HomeMy WebLinkAboutZOA-02-02CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER Mancinelli Council Bill No. 14-2002 Ordinance No. 1248 Series of 2002 TITLE- AN ORDINANCE AMENDING CODE OF LAWS SECTION 26- 603(2) CONCERNING SIGHT DISTANCE TRIANGLE STANDARDS WHEREAS, Section 26-603(2) of the Wheat Ridge Code of Laws governs standards for sight distance triangles at street intersections, and WHEREAS, the Council wishes to provide for specific sight distance triangle standards for the intersection of collector and arterial streets with one another; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO Section 1. Wheat Ridge Code of Laws 26-603 is hereby amended by the addition of two new subsections 2.e and 2 f to read. 2 Sight distance triangle requirement a. e. At signalized intersections, where both streets are either collectors and/or arterials, the required sight distances shall be governed by the standards set forth in the most current edition of the Policy on Geometric Design of Highways and Streets, published by the American Association of State Highway and Transportation Officials (AASHTO). f. For other signalized intersections involving local streets, the director of Public Works (or his/her designee) is authorized to permit modifications to the sight triangle requirements for special circumstances in accordance with the standards set forth in the most current edition of the Policy on Geometric Design of Highways and Streets, published by the American Association of State Highway and Transportation Officials (AASHTO) Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and GED\53027\407866 01 safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability: Conflicting Ordinances Repealed. If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Effective Date. This Ordinance shall take effect fifteen days after final publication, as provided by Section 5.11 of the Charter. Council Bill 13-2002 - An Ordinance repealing and reenacting Chapter 7 of the Code of Laws of the City of Wheat Ridge concerning the conduct of municipal elections. Council Bill 13-2002 was introduced on second reading by Mr. DiTullio, who also read the title, summary and background. Clerk assigned Ordinance No. 1247. Mr. Dahl explained that this Ordinance will eliminate having to review the election code each year to make sure it complies with State Law. He pointed out that the provision on campaign contribution limits will no longer be in the Code. Mr. Dahl also stated that this will eliminate the forms for Disclosure of Real Property and Disclosure of Conflict of Interest. Motion by Mr. DiTullio for approval of Council Bill 13-2002 (Ordinance 1247); seconded by Mr. Edwards; carried 7-1 with Mr. Gokey voting no. Item 3. Council Bill 14-2002 - An Ordinance amending the Code of Laws Section 26-603 (2) concerning Sight Distance Triangle Standards. Council Bill 14-2002 and was introduced by Mr. Mancinelli, who also read the title, summary and background. Clerk assigned Ordinance No. 1248. Motion by Mr. Mancinelli to approve Council Bill 14-2002 (Ordinance No. 1248) on second reading as attached to this packet and it take effect immediately after final publication; seconded by Mr. Edwards. Wheat eat of PMdge ub Public Works Department M E M O R A N D U M TO: Randy Young, City Manager FROM: Bob Goebel, Director of Public Works DATE: May 6, 2002 SUBJECT: Sight Triangle Code Revision On May 2, 2002, this item was presented to the Wheat Ridge Planning Commission and discussed. The addition of paragraph (f). was recommended by the Traffic Engineer and Planning Director. The Planning Commission recommended the addition of a reference to the same Policy Manual as referenced in paragraph (e). Since these changes are considered minor, the attached ordinance has these changes incorporated into it. The difference between the attached ordinance, and the ordinance published on first reading is the addition of paragraph (f). The staffs recommended addition of paragraph (f) with the manual reference recommended by Planning Commission allows the safest possible design to occur based on engineering design rather than arbitrary dimensions. In very special cases, the sight triangle may need to be modified if certain geometric conditions occur which result in the present distance requirements to be unsafe. The vast majority of sight triangles on local streets will be adequate with the existing code. On May 3, 2002, this item was discussed at the Public Works Advisory Committee meeting with no changes recommended. The Planning Commission, Public Works Advisory Committee, and the staff recommend approval of the ordinance on second reading in its attached form. Dahl, City Attorney ` GED\53027\407866.01 2 City Wheat Ridge MEMORANDUM Department of Public Works TO: City Council FROM: Bob Goebel, Acting Manager Today DATE: April 19, 2002 SUBJECT: Ordinance Revision for First Reading It has come to our attention in the implementation of the Streetscape Manual that the current ordinance for sight distance triangles is inappropriate for collector and arterial streets when they intersect with one another. Arbitrarily setting a measured distance at an intersection which is controlled by a traffic signal and has many turn lanes and turning movements creates the need for the added safety of engineered sight distance requirements. The American Association of State Highway and Transportation Officials Policy on Geometric Design has specific design requirements which should be used as the standard of safety for these intersections due to their unique configuration of turn movements, turn lanes, signalization, and higher speeds. The City Manager, The City Attorney, and I respectfully request that this item be addressed as soon as possible. To that end, and with the possibility of the May 27, 2002 meeting being canceled, we recommend that the attached item be added to the April 22, 2002 agenda for first reading. This item will then be discussed at PWAC on May 3`d and be up for your consideration on second reading at the May 13'h City Council meeting. It does not function well for the intersection of collector and arterial streets with one another. The ordinance amends the Code to apply the standards of the Institute of Transportation Engineers to such situations. This situation came to Staff's attention in connection with the City's streetscape project and monument sign at the intersection of 38w Avenue and Sheridan; however the change is needed for all such intersections in the City. PUBLIC FORUM There was no one to appear before the Commission at this time. 7. PUBLIC HEARING A. Case No. ZOA-02-02: An ordinance amending Section 26-603.2 of the Wheat Ridge Code of Laws concerning sight distance triangle standards. Alan White stated that proper notice requirements concerning this hearing had been met. He entered all pertinent documents into the record and informed the Commission they had jurisdiction to hear the case. The case was presented by Bob Goebel. The proposed ordinance follows safety guidelines set forth by the American Association of State Highway and Transportation Officials Policy on Geometric Design. He reviewed the staff report which recommended approval of the ordinance. In response to a question from Commissioner WEISZ, Mr. Goebel stated that he did not know exactly how many intersections would be affected and it is planned to correct sight distance triangles as staff becomes aware of them. Commissioner SNOW expressed concern about liability for the city if each intersection in the city is not evaluated. Mr. Goebel stated that there is not adequate staff time to evaluate each intersection in the city. In response to a question from Commissioner McMILLIN concerning the different heights of vehicles on the road, Mr. Goebel stated that the standard height for a driver's eye is 42 inches. There were no members of the public in attendance to address the ordinance. It was moved by Commissioner PLUMMER and seconded by Commissioner SNOW that Case No. ZOA-02-02, an ordinance amending Section 26-603.2 of the Wheat Ridge Code of Laws concerning sight distance triangle standards be amended to add the following words to Section 6: in accordance with the most current edition of the Policy on Geometric Design of Highways and Streets, published by the American Association of State Highway and Transportation Officials (AASHTO) and forwarded to City Council with a recommendation of approval. The motion passed unanimously. A. Case No. ZOA-02-03: An ordinance amending Articles I, III and IV of the Wheat Ridge Code of Laws concerning preliminary development plans and preliminary subdivision plans. This case was presented by Mary Austin. She reviewed the staff report which set forth a recommendation of approval of the proposed ordinance which would result in an elimination of redundant information and a reduction in review and processing time for applicants as well as staff.
