COMMENTS & EXCEPTIONS: Lanser Homes / MEMORANDUM Approved Date TO: Bob Middauqh, City Administrator FROM: Bob Goebel, Director of Public Worksvl SIIBJBCT: 10175 W. 35th Avenue DATE: 12/15/95 The letter from Mr. Kleder who lives at 3510 Lee St., just north of the subject property, spells out his frus£ration with a drainage problem allegedly caused by the construction Qf the subject single family residence. The natural lay of the land in this area is severely sloping north to south. When the Kleder home was constructed, my guess is the early sixties, the property was leveled by cutting into the natural slope on the south and filling the natural slope to the north. So much so, in fact, that the construction of a retaining wall was required. The subject property was constructed two years ago and was constructed with a walkout basement facing away from the slope. This still required some fill and an additional retaining wall above the existing wall on the Kleder property. Mr. Kleder alleges that since the subject property was constructed he has had drainage from it entering his property and home. A drainage plan and report was not required for the subject property as single family homes are exempt from that burden unless they are a part of a subdivision development. Nevertheless, the engineering department has responded to Mr. Kleder's concern by meeting with him and Mr. Gash, the owner of the subject property. We informed Mr. Gash of the problem and suggested possible solutions. Be aware that the City has no authority to require Mr. Gash to comply with our requests. Mr. Gash has in fact done a substantial amount of work to attempt to fix the alleged groblem. This work included creating a swale along the north side of his property to intercept any surface drainage and carry it to the west and along the Lee St. ROW. A surface drain was also installed to carry downspout water west to the street. A berm was placed along the edge of the asphalt at the Lee St. driveway of the property to keep any street runoff from entering his property and passing through to the Kleder property. On the Kleder property I observed problems along the perimeter of the house foundation which indicate a history of drainage problems. Specifically along the south foundation I noticed substantial settlement of adjacent concrete to the magnitude of 3 inches or more. I also observed leaking down spouts along the wall with very little control of the direction of flow away from the house. These deficiencies look to be well aged and substantially older than the Gash property. The slope of the yard is also directed toward the Memorandum 10175 W. 35th Avenue December 15, 1995 Page 2 PRoP~RTy house from the south property line north. This indicates that there is a historic drainage problem on the Kleder This is not to say that it may have not been enhanced by the construction of the Gash home. The answer to his final question "Who is responsible?" is difficult to give a definitive answer to. I can say with confidence that it is not the City's problem to solve. I think this is a Civil matter between two property owners and some give and take needs to occur. I have observed Mr. Gas very responsive. This letter is afarmal request to petition are-eualuation ofthe building and property drainage of 10175 W. 35 th Ave. Our property at 3510 Lee Sk {Built in 19581 has been adversety affected by improper drainage from 10175 W 35 th Ave. since the start of construction in 1993. We have been subjected to mud and water flowing onto our properly,water draining onto and flooding our properly, and a build up of water along our retaining wa11. The area along the retaining wa11 has tumed into a swamp like area that is killing the vegetation {35 year old junipers and grass},the smell is pulred, and in the xummer is infested with insects. Due to the improper drainage of 10175 W 35th Ave. the ground is satw-ated on our south side and has led to aur basement floading which it has not done before. I have concems about the lang term raznifications on the founda#ion at 3510 Lee St and communicated that fact with John Eckert in your Building Department- before the water made its way to the foundation, and subsequently flooded our basement.His response was that he "doubted whether it would reach the foundation". At that point I asked him to check urto what I had to do to get this problem resolved? I never heard from him again and he did not haue the decency to even rehun my calls When I did finally get him on the phone his responae was "Glen Gibley says its a Civil Issue". End of comreisation! Well I see things as being shu$led under the proverbial rug here. At the Board OfAdjustment hearing I specifically addressed the issue of drainage , and the possibility of a problem therein. Was there a proper plan review done? Caeg Knutsen from your engineering said that he never received any engineering regarding the property at 10175 W 35th Ave, and that property has piers/caissons driiled into a drainage easement. In frying to get this problem resolved, I have contacted tlhe - WheatRidge Building Depm-hnent, Planning and Zoning,and Engineering. Robert Gaspar, John Oss and Greg Knutsen had been here to look at the problem last spring when our basement flooded. Yet nothing has been resolved.
