be 30' of right-of-way in place for West 50th Avenue. No properties will be landlocked as a result of the partial vacation. 2. That the proposed vacation is in conformity with the goals and policies of the Transportation Section (Neighborhood Traffic Management Plan) of the Comprehensive Plan of the City of Wheat Ridge. Upon vacation approval, 30' of right-of-way will remain which is consistent with the section for a Class 5 street (minor industrial collector). 3. That the proposed vacation will not have a negative impact on the infrastructure of the City of Wheat Ridge. There should be no negative affect on the City infrastructure as adequate right-of-way will remain for street circulation and utility installation, if needed. 4. That adequate easements have been reserved for use and/or maintenance by the City of other utility agencies. To ensure access and maintenance of existing or future utilities, Staff is recommending that a utility and slope easement be reserved over the entire 10'. V. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that the designation of West 50th Avenue has changed from an arterial to a collector status on the Comprehensive Plan. A collector status street requires 30' of right-of-way where 40' is existing. Staff concludes that the criteria used to evaluate a right-of-way vacation supports approval of the request. For these reasons, a recommendation of approval is given for a 10' vacation with the condition that a utility and slope easement be reserved over the entire 10'. VI. RECOMMENDED MOTIONS Option A: "I move that Case No. WV-98-2, a request for approval of a 10' right of way vacation for West 50th Avenue abutting the rear of property located at 11001 and 11201' West I-70 Frontage Road North, be APPROVED for the following reasons: Planning Commission Page 3 WV-98-02/Medved C3 1. It has been declassified from an arterial to an industrial collector. This change requires a total of 60 feet of ROW rather than the 80 feet originally planned for. Because the road is not yet constructed, a change can be made to the plat vacating the south 10 feet of the proposed 50th Avenue ROW. Without final plans available for the construction of 50`h at this time, it is impossible to determine if a slope or wall easement is absolutely required. My recommendation for the safest course of action is to vacate the 10 feet of ROW and to reserve this 10 feet to be vacated as an easement at this time. It may not be necessary in the future, but it has no effect on the development of the parcel if granted.
