10. NEW BUSINESS
A. Case No. ZOA-99-05: Review and discussion on court decisions concerning
ordinances governing Day Care Centers.
Alan White presented this matter which was brought to staff's attention by the city attorney.
He explained that present zoning regulations show day care centers as special uses in R-2, R-
2A and R-3 zone districts. In a lawsuit decided against the city, the district court ruled that
the ordinance violates the city charter rules. He asked for direction from the Commission in
this matter.
It was moved by Commissioner SNOW and seconded by Commissioner THOMPSON
that the Planning Commission recommend to City Council that they repeal or remove
the existing language which the court has already found was not legally adopted. The
motion passed unanimously.
11. COMMISSION REPORTS
A. Comprehensive Plan Hearing - Commissioner SNOW moved and Commissioner
THOMPSON seconded that Planning Commission Chair BRINKMAN appear before
the City Council at its next meeting to encourage adoption of the Comprehensive Plan.
The motion passed 5 to 1 with Commissioner GOKEY voting no.
B. Brewer Tire Property - Commissioner THOMPSON asked what the owner plans for this
property. Mr. White replied that they plan to operate a repair service; however a large
percentage of repair is planned to go to another site so there won't be so many semi trucks
coming into the facility. He stated that the owners have been informed that the city will be
monitoring the situation to ensure that this repair does not evolve into the primary use
category which would constitute a code violation. Commissioner THOMPSON suggested
examining the ordinance which defines primary use. She expressed concern that, even
though the involvement of semi trucks may not be the primary use, this use can still involve
a large number of semi trucks on a property.
Commissioner SNOW expressed concern about semi trucks backing onto 44th in order to
turn around. Mr. White stated that this is supposed to be a pull in, drive through and pull out
situation and, in theory, there shouldn't be any backing up and blocking 44th Avenue.
C. I-70 and Hiahway 58 - In response to a question from Commissioner THOMPSON, Mr.
White responded that he does not yet know the date of the next public hearing on this matter.

RE: CODE OF LAWS SECTIONS ON DAY CARE CENTERS
As you are aware, the Code of Laws was amended in 19_ to add large
day care homes, small day care centers and day care centers as special uses in
the various residential zone districts in the City. However, that Code change was
attempted in a single ordinance which also addressed other issues. Because of the
single-subject requirement of Charter Section , the Jefferson County
District Court held that the ordinance was ineffective, and that the insertion of day
care homes as special uses in the residential districts was not effective or
enforceable.
The references to day care homes, however, were made and are present in
the existing printed copies of the Code of Laws, although those references are not
enforceable by virtue of the Court's decision.
I have prepared an ordinance repealing [reinstating] those references for
your consideration. It is attached.

TITLE: AN ORDINANCE REPEALING SUBSECTION 26-10(E)(2) AND (8)
OF THE WHEAT RIDGE CODE OF LAWS
WHEREAS, existing Subsections 26-10(E)(2) and (8) of the Wheat Ridge
Code of Laws classify large day care homes and small day care centers as
requiring a special use permit in the identified residential zone districts; and
WHEREAS, in Case No.

the applicability of the enforceability of these sections, as a result of their having
been adopted by Ordinance No. , Series 19_, was held invalid
and the adoption of the subsections themselves invalid; and
WHEREAS, the City Council wishes to [repeal the existing language]
[readopt said language in full compliance with Section of the Charter.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1 Subsection 26-10(E)(2) and (8) of the Wheat Ridge Code of
Laws are hereby repealed.
Subsection 26-10(E) of the Wheat Ridge Code of Laws is amended by the
addition of the following subsections, to read:
(E) Special Uses: The following uses shall be
permitted only upon approval of the Wheat Ridge
Planning Commission and city council, following
procedures as set forth in Section 26-6(B).
(1}
(2) Large day care home (see Section 26-5,
Definitions). .
(8) Small day care center.
Section 2 Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained. .
Section 3 Severability; Conflicting Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby repealed.
Section 4 Effective Date. This Ordinance shall take effect fifteen days
after final publication, as provided by Section 5.11 of the Charter.
