Changes required by the property owner or required hereunder shall be paid by the property owner in addition to the amount of the insurance claim. All STC's rights and remedies extend to changes. Unless otherwise agreed in writing, all changes are at STC's regular price therefore. SCOPE OF WORK: Property owner represents he/she owns the property on which the work is to be performed. Property owner will identify boundary lines and be responsible for obtaining all necessary zoning variations before commencement of work. The contractor shall comply with all local requirements for building permits, inspections, and zoning. All surplus material remains STC's property. STC purposely orders extra supplies to avoid delays in build completion. During work, STC may use property owner's utilities and all charges shall be the property owner's responsibility. If STC is unable to complete the work for any reason, it may assign its obligations hereunder to a contractor of its choice. All rights, remedies and privileges of STC hereunder inure to the benefit of, and are enforceable by an assignee of this contract. Property owner and each co-signer hereby waive all current and future claims and defenses in relation to quality of work or product, except claims under the warranty described below. Property owner agrees to execute all other documents which STC may require in order to carry out the terms of this contact or comply with all applicable laws. STC may make minor variations in work or substitute material of equal or better quality without consent of property owner. This contract does not include, unless expressly specified, any asbestos abatement, removal, or encapsulation, or any removal of lead paint. If asbestos or lead paint is found existing on the premises, any cost to abate, remove, or encapsulate shall be paid by the property owner. This contract does not include, unless expressly specified, any wood replacement, repair or insulation. Wood and insulation replacement not covered by insurance claim if needed to properly replace roof is an additional charge to property owner at STC's cost without markup. **STC will not be responsible for slight scratching or denting of gutters, oil droplets in driveways, hairline fractures in concrete, damage caused by stray nails, minor broken plants and shrubbery, or interior nail pops or drywall damage. STC is not responsible for damages to screens left in the window during time of production. DEFAULT: Property owner must contact STC to schedule work to complete repairs and replacement to property within three (3) days of insurance company approval of the claim, or pay STC cancellation fee of $1500, as liquidated damages and not as a penalty, in addition to all court costs, interest of 1.5% per month, and reasonable attorneys' fees of 35% of the balance due. The property owner shall be in default under this agreement in the event any of the following conditions or events occur: (a) failure to pay the contract price; (b) failure to provide access to STC between the hours of 7:30 a.m, to 7:30 pm. Monday through Saturday to perform the work as contained in the agreement; or (c) any other failure by the property owner to comply with the terms and conditions of this agreement. In the event of default, STC may pursue all remedies available under law, including placing a lien upon the property, and the property owner shall pay interest of 1.5% per month, reasonable attorneys fees of 35% of any balance due, and any and all court cost incurred in pursuing such default. Property owner further agrees that in the event of default, STC has a greater right of possession and that the property owner will make available to STC at a reasonable time the material provided under this agreement. DATES OF PERFORMANCE: Materials will be delivered and work will begin within 60 days of when the first payment clears bank. If a supplement is deemed necessary by STC due to items missed by the insurance estimate, it must be approved and received before materials are delivered and work begins. Any delays in secondary payment may subsequently effect commencement dates of project. Approximate commencement and completion dates of this agreement are estimates only. Any delays caused by events beyond the control of STC shall not constitute abandonment and shall not be included in calculating time frames for payment of performance. STC is not responsible for delay or inability to perform caused by acts of God, strikes, war, riots, shortages, weather conditions, public authorities or other causes or conditions beyond its control, or due to property owners conduct. COMPLETION : Property owner agrees to furnish final payment upon the substantial completion of the project as described in this agreement. It shall be deemed substantially completed when property owner takes possession of materials and is able to occupy dwelling. Property owner may withhold no more than 10% of the entire contract amount should significant services exist after the substantial completion of the project. This applies to minor repairs and "punch out' items. Payment of withholding is expected immediately upon completion of any outstanding services. *STC will voluntarily wait for final payment from insurance company to receive payment. Should insurance company not pay balance of claim to property owner or STC after a period of 90 days from completion, property owner will be responsible for paying that balance. SEVERABILITY: If any provision of this agreement shall be held invalid or unenforceable the remainder of this agreement shall not be affected thereby and shall continue to be valid. ENTIRE AGREEMENT: This agreement contains the entire agreement between the property owner and STC. This agreement supersedes all other written and/or oral agreements. Storm Team Construction carries workers' compensation, automobile and commercial general liability (bodily injury and property damage) insurance. A certificate of insurance identifying our insurance carrier and the types and amounts of coverage and our insurance contact information will be provided to the customer and is incorporated herein by reference and should be considered as part of this contract. WARRANTY: STC offers a three year warranty on all workmanship that takes effect the day of installation. Extended warranty is also available for an additional price. Warranty does not include failure caused by natural disaster, vandalism, fire, flood, or misuse and abuse. Warranty is only valid if balance is paid in full. (1.) Anything above will require owners permission.
