CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
August 24, 1992
The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilmember~ present Elise Brougham, Kent Davis, Don Eafanti, Phil
Edwards, Vance Edward~, Tony FIasco, Ron Selstad, and Bill Shanley Also
present City Clerk, ~anda Sang, rity Aiministrator, Robert Middaugh,
City Attorney, John Hayes, Director of Planning, Glen Gidley, Chief of
POlice, Jack Hurst, Director of Public Works, Bob Goebel, staff, and
intere~ted citizens
APPROVAL OF MINUTES of August 3, 1992 (Study Session) and August 10,
1992
Motion by ~r Eafanti for the approval of the Minutes of August 10,
1992, seconded by Phil Edwards, carried 8-0
Consensus was 8-0 to change the August 3 Study Session Minute~
CITIZENS' RIGHTS TO SPEAK
There was no one present to speak, but City Clerk, Wanda Sang, read a
letter into the record from a resident of District I
City Attorney, John Hayes, noted that this letter should not be part of
the record since it impugned Councilmembers and is contrary to Council
Rules
Mrs Brougham noted that the tone of the letter was not stopped by the
chair
Motion by Vance Edwards to leave the letter as part of the record,
seconded by Mr Selstad, failed 4-4 with Councilmembers Brougham,
Eafanti, Selstad, and Vance Edwards voting yes Mayor Winger broke the
tie and voted no, Motion failed 5-4

Council Bill 17 - An Ordinance providing for the rezoning from
Planned Industrial Development District to a Modified Planned

Motion by Mr Shanley that this Item be continued to September 28, 1992,
seconded by Mr DaVis, carried 8-0

Ridge Municipal Code, concerning Municipal Di~po~ition of

Motion by Mr Shanley that this Item be continued to September 14, 1992,
seconje~ by Mr Eafanti, carried 8-0

Item 3
Council Bill 20 - An Ordinance vacating a portion of West 39th
Avenue within the City of Wheat Ridge, County of Jefferson,
State of Colorado
Motion by Mr Eafanti to continue this Item indefinitely, seconded by
Mr Davi~, carried 8-0
DECISIONS, RESOLUTIONS, AND MOTIONS
Item 4. Jolly Rancher Request for accelerated PID review
Mr Middaugh and Mr Gidley explained that the City had been approached
by Jolly Ran1her, who i~ in need of rapid plant expansion and asked the
City's help to accelerate the process required to begin construction
Keith Krickbaum, 5060 Ward Road, plant manager for Jolly Rancher, was
present and asked for approval
Motion by Mrs Brougham that ~taff be authorized to follow an
accelerated processing schedule relating to the Jolly Rancher Planned
Industrial Development, Final Development Plan processing procedure~
It should be under~tood that although procedures may be mo1ified, there
is no guarantee of waivers or variances to development requirements or
standards associated with the proposed development That City Council
receive the entire planning commission packet and minutes as soon as
possible, seconded by Vance Edwards, carried 7-1 with Mr FIasco voting
no Mr FIasco feel~ that J)lly ~ancher had plenty of time to apply for
this, there are always probleilJs when we accelerate this Getting the
minutes from planning commission on Monday, won't be soon enough
Item 5
Design with options for W 38th Avenue/~ipling to Cody Street
Item 5 was introduced by Mr FIasco Mr Middaugh and Mr Goebel
presented the various options to Council and answered questions
Council had the opportunity to cho~e either a 36 ft, 3-lane design, a
44 ft, 4-lane design, or a 44 ft, 3-1ane design
Sworn in by the Mayor and speaking in favor of a 36-ft, 3-lane design

Their concerns were negative impact on their neighborhood, decreased
real estate values resulting from a 44ft street, air pollution, loss of
old trees, safety concerns regarding stopping in turn lanes, increased
cost for 44ft design, steep grades on n~ighboring streets, more than
ad~quate capacity with 3-lane design

Their concerns were that W 38th Avenue is designated a collector street
in t~e romprehensiv~ Plan, width of street does not det~rmine traffic,
people do, if a collector street is less t~an 44 feet, it is a problem,
progress for wheat Ridge, increased traffic to Lut~eran Hospital will
make it very dangerous for emergency vehicles, other vehicles, and
pedestrians, continuous turn lanes are very dangerous

Mrs Brougham read letters in support of 36 ft, 3-lane design into the
record They were from Ida Tyler, 10895 w 38th Avenue, Linnea
Thompson, 9795 W 38th Avenue, Dave and Raelene Edwards, 3240 Gray
Street, Mr & Mrs Dino H Pesci, 3815 Garland Street, Kathleen Krager,
Transporation Engineer
Mrs Brougham al~o submitted a petition with 51 signatures that
reque~ted that t~e slope of private driveways and public residential
streets not be increased in the design for the W 38th Avenue Street
Project She noted that Councilmember Eafanti had signed that petition
Upon questioning Chief of Police, Jack Hurst, Vance Edwards asked that
the record reflect that the Police Departmeni, j J,,"" !lot take a position
on either 3 lanes, 4 lanes, or street width
Ronald Selstad read a letter from wendy Whicher, 41~0-2 Independence
Court, opposing 4 lanes into the record
Motion by Mr Eafanti to go past 11 00 pm, seconded by Mr Selstad,
carried 8-0
Motion by Mr FIasco that the Public Works Department be directed to
prepare a road design for 38th Avenue between Cody Street and Kipling
Street that encompasses the following features 1 2 Traffic lanes in
each direction 2 A curb to curb road width of 44 feet flow line to
flow line 3 Sidewalks on the north and south side, seconded by Mr
Davis
Motion to amend this motion by Vance Edwards to change it to a 36 feet
flow line to flow lin,," 1esign with 3 lanes, seconded by Mr Selstad
Mr FIasco pointed out that this is in direct conflict with the
Comprehensive Plan and therefore he will vote against it
Phil Edwards will vote against the amendm,,"nt because of safety concerns,
some sacrifices have to be made to live in a City, one of them is
increased traffic, streets are a dangerous place 38th Avenue is
heavily utilized by emergency vehicles
Mr Shanley called for the que~tion
Mr Vance Edwards called for question of privilege to allow him to state
his reasons for voting for the 3-1ane design Consensus was 6 in favor
to let Vance Edwards speak
He spoke against 4 lanes and in favor of 3 lanes, listen to citizens

Call for the question carried 7-1 with Mr Selstad voting no
Vote on amendliJent <36 ft) was 5-3 with Councilmembers Phil Edwards,
Davis, and FIasco voting no
Motion by Mr Selstad to amend the original motion to redd t~e full
Option 1 design, secondei by Vance Edwards, carried 5-3 with
Councilmembers Phil Edwards, Davis and FIasco voting No
(Option 1 3 lane design - I move that the Public Works Department be
1irected to prepare a roai i~sign for 38th Avenue between Cody Street
and Kipling Street that encompasses the following features 1 2
Traffic lanes and a continuous center turn lane 2 A curb to curb
roal width of 36 feet 3 Bus pullouts as appropriate 4 Sidewalk
on the north and the south side with that section of sidewalk on the
north side between Independence and Kipling being 10 feet in width to
accomodate bicycle traffic)
Vote on original motion as amendei endorsing Option 1 carried 5-3 with
Councilmembers Phil Edwaris, Davis, and FIasco voting no
CITY ADMINISTRATOR'S MATTERS
Robert Middaugh asked City Council to hold a Special Meeting on August
31 to consider a financing package associated with undergrounding
utilities for 38th Avenue This cannot wait until the September 14
meeting Motion by Mr Shanley to ~old a special meeting on August 31,
1992 at 7 30 p m to discuss this, seconded by Vance Edwards, carried
b-2 with Mr FIasco and Mr Davis voting no
Mr Middaugh also asked for a Study Session to discuss two items, one
payplan, also, the Board of Education would like to address City
Council Consensus was 5 in favor to hold a Study Session on September
9, 1992
CITY ATTORNEY'S MATTERS
John Hayes announced that Kathy Haddock will JOIn his firm and might be
doing some work involving the City of Wheat Ridge He will bring her in
to introduce her
Motion by Vance Elwards to adjourn, seconded by Mr DaVis, carried 8-0
