PUBLIC FORUM There was no one to appear before the Commission. PUBLIC HEARING j A. Case No. MS-01-01: An application by Ryan Schacklett for approval of a two-lot yI , minor subdivision plat on property zoned Residential-One (R-1) and located at 12225 West 35th Avenue. This case was presented by Mary Austin. She reviewed the staff report and presented slides and overheads of the application. All pertinent documents were entered into the record and accepted by Chair McNAMEE. It was staff s conclusion that requirements of the Subdivision Regulations have been met and the parcels meet the lot area requirements of the R-1 zoning district. Therefore, staff recommended approval of the application with conditions as outlined in the staff report. Commissioner COOPER asked if the proposed lots would be similar in size to others in the neighborhood. Ms. Austin replied that there are mixed lot sizes in this neighborhood. These lots will be as large as others in the area but not as large as some of the surrounding parcels. In response to a question from Commissioner THOMPSON concerning fire and trash removal access, Ms. Austin stated that the fire department has no problem with the design. Commissioner WEISZ questioned whether the length of the driveway into lot no. 2 would present any problems. Ms. Austin stated that the driveway meets distance requirements. Ryan Shacklett 12225 W. 35th Avenue Mr. Shacklett, the applicant, was sworn by Chair McNAMEE. He explained that.his trash removal company will require taking trash out to the curb. He stated that he has lived in this area for many years and wants to remain there. He plans to remodel and sell the existing house and then build a new house on the other lot to live in. James Negri 122200 West 35th Avenue Mr. Negri was sworn by Chair McNAMEE. He addressed the Commission to recant the letter he originally wrote in opposition to the application. His opposition was based upon history of renters in the existing house. However, Mr. Shacklett has already made great improvements to the property and he now feels this proposal will be a great asset to the neighborhood. He expressed his full support of the application. Fred Deard 12155 West 35th Avenue Mr. Deard was sworn by Chair McNAMEE. He stated he has lived in this neighborhood since Planning Commission September 20, 2001 1969 and feels the applicant's project would be a great asset to the neighborhood and would increase property values. It was moved by Commissioner SNOW and seconded by Commissioner COOPER that Case No. MS-01-01, a request for a two-lot minor subdivision for property located at 12225 West 35`h Avenue be approved for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. The minimum lot size requirements of the R-1 zoning district have been met. 3. The development standards of the R-1 district have been met for the existing single family home. With the following conditions: 1. The underground irrigation ditch be labeled with the name Lee Stewart & Eskins Ditch and an easement in a total amount of 15 feet be provided as requested by the ditch company and depicted on the plat. 2. The developer provide the standard park land fee as required by the Subdivision Regulations and approved by the Parks Department. The motion passed 7-0 with Commissioner BRINKMAN absent. B. Case No. ZOA-01-02: An ordinance amending Sections 26-206, 26-207, 26-208, 26- 209, 26-210, 26-211, 26-212 and 26-611 of the Wheat Ridge Code of Laws pertaining to required setbacks for residential structures and exceptions thereto. Meredith Reckert presented this matter which is an ordinance containing changes to the residential setbacks as recommended by the Planning Commission at the last meeting. It was moved by Commissioner COOPER and seconded by Commissioner WEISZ that Case No. ZOA-01-02, an ordinance amending Sections 26-206,26-207, 26-208,26-209, 26- 210, 26-211, 26-212 and 26-611 of the Wheat Ridge Code of Laws pertaining to required setbacks for residential structures and exceptions thereto be forwarded to City Council with a recommendation of approval. The motion passed 7-0 with Commissioner BRINKMAN absent. 8. OLD BUSINESS A. Permission for access to Private property - Janice Thompson inquired as to the status of developing a method of providing access to private property for staff and commission members for inspection purposes when an application is filed. Meredith Reckert will look into this. Perhaps permission could be granted by the property owner at the time application is made. Case No. MS-01-01: An application by Ryan Schacklett for approval of a two-lot minor subdivision plat on property zoned Residential-One (R-1) and located at 12225 West 35th Avenue. This case was presented by Mary Austin. She reviewed the staff report and presented slides and overheads of the application. All pertinent documents were entered into the record and accepted by Chair McNAMEE. It was staff s conclusion that requirements of the Subdivision Regulations have been met and the parcels meet the lot area requirements of the R-1 zoning district. Therefore, staff recommended approval of the application with conditions as outlined in the staff report. Commissioner COOPER asked if the proposed lots would be similar in size to others in the neighborhood. Ms. Austin replied that there are mixed lot sizes in this neighborhood. These lots will be as large as others in the area but not as large as some of the surrounding parcels. In response to a question from Commissioner THOMPSON concerning fire and trash removal access, Ms. Austin stated that the fire department has no problem with the design. Commissioner WEISZ questioned whether the length of the driveway into lot no. 2 would present any problems. Ms. Austin stated that the driveway meets distance requirements. Ryan Shacklett 12225 W. 35th Avenue Mr. Shacklett, the applicant, was sworn by Chair McNAMEE. He explained that his trash removal company will require taking trash out to the curb. He stated that he has lived in this area for many years and wants to remain there. He plans to remodel and sell the existing house and then build a new house on the other lot to live in. James Negri 122200 West 35th Avenue Mr. Negri was sworn by Chair McNAMEE. He addressed the Commission to recant the letter he originally wrote in opposition to the application. His opposition was based upon history of renters in the existing house. However, Mr. Shacklett has already made great improvements to the property and he now feels this proposal will be a great asset to the neighborhood. He expressed his full support of the application. Prior to the neighborhood meeting, the Planning Department received a comment of support for the proposal from Don & Judy Kugler of 3520 Urban Ct. III. SUBDIVISION DESIGN This minor subdivision creates two lots. The property currently has a single family home which fronts on W. 35' Ave. The structure is situated on what will become Lot 1 of this subdivision. An additional lot will be created (Lot 2) in the rear of the existing single family residence. The R-1 zoning district which covers this property allows for single family residential and each of the lots are, subject to the requirements of that zoning district. Both lots meet the development standards for minimum lot area and minimum lot width. With the existing structure, Lot 1 will have a building coverage of 17.8% which is within the maximum limitation of 25%. The position of the existing structure on newly created Lot 1 meets the required setbacks. (Exhibit 4). Lot 1 and the existing home will be accessed from W 35" Ave. with the existing driveway leading to the 2 car garage. Lot 2 (the rear lot) will be accessed from W 35`h Ave. using a combination of a 15' wide cross- access easement on Lot 1 and the portion of Lot 2 which fronts on W. 35' Ave. Lot 2 will utilize the existing paved drive along the west side of the property. This concrete driveway is 24' wide and therefore meets the code requirement for a minimum of 20' in width paved. The cross-access easement on Lot 1 is granted in general note 45 and is depicted graphically on the plat. Easements have been reserved adjacent to the property lines as required by the City's Subdivision Regulations for utilities and access. This is a minor subdivision without public street dedication and as such, requires Planning Commission action only. All requirements of the Subdivision Regulations have been met. Since the neighborhood meeting was held, staff has received no objection to or public comment regarding this minor subdivision application thus far. Planning Commission Page 2 MS-01-O1/Shacklett IV. AGENCY REFERRALS All service agencies can serve the property as currently developed and when developed with an additional single family home. Any necessary system improvements, taps and meters will be at the applicant's expense. Xcel Energy can serve the property with requested utility easements adjacent to the front and rear lot lines for the installation and maintenance of utilities. These easements are discussed in general note #6 and are depicted graphically on the plat document. Consolidated Mutual Water Company will provide domestic water service to the property. Per the company's requirements, each separate structure must be served by a separate tap and meter and each property must front a company main. The portion of Lot 2 which connects to W 35' Ave. allows that lot to meet their requirement for service. Wheat Ridge Fire District will provide service to the property. The City Surveyor has reviewed the final plat document for completeness and has indicated that it is in compliance with the City's Subdivision Regulations. The Public Works Department will require a drainage letter for the site, prepared by a Colorado licensed professional engineer, prior to any new development on Lot 2. Additionally, a grading and erosion control plan, prepared by a Colorado licensed professional engineer, will be required prior to any development. Public improvements of curb, gutter and sidewalk are currently in place along W 35' Ave. No additional public improvements will be required. V. STAFF CONCLUSIONS AND RECOMMENDATION Upon review of the above request, staff concludes that the applicant is subdividing a single parcel into two parcels in order to develop an additional single family home. The requirements of the Subdivision Regulations have been met and the parcels meet the lot area requirements of the R-1 zoning district. Therefore, staff recommends APPROVAL for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. Please accept this letter, which I have given to my neighbor, Tom Karaffa, and I thank you for letting him voice my opinion. It has come to my attention that the property in question has been sold to Ryan Shacklett. I received a letter stating that he anticipates fixing up the existing property and building another residence in the rear. First, let me state that my family has lived across the street, at 12200 W. 35th Avenue for the last 15 years. I have many reservations about the changes in store for this address, if the minor subdivision is approved. As long as I can remember, this property has been one of the many eyesores in this block, and so when someone comes along stating that he is going to clean it up, it sounds very attractive. But when you talk to Mr. Shacklett his real intentions become apparent, and they raise many questions. He told me that he will fix up the front residence, build a home in the rear and if he likes that one he will move in. He stated that he will rent the front unit. What this says to me is that this has just become investment property, and the possible opportunity to rent two homes. Although his intentions are probably genuine, I know that when a person has the opportunity to make money, intentions often go out the window and the neighborhood is left in its wake. I am very opposed to any rental in my neighborhood, let alone two. That residence had a basement that has been used as a rental for years and the renters have many times been less than ideal neighbors. Following is a compiled list of comments submitted by these agencies. Planning & Development Department: The plat drawing needs to include labels indicating the zoning on and surrounding the site. The property being platted is zoned R-1. The adjacent property to the north and west is also zoned R-1. The adjacent property to the south and east is zoned R-1A. 2. Per the City's Subdivision Regulations, easement language is needed on the plat as follows: "Ten- foot (10') wide easements are hereby granted on private property adjacent to all public streets and front and rear property lines of each lot in the subdivision or platted area. Five-foot (5') wide easements are hereby granted on private property adjacent to all side lot lines of each lot in the subdivision or platted area. These easements are dedicated for the installation, maintenance and replacement of electric, gas, television cable, and telecommunications facilities. Utilities shall also be permitted within any access easements and private streets in the subdivision. Permanent structures and water meters shall not be permitted within said utility easements." 3. Per the City's Subdivision Regulations, easements as required in the above statement need to be graphically depicted on the plat. 4. To ensure that a nonconforming situation is not being created, a separate drawing (to scale) is needed at 8''/2' x 11" or 11" x 17" in size showing the location of all existing structures and major improvements, including those that will remain and any that will be removed. 5. A case history box is needed and should have the following case listed: MS-01-01. 6. The plat needs to clarify graphically exactly which area is to be used as a cross access easement. Since the access to Lot 2 requires a cross access easement over Lot 1., language is needed on the plat reserving that cross access/ingress-egress easement as follows: "The owner, his successors and assigns grants limited rights and privileges of access to and free movement through those areas indicated as "cross access/ingress-egress easements", as illustrated upon this plat. Such grant of easement shall be limited to the owners, tenants, customers, and guests of the owners, and shall furthermore grant access to, and free movement through said easements to those entering said easements from similarly recorded easements from adjacent properties and/or from abutting public streets." This plat needs to show dotted lines for all abutting lots for the adjoining Fitts Sub to the east. Certifications should read as follows: Mayor's Certification "This is to certify that the within plat has been approved by the City of Wheat Ridge" with a date line added next to the signature line. Planning Commission Certification "This is to certify that the within plat has been approved by the City of Wheat Ridge Planning Commission" with a date line added next to the signature line. 10. In each instance when the City of Wheat Ridge is referenced on the plat document, it needs to be 2 words: Wheat Ridge. 11. Eliminate the words "Preliminary Plat" and add the words "Final Plat" under the title of the plat. 12. Eliminate the words "Filing No 2" from the notary signature area. 13. Eliminate the signature line for the Secretary of the Planning Commission. 14. Eliminate the reference line to City ordinance under the approval by the Director of Public Works. 15. Eliminate the word "Community" from the title of the department under the approval by the Director of Planning and Development. I received a letter stating that he anticipates fixing up the existing property and building another residence in the rear. First, let me state that my family has lived across the street, at 12200 W. 35th Avenue for the last 15 years. I have many reservations about the changes in store for this address, if the minor subdivision is approved. As long as I can remember, this property has been one of the many eyesores in this block, and so when someone comes along stating that he is going to clean it up, it sounds very attractive. But when you talk to Mr. Shacklett his real intentions become apparent, and they raise many questions. He told me that he will fix up the front residence, build a home in the rear and if he likes that one he will move in. He stated that he will rent the front unit. What this says to me is that this has just become investment property, and the possible opportunity to rent two homes. Although his intentions are probably genuine, I know that when a person has the opportunity to make money, intentions often go out the window and the neighborhood is left in its wake. I am very opposed to any rental in my neighborhood, let alone two. That residence had a basement that has been used as a rental for years and the renters have many times been less than ideal neighbors. The two lots will be broken down into segments; One of which is occupied by an existing single family residence; The other portion for near future development of a new single family residence. The attached plan gives a general idea of how this land is to be divided into two lots.
