RE: Sandalwood Manor Lot Consolidation
Dear Ms. Anderson,

After the most recent review of the documents for the lot consolidation, I do not have any outstanding issues with
the Sandalwood Manor consolidation plat. Dave Brossman of the Public Works Department has also reviewed
the plat and has found that the plat is approvable. The plat can now be recorded with the Jefferson County Clerk
and Recorder. Once the plat is recorded, the consolidation of the three lots will be complete and will become
official.
In order for the plat to be recorded, the approved plat must be photographically reproduced on Mylar paper that is
at least .004 of an inch thick and has a matte finish on both sides. The Mylar paper must be signed by all the
required persons in the owners certification block including a notary along with their seal. A signature and wet
stamp will also be required by the surveyor. Once all the signatures are obtained, the Mylar should be submitted
to the City of Wheat Ridge Community Development Department. The Mylar will then be signed by all the
necessary personnel from the City and then be taken to the County to be recorded.

Please review the responses and redlines of the other commenting agencies and make changes accordingly for
further review. After all concerns have been addressed and the corrections have been made please resubmit four
full size copies of the plat to me for further review. Upon the correction of all discrepancies, the Consolidation
Plat can be printed on Mylars and sent to the Community Development Director for signatures.

I have completed the fourth review of the above referenced document received on June 30, 2009, for the
proposed consolidation located at 6005 & 6025 W. 38 h Avenue, and I have the following comments:
FINAL PLAT (Please refer to the redlined plat sheets for the following comments)
1. On Sheet 1:
a. Need to complete the title of Mr. Whelan by including the name of the business he is the
managing partner of (i.e., Sandalwood Partnership).
b. Correct the year for both the County Clerk and City Certification blocks (they are currently
shown as 2008).
2. On Sheet 2:
a. The Sidewalk Easement along 38`h Avenue, Reception #91043290 does not appear to be
shown correctly (see attached deed).
The Public Works Department requires 2 hardcopies accompanied by an electronic file
containing the revised Plat in AutoCAD 2000-2007 DWG format. The electronic rite may be
delivered with either on CD-ROM or by e-mail to me at: dbrossmanna ci wheatridae.co.us .

Joan,
Let this be a follow up to the revisions for the lot consolidation you submitted on Tuesday, March 3, 2009 for
Sandalwood Manor at 3825 Harlan St. After our meeting with Public Works (PW) it was determined that that
none of the proposed changes would allowed to be constructed in the right-of-way dedication area. As a result,
parking space that extends into the W 38th Ave dedication area should be removed. The retaining wall that is
proposed extend in to the right-of-way dedication area should also be altered so it does not encroach into the
dedication area.
There are two primary reasons for not allowing the wall in this location. The first, PW has indicated that if the wall
was constructed in the r-o-w it would have to be maintained by the City of Wheat Ridge and is not something the
City wishes to maintain. Secondly, when the improvements to W. 38th Ave are constructed, the portion of the wall
that proposed to be constructed in the r-o-w would have to be removed.
PW identified two solutions to this proposal. The first solution would be to keep the walls with the same "tiered"
design as they are, but then push back further so the wall does not encroach into the r-o-w dedication area. The
second possible solution would be to keep the walls in the same location with the same "tiered" design but then
merging the two walls into one wall at the locations where the front wall would extend into the r-o-w dedication
area.

Dear Ms. Anderson;
This letter is to serve as a follow-up to our phone conversation on the morning of October 24, 2008. On
the phone we spoke of three issues. One pertained to the dedication of land to the City of Wheat Ridge
for future right-of-way improvements along W. 38 b Ave in conjunction with the lot consolidation (Case
MS-08-02). The other two issues pertained to Phase II of the Sandalwood Manor building permit and
should be addressed prior to the next submittal for building permit review.
As discussed on the phone, the third submission of the plat for the lot consolidation has been received. A
digital file on a disk is required by the Public Works Department for their review. No digital file was
received with this submission; therefore Public Works will not review the submitted plat without the
digital file. However, prior to submitting the digital file, both the Public Works and Planning
Departments have identified potential changes to the plat that would create positive solutions for both the
city and the owner of the property to some of the issues raised in past.
If the owner should decide to proceed with the plan as proposed by the City of Wheat Ridge, 4 new, full
sue plats along with a disk containing the digital file should be resubmitted. If the owner should choose
not proceed with the plan as proposed by the City, then a disk with the digital file of the current submittal
on it is all that will be required.
The City will be reconstructing W. 38th Ave from Harlan St. to Wadsworth Blvd. in the near future. As a
part of the improvements to the road, the City will be required to acquire extra land on both sides of the
street. With this lot consolidation, the City sees an opportunity acquire the right-of-way that will be
needed for the future improvements to the road. The proposal by the city would be to dedicate the land
beginning at the back edge of the sidewalk that extends to the west from the comer of W 3811, Ave. and
Harlan St. (please see the attached "area of detail" on the lot consolidation plat) and extending that line
from the back of the sidewalk across the two parcels that have frontage along W. 38th Ave. This would
result in a 7 foot dedication along Parcel 2 and a 14 foot dedication along Parcel 3. It is likely that the
amount land required for the dedication in Parcel 3 will decrease from the 14 feet at the line between
parcel 2 and parcel 3, the further west the line goes.
This dedication would have several positive benefits for both parties involved:
I . The property would become city property and the owner would no longer have to pay taxes on
it.
2. The building would be 16 feet from the property line. This means that building will be only 4
feet off of the required 12 foot requirement in the Architectural and Site Design Manual
(ASDM). Thus making the building closer to the right-of-way line as is desired in the
"traditional overlay area" of the ASDM without having to reorient the building.

3. The area of the dedication would be maintained by the City and would not be the
responsibility of the owner.
4. The dedication of the land at this would result in a much easier process then if the City were to
acquire it immediately prior to the reconstruction of W. 38th Ave.
The two additional requirements discussed in the phone conversation pertain to the building permit
resubmittal.
1. Somewhere on the page that has the proposed site plan a small table should be included that
indicates the breakdown of the square footage of the existing building, the existing building
after the demolition of all areas being removed, the square footage of the new addition , and
the proposed square footage of the entire facility after construction is complete.
2. The Design Review Committee (DRC) would like to the architecture of the "bump-outs" to be
given more careful consideration in meeting the requirements of the ASDM. The committee
does appreciatethe detailgiven to the rest-of-the building and think that this design is an
overall better design than the "colonial style" building that was initially proposed. However,
the "bump-outs" share exactly the same roof-lines, materials, and other architectural elements
incorporated into rest of the W. 38th St. elevation. Since the city has allowed the site to remain
"as proposed" without moving the proposed building, the DRC would like to see the
elevations of the "bump-outs" be given special treatment to help them standout and create a
unique presence along W. 38t' Ave.
The committee would like to see that these elevations have unique identifying features,
changes in materials, varying rooflhres, and other elements that will help to increase their
visual presence while bringing elements of the east and southeast elevations into the southern
elevation. This will help ensure that building will be tied together while creating a uniqueness
and a presences at such highly visual corner in the City of Wheat Ridge.

4. Zoning, lot numbers, and subdivision names are required to be shown for all lot adjacent
the consolidation plat. If the lots have not been platted please label as "Unplatted Land".
5. Lot lines for all adjacent properties must be shown.
6. Add the text, "created by this plat" to the end of the text, "Total Area" which indicates the
total area for all three lots.
7. The "Total Area" block needs to include the area of all three lots in square feet. It is
approximately 91,735.62 square feet.
Other items of concern
1. A "Mineral Rights Certification Form" is required by the State of Colorado to be completed
with this application. This form was not included with the plans that were submitted. One has
been included with this letter. It will need to be filled out and returned with the second round
submittal.
2. Public Works was unable to review the consolidation plat because the plat is not on the correct
City Datum. As of March 1, 2008, all platted projects are required to be on the current City
Datum. An electronic copy of the plat is also required. Please see attached Public Works
review comments from Dave Brossman, dated August 19,2008, for all Public Works
requirements regarding the second submittal.

I received the Consolidation Plat for the above referenced on August 18, 2008 for the property
located at 3835 Harlan Street, and have the following comments:
Public Works cannot review the Plat as received for the following reasons:
a. The Plat is not on the Current City Datum as required by Section 26-407
of the Municipal Code of Laws. As I know you are aware, both the
horizontal and vertical the City coordinate systems moved in January
2008. The old local horizontal datum is now a modified (ground-based)
form of NAD83/92 State Plane horizontal coordinate system, and the old
NGVD29 vertical datum is now NAVD88 datum. These new coordinate
systems combined now comprise the Current City Datum.
b. All Applications received on or after March 1, 2008 need to be on the
Current City Datum.
c. A digital file containing the Plat AutoCAD 2004-2007 format was not
included with the submittal. The Plat will not be reviewed without the
digital file.
d. A completed copy of the Geodetic Surveying Requirements for Final Plats
was not included with the Plat submittal.
2. I have attached a copy of the current Land Surveying Info Packet for the Applicant to
use. I suggest they utilize the Final Plat Review checklist when completing the plat for
the next submittal, since its very likely they were utilizing outdated information when
completing this submittal.

This letter is in response to your request for confirmation of the availability of sanitary sewer service for
the above development. By supplying this information, the Wheat Ridge Sanitation District (District) is
not liable for the misidentification or misrepresentation of the property. The location of the property is
based solely on the description provided by the requestor, and the District is not responsible for the way
in which this information is used or disseminated.
The property is entirely within the boundary and service area of the District. The District collection
system in this area consists of a 12-inch sanitary sewer main line within Harlan Street to the east of the
property. Treatment of sewage generated within the District is provided by the Metro Wastewater
Reclamation District.
The District will be able to serve the property with respect to sanitary sewer service. The District's Rules

This letter is written to request lot consolidation of the three parcels owned by the Sandalwood
Partnership at 3835 Harlan Street, 6025 West 39`h Street, and 6005 West 38`h Street, Wheat
Ridge, Colorado for the purpose of renovating the interior and exterior of the existing facility at
3835 Harlan Street and construct a new 30 bed, 15,000 square foot rehabilitation facility addition
at the south end of the existing facility.
The existing 75 bed, 30,000 s.f. facility located at 3835 Harlan Street was constructed in three
phases with the original facility in 1959 and additions and alterations in 1961, 1964, and 1972. It
sets on what is noted as Partial 1 on the attached survey information. In 1992 during the purchase
of the facility the present owners also purchased the corner lot to provide additional parking for
the facility. And more recently the purchase of Partial 3 was made to allow for the expansion of
the facility.
A portion of the existing building will be demolished to provide parking for the spaces that will
be lost along west 38"i Avenue where the expansion is proposed.

Applicant/Owner Preliminary Proposal:
The applicant is proposing to renovate the interior and exterior of the building, at the
address indicated above, to upgrade the existing mechanical and electrical systems in
addition to cosmetic repairs and finish restoration.
Additionally, a new 30 bed, 15,000 square foot rehabilitation facility will be constructed to
the south end of the existing building highlighted by a porte cochere facing the corner of
W. 38th Ave. and Harlan St. A portion of the existing building will be demolished in order
to provide parking for the spaces that will be lost along W. 38th Ave. side due to the
expansion. The new building will be built with architecture in mind and will include
varying elevations to break up the massing along W. 38th Ave. The new sidewalk along
W. 38th Ave. will be detached with street trees and tree lawns.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will not be required for a building permit.
Planning comments:
The parcel on which the action is being requested is zoned Commercial One, C-1 and
Neighborhood Commercial, N-C. These districts are established to provide for areas with
a wide range of commercial land uses including, office, general business, and retail sales
and service establishments which are supported by the neighborhood, community and
region.
The property is located on the northwest corner of W. 38th Ave. and Harlan St. The
majority of the area is zoned commercially, whether it be C1, N-C, or R-C, as W. 38th
Blvd. is a major street with commercial uses extending from Sheridan Blvd to Wadsworth
Blvd. Directly to the north of this property there is an area of R-3 zoning that includes a
mix of single family homes, duplexes, and multi-family units. The lot to the north of the
proposed project does have a multi-unit building on it.
The current use on the property in question is an allowed use and can be expanded upon.
Since the current use is allowed, building permits are all that are need to be obtained.
However, they will need to be obtained before any renovations or construction on the
building can begin. The building permit will be reviewed and approved by staff. No
hearings before Planning Commission or City Council will be required for obtaining
building permits. This greatly reduces the time of the review and approval period.
During the remodel or expansion of any commercial building, there are 3 main
components of the remodel or expansion that are reviewed by staff. First, if a change in
the land use occurs or the floor area of a business is expanded, parking must meet the
requirements. If the new use requires more parking than previously required, the
appropriate increase in the amount parking must be provided.
The parking does look as if it will meet the minimum required spaces for a retirement
home and rehabilitation facility. Lost parking from the W. 38th Ave. frontage has been
moved to the northern portion of the property.
The second component reviewed by staff is the architecture and site design of the project.
The building must meet the architectural requirements set forth in the Architectural and
Site Design Manual to ensure the building is architecturally pleasing and is constructed of
quality materials.
The proposed expansion complies with the overall intended requirements of the
Architectural and Site Design Manual (ASDM). The quality of the architecture and site
should be incorporated into the landscaping and tree lawns. The detached sidewalk
along W. 38th Ave. should mimic the improvements that were installed between Sheridan
Blvd. and Harlan St. on W. 38th Ave. as part of the City's 2002 streetscape improvement
project. This should include street furniture, light fixtures, trees, and other landscaping
elements. Signage should also be taken into account in incorporating it into the design of
the site. Signage on the property at the northeast corner of W.38th Ave. and Harlan St. is
a good example of signage being incorporated into the site design and landscaping.
With the expansion, the property still must meet the minimum commercial landscape
requirement of 20%. Inner courtyards and other landscaped areas may count towards
this total. Any landscaping located in city right-of-way cannot be counted towards this
total. This includes tree lawns, trees, shrubs, or other landscaping elements that are in
the right-of-way. When building permit applications are submitted, a landscape plan will
be required and must provide a breakdown of the landscaping and hard surfaced areas.
Finally, the building must be ADA accessible and must also meet all other pertinent
codes. The City of Wheat Ridge currently uses the 2003 International Building Code for
building code standards for all new and remodeled commercial buildings.
A lot consolidation will be the only other requirement in addition to obtaining the building
permits. Currently, the property spans three lots. A lot consolidation will legally make the
three existing lots into one large lot. This is a requirement as it is not permitted to build
across lot lines in the City of Wheat Ridge even if they are under the same ownership.
This will free up more land for development and will provide greater ease in building if
future expansions are anticipated. The lot consolidation can be done concurrently as
building permits are being pulled or prior to issuance of a Certificate of Occupancy. A lot
consolidation of the 3 lots will require a hearing before the Planning Commission.
Public Works comments:
See attached Public Works. Further comments will be made upon application submittal.
Building comments:
Building Department was not present at the meeting. Comments will be made upon
application submittal.
Economic Development comments:
Urban renewal funds may be available for some of the improvements to this site. A
request may be made for funding may be required at a hearing before the Urban Renewal
Authority. It is recommended that this request not be made until plans are closer to the
final phases or are more concrete than conceptual.

The existing 75 bed, 30, 000 s.f. facility located at 3835 Harlan Street was constructed in
three phases with the original facility in 1959 and additions and alterations in 1961, 1964,
and 1972. Further updates in 1992 provided the facility with a fire sprinkler system
including a dry-pipe system in the attic.
The proposed work is initially a maintenance update of the existing facility to upgrade
the existing mechanical and electrical systems including replacing damaged piping,
upgrading the MAU in the main kitchen and the corridors, and replacing the
emergency generator, in addition to cosmetic repairs and finish restoration.
However, on a much larger scale a new 30 bed, 15, 000 s.f. rehabilitation facility
addition is proposed to be constructed at the south end of the property with the entry
porte cochere facing the corner of Harlan and 38th Avenue. The existing parking
currently located at this corner and parallel to 38th Avenue will be reworked to remain
along 381h Avenue and wrap behind the facility at the north end of the property. The
parking count will increase to provide the required 61 spaces for the completely built-
out facility. The facility will be single story with roof slopes similar to the existing facility,
combining gable end and hip roofs. The fagades have been set back 30 feet from the
ROW and the revised parking will provide the required 55 foot site triangle at the corner.
The proposed exterior finishes will be a combination of stone, masonry and lap siding
with an asphalt shingle roofing system. The undulating elevations with varying finishes
are proposed to represent different homes within a home. The 30 foot setback along
38th Avenue is to be landscaped with a meandering sidewalk, shrubs and trees as
approved by the City of Wheat Ridge. Trees will also be added along Harlan Street as
well as landscaping in the parking areas to meet the standards as noted in the City of
Wheat Ridge Design Standards.

Public Works Requirements:
2 Copies of the following civil engineering documents shall be created, signed, and sealed by a
Professional Engineer licensed in the State of Colorado, and submitted for review along with the
Building Permit Application:
1. Final Drainage Report: On-site detention incorporating water quality measures is
required for all commercial developments. A Final Drainage Report and Plan shall be
required. (Please see attached Site Drainage Requirements).
2. Grading & Erosion Control Plan: A Grading & Erosion Control Plan, including
specific details for all BMP's to be utilized both during and subsequent to construction.
3. Construction Plans: Construction Plans shall be required for all public improvements
and drainage-related items such as detention ponds, outlet structures, drainageways or
pans, and curb, gutter, & sidewalk. Include all COWR standard details for all proposed
constructed items (please see Note 1 below).
4. NPDES Permit: The area of the site is greater than 1 acre. Therefore, please be advised
that if the proposed area of disturbance is greater than one acre, a CDPS General Permit
for Stormwater Discharges Associated with Construction Activity shall be required from
the State of Colorado. This permit is issued through the Colorado Department of Public
Health & Environment, Water Quality Control Division. A Copy of the CDPS Permit
accompanied by a Stormwater Management Plan (SWMP) shall be submitted to the City
of Wheat Ridge for review and approval prior to issuance of any Grading/Fill and
Building Permits.
5. Site Plan: A Site Plan to include the following:
a. 24" X 36" sheet format.
b. A scale, north arrow, and vicinity map.
c. The boundary of the site and existing and proposed lot lines are to be completely
described using bearings and distances.
d. Date of map preparation, and the name, address, and fine of who prepared the
map.
e. Location of 100-year floodplain, if applicable.
f Existing and proposed contours at 2-ft intervals.
g. Adjacent streets, including Right-of-Way widths, names, and ROW centerlines.
h. Location of all existing & proposed easements and rights-of-way, fences, walls,
drainageways, ditches, buildings to be developed or retained on site.
4. Final Plat: A Final (Consolidation) Plat will be required as this design proposes building
across existing lot lines.
5. Trip Generation Study: A Trip Generation Study comparing existing values with proposed
values shall be required.
