This Development Escrow Agreement is entered into this 14th day of June, 2004 between the
City of Wheat Ridge, a Municipal Corporation, and Samuel Frederick Azlein, hereinafter
refened to as "Owner" and concems property located at 3945 Pierce Street, Wheat Ridge,
Colorado.
The Owner is the titled Owner of a tract of land in the City of Wheat Ridge, County of Jefferson,
State of Colorado, more fully described as Tract 24 Upland Acres, City of Wheat Ridge, County
of Jefferson, State of Colorado.
The sum of three thousand two hundred twentX five dollazs 3.225.00) to be held in escrow
with the City of Wheat Ridge for 10 yeara or until public improvements aze completed along
3945 Pierce Street, Wheat Ridge, Colorado, wliichever occurs first.
The City of Wheat Ridge shail have the absolute right to withdraw the Escrow funds for the
purpose of constructing public improvernents along 3945 Pierce Street. The City of Wheat Ridge
further agrees that the Owner shall have no further obligation to make any payments for such
public improvements.
The only requirement to withdraw the Escrow funds in behalf of the City of Wheat Ridge ehall
be a letter from thz Community Development Deparhnent of the City, executed by the llirector
of said Deparhnent and witnessed by the Nlayor of the City of Wheat Ridge. Said letter shall
state that the City is proceeding with the construction of public improvements along said streets
and wi11 utilize funds to defer costs of the construction project.

In the event that landscaping required by Wheat Ridge Code of Laws, Section 26-502
and/or as shown on an approved landscape plan is not installed

hav the ri t to enter upon said property to construct and/or install such improvements
or do other such work to accomplish that purpose as may be necessary, provided that the
City of Wheat Ridge shall first give notice in writing to the contractor, developer or
owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature, including
labor, materials and use of equipment either by force account or contract, the City shall
have the absolute right to withdraw the escrow funds to complete said landscape
improvements. The only precondition to the City's right to withdraw the escrow funds
for this purpose shall be a letter from the Community Development Director, stating that
the landscape improvements have not been completed or provided and that the
compliance date of ;jt)v S- has expired.

This Development Escrow Agreement is entered into this 14th day of June, 2004 between the
City of Wheat Ridge, a Municipal Corporation, and Samuel Frederick Azlein, hereinafter
refeaed to as "Owner" and concems property located at 3945 Pibrce Sfreet, Wheat Ridge,
Colorado.
The Owner is the titled Owner of a tract of land in the City of Wheat Ridge, County of Jefferson,
State of Colorado, more fully described as Tract 24 Upland Acres, City of Wheat Ridge, County
of Jefferson, State of Colorado.
The sum of thsee thousand two hundred twenty five dollars 3.225.00) to be held in escrow
with the City of Wheat Ridge for 10 years or until public improvements aze completed along
3945 Pierce Street, Wheat Ridge, Colorado, whichever occurs first.
The City of Wheat Ridge shaii have the absolute right to withdraw the Escrow funds for the
purpose of constructing public improvements along 3945 Pierce Street. The City of Wheat Ridge
further agrees that the Owner shall have no further obligation to make any payments for such
public improvements.
The only requirement to withdraw the Escmw funds in behalf of the City of Wheat Ridge shall
be a letter from the Community Development Department of the City, executed by the Director
of said Deparhnent and witnessed by the Mayor of the City of Wheat Ridge. Said letter shall
state that the City is proceeding with the construction of public improvements along said streets
and will utilize funds to defer costs of the construction project.

All permits shall be applied for through the Public Works Department. An approved pemvt is effective for a
period of one (1) year from date of issue and may be renewed. All fees shall be in accordance with those fees
established by the Uniform Building Code or other applicable City adopted Resolutions or Ordinances.
Note: All public improvements, when constructed, shaU be maintained (by the respective individual(s) and/or
company responsibk for the construction of that public and/or private improvement in the respective
development) on a daiiy bosis, or as needed, such that they are free of inud and other corutruction debris
tracJdng from the site. Failwe to comply with this requirement will result in the enjorcement of Article III,
Specified Nuisances, Section 15-16 (4) of the Ciry of Wheat Ridge Code of Laws.
MINOR EXCAVATION AND FILL PERMITS
1. 1-50 Cubic Yards: No permit is required for dumping or excavation of earth materials, which do not exceed
50 cubic yazds, provided, however, that any fill deposited is on natural terrain of less than three (3) horizontal
to one (1) vertical slope, or such fill is less than three (3) feet in depth and is not intended to support permanent
swctures, and in addition, such fill or excavation does not obstruct or otherwise adversely affect any
drainageways. Should any of t6e above standards be exceeded, or a drainage way be affuted, a pemvt shall be
required under the guidelines for No. 2.
2. 51-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 wbic yards may be
aliowed with a permit approved by the City Engineer. All applications are to be submitted on the appropriate
completed application form and shall be accompanied by the appropriate fee and sketch plan indicating the
following information before the permit will be issued.
A. Location and dimensions of all propeRy boundaries and structures on the site.
B. I.ocation and extent of azeas to be filled andlor excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of how and where
historic run-off will be maintained on and through the site.
D. Cross-section area to be filled and/or excavated indicaung original slope, new slope and depth of fiil.
E. Statement that indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion control plan showing placement of control devices such as hay bales, etc.
3. 501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic yards, but
dces not exceed 20,000 cubic yazds, may be allowed by a permit issued by the Ciry Engineer after review of
an application and supporting information. The following information shall be submitted with the required
application form:
A. A site plan, prepared and signed by a Colorado regis[ered professional engineer, at a scale of no less than
1 inch to twenty feet (1:20) which illustrates the following:
B. I.ocauon and dimensions of all property boundaries aod structures on the site.
C. I.ocation and extent of azeas to be filled and/or excavated.
D. Location of existing waterways and drainage courses indicating any changes. (for a site containing an
established irrigation ditch, a letter of approval from the appropriate diuh company shall be required).
E. Location of existing and proposed points of ingress.
F. Location and extent of existing vegetation, proposed changes in such vegetation and methods of
rehabilitation on site vegetation afrer earthwork operations aze complete.
G. Erosion contro] plan.
H. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours with contour
intervals of 2 feet and spot elevations.
I. At least two cross secaons (east to west and north to south) through the site showing depth of fill and/or
excavation.
J. A drainage report may be requireA if site runoff characteristics are changed.
K. Relative elevations of adjacent properties and structures.
L. Statement of purpose of intended fill and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Excavation and Fill Permits:
A. Rehabilitation: Within thirty (30) days afrer cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accordance with the approved plans. Rehabilitation shall consist of
leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"For the purpose of this Section, the term deDris shall have the same meaning as the terms "gazbage, trash
or junk" as defined in the Wheat Ridge Code of Laws, Section 154."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any f I] areas within the City of Wheat Ridge.
C. Excavation and/or fill areas shall be graded to facilitate weed convol until final grades are set and site
rehabilitaaon and use occur (must be leveled with side slopes not to exceed 3 to 1).

SCOPE
A geotechnical and geological engineering investigation was conducted at
the site of a proposed single family residence to be constructed at 3945
Pierce Street, in Lot 24, Upland Acres Subdivision, Wheat Ridge,
Colorado, to determine the best type of foundation system and provide
interior floor slab recommendations for the structure. Recommendations
for design and construction based on soil and groundwater conditions have
been provided. This investigation does not include evaluation of soil or
groundwater for the presence of pollutants or other environmental
hazards.
Information contained herein is based on a field and laboratory
investigation and experience with similar projects and conditions.
PROPOSED CONSTRUCTION AND SITE CONDITIONS
The structure will be a two story residential structure over a crawl
space. A wood frame superstructure will be supported by a reinforced
concrete foundation.
The site is located in a developed portion of Wheat Ridge. The surface
in the general vicinity is relatively flat. Surrounding properties are
fully developed, but there is no indication of previous improvements on
this property. Vegetation consists of various trees, shrubs, native
grasses and groundcover plants.
There are no apparent geologic hazards that should affect the proposed
construction.
SUBSURFACE CONDITIONS
Subsurface conditions were investigated by drilling two foundation design
test holes within the approximate building envelope. Test hole locations
are shown in Figure 1, Test Hole Location Plan.

Holes were drilled to a depth of 30 feet and samples were taken at
various intervals based On soils encountered and anticipated foundation
bearinq depths. Detailed soil descriptions and Standard Penetration test
results are shown in Figure 2, Test Hole Logs.
Soils are typical of mixed stream terrace and wind blown deposits.
Clayey sand soils were present to a depth of approximately 22 feet.
Bedrock was encountered at a depth of 22 feet in both test holes.
Published geologic maps indicate the area is underlain by bedrock of the
Denver and Arapahoe Formations. The Denver-Arapahoe Formation consists
of arkosic sandstone, shale and mudstorie (claystone). Claystone was the
predominant rock type beneath this site.
Swell-consolidation testing was conducted on two representative clayey
sand samples from depths of three and six feet. Tests indicate these
soils have no swell potential and low to high consolidation potential.
The sample from TH-1, at a depth of six feet, consolidated 0.6 percent
when saturated and loaded with a surcharge of 1000 psf. The sample from
TH-2 at three feet consolidated 3.3 percent under similar conditions.
Consolidation potential measured for the sample from TH-1, at six feet,
is probably more representative of actual conditions. Samples had
relatively low cohesion and most samples were not suitable for testing.
Disturbance during sampling and/or sample preparation may account for a
significant portion of the consolidation measured in the sample from
TH-2.

Results.
Groundwater was encountered during drilling operations at a depth of
approximately 22 feet in TH-2. Free water was not present in TH-1.
Groundwater was present in both holes at a depth of 20 to 21 feet when

the holes were checked four days a£ter drilling. The geologic and topo-
graphic conditions indicate that groundwater is contained in a relatively
large regional table. A significantly more shallow groundwater table is
not likely beneath the site in the foreseeable future. Groundwater
shallow enough to affect finished construction is unlikely.
Shallow perched water tables typically form, or rise, during periods of
heavy precipitation and surface water inflow, i.e., the spring and early
summer. Development will change surface and subsurface drainage and may
cause formation of new perched groundwater tables.
FOUNDATION RECOMMNDATIONS
The foundation should be supported on continuous spread footings designed
for a maximum contact pressure of 1500 psf. Maximum contact pressure
should be calculated using full dead load plus full live load. Footings
should be proportioned, as much as practical, to maintain even contact
pressures and help prevent differential settlement.
Footings should be constructed on natural soils that are smooth, even and
free of loose soil, rocks and debris. Footings should not be constructed
on frozen or saturated soils.
INTERZOR FLOOR S7.A8 CONSTRUCTION
The builder/owner should be aware that concrete floor slabs supported by
clay soil may move if support materials become wet. One means of
preventing slab movement is construction of a suspended floor over a
shallow crawl space. Anticipated expansion potential of soils present
indicates there is a very low risk of significant movement and damage.

The following procedures should be implemented to help prevent structural
damage if the floor slab moves, prolong slab life, and promote better
slab performance:
1. Expansive soils should not be compacted more than necessary for
excavation and should not be allowed to dry excessively. The bottom
surface of the excavation should be thoroughly wetted 24 hours prior
to slab placement.
2. Concrete slabs should be reinforced with steel mesh and should be
separated from all bearing members and utilities to allow
independent movement ( i.e., a"floating slab").
3. Joints should be scored in the slab at maximum 200-square-foot
areas.
4. A minimum void space of two inches should be constructed, above or
below, any non-bearing partition walls placed on the slab. In
finished areas, any furring strips, drywall, paneling, etc., should
stop a minimum of two inches above the floor slab.
5. Piping should not be placed under the floor slab if hot water
heating is used. A flexible connection should be utilized to allow
some movement between the furnace and the heating ducts, if forced-
air heating is used.
6. The foundation drain system and landscaping should be completed in
strict compliance with recommendations outlined herein to help
prevent wetting of slab support soils.
DRAIN SYSTEMS
A drain system should be constructed around the exterior foundation
perimeter. The drain system should be constructed in compliance with
details shown in Figure 4 and graded to a sump pit within the basement.
Excess water should be removed by an automatic sump pump placed a minimum
two feet below foundation bearing depth. The pump should discharge to
the ground surface a minimum of ten feet from any foundation wall..
Particular attention should be given to proper grading of drain pipe.
Improper grading, such as high or low spots in the pipe, could result in

foundation walls should be minimized and should be species that do not
require irrigation once established.
Downspouts and sill cocks should not be allowed to discharge directly
onto the ground surface. Splash blocks and/or downspout extensions
should be used wherever possible to discharge water beyond the limits of
foundation backfill.
The owner is encouraged to read A Guide to Swellina Soils for Colorado
Homebuvers and Homeowners, Special Publication No. 93, available from the
Colorado Geological Survey. Recommendations contained in the report are
applicable to all residential construction in the Denver area, reqardless
of soil expansion potential.
INSPECTION AND CONSULTATION
In any subsurface investigation it is necessary to assume conditions
encountered in the field investigation are representative of the site.
Actual conditions may differ from those encountered during the field
investigation.
Subsurface conditions should be verified through visual inspection of the
foundation excavation by a representative of this office prior to
construction. Drain system construction should also be inspected to
insure compliance with these recommendations.
