♦�A City of Wheat�idge COMMUNITY DEVELOPMENT Memorandum TO: AMOF Partnership, Address file for 10001 W. 32°d Avenue FROM: Scott Cutler, Senior Planner DATE: August 29, 2024 SUBJECT: Dwelling Units and Legal Nonconforming Status — 10001 W. 32°d Ave. The property at 10001 W. 32°d Avenue has a long history that pre -dates the City of Wheat Ridge, with multiple uses and building additions over the years. On August 6, 2024, Mary Panio, on behalf of the AMOF Partnership (owner), submitted an Existing ADU application to seek legalization of three existing dwelling units on the property. In prior communication with Mary Panio, staff recommended submitting the Existing ADU application in order to initiate a review of the existing dwelling units on the property and the potential best way to recognize them. The Existing ADU application specifically requested additional research and legalization of the duplex/dormitory building and the "small house." The City and Jefferson County have recognized four total dwelling units on the property: • Main house (constructed in—1927-1935): This house was originally a large home that was later used as a group home from the mid 1980s until 2013. It contains multiple bedrooms, a commercial kitchen, and is approximately 5,500 square feet according to the County. It is currently occupied by one of the owners of the partnership. • Duplex (constructed in—1982): Previously used as a dormitory for staff, this building contains two dwelling units and is a total of approximately 3,200 square feet. Each dwelling unit has two bedrooms and a kitchen and a separate entrance. This building is located immediately to the east of the main house. • Small house (constructed in—1942): This building is approximately 900 square feet and contains one bedroom and a kitchen. Some staff reports recognized this as a cottage and others as an office, reflecting its various uses over the years. This building is located in the northeast corner of the property, closer to Kipling Street. Another house is located on the adjacent property at 3250 Hillside Drive, which was previously under the same ownership. That house is located on a separate parcel and now has a separate owner, so was not analyzed as part of this report. The City has recognized the duplex and small house for decades as separate dwelling units, memorialized in staff reports throughout the City's history. However, these dwelling units were never formalized with a recognition of their legal nonconforming status, nor officially assigned separate addresses, as for many years they served as dwelling units for staff and caretakers of the group homes. They do not function as traditional ADUs as the property is set up in a more institutional or campus format. The buildings have been rented out to various tenants after the 2013 closure of the group home. The R-1 zoning allows for a single -unit home plus ADU on lots of 12,500 square feet or more. The property could potentially be subdivided in the future to accommodate new development with additional lots under the R-1 zoning. The duplex and small house are subject to the legal nonconforming provisions in Section 26-120 of the City Code. If removed or decommissioned as dwelling units, they could not be rebuilt as - is, but the property is still eligible for a new ADU if those structures are removed or decommissioned. A new ADU would not be permitted on the property at this time due to the presence of the duplex and small house. Due to the history and institutional nature of the property, the duplex and small house are better identified as legally nonconforming dwelling units, instead of as ADUs. As part of this recognition of the duplex and small house as being legally nonconforming, each of the three dwelling units is eligible for a separate address, which will allow separate meters for utility billing.
