That letter, dated May 16, 2018, was sent to the property owner listed in the Jefferson County Assessor
records, but was returned to us earlier this month marked "Return to Sender — Not at this address" and the
post office noting that they were unable to forward the letter. As such, we are now attempting to deliver
this letter directly to the subject property (3609 Sheridan Boulevard).

Dear Property Owner:
It has come to the attention of the City of Wheat Ridge that property located at 3609 Sheridan Boulevard
is being actively listed as an AirBnb with accommodations for multiple parties, and that this structure may
have a secondary unit in the basement.
The property is zoned Residential -One C (R -1C), which is the City's smallest lot single-family zone
districts. It only allows for single-family homes. Duplexes, accessory dwelling units, or any other type of
secondary dwelling is not permitted. Due to the age of the home (built in 1941 according to County
records) Staff reviewed our internal building permit archives to determine the legitimacy of the basement
dwelling unit, since the City of Wheat Ridge was not incorporated until 1969, and the construction of your
home would have been subject to Jefferson County zoning regulations at the time of construction. None of
the records on file indicate this property to have a duplex or any type of secondary dwelling unit in the
basement. Additionally, the County Assessor lists this property as a single-family home and not a duplex,
further solidifying the City's determination that this property is a single-family home.
We frequently receive calls from appraisers questioning the legitimacy of structures/dwelling units, and
the ability to rebuild in the event of casualty. Based on the information on hand, we would inform an
appraiser, realtor, title company, or other interested party that there is no record of the basement being
converted to a separate dwelling unit, nor does it have a Certificate of Occupancy as a stand-alone
residential structure.
Furthermore, the City's regulations regarding short-term rentals currently fall under the following
categories:
• Rooming and boarding: permitted as an accessory use in all residential zone districts. An
accessory use means the primary use of the home must be as a permanent residence. The definition
of rooming and boarding includes no more than 2 people residing with the permanent resident for
no less than 7 days.
• Rooming and boarding houses: Can accommodate 3 to 15 guest rooms, but are not permitted in
residential zone districts.
• Bed and breakfast: requires a special use permit in all residential zone districts, and requires the
owner to live on site. Additional regulations can be found in Section 26-608 of the Municipal
Code, but notably include a minimum lot size of 12,500 square feet and a maximum of 4 B&B
rooms.

It appears, from the Airbnb listings for the multiple beds available, that there is no minimum stay of 7
days required, and it is clear that more than 2 people are able to stay on site along with the permanent
resident (if there is one). As such, this property does not fall under the definition of rooming and boarding.
Since the property is zoned residentially, it cannot be considered a rooming and boarding house. Finally,
the property cannot be considered a bed and breakfast as it does not have 12,500 square feet of land area,
nor does it appear the owner lives on site. As such, this property cannot be utilized for "short-term"
rentals, unless the rooming and boarding definition can be met.

any life safety issues and to determine what action must be taken to remedy the unpermitted conversion of

1. This permit was issued based on the information provided in the permit application and accompanying plans and

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must
