After thinking about it I wonder if that is request is necessary since the structure has existing electrical, water, and heaters, which I will have brought up to code by city licensed contractors? Should default be made in payment of this agreement, a lien will be placed on the property and charges will be added from the date of restoration completion at the maximum allowed by law. If placed in the hands of an attorney for collection, the "Customer" will pay all attorney and legal fees. Colorado: Any person or company supplying labor or materials for this improvement to your property may tile a lien against your property if that person or company is not paid for their contributions. 4. The "Company" and the "Customer" agree to settle all disputes in accordance with the laws of Colorado and the county in which the agreement is executed. S. The full amount of all money as specified by an agreed price, or as specified by "Full Scope of Insurance Proceeds" does not include any extras such as carpentry repairs, or any other repairs not specified, and not covered by the "Full Scope of Insurance Proceeds", that is necessary to complete the repair process as required by local building codes, and building officials, or to satisfy cosmetically, the "Customer". 6. If the "Customer" chooses not to pay for a part of the scope of the agreement, an individual line item or a trade, the "Customer" releases the "Company" of its obligations for the performance of that component with regard to the integrity of the building system as a whole. 7. The "Company" is not responsible for damage below the roof due to leaks caused by excessive wind greater than 55mph, ice damming or hail, at any time during the construction process, or warranty period. 8. "Company" will not be responsible for soft, de -laminated, rotten or poorly installed decking below roofing material. "Customer" i s responsible for cost of decking replacement to satisfy "Company's" workmanship warranty. 9. The "Company" will not be responsible for slight scratching and denting of gutters, oil droplets in driveways, hairline fractures in concrete, flowers, or minor broken branches on plants and shrubbery. 10. You have the right to rescind this contract and obtain a full refund of any deposit within 72 hours after entering the contract. If you plan to use the proceeds of a property and casualty insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after you receive written notice from the property and casualty insurer that your claim has been denied in whole or in part. However, Johnson Construction Company LLC. is entitled to retain payments or deposits to compensate Johnson Construction Company LLC. for roofing work actually performed in a workmanlike manner consistent with standard roofing industry practices. Johnson Construction Company LLC, cannot pay, waive, rebate, or promise to pay, waive or rebate all or part of any insurance deductible applicable to the insurance claim for payment for roofing work on your property. 11. This agreement cannot be canceled once negotiations begin with your insurance company, and/or material has been delivered to your job site without written mutual agreement of both parties. 12. If this agreement is canceled by the "Customer" later than three (3) days from execution, 'Customer" agrees to pay to the "Company" 15% restocking fees if materials have to be returned due to cancelation. 13. The "Company" reserves the right to supplement the Insurance Company for increases in the "Full Scope of Project Work", and or documented price increases from suppliers.
