II. The insurance estimate/scope of this roofing project is attached to and made a part of this contract as the last page and will be signed separately. III. Customer agrees to pay a deposit of 50% of total estimate cost before work is to begin to secure materials and scheduling of needed labor. Remaining costs become due and payable upon completion of contracted work. IV. The COMPANY shall hold in trust any payment received from CUSTOMER until the COMPANY has delivered roofing materials at the site or has performed a majority of the roofing work on your property. V. The COMPANY carries worker's compensation, automobile and commercial general liability (bodily injury and property damage) insurance. A certificate of Insurance identifying our insurance carrier and the types and amounts of coverage and our insurance information is attached and is incorporated in here and should be considered a part of this contract. VI. You, the Customer, have the right to rescind this contract and obtain a full refund of any deposit within 72 hours after entering the contract. If you plan to use the proceeds of a property and casualty insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after you receive written notice from the property and casualty insurer that your claim has been denied in whole or in part. However, the Company is entitled to retain payments or deposits to compensate the Company for roofing work actually performed in a workmanlike manner consistent with standard roofing industry practices. The Company cannot pay, waive, rebate, or promise to pay, waive or rebate all or part of any insurance deductable applicable to the insurance claim for payment for roofing work on your property. VII. By executing this Contract, Customer hereby binds him, her or itself, his co-owners, heirs, partners and successors to the terms, agreements and obligations herein. VIII. Customer shall use its best efforts to obtain prompt payment from Insurance Company and Mortgage Company and prompt release of funds from any applicable Mortgage Company. Customer agrees to Reimburse Company for all reasonable costs incurred in enforcing the Terms of this Contract. IX. Customer further agrees that Company shall be entitled to a 1.5% per month interest on all amounts due and owing to it from the date of billing for the same in the event that such amounts are not paid within 30 days of invoice. X. All changes to this contract must be made in writing. XI. Contract is bound by Colorado law and in case of dispute, parties agree to arbitration. XII. EXPECTATIONS OF PREPERTATION FOR YOUR NEW ROOF - We will need access to your driveway during delivery of materials and during construction. - Please inspect the materials upon delivery to verify the color and style. We will not always replace flashing if it is good. You will receive credit for materials that are ordered but not used on your project. - Please keep pets and children indoors or away from work areas. - Please be prepared for the noise of the project. - Please cover any outdoor items such as patio furniture, etc. - Please remove any indoor items such as pictures or shelves hanging on the walls or any fragile items as the vibrations during the construction process may cause damage. - Please cover any items in your attic or anywhere you have an open ceiling. - Please note open ceilings or soffits that building codes now require nails to protrude through the roof decking. The nails may be visible if you have no ceilings or soffits. - Some minor cracks may appear in drywall/plaster during construction. Company will be responsible. - We will need access to electrical/water service during the construction - Please have your lawn mowed or grass short to assist in our clean-up efforts. - We will notify you in advance of the start schedule (weather permitting).
