Midroof & Final Roof inspections for ROOFS 6/12 PITCH & OVER: 3rd party inspection will be
required for both the midroof and final inspections. The 3rd party inspection report AND
THE ORIGINAL PERMIT CARD needs to be dropped off to the Permit Desk at the City of Wheat
Ridge. The report MUST BE SIGNED by the Homeowner.
REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec.
R806. The installation of ridge venting requires the installation or existence of soffit
venting. For calculation purposes, one hat or turtle vent equal to one-half of one square
foot of opening.
Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name) roof
covering" is required to be on site at the time of final inspection.

6. The issuance or granting of a permit shall not be'couued to be a permit for, or an approval of, anviolation of any provision of any

This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE
AND TIME WINDOW TO COMPLETE THE TRANSACTION. You will be notified if

at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

Please be advised that this law firm represents Fred and Kathy Marvel, who own the
property located at 10875 W. 32"d Avenue; Wheat Ridge, Colorado. The Marvels have requested
that I respond to your letter to them dated May 19, 2003.
First, it is important to clarify the material inaccuracy in the first sentence of your letter.
The Marvels have never requested that the City Manager provide any type of determination in
regards to the use of the batting cage at their residence.
Second, regarding the comment in your letter which references the batting cage ending up
being a"quasi-public recreation or commercial facilities", the City has been advised by the
Marvels on numerous prior occasions that they have never utilized the batting cage in that
manner nor do they intend to operate the batting cage in that manner. The batting cage is purely
for recreational use, and is similar to the innumerable property owners in the City of
Wheat Ridge who have basketball courts, volleyball courts, tennis courts, swimming pools, and
similar recreational facilities on their residential property. All of these varied recreational
facilities are used by not only the property owners and their families, but also by neighbors and
guests of the property owners. The Mazvels' batting cage is utilized in this same manner, which
is consistent with what is permitted by the Wheat Ridge Municipal Code. If you believe there is
some provision in the City of Wheat Ridge Municipal Code that expressly limits the use of a
batting cage and similar recreational facilities on residential property in the City of Wheat Ridge
to the owners of the property and family members only, please provide me the specific citation to
that portion of the Municipal Code on or before June 9, 2003.
Finally, in reviewing this situation with Mr. and Mrs. Marvel, you should also be aware
that other issues exist in this matter, including but not limited to; (1) the City's attempted
interpretation of the Municipal Code in a manner that results in a]ack of uniformity of
enforcement of municipal ordinances; (2) the selective enforcement of municipal ordinances,

which has resulted in the Marvels being inappropriately singled out by City of Wheat Ridge
officials, including you, for treatment in a manner that is not provided for in the City of Wheat
Ridge Municipal Code; (3) David Schneider's inappropriate misuse of his public office and
resources of the City of Wheat Ridge for the sole purpose of pursuing his own personal issues
with the Marvels.

The purpose of this letter is to respond to your request to the City Manager regarding a
determination on the use of the batting cage at your residence. Because the cage is located in a
residential zone district on a privately owned residential lot, the use is limited to the owners of the
property and family members. This limitation is enforced so that such facilities do not end up being
quasi-public recreation or commercial facilities impacting the surrounding residential
neighborhood.
I also wanted to remind you that the building permits for the batting cage and basketball court at
your residence are nearing their expiration date. Our records indicate that no final inspections have
been requested. We need to complete Ihe inspections in order to issue certificates of compliance for

Per your request, please find attached a copy of the zoning code related to fencing standazds. Per
section 26-603 (G.) recreational fences may be constructed to a height not to exceed ten (10) feet in
height. Per section 26-603 (C.) columns, poles and posts shall be permitted to be constructed up to
one (1) foot higher than the permitted fence heights.
Per the correction notice dated June 17, 2003, the existing poles supporting the netting are in excess
ofthe allowable eleven (11) foot height limitation.
Once the items on the cosection list have been completed, contact our office to perform a
reinspection of the batting cage.

The memo is intended to define the current status of the drainage improvements for the project at Marvel
Minor Subdivision and lot 3, 10875 W. 32"d Avenue. .
The drainage faciliries and grading as defined by the approved drainage report have been installed. Those
drainage facilities include:
1. The detention pond at the southeast corner of lot 3, 10865 W. 32nd Ave. is 25X5X6 feet deep,
filled witk: washed &'/<" river *ock and graded in accerdance with the original 3rainage
plan.
2. The detenfion pond at the southwest corner of lot 3, 10865 W. 32nd Ave. is 25X5X6 feet deep,
filled with washed'/~" &'/<" river rock and graded in accordance with the original drainage
plan:
3. The detenrion pond at the northwest corner of lot 2, 10855 W. 32"d Ave. is 25X5X10 feet
deep, filled with croshed 12" rock and graded in accordance with the ground teaain. Tlus
detention pond was not on the original drainage plan.
4. The detention pond at the northwest corner of lot 2, 10855 W. 32°d Ave. (item #3) has a
mechanical sump pump mounded approximately three feet from the top of the pond that
pumps excess surface water to the detention pond on lot 1. This sump pump was not on the
original drainage plan. Ken Fenwick will determine the effecriveness of this device.
5. The detention pond at the northwest corner of lot 1, 10845 W. 32"d Ave. is 25X5X6 feet deep,
filled with crushed 12" rock and graded in accordance with the ground tenain. It receives
excess surface overflow pumped from the lot 3 detention ponds on the southwest corner. This
detenfion pond was not in the original drainage plan.
6. In addifion, these three lots may be adversely impacted by the inconect grading in accordance
with their original drainage plans of the three lots directly east of the Marvel Minor
Subdivision. Crreg Knudson has indicated he will review this issue. Ken Fenwicic wili attempt
to evaluata and quantify flie adverse impact on lots 1, 2, & 3 of this issue.
I have requested Ken Fenwick to review these six items and determine if the all the drainage facilities and
grading for the three lots have been constructed at least per the approved drainage plan and re-certified it.
In addition, Ken Fenwick will provide written confirmafion, based on hydrological analysis, of the
effectiveness of each detention pond trench drain to percolate flows into the ground in relation to the tngh
gromid water table that has been aggravated by the construction in the azea and the erroneous grading of the
lots east of Marvel Minor Subdivision. Earl Vader excavated the ponds on lots 1, 2, & 3 and concurs
with the details outlined in this memo.

Dear Mr. Fenwick,
This letter is to inform you that the drainage certification letter prepared by you, and dated
November 30, 1999 for the respective drainage improvements for the above referenced project is
hereby denied by the City of Wheat Ridge. This denial is based upon recent, onsite inspections of
the site which have revealed that the two required detention areas with trench drains, located on
the east and west sides of Lots 2 and 3, have not been constructed, as designed in the Final
Drainage Report prepazed by you on Apri121, 1996, and approved by the City of Wheat Ridge
on Mazch 31, 1998.
Please be awaze that effective immediately, no Certificates of Occupancies will be issued for the
remaining two single family residences at Lot 1 and Lot 3 until the following items are
addressed:
1. A(1 of the drainage facilities and grading for this site have been constructed per the approved.
drainage report and plan, and correctly re-certified.
2. Written confirmation, based upon the respective hydrological analysis, will need to be
provided regarding the effectiveness of each detention pond trench drains to percolate flows
into the ground in relation to the high ground water table that has been made apparent by the
construction in this azea.

and construction of barriers for swimming pools located on the
premises of Group R. Division 3 Ocwpancies.

ments of this cnde, safety covers for pools and spas shall meet the
requirements for pool and spa safety covers as listed below. The
standard Iis[ed below is a recognized standard. (See Section

SECTION 420 - DEFINITIONS
For the purpose of this section, certain terms, words and phrascs
are defined as follows:
ABOVEGROUND/ON•GROUND POOL. See definition of
"swimming pool."
BARRIER is a fence, wall, building wa]I or combination

shall comply with the following:
1. The top of the barrier shall be at least 48 inches (1219 mm)
above grade measured on the side of the barrier that faces away
from the swimming pool. The maximum vertical clearance
between gradeand the bottom of the barrier shall be 2 inches
(51 mm) measured on the side of the barrier that faces away from
the swimming pooL The maximum vertical clearance at the bot-
tom of the barrier may be increased to 4 inches (102 mm) when
grade is a solid surface such as a conerete deck, or when the barrier
is mounted on the top of the aboveground pool structure. When
barriers have horizontal members spaced ]ess than 45 inches
(1143 mm) apart, the horizontal members shall be placed on the
pool side of the barrier. My decorative design work on the side
away from the swimming pool, such as protrusions, indentations
or cutouts, which render the barrier easily climbable, is prohibited.
2. Openings in the bacrier shall not allow passage of a
13/4-inch-diameter (44.5 mm) sphere.
EXCEPTIONS: 1. When verlical spacing benveen such opcnings
is 45 inches (1143 mm) oc more, the opening size mny be incceased
such that the passage of a 4-inch-diameter (]02 mm) spheee is mt
allowed.
2. For fencing composed of vertical and horizontal members, the
spacing betweeu vectical membecs may be increased up t0 4 inches
(103 mm) when the distance betwcen the tops of horizootal members
is 45 inches (1143 mm) or more.

that is not an indoor pooL 3. Chain link fences used as the barrier shall not be less than
facili[ies, designed for immcrsion of users aud usually having a
filter, hea[er and molor-driven blower. It may be installed indoors
or outdoors, on the ground or on a supporting stiucture, or in the
ground or in a supporting structure. A nonself-contained spa is
intended for recrealional bathing and contains water over
34 inches (610 mm) deep.
SPA, SELF-CONTAINED, is a continuous-duty appliance in
which all control, waler-heating and water-circulating equipment
is an integral part of the product,located entirely under the spa
skirL A self-contained spa is in[ended for recreational bathing and
contains water over 24 inches (610 mm) deep.
SWIMMING POOL is any strucmre intended for swimming
or recreational bathing that coniains water over 24 inches(610
mm) deep. This includes in-cround, aboveground and on-ground
~ swimming pools, and fixed-in-place wading pools.
S41'IMMING POOL, INDOOR, is a swimming pool that is
totally contained within a residential strueture and surrounded on
xIl four sides by walls of'said siructure.
SWIMMING POOL, OUTDOOR, is any swimming pool

4. Access gates shall comply with the requirements of Items 1
through 3. Pedestrian aceess gates shall be self-closing and have a
self-latching device. Where the release mechanism of the self-
]atching device is Iocated ]ess [han 54 inches (1372 mm) from the
bottom of the gate, (1) the release mechanism shal] be ]ocated on
the pool side of the barriei at ]east 3 inches (76 mm) below the top
of the gate, and (2) the gate and barrier shall have no opening
greater thxn i/2 inch (12J mm) withinl5 inches (457 mm) of the
release mechanism. Pedestrian gates shall swing away from the
pool. Any ogates other Ihan pedeshian access gates shall be
equipped with lockable hardware or padlocks and shall remain
locked at all times wheo oot in use.
5. Where a wall of a Group R, Division 3 Occupancy-dwelling
unit serves as part of the barrier and contains door openings
between the dwelling unit and the outdoor swimming pool thxt
provide direc[ access to the pool, a separation fence meeting the
requirements of Items 1, 2, 3 and 4 of Section 421.1 shall be pro-
vided.

where the barrier is mounted on top of the pool structure, and the
means of access is a ladder orsteps, then (1) the ladder or steps
shall be capable of being secured, locked or removed to prevent
access or (2) the ladder or steps shall be surrounded by a barrier
that meets the requiremeuts of Items 1 ihrough 5. When the ladder

421.2 Indoor Swimming Pool. For an indoor swimming pool,

Dear Mr. Fenwick,
This letter is to inform you that the amended final drainage
report, grading and the erosion control plan for the above
referenced project have been reviewed and approved for
construction. In conjunction with this approval, the City
acknowledges and supports the stipulations of the agreement dated
March 17, 1998 (see attached), and entered into by James and
Candice Cressman, 10825 West 32°d Avenue and Mr. Tom Radigan,
10845-10875 West 32"'1 Avenue. Please be aware of the following
items regarding the construction of the project:
l. No Certificates of Occupancies will be approved by the Public
Wor.ks Department until all of the terms stipulated in the
said agreement dated March 17, 1998 have been completed to the
satisfaction of both parties involved.
2. The proposed drainage facilities shall be constructed and
approved by the City of Wheat Ridge prior to issuance of any
Certificate of Occupancies.
3. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plan and shall be
maintained as needed during the course of construction.
4. Al1 drainage improvements shall be constructed in conformance
with the approved drainage report and plan.
5. It will be the responsibility of the contractor for the
project to repair any damage to the existing public

improvements on West 32"a Avenue as a result of related
construction traffic in the area. Also, the contractor will
be responsible for maintaining West 32"d Avenue on a regular _

6. Upon completion of the drainage improvements the engineer,
Mr. Kenneth Fenwick, P.E. shall provide to the City of Wheat
Ridge a letter of certification stating that the various
improvements, as defined in the amended drainage report and
plan, have been accurately surveyed to confirm that their
construction is in accordance with these documents. The
certification letter shall be written and stamped by the
engineer who prepared the drainage report, and shall be
submitted for review and approval by the City prior to
issuance of any Certificate of Occupancies.

Please let this letter serve as a follow-up to your inquiry re.-arding the construction of a 6' high
solid fence along your southern property line and extending across the bulb of the tum around
on Lot 4 of Marvel Minor Subdivision.
When the property was subdivided in 1996, it was approved with a private drive/access easement
for access to the existing house and the three newly created lots. Pursuant to Section 26-
30(N), a private drive for up to four dwelling units may be used for access to a public street for
property owners, visitors and emergency vehicles. When an access easement is used for
subdivision, there shall be provided space for vehicle turnaround if it dead-ends.
Prior to the time of application, Staff requested the applicant pursue full width street dedica[ion
(50' of r-o-w with 90' radius for the cul-de-sac bulb) with the adjacent property owners to the
west. Because these property owners were not interested in dedicating 25' and having a full
width public street built (with their financial participation) where they currently have a private
drive, there was no desi.-n altemative other than the private drive scenario for this property.
The subdivision was approved by Planning Commission at a public hearing with language
included as Note 4 on the document ensuring full rights of access to the private drive. Because
the access easement and tum-azound are located on a poRion of your property, in no way do you
have ezclusive rights to them. Therefore, we can not approve the permit submitted which '
prohibits access to the tum-around for the other propeRy owners and the general public. In
addition, fences located in minimum front yards are limited to a height of 48 inches. Any fence
exceeding the height limitation will require a variance to the City's fence height regulations prior
to the issuance of a building permit.
Relief of StafFs decision not to issue a permit for construction oF the fence across the tum-
around will have to be pursued as a change of conditions to the Planning Commission approval
tluough a public hearing process. Staff will not support this request unless an altemate design
for the turn-azound is submitted with the request. All property owners within the subdivision
must be a party to this application.
An alternative, once all lots are developed, would be to install an electronic fence across the
entrance from 32nd Avenue. This would have to meet the standards for emergency access by the
police, fire district and other emergency service providers. All property owners would have to
concur with the fence location and desi.an. The fence would have to be set back at least 20' from
the edge of the street.
In the interim you may want to put up a temporary barrier such as sawhorse blocking the
entrance which could be easily moved with a sign reading "construction traffic only". Once
a.-ain, there would need to be adequate room for a car to pull off the street to move the barrier
and the property owners would have to agree to it. No permit would be required for something
of a temporary nature, not permanently affixed to the ground.

~ 419.1 Scope. The provisions of this section apply to the design
and construction of barriersfor swimming pools located on the
premises of Group R, Division 3 Occupancies.
419.2 Standards of Quality. In addition to the other require-
ments of this code, safety covers for pools and spas shall meet the
requirements for pool and spa safety covers as listed below. The
standard listed below is a recognized standard. (See Sec[ion
3504.)
1. ASTM F 1346, Standard Performance Specification for
Safety Covers and Labeling Requirement for All Covers for
Swimming Pools, Spas and Hot Tubs
SECTION 420 - DEFINITIONS
For the purpose of this section, certain terms, words and phrases
are defined as follows .
ABOVEGROUND/ON-GROUND POOL. See definition of
"swimming pool."
BARRIER is a fence, wall, buildiug wall or combination

requirements of Items 1, Z, 3 and 4 of Section 421.1 shall be pro-
vided.
EXCEPTION: When apprwed by the building oFficial, one of the
following may be used: Y. Self-closing and self-la[ching devices instailed on all doors wilh
direct access m the pool with the release mechanism located a
minimum of 54 inches (1372 mm) abuve the Floor.
2. M alarm installed on aIl doors wi[h direct access to the pool.
The alarm shall sound con[inuously for.a minimum of 30 sec-
. onds wi[hin seven seconds after the door and its screen, if pres-
ent, are opened, and be capable oC pmviding a saund pressure
level oF not less than 35 dBA when measured inJoors a[ IO tect
-(3048 mm). The alurtn shall aubmatically reset under all condi-

[ions. The alarm system shall be equippcd wi[h a manual means,
such as a touchpad or switch, [o [emporarily deactivate the alarm
for a single opening. Such deactivation shall last no Ionger than
15 seconds. The deactivation switch shall be bcated at least
54 inches (1372 mm) above the threshold of the door.
3. Other means of prorection may be accep[able so bng as the
degree of protection afforded is no[ less than that afforded by
any of [he devices described above.

'Where an aboveground pool stmcture is used as a barrier or
wfiere the barrier is mounted on top of the pool structure, and [he
means of access is a ladder or s[eps, [hen (1) the ladder or steps
shall be capable of being secured, locked or removed to prevent
access or (2) [he ladder or steps shall be surrounded by a baaier
that mee[s the requirements of Items 1 through 5. When the ladder

or steps are sewred, locked or removed, any opening created shall
be protected by a barrier complying with Items 1 through 5.
421.2 Indoor Swimming Pool. For an indoor swimming pool,
protection shall comply with the requiremenrs of Section 421.1, Item 5.
421.3 Spas and Hot 1Yibs. For a nonself-contained and self-
contained spa or hot mb, protection shall comply with the require-
ments of Section 4211.

tion 4211.
