Dispatch advised a refused party wanted to see if the people asphalting the parking lot had a permit. Upon arrival I contacted Efrian Caraveo of Caraveo Construction. z asked Caraveo if he had a permit for laying the asphalt. Caraveo told me they did not need a permit to 1ay asphalt on private property. Caraveo told me the only time they need a permit is if they work onto the public roadway or if the asphalt goes below twelve inches. I then pulled my vehicle across the street to park and contacted Sergeant Gallegos by phone to discuss whether or not a permit was needed. While speaking with Sgt. Gallegos I observed a male walk towards my patrol car. I was not sure what the male was doing at the time. I needed to go back and speak with Caraveo so I pulled out of the park and drove back towards the church. While driving back I observed a male standing near the street with his arms extended from his side. The male appeared to be irritated. I pulled next to the male and advised him I was working on something else and I would be with him in a minute. After speaking with Caraveo, I went over and spoke with the ma1e. I told the male I was on the phone and I drove to the end of the lot and turned around and spoke with him. The male was extremely frustrated. The male then stated "do you have some answers for me." I replied back, "what is your question." The male wanted to know if they have a permit. I advised the male I was not sure if they needed a permit and that I would forward this onto the building inspector. The male continued to speak in a loud tone and wanted to know about disturbing the peace. I briefly explained the disturbing the peace law. The male stated he was going to call the police next time they disturbed his peace. The male was given Sgt. Gallegos's name and business card at his request. Nothing further. These areas will be graveled to serve as water quality filters. Construction of a curb or 6" berm is required to be constructed extending from the existing curb south to the middle of the building. The paving of parking lot without a Paving Permit. Statement of the Issues: The Pastor hired a contractor to pave about a 6' wide swath along the sides of the existing parking lot, and to continue the paving southward to the back of the church building. No Paving Permit was obtained nor was a proposed site improvement plan submitted for review and approval by City staff prior to the placement of the asphalt pavement. The neighbor to the west had expressed some legitimate concerns regarding drainage, and the neighbor to the east apparently has held some long time animosity towards the church in general. Discussion• Russ stated that he had visited the site the middle last week after learning of the paving, and had observed that the parking lot indeed had some new pauement recently placed along the edges of the existing lot, and also extended along the sides of the building. Mr. Ouray replied that "the City had asked that azea in and around the building be paved where vehicles park, such as the church-owned bus." Meredith said that indeed the azea where vehicles are to be pazked does need to be a hard surface such as asphalt however a Paving Permit must be obtained through the Dept. of Community Development prior to the commencement of the work. In addition, 6' wide landscape buffers along the property lines are required by City Code, and therefore need to be restored. Dave stated that the 6' wide "landscape strips" along the sides of the parking lot also provide minimal measures necessary for water quality that would ordinarily be required, in arder to allow the pauement to be placed along the sides of the building. Therefore, the recently placed 6' wide asphalt strips will need to be removed, and a pervious material such as gravel will need to be placed (no plastic underneath, etc., the strips are to remain permeable). Another azea of concern is the additional runoff produced by the new pavement alongside the building, which flows primarily to the neighbors lying to the west. 5600 W33rd Ave_ParkView Baptist Parking Lot (73-07).doc There is existing curbing along both property lines and runs to the southerly end of the existing asphalt parking lot. Russ and Dave both agreed that to protect the neighbors on both sides of the church from the additional site runoff; a hazd-surface berm needs to be placed from the end of the existing curbing and run southerly to about even with the middle of the church building. The berm may be either concrete or asphalt. The site begins to flatten out in this area, and if the berm is conshucted to this point it should prevent any negative impact to either of the neighbors. Pastor Ouray stated that he wished to be in full compliance with the law and that he will do whatever we ask of him. Pastor Ouray stated that his contractor, subsequent to the initial paving did apply for a Pauing Permit. As a condition of approval of the Permit, Pastor Ouray agreed to remove the asphalt strips that were just placed along the existing pavement, to construct a berm along both sides to the middle of the church building, and to place a perxneable material such as gravel within the 6' wide strips to allow for water to penetrate into the ground. It was clearly stated by all staff during this meeting, and acknowledged by the Pastor, that the Paving Permit will need to be issued to complete this work under the conditions stated above.
