The property in question is 50' wide with C-1 zoning on the eastern 35' and R-C zoning on the western 15'. The owners applied for a change of zoning to consolidate zoning on the property to C-1. Pursuant to Case No. WZ-00-01, the request was granted by City Council on May 22, 2000. A copy of the approving ordinance is attached.. Because of the unusual conditions on the property regarding the small size, multiple buildings and limited parking, staff requested an application for administrative planned building group be pursued as well. The applicant is proposing no physical changes to the property and the recorded pbg will be an encumbrance on the title. Future physical changes to the property will require re-review. For these reasons, Staff is not addressing the criteria used to evaluate a pbg and is recommending the planned building group plan be approved with suggested revisions. I. REQUEST The applicant requests approval of a rezoning from Restricted-Commercial and Commercial-One to Commercial-One for property located at 9709 W. 44th Avenue. The purpose of the rezoning is to allow motorcycle repair in the front building on the property and to consolidate zoning on the property. The request is for approval of a zone change only, not review of the submitted site plan which is for illustrative purposes only. No physical changes are proposed fot the property. Attached as Exhibit `B' of the Planning Commission report is the applicants' description of the use. II. AGENCY REFERRALS All of the responding agencies are currently serving the property. III. EVALUATION CRITERIA The City's Code of Laws provides the following review criteria to be used when evaluating requests for rezoning: That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. 2. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions. In addition to #2, that the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, comprehensive land use plan and other related policies or plans for the area. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. 5. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. 6. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. 7. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to adjacent properties. 8. That the property cannot reasonably be developed under the existing zoning conditions. 9. That the zoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. 10. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. IV. PLANNING COMMISSION ACTION A Planning Commission public hearing was held regarding this case on March 16, 2000. A recommendation of approval was made with the following conditions: 1. Use of the front building be limited to motorcycle repair as described in the applicants' Exhibit `B'. 2. A cross access/joint parking agreement with the property to the east be recorded. 3. There be no outside storage or repair 4. The proposed retail be limited to accessory items used by motorcycle enthusiasts such as t-shirts and chaps. 5. No parts sales be allowed. 6. There be no test driving of the motorcycles including "revving" of engines. 7. There be no delivery by semi's 8. Only biodegradable products be used in the cleaning processes 9. No painting be allowed. 10. No body work be allowed. 11. Hours of operation be limited between 8 a.m and 7 p.m. Based on information given by the City Attorney regarding appropriate zoning conditions, Staff is recommending that #2 above relating to cross access and joint parking with the property to the east be the only condition of approval. The applicants who own the property to the east have agreed to this condition. The ordinance has been modified accordingly. Legal description of the property. The legal description for both 9707 and 9709 W. 44th Avenue has been added as discussed at our meeting on March 7th. The legal description is part of the Declaration of PBG statement. 3. Scale and north arrow. A scale and north arrow has been provided on the PBG plan. 4. Date of preparation and preparer's name and address. The date of preparation, preparer's name and address has been added to the plan. 5. Fence locations. The location, height and type of fence at the rear of the property has been identified on the PBG plan. 6. Sign locations. No signs are currently located on the site. Any future signs will meet requirements of Article IV of the Wheat Ridge Zoning Code and is noted (see note number 1) on the PBG. 7. Building setbacks. The building setbacks per the property improvement surrey has been identified on the plan. 8. Vicinity Map. A vicinity map has been added to the PBG plan. 9. Fencing types and heights.
