I understand that the areas to either side of the relocated cashier's station are now used to display adult merchandise. The Code of Laws dealing with adult uses is quite specific concerning nonconforming adult uses. My letter of June 17~' clearly stated that under the nonconforming provisions of the adult business regulations, NO relocation or expansion of display area could occur at your establishment. To reiterate, expansion of the display area is a violation of Section 3-27 (5) of the Wheat Ridge Code of Laws which states: "The nonconforming use shall not be extended or expanded. An extension or expansion shall include any increase in the floor area of the building or structure in which the nonconforming use is conducted, and any expansion or relocation of the nonconforming use, in whole or in part, to a different part of the building or structure, and any increase in or relocation of display area. (emphasis added)" Consider this letter due notice that Final Take Video is in violation of Section 3-27 (5) of the Wheat Ridge Code of Laws. The new display areas must be removed within 14 days of receipt of this letter. Failure to remove the display areas will result in further enforcement action, up to and including a summons to municipal court and suspension of your adult business license. It has also been brought to our attention that a new sign has been placed on the door. The sign shows the name of the establishment being different than Final Take Video. As I mentioned in my previous letter and again when we met in my office, any change in the ownership of the company requires the submittal of a new license application along with the required fees. Pursuant to Chapter 3 of the Wheat Ridge Code of Laws the proposed changes must comply the following sections of the code. Sec. 3-17. Display; transferability; change of ownership; change of corporate structure (b) Licenses issued under this chapter shall not be transferable, sold, or leased except as provided herein. Any change in the partners of a partnership or in officers or directors of a corporate licensee or manager of a limited liability company holding a sexually-oriented business license shall result in termination of the license of the partnership or corporation, unless such licensee, within thirty (30) days of any such change, files a written notice of such change accompanied by the application fee and an investigation fee as required by this chapter. Any such change shall be reported on forms provided by the planning director and shall require the names of all new partners of a partnership, officers, and directors of a corporation, and the manager of a limited liability company and any information as required by section 3-6. Approval or denial by the planning director of such transfer shall be upon the same terms as provided for in this chapter for the approval or denial of a sexually- oriented business license. Sec. 3-27. Nonconforming use. (5) The nonconforming use shall not be extended or expanded. An extension or expansion shall include any increase in the floor area of the building or structure in which the nonconforming use is conducted, and any expansion or relocation of the nonconforming use, in whole or in part, to a different part of the building or structure, and any increase in or relocation of display area. Upon review of the plans submitted it has been determined the proposed alteration to relocate the managers station is allowed. Changing display racks to the style indicated in the submittal and installing them on the existing walls is permitted as long as there is no change to the location or amount of adult display space. Because of the change in ownership, you and your partner need to apply for a new license. This will require a new application, application fee and investigation fee.
