AN ORDINANCE ZONING CERTAIN PROPERTY (5220 SWADLEY)
WITHIN THE CITY OF WHEAT RIDGE, COLORADO, AGRICULTURAL-
TWO PURSUANT TO SECTION 26-6(C) OF THE WHEAT RIDGE CODE
OF LAWS AND AMENDING THE ZONING ORDINANCE AND MAP TO
CONFORM THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section . Findings of Fact.
(A) Application has been made for zoning certain property described on attached Exhibit
A, within the City of Wheat Ridge, Colorado, Agricultural-Two pursuant to Section
26-6(C) of the Wheat Ridge Code of Laws.
(B) Public notice has been given of such zoning by one publication in the Wheat Ridge
Transcript, a newspaper of general circulation within the City, and the official
newspaper of the City, at least fifteen (15) days prior to the hearing of such zoning.
(C) Written notice was sent by certified mail to all adjacent property owners and owners
of the property under consideration, at least fifteen (15) days prior to the public
hearing.
(D) Notice of such proposed hearing was posted on the property for fifteen (15)
consecutive days prior to said hearing.
(E) A need exists for zoning of this property Agricultural-Two.
Section 2• The property described in attached Exhibit A is hereby zoned Agricultural-Two,
subject to the conditions set forth below. _
(A) The property shall only be used as provided in Section 26-19 of the Wheat Ridge
Code of Laws, except for any special considerations set out in the Annexation
Agreement attached to the Annexation Ordinance.
(B) The following A-2 uses shall be deleted from the permitted principal uses and
permitted accessory uses on the property:
(1) Section 26-19 (B)(8)
(2) Keeping of Swine
(3) Section 26-19 (C)(8)
(4) Section 26-19 (C)(9)
Section The zoning ordinance and zoning map of the City of Wheat Ridge, Colorado are
hereby amended to conform with the zoning change to the property.
Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this
ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for
the preservation of health and safety and for the protection of public convenience and welfare. The
City Council further determines that the ordinance bears a rational relation to the proper legislative
objective sought to be attained.
Section . Severability. If any clause, sentence, paragraph, or part of this ordinance or the
application thereof to any person or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgement shall not affect application to other persons or
circumstances.
Section . This ordinance shall become effective fifteen (15) days after final publication.

5. APPROVAL OF MINUTES
The minutes of the March 5, 1998, Wheat Ridge Planning Commission were presented for
approval.
It was moved by Commissioner BRINKMAN and seconded by Commissioner DUNN to
approve the minutes as submitted.
Motion carried 4-0 with Commissioners GOKEY, SNOW and THEANDER absent, and
Commissioner SHOCKLEY abstaining.
6. PUBLIC FORUM
There was no one signed up to speak before the Commission.
7. PUBLIC HEARING
Chair THOMPSON declared the public hearing open.
A. Cases No. ANX-98-1/WZ-98-4 and No. ANX-98-2/WZ-98-5: +(Continued from
March 5, 1998) Application by the City of Wheat Ridge for approval of the annexation
and zoning of three parcels located at 11721 West 52nd Avenue and 5220 Swadley Street
within Jefferson County.
Alan White presented an overview of the case noting that there are two property owners
involved: Ronald and Michelle Beyer, 11721 West 52nd Avenue, who own approximately
2.5 acres and Irene Baker, 5220 Swadley Court, who owns approximately 5 acres making a
total annexation area of 7.5 areas. He presented overhead maps showing the exact location
of the properties involved and reviewed the zoning of the properties which is presently
Jefferson County SR-I and A-2. He advised that the present land use for Beyer property
included a single family residence, landscape contracting business and agricultural; and the
Baker's property contained three single family residences. He reviewed the surrounding
zoning as PUD-R on the north (Arvada), R-2 on the south (Wheat Ridge) , PUD-R
(Arvada) on the east and PUD-R (Arvada) on the west.
Mr. White stated that the City's Three Mile Plan is in place and that the North Plains
Community Plan adopted by Jefferson County calls this area an enclave and allows
residential up to 4 units per acres or the existing zoning.
Mr. White presented a map showing the outline of the development plan approved by the
City of Arvada for the Ridge Home property. He pointed out that the boundary line
between the residential area and the office park use was proposed to be a road and that the

plan for this road had been modified to include a portion for emergency access only. He
advised that the City of Wheat Ridge is not in agreement with the plan for emergency
access and noted that the annexation would include the right-of-way for West 52nd
Avenue adjacent to the two ownerships and would give the City the right to control its use.
Mr. White advised that the City of Wheat Ridge had provided public noticing and posting of
the property as well as the required legal notices for the zoning portion of these two cases,
and therefore there was jurisdiction to hear this case. He commented that Colorado statutes
contain no requirement for notification of an annexation hearing, however the public
notices did include the annexation along with the zoning.
Mr. White stated that at a neighborhood meeting held on February 24, the major concern of
the neighborhood was the use of West 52nd Avenue. Zoning uses were discussed at this
meeting and it was the consensus that A-2 would be the best zoning. He outlined the eight
criteria used to evaluate a zone change and reviewed the State statutes criteria for
annexation eligibility.
He reviewed the agency referrals which included the Arvada Fire Protection District, the
Valley Water District and the Public Works Department. He advised that the Arvada Fire
Protection District can service the subject property and has requested an emergency access
through the 52nd Avenue right-of-way to access the adjacent Arvada development. The
Valley Water District is currently serving the property by a 6-inch water main in 52nd
Avenue and a 30-foot right-of-way or a non-exclusive easement must be retained for
current water lines and use. Future development may require additional mains, taps, and
fire hydrants. The Public Works Department would not require any public improvements
at this time; however, future development would have to be reassessed.
Mr. White stated that the City of Arvada is not opposed to the annexations if the following
conditions were met:
1. The City of Wheat Ridge would maintain the 52nd Avenue right-of-way for
emergency access to the adjacent Arvada development and requested an additional 40 feet
of right-of-way, for a total of 70 feet for a future permanent connection.
Future development should respect the Arvada Comprehensive Plan designation of
suburban for this area.
Mr. White advised that staff had concluded the annexations meet the State criteria for
annexation eligibility, are logical extensions of the City's boundaries, are able to be served
by the City, and are in the best interest of the City. Further, the annexation of the West
52nd Avenue right-of-way allows the City to gain control of this street to address concerns
of the area residents with regard to impact of traffic from adjacent development in Arvada.

The staff also concluded that the requested zoning of A-2 would meet the City's criteria for
rezoning with the recommendation that the more intensive A-2 uses be eliminated (dog
kennels, catteries, veterinary hospitals, the keeping of swine) from the list of allowed uses.
Mr. White entered the staff report, comprehensive plan, three mile plan and zoning
ordinance into the record.
Commissioner SHOCKLEY asked why only these were the only three parcels in the area
under consideration for annexation.
Mr. White responded that the Boyers and the Bakers were the only property owners
interested in annexation at this time.
Commissioner BRINKMAN asked if staff felt that Arvada's conditions were reasonable in
regard to right-of-way.
Mr. White responded that he didn't believe it was a reasonable request as the extra 40 feet
would bring the street to the front door of the Boyers' residence.
Chair THOMPSON stated that although she did not want 52nd Avenue to be a through
street, she was concerned about emergency access. She asked if this was proposed to be a
gated access, to which Mr. White replied it was planned to be gated and that the Fire
District would have the only access to the gate.
The following individuals were sworn by Chair THOMPSON and addressed the
Commission:
Ron Beyer
11721 West 52nd Avenue
Mr. Beyer stated that he was requesting annexation to the City of Wheat Ridge because of
his agreement with the City's philosophy in regard to agricultural zoning and the
preservation of trees; however, the most important reason was that he did not want West
52nd Avenue to become a through street or even have emergency access. He felt that
having a gated emergency access would cause further delay for fire equipment going to an
emergency. He mentioned that one of the proposed plans was to bring 52nd Avenue south
to Ridge Road and that he would not be opposed to that type of connection. He agreed
with the A-2 zoning and the proposed conditions which would allow him to continue his
landscape business and cultivation of trees.

Irene Baker

Ms. Baker stated that she and her husband were in complete agreement with the statements
made by Mr. Beyers; and that it was her understanding that when this area was platted by
Arvada, it was to be a cul de sac. She also agreed with the A-2 zoning and the proposed
conditions.
Steve Steigleder
Deputy Fire Marshal, Arvada Fire Protection District
Mr. Steigleder stated that the emergency access had been requested because of the close
proximity of Station Two. He expressed concern that without the emergency access, it
would add an extra mile and more than a minute's time to reach the Arvada subdivision.
He explained that the proposed gate would have a light-weight chain which would be cut in
the event of an emergency, taking about ten seconds, and the gate would be reconnected by
the last personnel leaving the scene of the emergency. He advised that Arvada is proposing
a secondary access off of 58th and Oak Street; and that there would be the Kipling access
and possibly access from Lee Street; however, Station Two would provide the fastest
access.
Chair THOMPSON asked if the present right-of-way was sufficient for fire vehicles to
which Mr. Steigleder responded that, since there is a minimum of 20 feet required, the
present 30 feet of right-of-way would be sufficient.
Mr. White commented that the preliminary plan for the subdivision presently shows the cul
de sac with the emergency extension as a note. In response to Mr. Beyer's comments about
a 52nd Avenue connection to Ridge Road, Mr. White commented that Arvada would still
require emergency access across the subject area.
Commissioner DUNN asked if an emergency access would have to be maintained such as
snow plowing, etc. Mr. Steigleder replied that the access would have to be an all-weather
surface with the ability to support a 46,000-pound vehicle and would require maintenance
Commissioner COLLINS asked if a vacation of that portion of 52nd Avenue would do away
with the access lane to which Mr. White replied that it would.
Chair THOMPSON expressed concern about making a decision regarding right-of-way
when Arvada's plans are not completely finalized.

Mr. White noted that it is an immediate concern of the landowners that the issue be
addressed now.
Commissioner COLLINS suggested using a system that will support a fire truck but allows
grass to grow which would camouflage the road. Mr. Steigleder replied that the City of
Arvada has implemented some of these types of access and there have been problems with
maintenance; however, the District would look at any options available.
Richard O'Day
5422 Tabor Street, Arvada
Mr. Day represented the Rainbow Ridge Homeowners Association and commented that they
have been fighting this development because of traffic concerns. They don't want traffic to
use their neighborhood for access to Ward Road. He felt that a gated access would slow
fire response. He stated that the Association does favor the annexation because it would
give Wheat Ridge control of 52nd Avenue. He commented that there is not a good
comprehensive traffic plan in place by the City of Arvada. In regard to zoning, he
requested that fish hatcheries, riding academies and public stables, dog kennels, catteries
and veterinary hospitals, greenhouses and landscape nurseries which include the wholesale
and retail sales of bulk products such as manure, rock, sand as well as private and public
communication towers, radio and television antennas and water towers be considered for
elimination from the permitted uses.
Chair THOMPSON asked if the requests made by Mr. O'Day would prohibit the Beyers
from conducting their landscape business. Mr. O'Day replied that he was not concerned
with the Beyers. landscaping operation, but wanted restrictions in regard to the storage of
manure, etc. in case the property were sold.
David Gonyea

Mr. Gonyea addressed the request by the City of Arvada for an additional 40 feet of right-of-
way. He stated that because the road is so narrow, there is not room for 70 feet of right-of-
way and that he was opposed to the emergency access
Chair THOMPSON gave an invitation for anyone else to address Commission.
Mr. Beyer returned to the podium and asked Mr. Steigleder if Station Two was an
unmanned volunteer station and, if so, how this would affect response time. He also
expressed concern that a safety hazard would exist with the present right-of-way
considering the close proximity of residences to the proposed fire vehicle access.

(Commissioner BRINKMAN exited the meeting at 9:10 p.m. and returned at 9:14 p.m.)
Mr. Steigleder returned to the podium to address Mr. Beyer's concerns. He stated that
Arvada, like Wheat Ridge, is a totally volunteer fire department. He noted that Arvada
presently has some gates in place and they are checked yearly as well as when new
firefighters are being trained. He advised that the Fire District would post "no-parking -
fire-lane" signs in the access and that violations would be enforceable by fines.
Following further discussion, Chair Thompson closed the public comment portion of the
hearing.
It was moved by Commissioner BRINKMAN and seconded by Commissioner SHOCKLEY
to recommend to the City Council that the request to annex property into the Wheat Ridge
corporate limits pursuant to Case Nos. ANX-98-1 and ANX-98-2 for property located at
11721 West 52nd Avenue and 5220 Swadley Street be approved for the following reasons:
I. The annexations meet the State criteria for annexation eligibility.
2. They are logical extensions of the City's boundaries.
3. The annexations will allow the City to gain control of the development usage of
West 52nd Avenue.
4. The annexations reduce the area of enclaves which help clarify jurisdictional service
areas.
With the following conditions:
1. Provisions be made in the annexation agreement which prohibit the extension of
52nd Avenue to the east except for possible emergency access and that the access be
reviewed upon availability of final development plan of the Arvada properties to the east,
or be vacated as a main thoroughfare.
2. Provisions be made in the annexation agreement that a 30-foot right-of-way and/or a
non-exclusive public works and pedestrian easement be retained.
Following brief discussion, the vote was 5-0 with Commissioners GOKEY, SNOW and
THEANDER absent.
It was moved by Commissioner BRINKMAN and seconded by Commissioner SHOCKLEY
to recommend to the City Council that Case Nos. WZ-98-4 and WZ-98-5, a request to
approve Agricultural-Two zoning on properties located at 117721 West 52nd Avenue and
5220 Swadley Street, be approved for the following reasons:
1. The proposed zoning is consistent with the City's rezoning criteria.

2. It would allow the historical use of the properties to remain.
3. There would be no impacts as a result of the zoning.
4. The zoning is consistent with the City's Three Mile Plan.
With the following condition:
1. Delete dog kennels, catteries, veterinary hospitals and the keeping of swine and/or
pot bellied pigs, from the list of permitted principal uses.
2. Delete public and private communications towers, television or radio antennas or any
other similar communication receiving or sending device which does not exceed 35 feet in
height whether ground mounted or mounted upon a building or other structure, or water
towers or above-ground reservoirs not in excess of 35 feet in height from permitted
accessory uses and accessory buildings.
IL Discussion followed.
The vote was 5-0 with Commissioners GOKEY, SNOW and THEANDER absent.
8. CLOSE THE PUBLIC HEARING
Chair THOMPSON declared the public hearing portion of the meeting closed.
9. DISCUSSION AND DIRECTION ITEMS
Tree Preservation Ordinance. Presentation and update by Bill Cassel, City Forester, on
the adoption of the City's tree preservation and retention codes. At the direction of the
City Council, the Arborist Board and staff have reviewed and discussed the concept of tree
protection, modes of operation and possible impacts on developers and the community
forest in Wheat Ridge.
Mr. Bill Cassel, City Forester, presented this item stating that the Arborist Board has been
working over the past several months to review and rewrite the city code concerning trees
and shrubs which would also include the licensing of tree care and lawn care companies.
During that time, City Council requested that the Board also review the Historic
Preservation Ordinance as it related to trees. The Arborist Board felt this ordinance would
not be the proper place for tree protection and, therefore, City Council directed the Board
to draft an ordinance which would provide a method of preserving trees in Wheat Ridge.
Mr. Cassel referred to his memorandum to the Planning Commission, dated March 11, 1998,
which stated that, "tree preservation would involve a decision making process to retain and
preserve mature trees on any property slated for development under current city codes. Any

I. REQUEST
This is a City-initiated annexation and zoning on property in the process of being annexed to the City of
Wheat Ridge. There are three parcels of property being considered for annexation which are being
zoned pursuant to Case Nos. WZ-98-4 and WZ-98-5. The annexation case numbers are ANX-98-1 and
ANX-98-2.
Case No. WZ-98-4 relates to two parcels, with a combined area of 2.5 acres owned by Shelley and
Ronald Beyer located at 11721 West 52nd Avenue. The front portion of the property is used as a
residence, as well as the owners' landscape contractor's business with the rear parcel being utilized
agriculturally. Current zoning on the property is SR-1 (Suburban Residential-One) in Jefferson County.
The SR-1 zoning allows the contractor's business, the residence and the agricultural use with a one acre
lot size minimum. Please refer to Exhibit `A' which is a survey of the property
Case No. WZ-98-5 relates to property located at 5220 Swadley Street owned by Irene Baker. This
property contains five acres and has two single family residences on the southern portion. The rear
portion of the property is used agriculturally. Current zoning on the property is A-2 (Agricultural-Two)
in Jefferson County. Please refer to Exhibit `B' which is a survey of the property.
The City of Wheat Ridge is proposing a rezoning to Agricultural-Two which would allow current
utilization of all properties to continue with a one acre minimum lot size. It is the zone district within
the City of Wheat Ridge which is the equivalent of the existing Jefferson County zoning.
The City has initiated annexation to control development and usage of West 52nd Avenue due to
concerns over traffic impacts of the proposed development in Arvada to the east.
II. NEIGHBORHOOD MEETING

III. CRITERIA FOR EVALUATION
Staff has the following comments regarding the criteria used to evaluate a zone change or approval.
ZONING:
1. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies,
comprehensive land use plan and other related policies or plans for the area.
The City of Wheat Ridge has adopted the Jefferson County North Plains Community Plan as the
City's Three Mile Plan. In regard to the enclaves within or adjacent to jurisdictional boundaries,
the North Plains Plan indicates future land use as: 1) "Residential up to 4 dwelling units per acre
or existing zoning, whichever is greater; 2) if adjacent use in non-residential, then similar land
use could be reconsidered, provided adverse impacts are mitigated; and 3) Agricultural and
ranching land uses, if consistent with current zoning." Existing Jefferson County zoning is SR-1
and A-2 which allow one dwelling unit per acre minimum. Staff concludes that rezoning to A-2,
which also allows one unit per acre and permits the existing uses, provides consistency with the
City's Three Mile Plan.

2. That the proposed change of zone is compatible with the surrounding area and there will
be minimal adverse impacts considering the benefits to be derived.
Zoning and adjacent land use to the west and north is low density residential development zoned
PUD-R (Planned Unit Development - Residential) within the City of Arvada. To the east is
vacant property with PUD-I (Planned Unit Development - Industrial) zoning. Abutting the
property to the south is low density residential development within the City of Wheat Ridge with
R-2 zoning. The proposed A-2 zoning would allow the existing properties to be used as they
have historically. However, staff is concerned that some of the A-2 uses may not be appropriate
next to low density residential development. The more intensive uses such as dog kennels
should be eliminated from the list of allowed uses.
3. That there will be social, recreational, physical and/or economic benefits to the community
derived by the change of zone.
There will be physical benefits as a result of the annexation and rezoning as the City will have
control of development and usage of West 52nd Avenue.
4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the
change of zone, or that the applicant will upgrade and provide such where they do not exist
or are under capacity.
All service agencies are currently serving the property. The requirement for public improvements
on West 52nd Avenue and agency service facilities will have to be re-evaluated if future
development occurs.
5. That the proposed rezoning will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously reducing
light and air to adjacent properties.
No changes are proposed for the properties being annexed and zoned. Therefore, there should be
no affect on traffic on 52nd Avenue or on the amount of light and air to adjacent properties.
6. That the property cannot reasonably be developed under the existing zoning conditions.
Any property annexed into the City needs zoning approval. The A-2 zoning is equivalent to the
existing zoning in Jefferson County.

That the zoning will not create an isolated or spot zone district unrelated to adjacent or
nearby areas.
The A-2 zoning will allow historical use of the property to continue to be used for residential and
agricultural uses. There is other agricultural zoning and agricultural and residential uses in the
area, therefore, spot zoning is not an issue.
8. That there is a void in an area or community need that the change of zone will fill by
providing for necessary services, products or facilities especially appropriate at the
location, considering available alternatives.
There is no void in services that the zoning approval will fill. The annexation will allow the City
to have control of West 52nd Avenue.
ANNEXATION:
The Wheat Ridge Code of Laws does not contain criteria for review of an annexation, but state statute
provides criteria for eligibility for annexations. These criteria are:
1. Not less than one-sixth of the perimeter of the area is contiguous with the boundary of the
annexing municipality.
2. That a community of interest exists between the annexing area and the annexing municipality.
3. The annexing area is urban or will be urban in the near future.
4. The annexing area is integrated with or capable of being integrated with the annexing
municipality.
5. It is necessary and desirable to annex the property.
State statutes also state that meeting the requirement of contiguity "shall be a basis for a finding of
compliance with these requirements, unless the governing body finds that at least two of the
following are shown to exist:"
Less than 50% of the residents of the area to be annexed make use of part or all of the following
facilities of the municipality: recreational, civic, social, religious, industrial, or commercial; or
less than 25% of the area's adult residents are employed in the municipality.

2. One-half or more of the land to be annexed is agricultural.
It is not physically practicable to extend to the area those urban services which the annexing
municipality provides to all of its citizens.
Other than the contiguity requirement, these criteria are subjective. Certainly a community of interest
exists, the area is capable of being integrated into the City, and services are able to be extended because
the City is already serving the residential development to the south of West 52nd Avenue. Although
urban level development is not proposed at this time, it is possible that the area may be urban in the
future. It is reasonable to assume the property owners make use of the City's recreational, social,
religious and commercial facilities.
State statutes also require that a plan for the area extending three miles from the City's boundaries be in
place. The Planning Commission recommended adoption of the Jefferson County North Plains
Community Plan with modifications as the City's Three Mile Plan at the February 12, 1998 hearing.
That plan shows the area under consideration for annexation as an enclave and under the plan, suitable
for residential development up to 4 dwelling units per acre or agricultural uses if consistent with current
zoning. The requested zoning of A-2 limits residential development to one dwelling unit per acre and
allows the current uses of the properties.
Annexation is a policy decision which rests more on the question of whether the City should annex an
area considering the positive and negative aspects of the annexation than on set criteria. In other words,
do the costs of providing services to the annexing area balance with the revenues anticipated? Can
services be provided in a cost effective manner if there is nearby development also served? Is the
annexation a logical extension of the City's boundaries and service provision capabilities? Are there
other benefits or circumstances of annexing that outweigh these considerations?
IV. AGENCY REFERRALS
Arvada Fire Protection District can service the property. Any future development will require re-
evaluation for compliance with the Uniform Fire Code. The District requests an emergency access be
provided through the 52nd Avenue right-of-way to access the adjacent Arvada development.
Valley Water District is currently serving the property by a 6" water main in 52nd Avenue. A 30' right-
of-way or at the very least, a non-exclusive easement must be retained in 52nd Avenue for current water
lines and use. Any future development may require additional main lines, taps and fire hydrants.
Public Works Department will not require any public improvements at this time. Future development
will be reassessed for all applicable development standards.

The areas are shown in the City of Arvada's growth area. Arvada is not opposed to the annexations if
the following conditions are required:
Maintain the 52nd Avenue right-of-way for emergency access to the adjacent Arvada
development. For a future permanent connection, require a dedication of 70 feet of right-
of-way (additional 40 feet to that being required).
Future development should respect the Arvada Comprehensive Plan designation of
suburban for this area.
V. STAFF CONCLUSIONS
Staff concludes that the annexations meet the state criteria for annexation eligibility, are logical
extensions of the City's boundaries, are able to be served by the City, and are in the best interest of the
City. Annexation of the West 52nd Avenue right-of-way allows the City to gain control of this street to
address concerns of the area residents about the impact of traffic from adjacent development in Arvada.
The requested zoning of the properties meets the City's criteria for rezoning. The requested A-2 zoning
is appropriate for the existing uses of the property. No impacts from the rezonings are anticipated;
however, staff recommends that the more intensive A-2 uses be eliminated (dog kennels, catteries, vet
hospitals, the keeping of swine) from the list of allowed uses.
VI. RECOMMENDED MOTIONS
ANNEXATIONS
Option A: "I move to recommend to the City Council that the request to annex property into the Wheat
Ridge Corporate limits pursuant to Case Nos. ANX-98-1 and ANX-98-2 for property located at 11721
W. 52nd Avenue and 5220 Swadley Street, be APPROVED for the following reasons:
1. The annexations meet the state criteria for annexation eligibility.
2. They are logical extension of the City's boundaries.
3. The annexations will allow the City to gain control of the development and usage of West
52nd Avenue.
4. The annexations reduce the area of enclaves, which help clarify jurisdictional service
areas.

5. APPROVAL OF MINUTES
The minutes of the February 19, 1998, Wheat Ridge Planning Commission were presented for
approval.
Commissioner SNOW requested the following amendments to the minutes:
1) The second paragraph of page 4 should state that the motion carried by a vote of 7-0
rather than 8-0.
2) On page 9, the second paragraph should contain the words "Animal Control
Commission" rather than "Agricultural Commission."
It was moved by Commissioner GOKEY and seconded by Commissioner THEANDER to
approve the minutes as amended.
Motion carried 5-0 with Commissioners COLLINS and DUNN abstaining, and Commissioner
SHOCKLEY absent.

PUBLIC HEARING
Chair THOMPSON declared the Public Hearing open.

Alan White stated that a defect had been discovered in the public notice procedures for these
cases and, therefore, the Commission did not have jurisdiction to hear the cases. He requested
that the Planning Commission continue the public hearings until March 19, 1998, at 7:30 p.m.
He noted that the City Attorney had advised that no public testimony can be taken until that
date, and apologized to those in attendance who came to hear these specific cases.
Commissioner SNOW moved and Commissioner BRINKMAN seconded that Cases No. ANX-
98-1/WZ-98-4 and No. ANX-98-2/WZ-98-5 be continued until March 19, 1998, at 7:30 p.m. in
the Council Chambers of the Wheat Ridge Municipal Building.

Service natural gas regulator facility located at 7605 West 44th Avenue and 4401 Wadsworth
Boulevard in the Commercial-One Zone District.
Meredith Reckert presented an overview of the case stating that the owners of this property are
V&M Rentals and Public Service Company of Colorado. The owners have requested a
resubdivision of approximately 2.8 acres at the northwest comer of West 44th Avenue and
Wadsworth Boulevard. She presented a map and slides of the property, and entered into the
record the subdivision regulations, case file, packet materials and exhibits. She advised that the
property is within the City of Wheat Ridge, all notification and posting requirements have been
met and there was jurisdiction to hear the case. She stated there are currently two structures on
four parcels of property (Vein's Restaurant and Lounge on parcel one and the Public Service
Company gas regulator structure on parcel four) and that the primary reason for the request was
to move the Public Service Company gas regulator structure to the back of the property to allow.

Ms. Reckert advised that the right-of-way for both West 44th Avenue and Wadsworth is being
dedicated by this plat and a blanket cross access easement has been provided allowing free
movement through the drive aisles and parking areas on the property. She noted that all
requirements of the Subdivision Regulations have been met. She added that the Public Service
Company concurs with the proposed resubdivision, and the Colorado Department of
Transportation has approved the right-of-way width for dedication and has approved an access
permit.
Ms. Reckert informed that it was staff s conclusion that the resubdivision is required to allow
redevelopment of the property and, therefore, recommended approval.
Following discussion by the Commission, Chair Thompson asked if there were any individuals

The property located at 11721 W. 52"d Ave. is within the boundaries of the Arvada Fire
Protection District. Fire stations providing service to this site Station 2, 12195 W. 52"d Ave. and
Station 6, 6503 Simms St.
Since the conception of the proposed Continental Homes development to the East of this site, we
have asked that the Preliminarily and Final Plat be approved with an emergency access point from
W. 52"d Ave., through the existing street right of way. The access point will be gated for
emergency vehicles only, not as a full access point to the development.. This will provide the first
in station to the proposed development, Station 2, a direct access from W. 52"d Ave to the site
and cut response time and travel distance. In the event Station 2 would be within the Continental
Development, the emergency access point would also cut response times back to the Wheat
Ridge residential area on Simms St. and Swadley Street.
We would not be in favor of the West 52"d Ave. Right of Way being vacated as a result of the
annexation of these two properties.
Any future improvements to the site will require re-evaluation for compliance with the Uniform
Fire Code.

Two parcels of land are proposed for annexation to the City of Wheat Ridge. The parcels are
located north of W. 52nd Avenue at Simms Street and Swadley Street.
The Beyer property, located at 11721 W. 52nd Avenue and consisting of 2.5 acres, currently is
zoned SR-1 in Jefferson County. Existing uses on the property consist of a single family
residence, plant nursery, and horse stables. Under the proposed City zoning of A-2, these uses
are allowed and will remain.
The Baker property, located at 5220 Swadley Street and consisting of 5.0 acres, currently is
zoned A-2 in Jefferson County. The existing use is a single family residence which will remain
under the proposed City A-2 zoning.

The City of Wheat Ridge will be holding a neighborhood meeting to involve the public in the
proposal to annex and rezone property located at 11721 W. 52nd Avenue from County S-RI to
Agricultural-Two into the City of Wheat Ridge, and to annex and rezone property located at
5220 Swadley Street from County A-2 to Agricultural-Two into the City of Wheat Ridge.
The meeting will be held on February 24, 1998, at 6:30 p.m., in the Council Chambers of the
Municipal Complex at 7500 W. 29th Avenue. .
The purpose of the meeting is to provide the opportunity for citizens to become aware of a
proposal in their neighborhood and to allow the City and staff to respond to citizen concerns.
All residents within 600 feet are required to be notified of the meeting.
A staff planner will attend the meeting to discuss City policy and regulations and the process
involved. However, the planner will remain impartial regarding viability of the project. Keep in
mind that this pre-application neighborhood meeting is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the public hearings in front of Planning
Commission and City Council where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public hearings.

Department is open Monday through Friday 8:00 a.m. - 5:00 p.m.
