Customer agrees that Customer's telephone, electricity and water will be made available to Company's personnel dunng the course of the work Customer will also furnish at its expense, single phase, 220 -volt, 50 -amp electrical service Company shall not be responsible for protection of Customer's property, except to provide that protection which is specifically called for under the specifications provided by this Agreement Customer also agrees to remove store and/or protect personal property during Company's work. Customer will manage and be responsible for protection of vehicles and property exposed to damage by Company's work 5 Job Completion Job completion shall be the date on which Company s work Is substantially finished (as distinguished from the date of Customer's acceptance thereof) or the date at Company's last item of work at the property, whichever is earlier. Customer's failure to make prompt payment shall entitle Company, on forty-eight hours (48) hours' written notice, to slop work. The Agreed Pnce shall be increased by Company's reasonable costs to slop the project and/or resume work In the event Customer chooses not to pay for apart of the work, an individual line item or a trade. Customer releases Company of its obligations for the performance of that component with regard to the integrity of the building system as a whole 6 Insurance I Mortgage Company Customer hereby authorizes its insurance and/or mortgage company listed on the front of this Agreement to pay Company directly for all work and materials provided by Company to accomplish Customer's replacement or repair Customer further directs its insurer and/or mortgagee to include Company as a payee on all checks or drafts now or hereafter payable for such loss- Company reserves the right to supplement Customer's insurance and/or mortgage company for increases in the scope of work and/or documented price increases Customer agrees to allow these supplements to be paid directly to Company Company makes no representations or warranties regarding Customer's insurance coverage or if Customers insurer will pay for all or any of the work to be performed by Company under this Agreement Customer agrees to pay Company in full for all work performed by Company under this Agreement, regardless of Customer's insurance coverage. In the event that Company learns of the presence of such materials on Customer's property, Company reserves the right to immediately stop work and negotiate a change order for such additional work as may be required 10 Liability Company is riot responsible for damage or loss caused in whole or in part by the acts or omissions of other parties. trades or contractors. lightening, gale force winds (+50 m p h ), hailstorms, ice damage, ice damns (caused by thawing and freezing of ice, water or snow) hurricanes, tornados, floods earthquakes or other unusual phenomena of the elements, structural settlement, failure, movement, cracking or excess deflection of the roof deck defects or failure of materials used as a roof substrate over which Company's rooting material is applied, faulty condition of parapet walls, copings, chimneys, skylights, vents, supports or other parts of the building, vapor condensation beneath the roof. penetrations for pitch boxes, erosion, cracking and porosity of mortar and brick, dry rot, stoppage of roof drains and gutters penetration of the roof from beneath by rising fasteners of any type. inadequate drainage, slope or other conditions beyond the control of Company which cause ponding or standing water, termites or other insects, rodents or other animals, fire, or harmful chemicals. oils, acids and the like that come into contact with Customer s roof and cause a leak or otherwise damage Customer's roof It Customer's roof fads to maintain a watertight condition because of damage by reason of any of the foregoing, any applicable written limited warranty shall immediately become null and void for the balance of its term Company accepts no liability to indemnity or hold Customer harmless for claims or damages to persons or property, except to the extent that such damage occurs during performance of Company s work and are the direct result of Company's error or omission. Notwithstanding the foregoing, Company shall not be responsible for damages to any area of the property upon which Company's work has not been completed nor is Company responsible for slight scratching or denting of gutters, oil droplets in driveways, hairline fractures in concrete, damage to flowers or landscaping, or minor broken branches on trees, plants or shrubbery. In no event shall Company be responsible for any type of damage resulting from vibrations, including, but not limited to, interior drywall damage, nail pops or disconnection of chimneys, flues, air ducts, ventilation shafts, exhaust vents. furnace vents or sewer vents. Alf excess materials remain the property of Company - 4 Access to Property The pnces and terms of Company's estimate and this Agreement are based upon completion of the work during normal working tours, and Customer agrees to provide Company access to Customer's property as required for completion of the work Customer will be responsible if any interruption of Company's work results from Customer's failure to provide reasonable access or due to the acts or negligence of others not under Company's direction Company shall not be responsible for damages ansing from delay due to inclement weather, strikes, fires, accidents. delays in shipments or delivery of materials. or any causes beyond Company's reasonable control. Customer agrees that Customer's telephone. electricity and water will be made available to Company's personnel dunng the course of the work Customer will also fumish at its expense, single phase, 220 -volt, 50 -amp electrical service Company shall not be responsible for protection of Customer's property, except to provide that protection which is specifically called for under the specifications provided by this Agreement Customer also agrees to remove store and/or protect personal property during Company's work. Customer will manage and be responsible for protection of vehicles and property exposed to damage by Company's work 5 Job Completion Job completion shall be the date on which Company's work Is substantially finished (as distinguished from the date of Customer's acceptance thereof) or the date of Company's last dem of work at the property, whichever is earlier. Customer's failure to make prompt payment shall entitle Company, on forty-eight hours (48) hours' written notice, to stop work The Agreed Price shall be increased by Company's reasonable costs to stop the project and/or resume work In the event Customer chooses not to pay for a part of the work, an individual line item or a trade, Customer releases Company of its obligations for the performance of that component with regard to the integrity of the budding system as a whole 6 Insurance / Mortgage Company Customer hereby authorizes its insurance and/or mortgage company listed on the front of this Agreement to pay Company directly for all work and matenals provided by Company to accomplish Customer's replacement or repair Customer further directs its insurer andlor mortgagee to include Company as a payee on all checks or drafts now or hereafter payable for such loss Company reserves the right to supplement Customer's insurance and/or mortgage company for increases in the scope of work and/or documented pnce increases Customer agrees to allow these supplements to be paid directly to Company Company makes no representations or warranties regarding Customer's insurance coverage or if Customer's insurer will pay for all or any of the work to be performed by Company under this Agreement Customer agrees to pay Company in full for all work performed by Company under this Agreement, regardless of Customer's insurance coverage. Customer also agrees to pay Company directly for all amounts, despite depreciation or deductibles, and to also pay for additional work not covered by Customer's insurer and that said amounts must be paid before lob completion In the event Customer breaches this Agreement, Customer agrees to pay Company a) in full on a time and materials basis, for all work and matenals provided by Company as of the date of such breach. and b) a consulting and adjusting fee equal to 20% of the total cost of the work and matenals provided by Company as of the date of such breach, which fee represents the industry standard for reasonable profit and overhead generally paid by the insurance industry and is not a penalty 7 Limited Warranty A written limited warranty may be offered on workmanship and matenals provided pursuant to this Agreement on the terms and conditions reflected in any written limited warranty matenals provided at the time of sale If Company is not paid in full in accordance with this Agreement, all such warranties are null and void 8 Past Due Amounts Customer agrees to pay a service charge of 8% per annum on all balances 30 days or more past due Customer also agrees to pay for all collection costs, including employee time and expense and all attorneysfees and costs Company incurs in either collection of and/or protection of its interests in Customer's past due account or performance of this Agreement 9 Hazardous Materials Nothing contained in this Agreement shall be construed to require Company to determine the presence or absence of any hazardous matenals or asbestos -containing matenals affecting the property or to require Company to remove or protect such materials. In the event that Company learns of the presence of such materials on Customer's property, Company reserves the right to immediately stop work and negotiate a change order for such additional work as may the required 10 Liability Company is not responsible for damage or loss caused in whole or in part by the acts or omissions of other parties, trades or contractors. lightening. gate force winds (+50 m h ), hailstorms, ice damage, ice damns (caused by thawing and freezing of ice, water or snow) hurricanes, tornados, floods. earthquakes or other unusual phenomena of the elements, structural settlement failure, movement, cracking or excess deflection of the roof deck, defects or failure of matenals used as a roof substrate over which Company's roofing material is applied; faulty condition of parapet walls, copings, chimneys, skylights, vents, supports or other parts of the building, vapor condensation beneath the roof, penetrations for pitch boxes, erosion, cracking and porosity of mortar and trick, dry rot, stoppage of roof drains and gutters, penetration c! the roof from beneath by nsing fasteners of any type, inadequate drainage, slope or other conditions beyond the control of Company which cause ponding or standing water, termites or other insects, rodents of other animals, fire, or harmful chemicals, oils. acids and the like that come into contact with Customer's roof and cause a teak or otherwise damage Customer's roof If Customer's roof fads to maintain a watertight condition because of damage by reason of any of the foregoing, any applicable written limited warranty shall immediately become null and void for the balance of its term Company accepts no liability to indemnify or hold Customer harmless for claims or damages to persons or property, except to the extent that such damage occurs during performance of Company's work and are the direct result of Company's error or omission. Notwithstanding the foregoing, Company shall rot be responsible for damages to any area of the property upon which Company's work has not been completed nor is Company responsible for slight scratching or denting of gutters, oil droplets in driveways, hairline fractures in concrete, damage to flowers or landscaping, or mina broken branches on trees, plants or shrubbery. Dear Mr. Khribeche: As requested, we conducted a subsurface exploration to develop recommendations for foundation design at the subject site on October 7, 2006. The exploration was performed by drilling two test borings to depths of 25-0" and 20'-0" over the planned construction area. The locations of the test borings and the logs of subsurface materials are enclosed. The discussion and recommendations presented below are based on the results of data gathered during the subsurface exploration, observation of general field conditions, and previous experience in the area with similar materials. PROPOSED CONSTRUCTION As we understand, a new wood frame duplex residence will be built at the site. The proposed structure is planned to contain full basement levels and to have attached garages located along the east side of the structure. The foundation excavation for the residence is expected to range in depth from about 3 feet for frost walls to a maximum of 8.5 feet for basement walls. Foundation loadings for the proposed construction should be relatively light. STTE AND SUBSOIL CONDITIONS The site of the proposed construction is a gently sloping developed property in a mature residential area. An existing residence, which appears to be built over a crawl space, is located to the northeast of the proposed new structure and will be removed shortly. In addition, a large concrete slab area and apparent frost wall foundations are located in the eastern portion of the Mr, Khribeche -2- October 13, 2006 Job l7455] Soil AnalyHcs planned construction area. We have been told that the slab area is the footprint remnant of a previous printing shop once located at the site. All old foundations, fill and disturbed soils must be completely removed from the footprint of the new construction. Any low areas created by the removal of the existing construction must be refilled with properly compacted structural fill up to the level(s) of the proposed new construction. The proposed construction will be placed over the area of our rivo foundation test borings, whose locations are shown on Figure 1. Generally speaking, the ground surface in the construction area slopes toward the southeast at about 0 to 3 percent. The existing ground cover consists of concrete slabs, grass and weeds. Subsurface conditions encountered by the two test borings are variable with depth below groundlevel. Foundation Boring # 1, which was drilled in the southwest portion of the proposed construction, encountered generally firm and slightly moist clayey topsoil materials from groundlevel to a depth of 1'-6'; medium to stiff and moist to medium moist sandy clays from 1'-6" to 13'-0"; medium to soft and very moist to wet sandy clays from 13'-0" to 20'-0"; and hard and medium moist claystone bedrock materials from 20'-0" to at least 25-0", the maximum depth explored. Foundation Boring #2, which was drilled in the northeast portion of the proposed construction, encountered generally firm and slightly moist clayey topsoil materials from groundlevel to a depth of 1'-6"; medium to stiff and moist to medium moist sandy clays from 1'-6" to 13'-0"; and medium to soft and very moist to wet sandy clays from 13'-0" to at least 20'-0". Free groundwater formed in Boring # 1 at a depth of 15'-4" and in Boring #2 at a depth of 15-2" while we were at the site. TE T RESULTS AND GEOTECHNICAL CONSIDERATIONS The subsoils at the site were carefully observed as the cuttings were recovered from the test borings, and the resistance of the materials to the advancement of the drilling augers was noted. In addition, Field Penetration Tests were performed at selected depths to assist in evaluating the allowable bearing value of the soils and to provide undisturbed samples for precise examination and for testing in a one-dimensional consolidation unit and for grain size analysis. Test results are attached. Based on the results of the exploration combined with previous experience with similar subsoil conditions, the most pertinent foundation engineering characteristics and considerations at the site are as follows: Mr. Khribeche -3- October 73, 2006 Soil Analytics Job #4551 1. All disturbed materials, including those associated with the past construction and with the existing construction which is to be removed, should be completely removed from the building footprint. Likewise, the upper clayey topsoil present to the 1.5-foot level beyond the old construction may be an unreliable bearing layer and should be removed from below all foundation footings. 2. Below the 1.5-foot level, the exploration encountered medium to stiff and moist to medium moist sandy clay soils which extend to approximately the 13-foot level. Test results indicate that this layer has low swelling components and has a moderate allowable bearing capacity. 3. Below an approximate depth of 13 feet the exploration encountered medium to soft consistency and very moist to wet sandy clay soils which extend to at least 20 feet and which overlay hard claystone bedrock. The very moist to wet sandy clay layer is essentially non expansive and has a relatively low allowable bearing capacity. The planned basement excavation should be limited to 9.5 feet to provide a protective cushion over the underlying weaker soils. 4. Changes to the density and moisture content of clayey soils affect their swell properties. Clayey soils at bearing level(s) should not be compacted to high densities and low moisture levels since this may result in these soils becoming more expansive. If these soils are unavoidably disturbed at and below foundation bearing levels during excavation, al] such disturbed materials should be subexcavated and replaced with properly compacted granular structural fill. FOUNDATION RECOMMENDATIONS Minimum Pressure Footing Foundation System Provided that the builder and owners take precautions to minimize post construction wetting of the subgrade and carefully follow all of the recommendations and requirements of this report in the construction of the foundation system, then it appears feasible to support the structure using a minimum pressure footing foundation system. Footing foundations for Mr. Khribeche -4- October 13, 2006 Soil Analytics )ob 1t4551 upper frost walls which bear on the upper sandy clay soils and below the level of disturbed unsuitable soils and below the topsoil layer should be designed for a maximum allowable soil bearing pressure of 2,400 psf and for a minimum dead ]oad pressure of 700 psf. Footing foundations for the proposed basement level which bear on the underlying stiff sandy clay soils should be designed for a maximum allowable soil bearing pressure of 2,000 psf and for a minimum dead load pressure of 600 psf. As previously discussed, the basement excavation should be limited to a maximum depth of 9.5 feet to leave a protective cushion over underlying wetter and weaker soil conditions. The final determination of actual foundation sizes and areas will be made based on the plans for the proposed construction, the criteria given above, and calculations by the foundation design engineer. Footings should be placed at least 3.0 feet deep below final exterior grades to provide protection against frost action. In addition, we recommend that all concrete foundation walls contain sufficient horizontal reinforcing to enable them to span an unsupported distance of at least 15 feet. The excavation should be made with suitable equipment by an experienced operator. All disturbed and unsuitable soils should be completely removed from foundation bearing areas to avoid settlement. Great care must be taken not to undercut the base of the excavation. If the excavation is undercut, the low areas should be levelled and the grade restored using properly compacted granular structural fill. Do not use clay soils as compacted fill below footing foundations. If the clay soils at the site are overcompacted to high densities in a dry state, they may tend to become expansive. Obviously this is something which should be avoided. EXCAVATION SLOPES The sides of all excavations should be constructed to assure stability and safety following local, state and federal (OSHA) standards. In our opinion the soils encountered to the proposed basement level may be classified as Type A soils according to the OSHA system. For Type A soils OSHA recommends a maximum allowable s(ope of 095 : 1(horizontal : vertical). As a practical matter we expect that a vertical excavation for the proposed basement may be self supporting on a short term basis provided it is well made and not overloaded by surcharge loads around the top of the excavation. Mr. Khribeche October 13, 2006 Soil Analytics Job #4557 PROTECTION OF CLAYEY SOILS FROM DRYING AND OVER COMPACTION As previously noted, the sandy clay soils which were encountered below the clayey topsoils have low swelling components at existing density levels and moisture contents. All exposed clay subsoils must be prevented from drying during construction since they may become more expansive if they dry to higher density levels and lower moisture contents. If the excavation is made in hot weather without the footings being placed soon thereafter, drying can be prevented by covering the surface of exposed clays with an impervious moisture barrier which is removed only when the concrete is poured for footings and flatwork. Likewise, the foundation soils should not be overcompacted to abnormally high density levels at abnormally low moisture contents since such overcompaction can result in an increase in swell potential. If a crawl space area is constructed below part of the structure, the ground surface in the crawl space area should be permanently covered with an impervious moisture barrier sealed against the foundation. The purpose of this is to prevent any clayey soils which are present from drying and shrinking and to help reduce humidity in the crawl space area. We recommend the use of a heavy gauge polyethylene material or 55 pound felt building material. A minimum lap of 12 inches should be provided for polyethylene materials and a minimum lap of 3 inches should be provided for felt materials. The laps should be sealed with a mastic compound. All crawl spaces must be well vented and protected against excess humidity and the development of unhealthy conditions. Good care must be used in the prepararion of all foundation bearing areas in order to lessen the risk of foundation settlement. Prior to foundation construction the base of the completed excavation should be properly prepared. All unsuitable foundation materials, including all loose, incompetent, disturbed, and frozen soils, must be completely removed from foundation bearing areas and the resulting excavation backfilled with good quality, non expansive, structural fill materials (CDOT ciass 6 base is acceptable) compacted to 100 percent of standard Proctor maximum density at optimum moisture content. All structural fill must be compacted in 6-inch lifts to the stated density level and moisture content. The compacted backfill must extend upward to the level of all structural foundation elements. Structural fill should be used below flatwork in all areas, interior and exterior, where fill is needed to establish the design slab grade. Structural fill must be used to repair and stabilize all disturbed and incompetent areas where footing foundations will bear. Structural fill should be used below slabs to restore grade following the removal of undesirable soils in order to reduce the magnitude of slab movement and cracking. Structural fill should also be used in any other areas where structural accessories would be negatively affected by ground shifting over time. Structural fill should be placed in accordance with accepted good practice. We recommend that the structural fill conform to CDOT class 6 base course for typical applications. The standard Proctor procedure (ASTM D698) should be used to develop the compaction curve(s) for the fill soil(s) to be used. All such fill must be uniformly moisture conditioned to within 2% below to 2% above optimum moisture content and compacted with appropriate equipment in thin lifts not exceeding 6 inches in compacted thickness. Depending on location, the following minimum percentages of the maximum dry density as determined by the standard Proctor procedure are recommended for structural fill and backfill: • Below footing foundations 100% • Below floor slabs 957o • Below paved areas 957o • Behind retaining walls .................................92-94% • Common fill area 9070 LATERAL EARTH PRESSURES ON FOUNDATIONS The site sandy clay soils may be considered for use as backfill behind foundation walls. The most sandy, friable and clod free soils should be segregated from the excavated materials, stockpiled, and evaluated for use as backfill behind walls. Assuming that the backfill behind foundation walls is carefully and moderately compacted using suitable equipment to the extent Mr. Khribeche -7- October 13, 2006 Soil Analytics Job tt4551 that it does not settle after construction, the walls retaining such fill should be designed for an equivalent fluid unit weight of at least 70 pounds per cubic foot. Care must be taken not to overcompact the backfill or to operate heavy equipment above the foundation wall backfill since this will result in excessive earth pressure on foundation walls. The backfill should not be puddled since the trapped water will percolate downward over time and could result in undesirable consequences. If the builder uses the site clayey materials as backfill then the clays should be placed so as to minimize the lateral pressures that will be exerted on the foundation walls by compaction. Heavy compaction must not be performed since overcompaction will result in initial excessive earth pressures. For this reason, clay backfill behind foundation walls should be gently compacted by suitable equipment to about 90 percent of standard Proctor density at optimum moisture content plus 2 percent. While lower densities are desirable to lessen lateral pressures on walls, if they are too low the backfill may settle after construction. Therefore, the desired density is the lowest density needed to prevent settlement of the backfill after construction. If the owner desires to reduce the lateral forces on walls exerted by clayey backfill then imported non clayey sandy to gravelly materials should be used for exterior backfill. If such imported granular backfill is used, the walls retaining such fiil shouid be designed for an equivalent fluid unit weight of at least 50 pounds per cubic foot. FOUNDATION REINFORCING All foundation walls must be well reinforced in accordance with the structural requirements. Refer to the foundation design prepared by the structural engineer. FLOOR SLAB CONSTRUCTION As previously noted, the sandy clays encountered to the proposed construction levels have components with a low swell rating at existing moisture contents and density levels. If clay soils dry and are compacted to higher density levels at lower moisture content, this change in their condition may result in these soils becoming more expansive. Therefore the soils should be maintained at in situ conditions below the locations of footings and slabs. We assume that concrete floor slabs are planned for use in the basement levels and for the floor of the attached garages. Garage slab Mr. Khribeche -8- October 13, 2006 Soil Analytics ]ob 174551 performance can be enhanced by replacing all unsuitable and organic soils with properly compacted granular structural fill. Concrete floor slabs which are cast on stable non expansive materials are expected to perform relatively well. However, if expansive materials are present subsequent wetting of the subgrade can result in slab movement and cracking. Or if loose non uniformly densified fill is placed as a base for slabs, the slabs may settle over time. If there are locations where the future owners need to eliminate all risk of any floor movement, then consideration should be given to the use of a structurally supported floor. All floor slabs should be constructed utilizing the following details and precautions. While these details wili not necessarily prevent slab movements, they will help prevent any slab movements that do occur from affecting either the foundation or the superstructure of the building. 1. All base fill used below slabs should be non expansive granular material which is uniformly densified to 95% of standard Proctor maximum density at optimum moisture content. 2. Separate the slabs from all bearing members and utility lines to allow their independent movement--construct "floating" slabs. Provide positive control joints at the junction of the siabs with foundation walls, and provide frictionless sleeves for all columns and utility lines which pass through slabs. 3. Joints should be scored in the slabs at maximum 200-square foot areas. 4. If hot-water heat is used, the piping should not be placed beneath the concrete slab. If a forced-air furnace is used, a minimum 2-inch collapsible connection should be provided between the furnace and the heat ducts. Provide flexible connections for all slab bearing mechanical equipment to allow for at least 2.0 inches of vertical movement. 5. Construct a minimum 2-inch slip joint above or below all partitions located immediately above concrete siabs-on-grade. 6. Do not use rigid floor coverings which will readily reflect even slight movement or cracking of the concrete slab. Rather, use a type of covering which will not be affected by movement of the slab. Mr. Khribeche -9- Octobcr 13, 2006 Soil Analytics ~oo w4o~~ In addition, good backfill and surface drainage should be provided, and lawn irrigation minimized, as discussed later in this report. BACKFILL AND SURFACE DRAINAGE Excess wetting can cause expansive materials to swell and some lower density materials to settle. In order to optimize foundation and floor slab performance, the foundation soils should be protected from being excessively wetted after construction. This can generally be assisted by using a suitable backfill and by compacting the backfill sufficiently so that it does not settle following construction. The backfill should be free of debris and should be compacted taking into account the considerations described in the previous section on lateral earth pressures. Some water may be blended with the backfill in the stockpile but away from foundation locations to permit proper compaction; however, the backfill must not be puddled. In addition, a berm may be constructed adjacent to the foundation walls to allow for a good slope away from the building even if some settlement should occur. Precautions must be taken to prevent the entrapment of free water within any portion of the excavation during construction. If any settlement should occur in the backfill, it could adversely affect utility lines which transmit fluids and pass through the grade beam foundation walls. It is not uncommon for such piping to shear at the foundation walls due to movements in the backfill. It is recommended that the pipes pass through slotted openings in the foundation walls or that flexible connections be used to compensate for shifting of the foundation wall backfill. It is also recommended that all water lines be carefully pressure tested prior to final acceptance and that any leaks detected be repaired. The final grade should be sloped well away from the structure on all sides. A minimum slope of 12 inches in the first 10 feet is recommended. All downspouts should discharge into extensions which slope away from the foundation walls and extend beyond the limits of all backtill. The points of discharge should be at least 5 feet from the foundation walls and good drainage should be maintained at and beyond these points. All future owners of the structure should be advised of the desirability of keeping moisture away from the foundation and slab-on-ground areas. In no event should an automatic sprinkler system be installed next to the foundation walls. There should be little or no watering or irrigation within 5 feet of the foundation walls. The area next to the structure may then be covered with gravel, bark chips, or other materials requiring no rainfall or irrigation. cTrucURFACE UNDERDRAIN The results of the exploration indicate that a foundation underdrain system should be installed in view of the presence of clayey soils and free water below proposed basement level. Refer to the attached detail of a suggested foundation underdrain system. The drain pipes should be at least 4 inches in diameter, should be placed below the floor level, should be surrounded by free-draining granular material, and should be graded to sumps at a minimum slope of 1 percent. Provisions should be made to remove collected water from the sumps by pumping or by gravity flow to a suitable daylight outlet. The drain system should be constructed to relieve any water bui]dup in the exterior backfill around foundation walls. LIMITATIONS The above recommendations are based on the exact location where the test holes were drilled, the proposed construction, and the assumption that the subsurface conditions do not vary greatly from those encountered in the test borings. The exploration was conducted and the report has been prepared in accordance with generally accepted geotechnical engineering practice in the Denver area, and no other warranty, expressed or implied, is made. Rehabilitation: Within thirty (30) days after cessation of filling and/or excavation, rehabilitation for the site shall haue been completed in accordance with the approved plans. Rehabilitation shall consist of leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable to the CiTy Engineer. B.
