understanding of the limitations of your 1994 conditional use approval as a private club. You have
indicated that you will cease rentals of the Sons of Italy property at 5925 W. 32nd Avenue to non-members
but will continue renting to Order members for their various special occasions. We acknowledge that
those member -hosted events may be attended by members and non-members alike. Please note that
extending membership to an individual who would other be hosting a non-member event shall not be
permitted as a means of circumventing the conditional use permit (CUP) approval.

Dear Mr. Mendez,
I write to you today as the current President of the Order Sons of Italy in America, Denver Lodge # 2075 (the
"Order"). As you know, the Order is the owner of the property located at 5925 West 32nd Avenue, Wheat Ridge,
Colorado 80212 (the "Lodge"). The Order is in receipt of your August 2, 2017, letter and upon review of that letter
and the information enclosed therewith the Order has prepared this response, which the Order believes should
mitigate any concerns with the ongoing operation of our Lodge.
The Order understands the use of the Lodge as a "private club" is governed by the Conditional Use Permit
(CUP) approved for the Lodge in 1994. As acknowledged by city staff in 2007 and again in your letter, the CUP
specifically permits the Lodge to operate as a private club, which was (and is) defined as follows:
Club or lodge, private. An association of persons for the promotion of some nonprofit common
object, such as literature, science, politics, or good fellowship, meeting periodically, limited to
members, within a building having not more than one-third of the 'gross floor area' used for
residential occupancy. Examples: Elks, Masons, Kiwanis, etc.
The Order understands this definition of private club does not allow for rental of the Lodge to non-members
and agrees to no longer do so. The Order has updated its internal policies and procedures accordingly. However,
the Order does intend to continue renting out the Lodge to Order members for their various special occasions
(weddings, birthdays, etc.) and the Order expects such gatherings may or may not be attended by non-member
guests. The Order will continue to work with its staff and the City of Wheat Ridge to ensure any use of the Lodge
complies with the CUP and any other applicable City regulations.

It has recently come to the attention of the City of Wheat Ridge that the Sons of Italy facility located at
5925 W. 32nd Avenue is being rented to outside entities for events.
This property is zoned residentially and has been since the City of Wheat Ridge was incorporated in 1969.
All residential zone districts allow for "clubs operated for the benefit of members only and not for gain "
as a special use. In a previous version of the Municipal Code, private clubs were considered a conditional
use, and accordingly the Sons of Italy obtained a Conditional Use Permit for a private club in 1994. As the
names suggest, private clubs and clubs operated for the benefit of members only allow for events held by
the Sons of Italy and its members. This designation does not allow for the Sons of Italy facility to be
rented out as an event center.
After reviewing our files, it appears the same issue came to our attention 10 years ago. A meeting was
held in August 2007 between Sons of Italy representatives and City of Wheat Ridge Staff. The attached
documentation from that meeting demonstrates the Sons of Italy was made aware of their designation as a
private club and of their inability to rent out the facility to non-members. At that time, there was some
discussion of potential options to expand uses, but no further action was taken. Our determination of use,
as discussed in the attached 2007 documentation, remains the same.

Planning comments:
The parcel on which the action is being requested is zoned a Residential One "C" District,
R -1C. This district is established to provide high quality, safe quiet and stable medium
density residential neighborhoods with single family dwelling units and to prohibit activities
of any nature which are incompatible with low density residential character.
The property is a large lot with a building where the Sons of Italy hold meetings, club
functions and other events. There is also a caretaker's residence on the property with a
detached garage. The properties surrounding this parcel have a mix of zone districts.
The immediate area is primarily R-1 C with a few lots of R-3 mixed in. The area directly to
the west is zoned R-2 while the area to the south is zoned R-3. Single Family homes do
make up the majority of homes in the area but there are duplexes and multi -family units,
as well.
The City of Wheat Ridge does not allow liquor licenses to be issued for properties with
residential zoning. Normally, to allow for a liquor license to be issued, a zone change to
a commercial zone district would need to occur.
As per City Code, public or private golf courses, country clubs, or clubs that are operated
for the benefit of their members are allowed uses in a residential zone district. As an
accessory to the club, they are allowed restaurants, lounges, and bars as long as it is for
the benefit for club and its members. The terms, conditions, and definition of a member
are left to the discretion the club, its bylaws and its governing body. The terms,
conditions, and definitions of membership are not reviewed by the City of Wheat Ridge
Further research done by City Clerk's Office has indicated that a full liquor license will not
be required for a club to who wishes to serve alcohol to their member. A "club" license is
all that will need to be obtained. This should eliminate the need to obtain a liquor license.
This should allow for the facility to be rented to its members and be able to provide
alcohol at those events.
If this option were pursued, the next step would be to obtain the required license required
by the City Clerk's Office.
If the current facility was rented to non-members, both a rezoning and obtaining a liquor
license would be required. The rezoning process can take up to 6 months and cost
several thousand dollars. The proximity of single family residences and the fact that there
is no commercial property in the area may be indicators that a rezoning in the area may
be difficult.
If a rezoning is pursued, a rezoning to a Planned Commercial Development (PCD) would
be required. Rezoning to a PCD is comprised of two steps. The first step in the rezoning
process is an Outline Development Plan. The ODP would rezone the property and define
the allowable uses for the property, as well as establish development standards such as
minimum landscaping coverage, maximum building height and maximum building
coverage. The ODP process requires public hearing review by Planning Commission and
City Council.
The second component in the PCD rezoning process is a Final Development Plan. The
FDP addresses the finer details of the development including landscaping, architectural
design of the proposed structure, and drainage improvements. The FDP can be
approved administratively.

The Community Development Department has received a request for zoning verification in
preparation of issuance of a liquor license for the property located at 5925 W. 32nd Avenue. In
response to this request, I offer the following information:
The property is currently zoned Residential One -C (R-1 Q. The R-1 C zone district allows for single-
family residential dwellings, in addition to some low intensity non-residential uses. The subject
property currently contains a building used for the "Sons of Italy"; a private membership
organization. According to information contained within a land use case file, the present use has
existed since the late 1980's. Prior to this, the property was occupied by a church.
The R -1C zone district in the present Zoning Code (or previous versions) does not list `private clubs'
as an allowed use. It is assumed that a determination was made in the past which allowed a private
club, such as the Sons of Italy, to operate in the residential zone districts as it is similar in nature to
another listed use: `Public or private golf courses or private country club or private club operated
for the benefit of members only and not for gain.' When the Sons of Italy purchased the property, a
`public or private golf course...' was allowed in the residential zone districts as a use by right. This
allowance was changed with an amendment to the Zoning Code which made `public or private golf
courses...' a conditional use. In 2001, the category was changed to `public or private golf courses,
country clubs or clubs operated for the benefit of members only and not for gain'. Additionally,
conditional uses were removed from the Zoning Code and everything listed as a conditional use was
then classified a special use.
A land use case was processed in 1994 for this property (CUP -94-1). The application was a request
for a conditional use permit to allow an expansion of the existing facility. The request was granted
and the expansion allowed.
Given the previous interpretation, the current land use on 5925 W. 32nd Avenue is classified as a
`Public or private golf course, country clubs or clubs operated for the benefit of members only and
notfor gain', and is a special use in the R -1C zone district. It is important to note that over the
course of the past 20 years, the `golf course' category has been allowed as a use by right, and then a
conditional use and now it is listed as a special use: evidence that the use is more intensive than the
surrounding residential and requires further review.
Community Development Staff was contacted by a representative of the Sons of Italy in preparation
of the liquor license application. The representative stated that the liquor license was needed so that
the facility could be rented out to non-members for private gatherings, such as weddings. It is Staff s
opinion that this intended use for non-members is not consistent with the original interpretation, or
with the `public or private golf course...' use listed in the residential use chart. Staff feels that
renting the facility to non-members would transform the facility into a rental hall or event center,
uses not allowed in the residential zone districts.
In light of this examination, Staff has indicated that the zone district does not allow a bar, tavern,
nightclub or drinking establishment, retail liquor store or 3.2% beer retail store.

Timeline of events: Sons of Italy
1986: Approved as a "Lodge Meeting Hall" at 5955 W. 38th Ave, zoned C-1 at the time. Verified zoning
with old zoning maps
1991: Approved as a "Fraternal Organization" at 5925 W. 32"d Avenue, zoned R-3 at the time. Now
zoned R -1C. Approval states zoning to be C-1.

2007: Liquor License Zoning Verification form submitted to Travis Crane
Memo written to Deputy City Clerk stating the use of the property as a "public or private golf

such, the liquor license for the purpose of renting out the facility to non-members is not
consistent with the original interpretation of the use of the property by the Sons of Italy. The
memo stated that the renting of the facility to nonmembers transforms the facility into a rental
hall or event center, neither of which are allowed in the residential zone districts.
A pre -application meeting was held with the Sons of Italy following this determination to discuss
the clubs options. Options included obtaining a "club" license which would allow the private
club to serve alcohol to their members and guests. Another option discussed was the rezoning
of the property to PCD, which was anticipated to be "difficult" for this particular property given
the surrounding single family environment.
2017: PD contacted staff to determine if the property was allowed to have events, as there were
complaints from neighbors. Staff indicated that events for members were allowed, but the
facility could not be rented out to nonmembers.
City Clerk was contacted to determine if the Sons of Italy had a liquor license, which they do not.
Rather they have a series of special events "permits" that allow them to sell alcohol on certain
dates and between certain times.

Hi Zack,
The Sons of Italy does not have an actual liquor license, but holds numerous city issued special event "permits" that
allow them to sell alcohol on certain dates and between certain times. They had a permit recently for 7/28 and have
more issued for the upcoming dates 8-25, 9/22, 10/27 and 12/22 from 7-11 pm unless they are suspended or revoked at
liquor board hearings.

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name)
roof covering" is required to be on site at the time of final inspection.

You are allowed 1 freestanding sign for every street right-of-way adjacent to your
property. The allowable sign size is related to building size.
Step 1: Determine the square footage of the building:

interstate, freestanding signs may be 50 feet tall. These signs must be setback at least 30 feet from

A building permit application, and
A wall sign, calculation sheet
All signs are classified as 'minor' building permits. The following items must be submitted with
a permit application for a sign:
A completed building permit application (front and back)
A calculation sheet
For wall signs -- a site plan which shows the entire building (with wall length
dimensions), location of street, location of any existing signage and location of proposed
signage
For freestanding signs -- a site plan which shows the location of the building, the size of
the building, location of any existing freestanding signs and location of proposed
freestanding sign (with distance to property lines)
A detail sheet which shows the height of the proposed sign (freestanding), sign copy with
dimensions, electrical information, looter information (treestanding)
A building permit and a signage calculation sheet are required submittal items with any building

Dear Jack,
After a plan review of the proposed remodel for the Sons of
Italy building, I am submitting the following comments/requirements
concerning this project:
1. Provide complete set of plans regarding up-grade and addition
to fire alarm system in building.
2. A 20ft. fire lane must be relocated and maintained on north
side of the building.
3. All hood and duct fire suppression systems for the kitchens
will have to be connected to the fire alarm system.
4,y,d ~ Square footage of the building for basement and main floor
h~~~ will reguire the installation of a complete fire sprinkler
v h system throughout the building. Provide complete set of plans

will be addressed as the need arises.
