Sampling: During the sampling process, suspect ACM was separated into three EPA categories. These categories are thermal system insulation (TSI), surfacing ACM, and miscellaneous ACM. TSI includes all materials used to prevent heat loss or gain or water condensation on mechanical systems. Examples of TSI are pipe coverings, boiler insulation, duct wrap, and mud packed fitting cement. Surfacing ACM includes all ACM that is sprayed, trowelled, or otherwise applied to a surface. These applications are most commonly used in fireproofing, decorative and acoustical applications. Miscellaneous materials include all ACM not listed in the thermal system insulation or surfacing categories, such as linoleum, vinyl asbestos flooring, and ceiling tile. Boulder Environmental Inc. followed EPA recommended sampling guidelines for identification of asbestos in bulk matrices. A set of three (3), five (5), or seven (7) samples were collected for each material type and analyzed by Polarized Light Microscopy (PLM). Each sample set was systematically analyzed. Upon determination that a sample in a set contained asbestos, analysis of the remaining samples in the set was discontinued. If no asbestos was detected during the analyses, the suspect material was determined to be negative for asbestos content. Suspect materials are assigned numerical values based on an evaluation of the building materials condition at the time of the inspection. The numbers assigned are: 1. Damaged or significantly damaged thermal system insulation ACM. 2. Damaged friable surfacing ACM. 3. Significantly damaged friable surfacing ACM. 4. Damaged or significantly damaged friable miscellaneous ACM. 5. ACM with potential for damage. 6. ACM with potential for significant damage. 7. If asbestos removal is required: (Asbestos removal permits and notifications): Asbestos removal in Single Family Residential Dwelling (SFRD's) in quantities of "> SO LF or 32 SF or a SS gallon drum, but _5 260 LF or 160 SF or a 55 -gallon drum" requires a permit or notification requirement for asbestos removal contractors which involves a ten working day waiting period. Removal of non -friable asbestos containing building materials requires a notification fee of $60. Removal of friable asbestos within this range of quantities requires a permit fee of $180 for a friable asbestos removal. If the quantity of ACBM to be removed exceeds is "> 260 LF or 160 SF or a SS gallon drum" in a Public and Commercial Building, School or a SFRD, a permit/notification a ten working day waiting period is required before a permit is valid. These circumstances also require a notification fee of $80 for a non -friable asbestos removal or a permit fee of 400 for a friable asbestos removal. These trigger levels apply to SFRD's which are intended to be demolished. Emergency asbestos abatement / demolition permits may be issued if project circumstances pose an immediate hazard to public health and environment. CDPHE does not typically waive permit waiting periods because of financial hardships or planning issues. With this new law homeowners who reside in the home they wish to renovate can now choose to be afforded the same protections as they are entitled to in a public and commercial building, unless the homeowner chooses to waive this protection. To waive these protections, the homeowner must sign this form declaring that they do not want their home to be considered an "Area of Public Access" for purposes of determining the applicability of portions of Colorado's asbestos regulation. The term "Area of Public Access" is unique to Colorado's asbestos regulation and basically determines if an abatement permit, engineering controls, and air clearance testing is required. If a building is not an "Area of Public Access" then only certification, notification and asbestos disposal requirements in Colorado's regulation are applicable. This declaration will not affect you in any other way as it only determines your home's status with respect to Colorado's asbestos abatement regulation. CDPHE may decide, on a case-by-case basis, to waive the 10 working -day waiting period for an Opt -out form. Where the homeowner has chosen to opt -out, the residential dwelling will revert to being an area of public access subject to all the protective requirements contained in Colorado Air Quality Control Commission's Regulation No. 8, Part B: 1) at the time of the homeowner's choosing; 2) when the homeowner no longer own the single-family residential dwelling; or, 3) if the dwelling ceases being the homeowner's primary residence, whichever is first.
