REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75% of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75% of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. In order to pass a final inspection of elastomeric or similar type roof coverings, a letter of inspection and approval from the manufacturer technical representative stating that "the application of the roof at (project address) has been applied in accordance with the installation instruction for (roof material brand name) roof covering" is required to be on site at the time of final inspection. A detail of the keystone block wall, and the location of this wall in relation to existing easements and its affect on proposed drainage and grading work, shall be submitted for review and approval by the Public Works Department. City may terminate this License at any time without notice should Licensee violate or breach any of the terms or conditions hereof. 7. Severabilitv: Enforceabilitv: Validit If any term, covenant, condition or provision of this License or the application thereof to any person or circumstance shall, at any time or to any extent be held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this License or the application for such term or provision to persons or circumstances other than those to which it is held invalid or unenforceable shall be valid and enforced to the fullest extent provided by law. RECITALS: A. The City is the owner of a drainage easement across certain real property located within the County of JefFerson, State of Colorado, more particulariy described as the 10' wide drainage easement along the south property line and within Lot 17, Block 1, Distinctive Addresses at Applewood as shown on the plat thereof (the "PIaY") recorded at Book 114, Page 57, Reception No. 93161210, Jefferson County Clerk and Recorder (the "City EasemenY'). B. Licensee owns Lot 17, Block 1, real property located adjacent to the City Easement. The locations of the City Easement and Licensee's property are shown on Exhibit A attached hereto and incorporated herein by this reference. C. Licensee has constructed a brick retaining wall which encroaches into the City Easement in violation of the restrictions of the Plat. D. This license is given to permit the encroachment to remain, on a revocable basis. LICENSE FOR AND IN CONSIDERATION OF the mutual promises and covenants contained herein, the payment to the City by Licensee of Ten Doilars and other good and valuable consideration, the delivery, receipt and acceptance of which are hereby acknowledged and confessed, the Parties agree as follows: 1. Grant of License The City hereby grants to Licensee a license over and across a portion of the City Easement, as shown on the attached Exhibit A and hereinafter referred to as the "Licensed Area," for the purposes and subject to the restrictions set forth herein. Use of the Licensed Area shall be exclusively for the Licensee and the City, and not for access by the general public. GED\53027\362741.01 2. Acknowledament of Licensee Licensee acknowledges that the City's grant of this License does not grant any prescriptive rights in the City Easement to Licensee, and recognizes that the City Easement is owned by the City for the benefit of the general public. Licensee acknowledges that City does not waive any of its rights in the City Easement. 3. Limitations on Use of the City Easement a. The Licensed Area may be used solely and exclusively for the following purposes: maintenance of a block retaining wall, 9$ feet in Iength, which encroaches within the drainage easement in violation of the restrictions shown on the Plat. b. Licensee agrees to maintain the block retaining wall in good repair and safe condition. Ail repairs shall be made at Licensee's sole expense. Licensee shall maintain the retaining wall free from unsightly debris or accumulations of trash and the like and, in compiiance with the standards set by City, junk, weed, litter and nuisance ordinances. c. No additional improvements shall be constructed on the Licensed Area by License. d. This License is not exclusive. The City reserves the right to make or permit such use of the Licensed Area as is not incompatible with the uses permitted to Licensee,- and as consistent with the requirements and restrictions of the Plat. e. Upon termination of this License for any reason, the retaining wall shall be removed at Licensee's sole expense and the natural slope and grade restored. In the event Licensee fails or refuses to remove the wall within thirty (30) days of the Citys written request, the City may remove the wall and recover its costs to do so by certification to the County Treasurer in the same manner as taxes or by any other method provided by law. f. If the City requires access to any portion at any time to the Licensed Area, the retaining wall will be removed to gain access as necessary. Reconstruction of the wall as an encroachment will not be allowed in the future. 4. Indemnification The Licensee agrees to indemnify and hold harmless City, its officers, employees, insurers and self-insurance pool from and against ali liability, claims and demands o n account of injury, loss or damage including, without limitation, claims GED\53027\362741.01 . _2_ arising from bodily injury, personal injury, sickness, disease, death, property loss or damage, or any other loss of any kind whatsoever which arise out of or are in any manner connected with this License and the encroachment of the retaining wall within the easement. The Licensee agrees to investigate, handle, respond to and to provide defense for and defend against any such liability, claims or demands at the sole expense of the Licensee. The Licensee also agrees to bear all other costs and expenses related thereto, including court costs and attorney fees, whether or not any such liability, claims or demands alleged are groundless, false or fraudulent. 5. Governmentai lmmunitv The Parties understand and agree that City is relying on and does not waive or intend to waive by any provision of this License, the monetary limitations (presently, $150,000 per person and $600,000 per occurrence) or any other rights, immunities and protections provided by the Colorado Governmental Immunity Act (C.R.S. § 24-10-101, et seq.), as from time to time amended, or otherwise available to City, its officers or employees. 6. Term of License: Revocation This License shall be in force and effect from the date first set forth above. City shall have the right to terminate this License upon 30 days' notice to Licensee, in City's sole and exclusive discretion, with or without cause. City may terminate this License at any time without notice should Licensee violate or breach any of the terms or conditions. hereof. 7. Severabilitv; Enforceabilitv: Validit If any term, covenant, condition or provision of this License or the application thereof to any person or circumstance shali, at any time or to any extent be held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this License or the application for such term or provision to persons or circumstances other than those to which it is held invalid or unenforceable shall be valid and enforced to the fullest extent provided by law. I visited the site with the public work's department that same day to assess the damage done to the outfall shucture and the down stream drainage swale. There has been significant damage done to the grouted np rap at the base or discharge sides of the structure. The rip rap along the north embankment has also been either removed or covered with dirt. These damaged areas will need to be reconstructed by installing grouted 12 inch rip rap material to a point 20 feet west of the outfall shucture. The fil] material placed over the north rip rapped area will need to be removed so that it matches the erosion protection on the south side of the structure. All repairs will require that appropriate inspections be performed by the public work's deparhnent prior to the placement of the rip rap or the grout material, 24 hour notice will need to be provided to schedule an inspection. All debris, broken concrete and earth that was disturbed below the structure must also be removed from the drainage channel. This work will need fo be comnleted and acceoted no Iater than huna 2, 200 and damaging conditions that currently exist. If this complehon date is not met, the City willtbe fo ced to make the repairs and bill the contractor for time and materials to complete the repairs. I visited the site with the public work's department that same day to assess the damage done to the outfall structure and the down stream drainage swale. There has been significant damage done to the grouted rip rap at the base or discharge sides of the shucture. The rip rap along the north embanlanent has also been either removed or covered with dirt. These damaged areas will need to be reconstructed by installing grouted 12 inch rip rap material to a point 20 feet west of the outfall structure. The fill material placed over the north rip rapped area will need to be removed so that it matches the erosion protection on the south side of the structure. All repairs will require that appropriate inspections be performed by the public work's department prior to the placement of the rip rap or the grout material, 24 hour notice will need to be provided to schedule an inspection. All debris, broken concrete and earth that was disturbed below the structure must also be removed from the drainage channel. This work will need to be completed and acceoted no later than June 2. 2000 due to the unsafe and damaging conditions that cunently exist. If this completion date is not met, the City will be forced to make the repairs and bill the contractor for time and materials to complete the repairs. Conclusions and recommendations presented are based.on a field arid laboratory investigation, results of previous investigations within the subdivision . and experience with similar projects and conditions. PROPOSED CONSTRUCTION A one to two story single family residence over a full-depth, to garden-1eve1 basement and/or crawl space will be constructed. A wood £rame superstructure will be supported by a reinforced concrete foundation. SITE CONDITIONS The property is in a relatively flat area south of a broad drainage channel. Grading operations have created most of the existing topographic relief within the subdivision. The surface generally slopes to the north and west. Three to four feet of structural fill has been placed in this lot to raise the surface above a storm drainage channel alang the south property line. There is a gentle embankment between the 1ot and drainage channel. The only apparent geologic hazard that may affect the proposed construction is shallow groundwater. The ditch is five to six feeC lower than the proposed ' residence and may affect future groundwater conditions at ~ anticipated foundation depths: ; SUBSURFACE CONDITIONS Subsurface conditions were investigated by drilling two foundation design test holes within the anticipated building envelope. Test hole locations are shown in Figure l, Test , Hole Location Plan. Holes were drilled to a depth of 30 feet and samples were taken at various intervals based on anticipated foundation bearing depths and soils encountered. Lithologic logs with detailed soil and bedrock descriptions and Standard Penetration test results are shown in Figure 2, Test Hole Logs. Soi1s consist of 13 to 14 feet of sandy to very sandy; slightly gravelly clay. Natural soils were deposited by slope wash and stream flow and are part of a mixed alluvial fan and alluvial terrace deposit. Bedrock was encountered at depths of 13 to 14 feet. Bedrock is blocky olive green claystone of the Denver Formation. Bedrock conditions will not affect 'foundation design because of soil thickness and shallow groundwater. Swe.ll-consolidation testing was conducted on three samples of sandy clay from TH-1 at a depth of six feet and.TH-2 at three and six feet. Tests indicate that soils have a low to PROJECT NO: 99-541$~ ~ September 27, 1999. Page 3 nil-swell potential., The sample from TH-1 at six feet swelled a maximum of 0.1 percent when saturated under a constant load of 1000 pounds per square foot (psf). Other samples eonsolidated under similar conditions: Detailed test results are presented in Figures 3 and 4, Swell- Consolidation Test Results. Groundwater was encountered at depths of 15 to 16 feet during drilling and was at a depth of nine feet when holes were checked three days after drilling. The geologic and topographic location of the site indicates a more shallow groundwater table may exist during portions of the year. Groundwater shallow enough to affect proposed construction is possible. The following measures should be taken to reduce potential for flooding in below-grade habitable space: l. Foundation drain systems should be constructed as outlined herein. 2. The ground surface around the residence should be graded and landscaped as outlined herein. 3. A minimum six-inch-thick layer of washed gravel or crushed rock should be placed below basement floor slabs: 4. Excavation depth should be kept as shallow as practical and should not exceed six feet. FOLTNDATION DESIGN RECOMMENDATIONS The foundation may be supported on continuous spread footings designed for a maximum contact pressure of 2000 . . ~ - - PROJECT~ N0. 99-5416 , . - . September 29, 1999. Page.4. . psf. Contact pressure should be calculated using full dead load plus full live load. Footings should be proportioned, as much as practical, to achieve even coritact pressures and help prevent differential settlement. Footings should be constructed on undisturbed natural soils that are smooth, even and free of debris or rocks over three inches in diameter. Footings should not be constructed on frozen or saturated soils. Foundation walls should be designed to withstand a minimum equivalent fluid pressure of 40 pounds per cubic foot for at-rest lateral pressure. An equivalent fluid pressure of 300 pcf may be used for passive pressure calculations. INTERIOR FLOOR SLAB CONSTRUCTION The builder and home buyer should be aware that concrete floor slabs placed on any clay-containing soil or bedrock may move if support materials become wet. One means of assuring slab movement will not occur is construction of a suspended floor system. Expansion potential of materials at, and below, basement floor depth is low to nil and the risk of significant basement floor slab heaving is relatively low. : The following procedures should be implemented to prolong slab life and promote better slab performance if interior floor slabs are used and risk of some movement can be tolerated: . . ~ . ~ . . . . . . PROJECT NO. 99-5416 . . September 27., 1999 Page 5 1. Soils should be moistened thoroughly 24 hours prior to placing concrete:, Soils should not be compacted more than necessary for excavation. Backfill soil below slabs next to walk-out basement walls should be moistened and compacted to prevent settlement. 2. Concrete slabs should be reinforced with steel mesh and should be separated from all bearing members and utilities to a11ow independent movement ( i,e., a "floating slab"). 3. Joints should be scored in the slab at maximum 200 square foot areas. 4. If hot water heating is used, the piping should not be placed under the floor slab. If forced-air heating is used, a flexible connection should be u:tilized to a11ow some movement between the,furnace and the,heating ducts. S: Foundation drain systems and landscaping should be completed in strict compliance with recommendations outlined herein to help prevent wetting of slab support soils. , DRAIN SYSTEMS A drain system should be constructed around the exterior and interior'foundation perimeter. The drain system should be constructed in compliance with tHe details shown in Figure 5, Drain System Detail; and should be graded to a sump pit ,within the basement. The sump should be fitted with an automatic pump to discharge water a minimum of ten feet from the foundation. Particular attention should be given to placing polyethylene along the bottom of the drain and up the foundation wa11 and to proper grading of drain pipe. Improper grading, such as high or low spots in the drain pipe, could lead to drain PROJECT NO. 99-5416 ~ . September 27, 1999 Page 6 , . . failure and over wetting of foundation bearing soils result- ing in damage to the foundation and superstructure and/or basement flooding. FOLJNDATION BACKFILL Backfill placed against foundation walls should be free of trash and fragments of rock over six inches in maximum diameter, moistened, and compacted to a minimum of SS percent of modified Proctor density. Controlled puddling should not be used. Foundation walls should be a minimum of seven days old prior to backfilling. All walls over four feet high should have floor systems in place or be we11 braced to prevent damage from lateral pressure. The area surrounding foundation walls should have a positive slope away from the walls. A one-foot drop in elevation for the first ten feet away from walls is recommended. The owner should periodically inspect the surface around the foundation to locate and correct grading problems that may occur due to settlement of foundation backfill. LAWN AND LANDSCAPE IRRIGATION Lawn and landseaping irrigation should be controlled, as much as possible, to prevent additional wetting of subsoils. Sprinkler heads should be placed so that spray does not fall within five feet of foundation walls if an - - - PROJECT NO. 99-5416. : - . . . . - . Installing any portion of an irrigation system within five feet: of walls should be avoided. Decorative laridscaping, such as rock and/or bark should be used in areas directly adjacent to foundation walls. Shrubbery planted within five feet of foundation walls should be species that do not require irrigation once established. Downspouts and sill'cocks should not be allowed to discharge directly onto the ground surface. Splash blocks and/or ' downspout extensions should be used to discharge water beyond the limits of foundation backfill where backfill soils are not covered'by pavement and/or sidewalks. The owner is encouraged to read A'Guide to Swelling Soils for Colorado Homebuvers and Homeowners, Special Publication No. 43, available from the Colorado Geological Survey. Landscape and surface drainage recommendations presented in the report are applicable to all residential construction in this area, regardless of soil expansion potential.
