Prior to testing, a visual inspection was performed to confirm the completeness of asbestos removal and cleanup. The visual inspection was performed in accordance with the American Standard for Testing and Materials' "Standard Practice for Visual Inspection of Asbestos Abatement Projects". All abated asbestos materials, including contaminated dust, debris, or residues were satisfactorily determined to have been removed. Air samples were then collected inside the contained area utilizing aggressive air sampling techniques as described in 40C.F.R. Part 763, Appendix A to Subpart E (EPA 1995). Five air samples and two blanks were analyzed utilizing Phase Contrast Microscopy (PCM) employing the NIOSH 7400 method. Sampling: During the sampling process, suspect ACM was separated into three EPA categories. These categories are thermal system insulation (TSI), surfacing ACM, and miscellaneous ACM. TSI includes all materials used to prevent heat loss or gain or water condensation on mechanical systems. Examples of TSI are pipe coverings, boiler insulation, duct wrap, and mud packed fitting cement. Surfacing ACM includes all ACM that is sprayed, troweled, or otherwise applied to a surface. These applications are most used in fireproofing, decorative and acoustical applications. Miscellaneous materials include all ACM not listed in the thermal system insulation or surfacing categories, such as linoleum, vinyl asbestos flooring, and ceiling tile. Boulder Environmental Inc. followed EPA recommended sampling guidelines for identification of asbestos in bulk matrices. A set of three (3), five (5), or seven (7) samples were collected for each material type and analyzed by Polarized Light Microscopy (PLM). Sample locations were selected by a random selection method as described in Asbestos in Buildings, Simplified Sampling Scheme for Friable Surfacing Materials (EPA 560/5-85-03a, October 1985, AKA "Pink Book"). Suspect materials are assigned numerical values based on an evaluation of the building materials condition at the time of the inspection. The numbers assigned are: 1. Damaged or significantly damaged thermal system insulation ACM. 2. Damaged friable surfacing ACM. 3. Significantly damaged friable surfacing ACM. 4. Damaged or significantly damaged friable miscellaneous ACM. 5. ACM with potential for damage. 6. ACM with potential for significant damage. 7. Removal of non -friable asbestos containing building materials requires a notification fee of $60. Removal of friable asbestos within this range of quantities requires a permit fee of $180 for a friable asbestos removal. Emergency asbestos abatement / demolition permits may be issued if project circumstances pose an immediate hazard to public health and environment. CDPHE does not typically waive permit waiting periods because of financial hardships or planning issues. With this new law homeowners who reside in the home they wish to renovate can now choose to be afforded the same protections as they are entitled to in a public and commercial building, unless the homeowner chooses to waive this protection. To waive these protections, the homeowner must sign this form declaring that they do not want their home to be considered an "Area of Public Access" for purposes of determining the applicability of portions of Colorado's asbestos regulation. The term "Area of Public Access" is unique to Colorado's asbestos regulation and basically determines if an abatement permit, engineering controls, and air clearance testing is required. If a building is not an "Area of Public Access" then only certification, notification and asbestos disposal requirements in Colorado's regulation are applicable. This declaration will not affect you in any other way as it only determines your home's status with respect to Colorado's asbestos abatement regulation. CDPHE may decide, on a case-by-case basis, to waive the10 working -day waiting period for an Opt -out form. Where the homeowner has chosen to opt -out, the residential dwelling will revert to being an area of public access subject to all the protective requirements contained in Colorado Air Quality Control Commission's Regulation No. 8, Part B: 1) at the time of the homeowner's choosing; 2) when the homeowner no longer own the single-family residential dwelling; or, 3) if the dwelling ceases being the homeowner's primary residence, whichever is first. Conclusion: The quantity of asbestos disturbed (-200 square feet of asbestos textured drywall) exceeds the "trigger levels" as defined by Colorado Regulation 8, asbestos mitigation as described under "major asbestos spills" is required. The inside of the home and its contents are considered asbestos contaminated and should be decontaminated or disposed at an EPA landfill that accepts friable asbestos waste. Only asbestos certified personnel should enter the building unless authorized by the Colorado Department of Public Health and Environment. Per Colorado Regulation 8, a "major asbestos spill" response is required: III. T. Major Asbestos Spills In the event of an asbestos spill involving greater than the trigger levels, the building owner or contractor shall: III. T. 1. a. Restrict access to the area and post warning signs to prevent entry to the area by persons other than those necessary to respond to the incident. III. T. 1. b. Shut off or temporarily modify the air handling system to prevent the distribution of asbestos fibers to other areas. III. T. 1. c. Immediately contact the Division by telephone, submit a notification in compliance with subsection III.E. (Notifications) and, if in an area ofpublic access, apply for a permit in accordance with subsection III. G. (Permits). III. T. 1. d. Be exempted from the requirements to have a certified Supervisor on-site at all times, until such time as the immediate danger has passed. Any cleanup or asbestos abatement that must occur after the immediate danger has passed shall be supervised by a person certified by the Division. III. T. 1. e. Using certified Supervisors and certified Workers in accordance with section H. (Certification Requirements) of this Regulation, seal all openings between the contaminated and uncontaminated areas and establish negative air pressure within the contaminated area in accordance with paragraph IIIJ. (Air Cleaning and Negative Pressure Requirements). This is to be accomplished using polyethylene sheeting to cover areas such as doorways, windows, elevator openings, corridor entrances, grills, drains, grates, diffusers and skylights. III. T. If HEPA vacuum or steam clean all carpets, drapes, upholstery, and other non -clothing fabrics in the contaminated area or discard these materials. III. T.I.g. Launder or discard contaminated clothing in accordance with subsection IIIR. (Waste Handling). III. T. 1. h. HEPA vacuum or wet clean all surfaces in the contaminated area. III. T. 1. i. Discard all materials in accordance with subsection III.R. (Waste Handling). III. T.I.j. Following completion of subparagraph III. T. 1. a. through III. T. 1. i. above, comply with air monitoring requirements as described in subsection IIIP. (Clearing Abatement Projects); air samples shall be collected aggressively as described in 40 C.F.R. Part 763, AppendixA to Subpart (EPA 1995), except that the air stream of the leaf blower shall not be directed at any friable ACM that remains in the area. III. T. Lk.
