On Tuesday, July 29, 2003, T performed a field check to measure the setback of the existing sign. The setback to the concrete base is 10 feet a few inches. The setback to the edge of the sign is approximately 9 feet. Pursuant to Section 26-709D3.b. Sign setback requirement for signs from 7 to 25 feet in height is 10 feet. In addition, the proposal enlarges the square footage of the sign. Pursuant to Section 26-707A.1. "Rebuilding, enlargement, relocation, extension, replacement or reconstruction of a nonconforming sign is not permitted unless such sign is brought into conformance with this article." The existing sign does not meet setback requirements; therefore it is a nonconforming sign. If the sign is to be enlarged it must meet the 10 foot setback requirement. A face change can be made to the sign without having to bring the sign into conformance. No enlargement or alteration of the sign is allowed with a face change, and it does require a sign permit.
