That approval came with two conditions: 1. That dog training/daycare could be allowed at the location if there were no outdoor runs or pens. 2. That dog boarding could be permitted if the dog training, daycare, and retail component of the business was the primary use of the building and property and the boarding represented an accessory use. The boarding must occur in a soundproofed building consistent with the soundproofing requirements for veterinary hospitals. Again, no outdoor runs or pens could be present. The City's zoning code only allows outdoor runs and pens in agricultural and industrial zone districts. Outdoor runs and pens can refer to individual dog containment areas that might be associated with an individual kennel, as well as larger group dog play areas. The limitation on outdoor dog areas is consistent with the soundproofing requirement for boarding facilities to prevent noise and limit impacts on neighboring properties, which are often residentially zoned, given the city's development patterns. At the City Council study session on November 5, 2018, the issue of outdoor play areas for dog - related businesses was discussed, and City Council was not inclined to pursue a code amendment that would allow additional zone districts to have such outdoor dog -related uses. For the business license, Randy Slusser indicated that a permit would be required for the window that was replaced in the main building. Any additional modifications to the rear accessory building, which you had mentioned during the course of our inspection last Friday, would also trigger City review and approval through a building permit. The Community Development Department can conditionally approve the business license application under the condition that a permit for the window is obtained within 60 days of this letter.
