Our crew measured the following drainage related improvements: 1_ Detention pond cross-sections, at approximately 50- foot intervals, along the east and south sides of the buiiding; and, 2. invert elevations for the metered outlet structure at the initial storm, 100-year storm, and invert-out locations. As you are aware, Ron Luke, (the owner) removed the previously constructed trickte channel, and poured a new one a grade of 025 percent to achieve the detention volumes required in our drainage report. He afso had the side slopes re-graded to achieve the 2 percent grades called for on our plans_ Based upon comparing the design with those improvements measured today, we found no signrficant differences in either the elevations or locations of drainage improvements shown on our plans. Therefore, we have concluded that the drainage improvements were built substantially in accordance with the approved drainage plans and report, and that the required volumes have been achieved. The property is zone Planned Commercial Development and located at 3470 Wadsworth Boulevard. Pursuant to Section 26-6(2)(a) of the Wheat Ridge Code of Laws, the zoning administrator is empowered to decide upon applications for minor variances as long as 1. The variance does not exceed 10% oF the maximum standard; 2. The zoning administrator finds that the "findings of fact," as seC forth in subsection (2)(c), are substantially complied with and support the request; 3. No protests have been received during such ten-day period; 4. That no additional dwelling units would result from approval of such variance. This case first surfaced after the applicant, who had a professional survey pin survey performed for the development of the site, noticed that the proposed structure was too close to Yhe southern property line. Because tbe southern property line is a public right-of-way, any structure which with a side yard abutting a public right-of-way must retain a 30' side yard setback from property line. Afrer finding tbe design flaw, the applicant applied for the administrative application in hopes of rectifying the situation. We have not received any letters or phone calls in opposition of this case. Therefore, staff recommends approval of Case No. WA-98-I 1. All requirements of Section 26- 6(2)(a) of the Wheat Ridge Code of Laws have been met and the findings of fact support approval.
